4 Electrnic Devices Distracted Driving and Cell Phne Plicy Rev. 8/25/2015 We deeply value the safety and well-being f all peple wh drive fr ur cmpany. Due t the increasing number f accidents natinwide resulting frm the use f cell-phnes and similar devices while driving, we are instituting a new plicy. The plicy applies any time a vehicle is perated fr cmpany business whether it is wned by the cmpany r wned by anther individual. If a driver must make an emergency call (911), the vehicle shuld be parked in a safe lcatin befre making the call. If pulling ff n a highway shulder, 4-ways and/r warning devices shuld be utilized right away. Als be sure all brakes are engaged. 5 Seat Belt Usage Seat Belt Plicy Rev. 8/25/2015 Evans Delivery recgnizes that safety belt use helps t prtect ur Independent Cntractrs, reduces injuries, and cntrls perating cst. Studies have shwn that sixty percent f all passengers killed in traffic crashes were unrestrained. If yu are nt wearing a safety belt, yur chances f being killed are twenty-five percent higher if yu are thrwn frm yur vehicle. Reducing these cstly injuries and deaths prtect ur Independent Cntractrs and can strengthen ur effectiveness as a cmpany. Mrever, safety belt use in Cmmercial Mtr Vehicles (CMV) is required by Federal Law. Seat belt vilatins are used in the Unsafe Driving Basic fund in the Cmprehensive Safety Accuntability (CSA) Prgram. This particular categry is mst clsely assciated with crashes s vilatins, like failure t wear a seat belt while perating a CMV, are very high in severity. Seat belts must be used at all times, n matter hw far the dispatch. By abiding t this plicy yu will prtect yurself in the event f an accident first and fremst. Always wearing a seat belt will als prevent the Unsafe Driving CSA Scre frm grwing t an unacceptable level fr yurself and the Evans Delivery Cmpany. Please be aware that if yu receive a vilatin (392.16) fr failure t wear a seatbelt while perating a CMV, yu will be immediately suspended and required t participate in a training curse prir t returning t active status, at which time yu will be placed n prbatin fr ne year. 6 Security N Stp Plicy and Strage f Laded Cntainers Rev. 8/25/2016 Evans strives t prvide the best custmer service pssible. Unfrtunately, the frequency with which individuals steal r hijack cntainers is n the rise. In the event that a cntainer is stlen while in the custdy and cntrl f an Evans driver, Evans custmer relatins are adversely impacted. In an effrt t maintain sund custmer relatins and minimize the chance f theft r hijacking, We strngly recmmend that the truck nt stp fr the first 50 t 100 miles f a trip and nt be left unattended fr the first 200 miles. If stpping and/r leaving such a lad unattended cannt be avided, the truck shuld be equipped with stealth methds t disable the pwer unit in a manner that nly allws the authrized driver t access and start the pwer unit (e.g. hidden kill switch r dispatch based telemetric shutdwn). Evans als recmmends the fllwing theft preventin strategies: ALL laded cntainers MUST be stred in an authrized secure yard; Dn t leave trucks and carg unattended in unsecured areas, such as truck stps, shpping centers parking lts, and rest areas; Dn t stage carg ver the weekend; Dn t leave a bill f lading n the back f the trailer; Dn t discuss yur lad r yur rute with anyne yu dn t knw (r within hearing distance f anyne); Evans understands that nt all incidents are avidable. In the event that a cntainer is stlen while in yur custdy and cntrl, Evans will investigate the incident t determine whether the abve recmmendatins were fllwed. Yur driver services and/r mtr carrier lease agreement may be subject t terminatin if it is discvered that sme r all f the recmmendatins were disregarded. En Rute Driver Security As a result f the tragic events f September 11, 2001, security has becme a tp pririty fr the Evans Netwrk f Cmpanies. A majr part f this fcus is n the safety and security f ur drivers. The wrld f a prfessinal driver, whether it is alne n a highway, in a rest area r truck stp, r driving thrugh an industrial part f a majr city, can be a dangerus place. Prfessinal drivers, their vehicles, and the lads they haul are mst vulnerable while in transit. Opprtunities abund fr criminals, carg thieves, terrrists, r ther individuals r grups t victimize drivers in transit; but there are steps yu can take t help reduce risk and increase persnal security. These security tips must be fllwed by all in-transit drivers: Obey the Evans N Stp Plicy All trucks shuld be dispatched under a N Stp directive requiring that the lad shuld nt be left unattended fr the first 200 miles f the trip. Maintain cmmunicatin with yur dispatch, call yur dispatch any time yu: Change yur planned rute. Make an unscheduled stp. Are running late due t traffic, weather etc. Have an accident r breakdwn. Never discuss lad related infrmatin such as the type f carg, pick-up and delivery lcatins r times, r rutes traveled with anyne while ut n the rad. Drivers shuld be very suspicius f anyne asking abut their lad r destinatin. Stp r park nly in safe well-lit areas where ther trucks are present, such as reputable truck stps r high traffic well lit rest areas. Always lck the vehicle. 7 Be suspicius f anyne asking r signaling yu t stp. A frequent ply used by hijackers is t create a scenari that cmpels a driver t stp. If yu must stp due t a blcked radway r serius accident, ntify the authrities and/r yur dispatch befre yu leave yur vehicle. Inspect yur vehicle. Cnduct a thrugh pre-trip inspectin befre yu start yur trip. In additin t checking fr safety defects a driver shuld als check the lad seals. If there is any indicatin f a brken r tampered seal, reprt this immediately t yur dispatcher. Als cnduct an inspectin f yur equipment after each stp r rest perid. Prepare and execute a well thught ut trip plan. Drivers hauling hazardus materials must be ruted s they avid heavily ppulated areas, bridges and tunnels. Keep yur rute as direct as pssible. Never take a laded trailer hme r park in an unsecured r unauthrized area. Secure the trailer drs with a padlck and/r seal. Keep tractr drs lcked and windws rlled up CARGO SECURITY Whether it s a cntainer f persnal cmputers, a full trucklad f pharmaceuticals, r 5,000 punds f fish, yur carg is a ptential target fr theft. Sme estimates place the annual carg lss in the United States at $10 billin. Of curse, as the value f carg rises, the number f carg thefts increase. Csts frm carg thefts include nt nly the actual value f the carg itself, but als: Increased insurance premiums. Lss f prfit. Lss f custmers and business pprtunities. Interruptin f freight distributin. Increased verall supply chain csts. Carg theft is an equal pprtunity crime street gangs, carrier emplyees, rganized crime, and terrrists are all actively invlved in the trade f stlen freight. Criminals are becming increasingly mre rganized, and are relying mre and mre n inside infrmatin and advanced technlgy. The fllwing tips are will help yu have a better understanding f hw t maintain carg security: Always cnduct a thrugh pre-trip inspectin; this helps prevent breakdwns leaving yu stranded in dangerus areas. Never leave a lad unattended. Never accept r allw anyne t place any unauthrized r undcumented carg n yur unit. View anyne wh asks t lad any unscheduled freight abard yur unit as highly suspicius and ntify the authrities and/r yur dispatcher immediately. Drivers must supervise all lading peratins. D nt accept ver, shrt, r damaged freight withut authrizatin frm yur dispatcher. Be sure t get nly the type f freight and exact number f pieces that are listed n the shipping papers. Carg shuld be free f any visual damage and nce laded it shuld be secured frm shifting r falling. All lad-related dcumentatin must be thrughly reviewed and verified by the driver. Any discrepancies must be reprted and reslved befre the paperwrk is signed and the trailer sealed. Drivers must be especially alert when leaving a shipper because a vast majrity f hijackings and carg theft incidents ccur within a shrt distance frm the lad s pint f rigin. Be especially aware arund traffic signals and n/ff ramps. These are prime hijack areas. Call yur dispatch at regular intervals thrughut the day including when laded and ready t leave the shipper. 8 INCIDENTS AND RESPONSES Even if yu fllw all the security guidelines, yu may be faced with a dangerus situatin. If this ccurs yu must knw hw t respnd. Remember yur persnal safety is f primary cncern. Sme types f carg thefts include: Armed rbberies. Burglaries. Mst cmmn type f rbbery. Theft f laded trailers frm trucking facility. Theft f a vehicle after thieves cmpel a driver t make an unplanned stp. Theft f a vehicle when a driver stps (signal lights, truck stps, rest areas etc.). Occur at terminal facility. Occur at shipper facilities. Cunterfeit paperwrk and fraud. Grab and run. Generally, this methd is used by independent cntractrs wh transprt chassis/cntainers t and frm cntainer terminals and intermdal rail yards. The driver presents cunterfeit paperwrk t the security persnnel and ultimately makes ff with an entire cntainer f valuable freight. Often used by thieves wh have inside infrmatin abut a lad f expensive, high tech merchandise. Criminals break int a stpped truck and ff-lad as much freight as pssible befre the driver returns. If yu are a victim r see a carg theft in prgress dn t be a her, yur safety is primary. Observe and remember as much as yu can f such things as the height and weight f the criminals. Type and clr f clthes etc. Vehicle descriptins etc. Leave the area and call the authrities and yur dispatcher as sn as pssible. If we rise t the alert status in either the Unsafe Driving r Driver Fatigue basic, this may prmpt a Department f Transprtatin interventin. Remaining ut f the alert status in the Driver Fatigue basic is vital, which is why it is s imprtant t fllw the Hurs f Service Plicy. Vilatins in the Driver Fatigue basic that must be avided in radside inspectins include: The 11 Hur Rule The 14 Hur Rule The 60/70 Hur rule The 30 Minute Break Rule The Recrd f Duty Status Nt Current rule Under CSA rules, a vilatin will fllw an independent cntractr fr a three (3) year perid. Please be aware that if yu receive a vilatin fr Hurs f Service r Driver s Recrd Duty Status Nt Current, yu will nt be dispatched fr a 24-hur perid f time. Yu will als be placed n prbatin fr a ne (1) year perid and will be required t participate in additinal training. Any additinal vilatins during the prbatinary perid will result in terminatin f yur driver services and/r mtr carrier lease agreement. The Evans Netwrk f Cmpanies is strngly cmmitted t full cmpliance with the current federal hurs-f-service regulatins, as well as any additinal lcal regulatins which may apply. The hurs-f-service (lgging) regulatins fr drivers f prperty-carrying vehicles are part f the Federal Mtr Carrier Safety Regulatins, specifically cntained in Part 395 f the FMCSRs. Electrnic Lgs Federal regulatins require that cmmercial drivers transitin t electrnic lgs in The electrnic lg prgram in use at the Evans Netwrk f Cmpanies is called BigRad. This is FREE app that can be dwnladed t yur ios phne r tablet frm the App Stre r t yur Andrid phne r tablet frm the Ggle Play stre. It wrks in cnjunctin with Dashlink hardware and helps yu track yur hurs and keep yur duty status up-tdate. It als sends yur electrnic lgs t the crprate ffice in real-time, eliminating the need t mail in paper lgs. Timeline fr Transitining t Electrnic Lgs All drivers (whether independent cntractrs, cntract drivers, r cmpany drivers) wh sign n with the Evans Netwrk f Cmpanies n r after June 30, 2017, will be required t use electrnic lgs immediately. Drivers wh signed n prir t this date and wh remain in gd standing with regard t this plicy will have the ptin t use traditinal (paper) lg bks until September 30, Hwever, all drivers are encuraged t transitin t electrnic lgs as sn as pssible and financial incentives are in place fr thse wh d. 10 Traditinal Lg Bks The Evans Netwrk f Cmpanies prvides specifically frmatted lg bks and/r time-keeping frms fr thse drivers using traditinal (paper) lgs bks. N ther frms may be used. The fllwing eleven (11) items MUST appear n each lg: 1. the date (generally lcated at tp left f the frm) 2. the 24-hur perid's starting time (mst cmmnly midnight r nn, but yur terminal/agent may specify anther time) 3. the full name f the carrier (check the crrect bx) 4. the carrier's main ffice address (check the crrect bx) 5. the truck number, tractr number, and/r trailer number (generally lcated at the tp f the frm) 6. the name f yur c-driver, if any 7. the shipping dcument number r name f shipper and cmmdity (generally lcated in the Remarks sectin f the frm) 8. the graph grid with a "remarks" sectin (can be used either vertically r hrizntally) 9. the ttal miles driven during the 24-hur perid cvered by the lg 10. the ttal hurs (at the end f the grid) 11. yur signature/certificatin Getting Started When yu begin t fill ut yur lg, sme items can be immediately entered, with the rest being filled in as yur day prgresses. T begin, fill in #1 thrugh 7 listed abve. Entering Time n the Lg Grid Update yur lg as the day prgresses. Regulatins require that yu keep the current day s lg, current t the last change f duty status, plus the lgs fr the previus seven (7) cnsecutive days in yur pssessin. Yu must be able t prduce these dcuments if requested t d s by a law enfrcement fficial r DOT inspectr. Sleeper Berth: Yu may lg time n this line that yu actually spend in a sleeper berth that meets the requirements set frth in Sec f the FMCSRs. 11 On Duty (Nt Driving): All ther time when yu are wrking r in the vehicle, but nt in the sleeper r driving must be lgged n line 4. This includes: Check Yur Wrk all time at a plant, terminal, facility, r ther prperty, f a mtr carrier r shipper r n any public prperty, waiting t be dispatched, unless yu have been relieved frm duty by the mtr carrier; all time fueling, inspecting, servicing, r cnditining any cmmercial mtr vehicle at any time; all driving time as defined in the term driving time ; all time, ther than driving time, in r upn any cmmercial mtr vehicle, except time spent resting in a sleeper berth; all time lading r unlading a cmmercial mtr vehicle, supervising, r assisting in the lading r unlading, attending a cmmercial mtr vehicle being laded r unladed, remaining in readiness t perate the cmmercial mtr vehicle, r in giving r receiving receipts fr shipments laded r unladed; all time repairing, btaining assistance, r remaining in attendance upn a disabled cmmercial mtr vehicle; all time spent prviding a breath sample r urine specimen, including travel time t and frm the cllectin site, in rder t cmply with the randm, reasnable suspicin, pst-accident, r fllw-up testing required federal regulatins, when directed by a mtr carrier; perfrming any ther wrk in the capacity, emply, r service f a mtr carrier; and/r perfrming any cmpensated wrk fr a persn wh is nt a mtr carrier. (Sec ) At the end f the day, check yur entries and duble-check yur calculatins. Regulatins require that: entries are current t the last change f duty status. entries are legible and in yur wn handwriting. entries include all f the required eleven (11) items as described abve. entries n the lg are made using the time standard in effect at yur terminal (agency) r using time zne selected by yur agency t use fr its fleet. entries are cmpleted in duplicate. Submit Yur Lgs Weekly At the end f the week, re-check yur lgs fr cmpleteness, accuracy, and legibility. Any crrectins must be made by yu, in yur wn handwriting. Then submit yur riginal daily lgs (nt cpies) with yur weekly paperwrk. If yu d nt use a Cmdata fuel card fr fuel purchases, yu must als include cpies f fuel purchase receipts. Cntact Crystal Miller, the Hurs f Service Supervisr ( , extensin 3313) as sn as pssible if yu are unable t submit yur lgs n time. If yur lgs are nt submitted with yur weekly paperwrk, yur Cmdata card may be blcked; and, if yu are habitually late with submitting yur lgs, yu may lse yur Cmdata r direct depsit privileges, causing yur settlements t be mailed via the U.S Pstal Service. Cntinued vilatins will be grunds fr terminatin f yur lease agreement and/r driver services. 16 Passengers Passenger Plicy Rev. 8/25/2015 Federal regulatins d nt permit truck drivers t invite passengers int their tractr withut the express permissin frm the mtr carrier. After driving fr Evans fr a perid f ninety (90) days, a driver may request that he/she be allwed t carry a passenger in the tractr with them. The request shuld be in writing, addressed t the Safety Department and specifically identify the driver making the request, the identity f the passenger, the relatinship f the passenger t the driver, and the perid (nt t exceed tw weeks) fr which authrizatin is requested. Please allw a minimum f ne (1) week fr the prcessing f any such request. The fllwing general guidelines are established: The passenger must be at least eighteen (18) years f age OR if the passenger is the sn, daughter, grandsn r granddaughter ( direct descendant ) f the driver the passenger must be at least furteen (14) years f age. A cpy f the birth certificate r driver s license f the passenger will be required as prf f age. Thse passengers wh are at least eighteen (18) years f age must sign a release. The release must be signed in the presence f an Evans manager OR, if that is nt practical, must be signed and ntarized. Fr a direct descendant f the driver wh is between the age f furteen (14) and eighteen (18), the release frm must be signed by bth parents (r legal guardians) f the minr. (Evans may, at its sle discretin, make special accmmdatins if nly ne parent f the minr is living.) Evans management retains the right t refuse r suspend the passenger privileges at any time and fr any reasn. The driver s safety recrd will be cnsidered when granting any passenger privileges. N passengers will be authrized between Nvember 1 and March 31. Each authrizatin granted will have a specific starting date and ending date. The effective perid f the authrizatin shall nt exceed tw (2) weeks unless the passenger is the spuse f the driver, in which case special privileges may be granted at the sle discretin f the cmpany. The same passenger may nt receive mre than tw (2) authrizatins within any calendar year. Yu may be required t purchase r prvide prf f passenger insurance. 17 Inspectins Peridic Inspectin Plicy Rev. 8/25/2016 Systematic maintenance f equipment is an essential element f ur transprt peratin. Part 396 f the Federal Mtr Carrier Safety Regulatins (FMCSRs) requires mtr carriers t inspect, repair and maintain all mtr vehicles under their cntrl. Even if there were n federal regulatins in place, hwever, it makes excellent business sense t have an rganized maintenance prgram in peratin. It is ur plicy t take a preventative maintenance apprach and keep all transprtatin equipment well maintained and in safe and efficient perating cnditin at all times. The specifics f that apprach are detailed as fllws: Regulatin requires that cmmercial mtr vehicles perating in interstate r freign cmmerce pass inspectin at least annually. Hwever, ur plicy supersedes this and we require a full federal inspectin every six-(6) mnths. This requirement may be met either thrugh a peridic inspectin prgram administered by yur state r by having an inspectin perfrmed by a cmmercial garage r similar cmmercial business, as lng as the inspectin cmplies with federal standards r cmpatible state standards. Inspectins are due within six-mnths frm the last. A series f reminder s are sent t yur agent r terminal manager beginning apprximately 45 days prir t yur upcming due date. Prescriptin Medicatins. The use (by a driver) f legally prescribed medicatins issued by a licensed health care prfessinal familiar with the driver's wrk related respnsibilities.
