The license is restricted t prhibit the persn frm driving a mtr vehicle that is nt equipped with an ignitin interlck system; (iii) Advises the persn f the requirements under paragraph (7) f this subsectin fr a persn wh des nt participate in the Ignitin Interlck System Prgram in accrdance with this paragraph during the 1-year perid f suspensin; (iv) Advises the persn f the right t request a hearing n a suspensin under this paragraph; and (v) Advises the persn f the right, instead f requesting a hearing n a suspensin under this paragraph, t be subject t a 1-year perid f suspensin, during which, the persn may be issued a restricted license under this paragraph if the fllwing cnditins are met: 1. The persn's driver's license is nt currently suspended, revked, canceled, r refused; 2. The persn surrenders a valid Maryland driver's license r signs a statement certifying that the driver's license is n lnger in the persn's pssessin; and 3. (9) If the Administratin finds at a hearing that maintenance f an ignitin interlck system n a mtr vehicle wned by the persn creates a financial hardship n the persn, the family f the persn, r a c-wner f the mtr vehicle, the Administratin: (i) Shall impse a restrictin n the license f the persn fr nt less than 6 mnths and nt less than the perid required under f this title, dating frm the expiratin f the 1-year perid f suspensin, that prhibits the persn frm driving any mtr vehicle that is nt equipped with an ignitin interlck system; and (ii) May nt require the persn t maintain an ignitin interlck system n any mtr vehicle t which the financial hardship applies. (10) An exemptin under paragraph (9)(ii) f this subsectin applies nly under circumstances that: (i) Are specific t the persn's mtr vehicle; and (ii) Meet criteria cntained in regulatins that shall be adpted by the Administratin. Elects in writing t participate in the Ignitin Interlck System Prgram fr 1 year; (viii) Prvide infrmatin abut the Ignitin Interlck System Prgram and hw a persn participates in the Prgram under f this title; and (ix) Within 72 hurs after the issuance f the rder f suspensin, send any cnfiscated driver's license, cpy f the suspensin rder, and a swrn statement t the Administratin, that states: 1. The fficer had reasnable grunds t believe that the persn had been driving r attempting t drive a mtr vehicle n a highway r n any private prperty that is used by the public in general in this State while under the influence f alchl, while impaired by alchl, while s far impaired by any drug, any cmbinatin f drugs, r a cmbinatin f ne r mre drugs and alchl that the persn culd nt drive a vehicle safely, while impaired by a cntrlled dangerus substance, in vilatin f an alchl restrictin, r in vilatin f f this title; 2. [death r life threatening injury] (1) If a persn is invlved in a mtr vehicle accident that results in the death f, r a life threatening injury t, anther persn and the persn is detained by a plice fficer wh has reasnable grunds t believe that the persn has been driving r attempting t drive while under the influence f alchl, while impaired by alchl, while s far impaired by any drug, any cmbinatin f drugs, r a cmbinatin f ne r mre drugs and alchl that the persn culd nt drive a vehicle safely, while impaired by a cntrlled dangerus substance, r in vilatin f f this title, the persn shall be required t submit, as directed by the fficer, t a test f: (i) The persn's breath t determine alchl cncentratin; (ii) One specimen f the persn's bld, t determine alchl cncentratin r t determine the drug r cntrlled dangerus substance cntent f the persn's bld; r (iii) Bth the persn's breath under item (i) f this paragraph and ne specimen f the persn's bld under item (ii) f this paragraph. (2) If a plice fficer directs that a persn be tested, then the prvisins f f the Curts and Judicial Prceedings Article shall apply. (3) Any medical persnnel wh perfrm any test required by this sectin are nt liable fr any civil damages as the result f any act r missin related t such test, nt amunting t grss negligence. (d) Prcedure where individual incapable f refusing test. -- (1) If a plice fficer has reasnable grunds t believe that a persn has been driving r attempting t drive a mtr vehicle while under the influence f alchl, while impaired by alchl, while s far impaired by any drug, any cmbinatin f drugs, r a cmbinatin f ne r mre drugs and alchl that the persn culd nt drive a vehicle safely, while impaired by a cntrlled dangerus substance, r in vilatin f f this title, and if the plice fficer determines that the persn is uncnscius r therwise incapable f refusing t take a test, the plice fficer shall: (i) Obtain prmpt medical attentin fr the persn; (ii) If necessary, arrange fr remval f the persn t a nearby medical facility; and (iii) If a test wuld nt jepardize the health r well-being f the persn, direct a qualified medical persn t withdraw bld fr a test. The persn was detained while perating a cmmercial mtr vehicle r while hlding a cmmercial instructinal permit r a cmmercial driver's license; 2. The plice fficer had reasnable grunds t believe the persn was in vilatin f an alchl restrictin r in vilatin f f this title; 3. 51 27 (g) Request t participate in Ignitin Interlck System Prgram (g) Request t participate in Ignitin Interlck System Prgram. -- Instead f requesting a hearing r n a suspensin r revcatin under subsectin (f) f this sectin, a persn may request t participate in the Ignitin Interlck System Prgram under f this title if: (1) The persn's driver's license is nt currently suspended, revked, canceled, r refused; and (2) Within the same time limits set frth in subsectin (f) f this sectin, the persn: (i) Surrenders a valid Maryland driver's license r signs a statement certifying that the driver's license is n lnger in the persn's pssessin; and (ii) Elects in writing t participate in the Ignitin Interlck System Prgram fr: days fr an ffense f a test result indicating an alchl cncentratin f at least 0.08 but nt mre than 0.14; 2. 1 year fr an ffense f a test result indicating an alchl cncentratin f 0.15 r mre; r 3. 1 year fr an ffense f a test refusal. (h) Withdrawal f initial refusal t take test; subsequent cnsent. -- (1) An initial refusal t take a test that is withdrawn as prvided in this subsectin is nt a refusal t take a test. (2) A persn wh initially refuses t take a test may withdraw the initial refusal and subsequently cnsent t take the test if the subsequent cnsent: (i) Is unequivcal; (ii) Des nt substantially interfere with the timely and efficacius administratin f the test; and (iii) Is given by the persn: 1. Befre the delay in testing wuld materially affect the utcme f the test; and 2. A. Fr the purpse f a test fr determining alchl cncentratin, within 2 hurs f the persn's apprehensin; r B. (2) A ntice issued under this subsectin, and a hearing requested by the individual, shall meet the requirements f Title 12, Subtitle 2 f this article. (3) The Administratin may extend the perid f a license revcatin under this subsectin fr nt mre than the perid f time specified in paragraph (4) f this subsectin: (i) If the individual des nt request a hearing as prvided by Title 12, Subtitle 2 f this article; (ii) After a hearing, if the individual is determined t have been cnvicted f a vilatin described in this subsectin while the individual's license t drive was revked; r (iii) If the individual fails t appear fr a hearing requested by the individual under this subsectin. (4) The Administratin may extend the perid f license revcatin fr nt mre than: (i) 1 year if it is the individual's first vilatin; (ii) 18 mnths if it is the individual's secnd vilatin; r (iii) 2 years if it is the individual's third r subsequent vilatin. 57 33 (d) Licenses currently revked may nt be revked. -- Ntwithstanding any ther prvisin f this title, the Administratin may nt revke a license that is currently revked EFFECT OF ACCUMULATED POINTS (a) Actin by Administratin. -- The Administratin shall take the fllwing actins fr pints accumulated within any 2-year perid: (1) Send a warning letter t each individual wh accumulates 3 pints; (2) Require attendance at a driver imprvement prgram cnducted under f this title by each individual wh accumulates 5 pints, except that a Class A, B, r C licensee wh submits evidence acceptable t the Administratin that he is a prfessinal driver may nt be called in until he accumulates 8 pints; and (3) Except as prvided in f this subtitle: (i) Suspend the license f each individual wh accumulates 8 pints; and (ii) Revke the license f each individual wh accumulates 12 pints. (b) Administratin t issue ntice. 59 IGNITION INTERLOCK SYSTEM (a) Definitins. -- (1) In this sectin the fllwing wrds have the meanings indicated. (2) "Apprved service prvider" means a persn wh is certified by: (i) The Administratin t service, install, mnitr, calibrate, and prvide infrmatin n ignitin interlck systems; and (ii) A manufacturer t be qualified t service, install, mnitr, calibrate, and prvide infrmatin n ignitin interlck systems. (3) "Manufacturer" means a persn wh manufactures ignitin interlck systems and wh certifies that apprved service prviders are qualified t service, install, mnitr, calibrate, and prvide infrmatin n ignitin interlck systems. (4) "Participant" means a participant in the Ignitin Interlck System Prgram. (5) "Prgram" means the Ignitin Interlck System Prgram. (b) In general. -- (1) The Administratin shall establish an Ignitin Interlck System Prgram in accrdance with this sectin. (2) The Administratin shall establish a prtcl fr the Prgram by regulatins that require certain minimum standards fr all service prviders wh service, install, mnitr, calibrate, and prvide infrmatin n ignitin interlck systems and include requirements that: (i) A service prvider wh applies t the Administratin fr certificatin as an apprved service prvider shall demnstrate that the service prvider is able t cmpetently service, install, mnitr, calibrate, and prvide infrmatin t the Administratin at least every 30 days n individuals required t use ignitin interlck systems; (ii) A service prvider wh applies t the Administratin fr certificatin as an apprved service prvider shall be certified by a signed affidavit frm the manufacturer that the service prvider has been trained by an authrized manufacturer and that the service prvider is cmpetent t service, install, mnitr, calibrate, and prvide infrmatin n ignitin interlck systems; (iii) Apprved service prviders be deemed t be authrized representatives f a manufacturer; and (iv) Any service f ntice upn an apprved service prvider, wh has vilated any laws r regulatins r whse ignitin interlck system has vilated any laws r regulatins, be deemed as service upn the manufacturer wh certified the apprved service prvider. (i) Length f participatin fr habitual ffenders. -- [24 mnths] 40 An individual whse license is suspended under (c)(2)(iv) f this subtitle is a habitual ffender whse license may nt be reinstated unless the individual participates in the Prgram fr at least 24 mnths. 4 (j) Equipment standards and prtcl. -- (1) Fr purpses f an ignitin interlck system used under (f) f this title, this sectin, r a curt rder under f this article, the Administratin shall permit nly the use f an ignitin interlck system that meets r exceeds the technical standards fr breath alchl ignitin interlck devices published in the Federal Register frm time t time. (2) Fr purpses f an ignitin interlck system used under this sectin, the Administratin shall require the Prgram prtcl adpted by the Administratin. (k) Mnitring participatin; fee. -- (1) An individual required t use an ignitin interlck system under a curt rder r this sectin: (i) Shall be mnitred by the Administratin; and (ii) Except as prvided in paragraph (2) f this subsectin, shall pay the fee required by the Administratin under subsectin (f)(3) f this sectin. (2) The Administratin shall waive the fee required under this subsectin fr an individual wh is indigent. (l) Curt rder nt affected. A curt rder that requires the use f an ignitin interlck system is nt affected by (c)(3) f this subtitle. The Administratin shall cnsider a participant t have successfully cmpleted the Prgram if the Administratin receives frm the participant's apprved service prvider a certificatin that in the 3 cnsecutive mnths befre a participant's date f release frm the Prgram there was nt: (1) An attempt t start the vehicle with a breath alchl cncentratin f 0.04 r mre unless a subsequent test perfrmed within 10 minutes registered a breath alchl cncentratin lwer than 0.04; (2) A failure t take r pass a randm test with a breath alchl cncentratin f r lwer unless a subsequent test perfrmed within 10 minutes registered a breath alchl cncentratin lwer than 0.025; r (3) A failure f the participant t appear at the apprved service prvider when required fr maintenance, repair, calibratin, mnitring, inspectin, r replacement f the device causing the device t cease t functin as required under this sectin. () Issuance f license n successful cmpletin f Prgram. -- If an individual successfully cmpletes the Prgram and the individual's license is nt refused, revked, suspended, r canceled under anther prvisin f this article, the Administratin shall immediately issue a license t the licensee. (p) Reentry int Prgram. -- [If licensee fails ut, can get back in after 30 day suspensin] (1) Ntwithstanding f this title, if the Administratin remves an individual frm the Prgram because the individual vilated requirements f the Prgram, the Administratin may allw the individual t reenter the Prgram after a perid f 30 days frm the date f remval. (r) Ntice r warning f participatin in Prgram. -- (1) If a persn is required t be a participant under subsectin (d) f this sectin, the Administratin shall include in the ntice f prpsed suspensin r revcatin a warning in bld cnspicuus type that the persn shall participate in the Prgram. (2) At the time that the Administratin issues a license t a persn wh is under the age f 21 years, the Administratin shall prvide t the persn a written warning in bld cnspicuus type that the persn shall participate in the Prgram if the Administratin finds the persn vilated the alchl restrictin n a driver under the age f 21 years r the persn vilated any prvisin f f this article. (5) "Interlck" means the mechanism by which a mtr vehicle is prevented frm starting when the test result f an individual's breath alchl analysis exceeds a preset alchl cncentratin level. (6) "Participant" means an individual enrlled in the Ignitin Interlck System Prgram. (7) "Prgram" means the Ignitin Interlck System Prgram established by the Administratin under Transprtatin Article, , Anntated Cde f Maryland. (8) "Reprting perid" means the time perid that begins at the time f installatin f the ignitin interlck device and reccurs every 30 days thereafter until the successful cmpletin f the Prgram. (9) "Service Prvider Certificatin" means an electrnic verificatin that the data recrded by the device, and certified as accurate by the participants apprved service prvider, and transmitted t the Administratin in the 3 cnsecutive mnths prir t the participants cmpletin date did nt cntain any f the vilatins specified in Transprtatin Article, (n), Anntated Cde f Maryland. (10) "Successful cmpletin" means satisfactrily fulfilling all the cnditins fr participatin in the Prgram and the Administratin is in receipt f the Service Prvider Certificatin. 77 53 COMAR REQUIREMENTS FOR ENROLLMENT IN PROGRAM A. T enrll as a participant in the Prgram, an individual shall: (1) Have a valid Maryland license that is nt currently suspended, revked, cancelled, r refused in this r any ther state; (2) Ntify the Administratin, in writing, f the individual's chice t participate in the Prgram; (3) Have an interlck device installed in the individual's vehicle by an apprved service prvider; (4) Surrender all Maryland driver's licenses, including a temprary license, r submit a signed statement certifying n driver's license is in the individual's pssessin; (5) Submit the service prvider's cmpleted sealed enrllment frm t a full service Administratin ffice; (6) Pay the required ignitin interlck participatin fee as set frth in COMAR ; and (7) Obtain a driver's license with an interlck-restrictin. B. An individual may nt becme a participant and will nt receive credit fr participatin in the Prgram unless all the requirements set frth in A f this regulatin have been cmplied with. C. Except when the participant is a repeat ffender subject t the prvisins f Transprtatin Article, (e), Anntated Cde f Maryland, an emplyer waiver, allwing the participant t drive an emplyer vehicle in the curse f the participants emplyment during nrmal wrking hurs, may be granted by the curts, r by the Administratin, with submissin f dcumentatin f current emplyment and the need fr the participant t perate the mtr vehicle in the curse f emplyment, in a frm that is acceptable t the Administratin. D. An individual wh requests an administrative hearing t shw cause why the individuals drivers license shuld nt be suspended r revked is n lnger eligible t participate in the Prgram unless: (1) The individual withdraws the request fr an administrative hearing and cmpletes all the requirements set frth in A f this regulatin; r (2) The individuals license suspensin r revcatin is mdified by a final decisin f an administrative law judge f the Office f Administrative Hearings t allw participatin in the Prgram. E. If the device is installed in a vehicle nt wned by the participant, the individual shall prvide the Administratin with a ntarized signed statement frm the wner f the vehicle authrizing the installatin f the interlck device. F. The participant shall abide by the terms and cnditins f the service prvider's agreement, including payment f all csts and fees assciated with the Prgram. G. The Administratin ignitin interlck participatin fee may be waived fr participants experiencing financial hardship as set frth in COMAR H. As a cnditin f cntinued enrllment in the Prgram, a participant shall have the interlck device serviced and data dwnladed by a service prvider, at a frequency nt t exceed 30 days. 78 54 COMAR VIOLATIONS OF INTERLOCK PROGRAM A. A participant is in vilatin f the Prgram requirements if the individual: (1) Receives a suspensin, revcatin, refusal, r cancellatin f the individual's driving privilege; (2) Has the interlck device installed in a vehicle with an expired r invalid registratin; (3) Remves the interlck device withut prir apprval frm the Administratin; (4) Operates a vehicle withut an ignitin interlck device installed in the vehicle; (5) Tampers with, bypasses, damages, r therwise remves r renders the ignitin interlck device inperable, r allws anther individual t tamper with, bypass, r render the device inperable; (6) Attempts t start r perate a vehicle with a breath alchl cncentratin greater than percent, unless there is a subsequent test reading within 10 minutes that indicates a breath alchl cncentratin belw percent; (7) Fails t submit t a retest after starting the vehicle; (8) Fails t perate the interlck-equipped vehicle at least 50 times during a reprting perid as recrded n the interlck device; (9) Fails t take the interlck-equipped vehicle t a scheduled mnthly mnitring appintment with the service prvider as set frth in Regulatin.03F f this chapter; (10) Fails t abide by the terms and cnditins f the participant's agreement with the service prvider; (11) Allws anther individual t blw int the interlck device while the participant is perating the vehicle; (12) Participates in any ther act r use f the interlck device that pses a threat t highway safety; r (13) Receives an Order f Suspensin under Transprtatin Article, , Anntated Cde f Maryland. B. The Administratin may extend the participant's required perid f participatin in the Prgram by 30 days instead f remval fr a vilatin set frth in Regulatin.04 f this chapter. C. The Administratin shall remve any participant wh is in vilatin f Prgram requirements during mre than three mnthly mnitring cycles. D. The Administratin shall ntify the participant f the remval frm the Prgram and reinstatement f a suspensin r revcatin, r f the Administratin's decisin t extend the participant's required perid f participatin in the Prgram. An individual participating in the prgram wh is ntified by the Administratin that the individual will be remved fr vilatins f the Prgram under this chapter, may: (1) Request a hearing n the suspensin r revcatin resulting frm the remval frm the Prgram; and (2) Have the suspensin held in abeyance pending the utcme f the administrative hearing. B. The interlck unit shall remain installed in the vehicle until a final decisin is rendered at the hearing regarding the individuals participatin in the interlck prgram. COMAR REFERRAL TO MEDICAL ADVISORY BOARD This chapter des nt limit the Administratin's authrity t: A. Refer a participant t the Medical Advisry Bard; r B. Require that a participant in the Prgram be actively enrlled in r have cmpleted a certified alchl treatment r substance abuse prgram. COMAR SUCCESSFUL COMPLETION A. An individual has successfully cmpleted the Prgram when: (1) The participant satisfactrily fulfilled all the cnditins fr participatin in the Prgram; and (2) The Administratin is in receipt f the Service Prvider Certificatin as required in Transprtatin Article, (n), Anntated Cde f Maryland. B. A persn wh successfully cmpletes the Prgram will receive credit twards future participatin in the Prgram arising frm the same incident.
