Cmfrt Crridr Ms. Galbraith Ms. Galbraith explained that this internatinal advisry panel will be studying the Mt. Cmfrt Crridr and delivering its pinin by the end f December. There will be several businesses and cunty and lcal

2 gvernments cntributing t the cst fr the weeklng event. McCrdsville s prtin f the $135,000 cst is $10,000. NineStar will be cntributing the majr prtin f the cst. She is seeking Cuncil apprval fr cmmitment f Twn dllars. Mtin by Mr. Williams t apprve a payment f $10,000 t NineStar fr the ULI cntributin. Strayer. 4-1, Burney nay. Trash Service Amendment The prpsed rdinance amendment was tabled until December 19 th. The billing date will be changed t agree with the existing sewer and strm water billing date. The rder f the distributin f a payment fr services (trash, strm water, and sewer) will be mdified. Charging the fee fr trash pickup t renters will be permitted if the prperty wners sign ff n it. Ordinance Nise Ordinance Amendment The prpsed rdinance amendment was tabled until December 19 th. Tw changes will be made: Decibel levels will be measured frm the cmplainer s prperty line (Item 5). The fee prtin will be changed t charge per citatin. (Article 93.99) Public Cmments Leah Brrmann, resident: In Octber 2017, the Twn did nt want t use decibels as a measurement. Several mnths later the Twn accmmdated the Cks wh wanted meters. Chief Rdgers was against using meters. She is cncerned the Cks will cntinue t d what they want. She asked fr a repetitin f fine amunts. Dug Dinsmre, resident: He is cncerned abut the decibel level being set at 66. The rdinance is being changed fr ne entity and is leaving the hmewners ut f it. Hw can the Cuncil d that? The winery has never dne what they said they wuld. He is cncerned he will have t put up sund wall barriers because he is being frced t due t the lack f prtectin frm the situatin via the rdinance. Mark Helle, resident: The neighbrs wuld like the lwer decibel level enfrced when the nise is between and residential and cmmercial prperty use. The 30-minute windw fr turning it dwn means if the fficer ges back and the nise is still up, they can be cited again. Blair Brrmann, resident: He did nt think it was ever the intentin t apprve utdr cncerts. Hwever, they can still happen with regularity and the utside neighbrhd peace will still be ruined. He suggested having a specific number f cncerts per year (perhaps 4) r t hld all cncerts inside. Dnna Price, resident: Mrs. Price asked why the Cuncil abated the existing winery citatins at the Nvember 13 th meeting. She asked if the Twn was dne waiving them nw. She des nt want the game played that way ging frward. Public Hearing n Additinal Apprpriatin fr the Special LOIT Fund Mtin by Mr. Wd t recess the Twn Cuncil Meeting. Hback Case The 2016 strm water fees and the land annexatin are being challenged by Mr. Hback and Ms. Daw. Mr. Mrelck wuld like Cuncil apprval t hire an utside legal firm t represent the Twn. Mtin by Dr. Burney that we apprve Larry Lngman t sign a retainer agreement with Barnes & Thrnburg t represent us in this matter with the Tax Bard. Strayer Street Lighting alng Bradway There might be flexibility t duplicate the lights n Bradway n the Meijer side fr the nrth side f Bradway as well. Cumulative Capital Develpment Fund Mr. Lngman recmmended the Twn Cuncil lk at establishing a CCD rate in Other Cmmittee Reprts RDC: The annual TIF meeting fr assciated taxing units will be held December 12 th at 6:00 p.m. Plan Cmmissin: Did nt meet. Architectural Review: Did nt meet. Parks Bard: A kids business market will be held in June fr the first time. Jump Start Sprts will partner with the Twn frm April 6 th thrugh May 18 th fr T-Ball fr ages 3-5; the sessins will be held n Saturdays. Additinal sessins are being planned. April 20 th the Easter Egg Hunt will be held. Hancck Cunty Slid Waste Cmmittee: Did nt meet. Public Wrks Cmmittee The snw remval plicy was updated. Several invices were apprved. Hancck Cunty Surveyr s Office Invice fr the strm water rdinance update Mtin by Mr. Strayer t recmmend the Hancck Cunty Surveyr s invice payment f $6,000. Zning Ordinance Prpsed Updates Mr. Crum shwed a Pwer Pint presentatin f the prpsed zning updates. Public Cmments Mindy Herman, resident: She des nt want any zning change t the land being cnsidered by Westprt Hmes fr develpment. She asked the Cuncil t stick t the cmprehensive plan. She thanked the staff and Cuncil fr their service. Elizabeth Stck, resident: She attended the Westprt meeting. She thinks there are t many hmes fr the space. It will stress the schl and increase traffic in an already cngested area. Westprt is prpsing 232 hmes. She thinks the value f the prpsed hmes is t lw fr the area and surrunding prperties. She asked the Cuncil t d their due diligence regarding Westprt and the class actin suit that has been filed against them. Ryan Crum: Mr. Crum explained the current situatin n this prpsed develpment that has nt yet been t the Cuncil fr an infrmal presentatin. Sean Cnby, resident: Champin Lakes residents were given nly fur days ntice by Westprt f the meeting. He wuld like t see a similar cmmunity fr the develpment as is Champin Lakes. Debrah Riddick, resident: Her biggest cncern is traffic. The area is nt ready fr a big neighbrhd. Daniel Stck, resident: The R-1 zning is imprtant fr the traffic flw. Westprt will turn CR 750N int a prblem that will be just as bad as CR 700N will be. The prductin hmes are nt built well and culd cause physical and psychlgical prblems t hmewners due t the prblems with cnstructin and materials used. Beth Miller, resident: Her main cncern besides the huses is traffic. She gave the Cuncil a picture f the current traffic issues at McCrdsville Elementary during pickup and drp ff times. 4 P a g e
