10 GENERAL SALES CONDITIONS APPLICATION The belw cnditins are applied fr the sale cntracts cncluded between ENERGOTYTAN cmpany, called belw SELLER, and buyer f their prducts, called CUSTOMER, suppsing that anther cntract des nt prvide therwise. DELIVERIES a) Custmer is bligated fr the rdered prducts cllectin b) Delivery is dne n the basis f written rders c) Delinquent Custmer wn't receive new delivery as sn as all amunt due will be settled, and SELLER keeps the prperty f delivered gds till the full vedue invice(s) payment d) Custmer bears full respnsibility against the results f incrrectly r indistincly fullfiled rders e) The delivery unit is package with prducts' r meters quantity etc., placed int qutatin (e.g. 1 package = 100 pcs); in the case f tls the delivery an unit is 1 pc; an rder with the quantity lwer than suitable fr full package is realized in full package with runding up. TECHNICAL DATA All the technical data and parameters included in catalgues and ther SELLER's publicatins can be subject fr changes withut ntice. The abve rule des nt cncern the prducts already rdered, which will be sld accrdingly t data and technical parameters bligatry in the day f rder's placement / cnfirmatin. In the case when the gds' delivery under the technical data and parameters valid in the day f rder placement is impssible, and CUSTOMER will nt agree fr the changes, he will be entitled t cancell the rder within 3 days frm the infrmatin receiving that the change will ccur (r frm the date f prduct's cllectin, which such change cncerns). DELIVERIES All the despatches are delivered with carrier cmpany (if the cntract des nt prvide therwise) The prducts beeing n stck are sent next wrking day. Charges fr packaging, lading and transprt are calculated indywidually ( depend n quantity/ type f prducts ). PRICES All the prices n ffers are given in PLN (Plish zltys) and d nt include VAT, packaging and transprt csts. These prices are nt binding fr SELLER, wh can change them in the result f csts increasing caused e.g. higher rate f exchange. After rder placement SELLER will be als entitled fr prices' change in the case f the wn csts increasing, beeing the price's calculatin basis r ther bjective factrs like e.g. change f currency exchange rate. The prices fr prducts nt included int price-list are established fr individual demand. ENERGOTYTAN can alw a trade discunt fr bulk buyers (cmmercial cmpanies) r regular individual custmers. PAYMENTS - Cash in the day f gds' cllectin, prepayment - Paymnet against cllectin (credit-mail), - Regular custmers - transfer payment, - We issue penality ntes fr verdue payments. - The payment is dne n the basis f invice attached fr the delivery( if the cntract des nt prvide therwise ). ORDERS' CONFIRMATION We cnfirm rders, term f deliveries and prices nly n Custmer request CLAIMS AND PRODUCTS RETURNS CUSTOMMER is bliged t check the delivery cnfrmity with dcumentatin just after gds receiving. Claims must be presented in writting. WARRANTY ENERGOTYTAN is bliged t eliminate eventual prduct(s) default(s) resulting frm defective cnstructin / material defects r replace the prduct(s) fr new ne(s) within 15 wrking days ( if anther cntract des nt prvide therwise). CUSTOMER sends claimed prduct(s) at his charge at the service address indicated by SELLER. ENERGOTYTAN'S respnsibility cncerns nly the defauts annunced within 1 mnth frm prblem detectin and nt later than 1 year frm purchase. ENERGOTYTAN's engagements, resulting frm this warranty are limited t the csts which d nt exceed ttally the prduct(s) price RESPONSIBILITY - LIMITATIONS ENERGOTYTAN des nt bear respnsibility fr the damages resulting frm prductin stpping, lss f prfit r indirect lsses.
