3 Sectin 5.50 Mbile Fd Vendrs (per. Ord and Ord. 3338) Definitins. Fd truck means any self-cntained mtrized vehicle, r self-cntained enclsed trailer with a valid license plate, frm which prepared fd fr immediate cnsumptin is served. Fd truck vendr means a persn engaged in the business f selling fd r beverages frm a self-cntained mtrized vehicle r a self-cntained enclsed trailer with valid license plates and registratin. A fd truck vendr des nt include an ice cream truck peratr. Restaurant means any business establishment whse principal business (meaning 51% r mre f sales) is the selling f unpackaged fd t the custmer in a ready-t-cnsume state, in individual servings, r in nn-dispsable cntainers, and where the custmer cnsumes these fds while seated at tables r cunters lcated within the building. City Special Event Any utdr r seasnal event including, but nt limited t a picnic, parade, carnival, craft fair, art fair, bicycle/mtrcycle / vehicle ride, walk / run, car shw, wedding r ther receptin, r any ther event held n public prperty which is pen t attendance by the general public and / r may require special cnsideratin frm any r all f the fllwing City Departments: Clumbia Plice Department (CPD), Clumbia Fire Prtectin District (CFPD), Department f Public Wrks (DOPW), Clumbia Emergency Medical Service (EMS), and Cmmunity Develpment Department (CDD) License Required. N fd truck vendr may perate in the City withut first securing a license. Such license shall be renewed annually n a rlling basis. All ther licensing regulatins f Sectin 5.04 BUSINESS LICENSING AND REGULATION shall apply. In the event that ne persn r cmpany perates mre than ne fd truck r mbile fd cart in the City, each such fd truck shall require a separate license Manner f Operatin Certain Lcatins Prhibited. Fd trucks may nt lcate r perate within seven hundred fifty (750) feet f an existing restaurant unless they are part f a City Special Event. Fd trucks may nt perate in any R zned residential district r n public right-f-way except as part f City Special Events, as described herein. Fd trucks may nly lcate n the prperty f an existing restaurant if (a) the recrd wner f the established restaurant prvides written cnsent, and (b) the restaurant is n clser than seven hundred fifty (750) feet t anther restaurant. City Special Events. Fd trucks may nly perate in an R zned area r n public right-f-way if they are part f a City Special Event. Any City Special Event that will include fd trucks must list the number f fd trucks and apprximate lcatin f said fd truck(s) n their Special Event applicatin. Fd trucks participating in special events must be licensed by the City. Hurs f Operatin. Fd Trucks shall nly be perated between the hurs f 7:00 a.m. and 10:00 p.m.

4 Sale f Liqur. Selling r serving f liqur, including beer, wine, and all alchlic beverages frm fd trucks shall be regulated by Sectin 5.20 (LIQUOR CODE) f the City s Cde f Ordinances. Vehicle Appearance and Maintenance. Fd trucks shall be kept in gd mechanical and structural cnditin. Vehicles and carts shall have a clean exterir and interir and shall be equipped with signs t alert traffic t prceed with cautin past the truck r cart while it is serving custmers. Each vehicle shall have the cmpany name affixed t it in a prfessinal, wrkmanlike manner and in letters that are a minimum f six inches (6 ) in height. The cmpany name shall be affixed t each side and rear f the vehicle. Generatrs and fuel tanks shall be affixed t the vehicle and shall nt be placed n the grund. Peripheral Setup. N tents, tables, chairs, r ther materials shall be placed at the designated vending area. Signage shall be limited t signs permanently r magnetically affixed t the vehicle r cart. Fd trucks shall nly be permitted t cnnect t City water, electric, r ther utility t cnduct business with the written cnsent f the City. Fd truck vendrs must als prvide fr the sanitary cllectin f all refuse, litter, and garbage generated by patrns using the service, and remve all such waste materials frm the lcatin befre the vehicle departs Public Health Standards. N fd, fd prducts, r beverages fr public cnsumptin shall be kept, ffered fr sale, transprted, r handled except in accrdance with the rules and regulatins f the State f Illinis and the Mnre Cunty Health Department. If the Mnre Cunty Health Department r State f Illinis suspends r revkes their respective permits and/r licenses, the City s business license shall hereby be revked until such time as the State r Mnre Cunty permit and/r license is reinstated Suspensin and Revcatin f License. Revcatin r suspensin f a license fr a fd truck shall be dne in accrdance with Sectin 5.04 BUSINESS LICENSING AND REGULATION License Nn-Transferable. Any license issued fr the peratin f a fd truck shall nt be transferable.
