3 Intrductin This guide has been created t help hmewners understand hw t build a safe, legal and functinal secnd dwelling unit (Secnd Unit) in the Twn f Innisfil. It gives a summary f land use planning and building permit requirements. If there are any differences between this reference dcument and the frmal regulatins and by-laws, the frmal regulatins will apply. What is a Secnd Unit? A Secnd Unit might als be called ne f these names: accessry dwelling unit secndary suite accessry apartment in-law suite granny flat garage suite basement apartment It is a separate living space with kitchen, bathrm, sleeping and shared laundry facilities r a space with the required cnnectins and hk-ups, that is lcated n the same prperty as yur huse (detached, semi-detached r rw huse). Yu can live in it, allw yur family members t live in it, r rent it ut. It cannt be severed frm the lt f the principal dwelling and/r sld. 4 Hw d I make my Secnd Unit legal? T be legal, yur Secnd Unit must be registered with the Twn. T register yur unit, it must cmply with the Twn s Zning By-Law and the Ontari Building Cde, Fire Cde and Electrical Cde. 5 When will I need apprvals and permits/ inspectins? Yu will need the apprpriate apprvals frm the Twn f Innisfil and must meet the Twn s Zning By-Law and the Ontari Building, Fire and Electrical Cde s. A permit frm a Cnservatin Authrity may als be required. The fllwing helps identify which apprvals and permits/inspectins yu will need in the stages f cnstructing yur Secnd Unit: Befre yu build 1. Check that yur Secnd Unit meets the Twn s Zning By-law ( Sectin 3.5 cntains specific infrmatin n Accessry Secnd Dwelling Units (Residential Znes). Mre infrmatin n zning requirements is in the Step 1: D Yur Hmewrk sectin f this Guide. Please cntact the Twn fr assistance at Check if yur prperty falls within the regulatry area f the Lake Simce Regin Cnservatin Authrity ( r the Nttawasaga Valley Cnservatin Authrity ( ). Lk up yur prperty n the maps n their websites and if yu are within their regulatry area, yu will need t apply fr a permit frm the Cnservatin Authrity befre yu can apply fr a building permit frm the Twn. 3. Submit a building permit applicatin including any required plans and change f use evaluatins t the Twn; it will be reviewed by bth the Twn s Cmmunity Develpment Standards Branch and Planning Services fr cmpliance with the Ontari Building Cde and the Twn s Zning By-Law. Mre infrmatin n building permit requirements is included in the Step 2: Build Yur Secnd Unit sectin f this Guide and n the Twn website at: Once yu have yur building permit 4. When yur building permit is issued, inspectins will be required at certain stages f the cnstructin prcess. These will be specified t yu when the building permit is issued. Yu must cntact the Twn s Cmmunity Develpment Standards Branch t bk the required inspectins. This can be dne nline: 5. Electrical wrk requires a separate permit and Inspectin Reprt frm the Electrical Safety Authrity (ESA) t ensure cmpliance with the Ontari Electrical Safety Cde. Infrmatin n btaining this permit and Inspectin Reprt is n the ESA s website: After yur Secnd Unit is built 6. Yu must register yur Secnd Unit after yu have a Final Inspectin Reprt frm the Twn. Re-inspectin fr cmpliance with the Fire Cde will ccur every 5 years. While the Building Cde regulates the cnstructin f the Secnd Unit, the Fire Cde regulates its maintenance and peratin after it has been built and registered with the Twn. The Step 3: Register Yur Secnd Unit sectin f this Guide cntains further infrmatin. 4

6 Is there funding t help me with cnstructin csts? Yes, there is funding available thrugh the Twn and/r the Cunty f Simce t help yu legalize yur new OR existing Secnd Unit. There are several benefits t the cmmunity frm Secnd Units, such as mre safe and affrdable rental husing ptins. Here are sme ways t help fund yur prject: Receive a refund f up t $1000 n yur building permit applicatin and/r inspectin fees. Wh d I cntact? Twn f Innisfil Custmer Service at Are there any restrictins? Yes, the refund is nly available t the first 50 Secnd Units that are registered with the Twn. All fees must be paid first, and then the wner will receive the refund when they register their Secnd Unit. T qualify, the name f the wner n the building permit applicatin and Secnd Dwelling Unit Registratin Frm must be the same. When des the prgram end? The prgram will end nce 50 Secnd Units are registered. Register yur Secnd Unit and yu wn t be charged a registratin fee (nly ffered t wner-ccupied prperties). Wh d I cntact? Funding is available n a first cme, first serve basis. Why des the hmewner need t live in the principal dwelling r Secnd Unit? What are the exemptins? The Twn cnsulted with the cmmunity regarding hw Secnd Units shuld be allwed in Innisfil. There were cncerns abut prperty maintenance issues assciated with absentee landlrds. Requiring the wner t live at the prperty, except in the specific circumstances, will help address these cncerns. The wner is exempt frm living at the prperty if: a) The secnd unit existed befre Nvember 16, 1995; r b) The secnd unit cmplies with Part 9 f Ontari Building Cde; r c) The secnd unit is in a detached accessry structure. 5

7 Planning fr a Secnd Unit There are three main steps t building a legal Secnd Unit n yur prperty: Cnsider the legal requirements and decide if a Secnd Unit is right fr yu and yur prperty 1. If yu meet all f the basic criteria belw, then yu shuld be able t build a Secnd Unit n yur prperty. Hwever, yu must als meet ther zning requirements (e.g. parking and entrance) as well as the applicable standards f the Ontari Building, Fire, and Electrical Cde s. Please cntact the Twn ( ) t cnfirm yur particular circumstances. Basic Zning Criteria: I live in a single-detached huse, semi-detached huse r street twnhuse; I d nt have a garden suite, ldging huse r grup hme n my prperty already (Nte: Yu can nly have ne Secnd Unit n yur prperty); I d nt live in a huse within 100 metres f the Lake Simce shreline that has a private septic system; I d nt live within hazard lands, such as fld-prne r highly ersive areas (this is determined by the apprpriate Cnservatin Authrity); and, I d nt live within the Ckstwn settlement area, as shwn n Schedule B2 f the Twn s Official Plan. 9 Hw can I build an attached Secnd Unit? Belw are a few examples f different ways t build an attached Secnd Unit: Secnd Unit created in basement f an existing r newly built dwelling Secnd Unit abve an attached garage, in an existing space r additin At grade Secnd Unit created in an existing space r additin Pht: adapted frm the City f Kingstn Guide t Develping a Secnd Residential Unit Orange shading shws lcatin f Secnd Unit Regardless f hw yu decide t build yur Secnd Unit, it will need t meet all applicable Cde requirements and the Twn s Zning By-law. Can I build a detached Secnd Unit? Yes, but in rder t build a Secnd Unit in a detached structure (e.g. garage) yu must be able t meet all f the fllwing zning requirements: Yur lt must be greater than 1000 square metres (apprximately 0.25 acres) in size; Yur Secnd Unit must be n mre than 60 metres frm the principal dwelling; Yur Secnd Unit must nt be higher than 5 metres frm the grund; and, Yur Secnd Unit must be able t meet all applicable Zning By-law prvisins, such as minimum setbacks frm lt lines. Yur detached Secnd Unit will als need t meet the standards f the Ontari Building, Fire and Electrical Cde s. 8

10 Hw big can a Secnd Unit be? It can be n bigger than 50% f the grss flr area f yur huse, up t a maximum size f 100m 2. It can have a maximum f 3 bedrms. T figure ut hw big yur Secnd Unit can be, fllw these tw simple steps: Step 1: Calculate the grss flr area f yur huse. This is the ttal area f each flr f yur huse, but des nt include any garage, carprt, prch, veranda, balcny, sunrm, unfinished attic, unfinished basement r unfinished cellar. D nt include flr area ccupied by mechanical, service and electrical equipment either. Step 2: Calculate the maximum flr area f yur Secnd Unit Divide the grss flr area (the number yu calculated in Step 1) by tw. The number yu get is hw big yur Secnd Unit can be, up t maximum f 100m 2. Sample Calculatins Example 1: Bungalw with Basement Step 1: Grss flr area calculatin Grss flr area = main flr area + (basement flr area - basement service area) Grss flr area = 90m² + (90m² - 10m²) Grss flr area = 170m² Step 2: Maximum flr area f Secnd Unit calculatin: Maximum flr area = grss flr area 2 Maximum flr area = 170m² 2 Maximum flr area = 85m² The maximum size f the Secnd Unit (attached r detached) is 85m². Example 2: Tw-Stry Huse with Basement Step 1: Grss flr area calculatin Grss flr area = main flr area + secnd flr area + (basement flr area - basement service area) Grss flr area = 90m² + 80m² + (90m² - 12m²) Grss flr area = 248m² Step 2: Maximum flr area f Secnd Unit calculatin: Maximum flr area = grss flr area 2 Maximum flr area = 248m² 2 Maximum flr area = 124m² (Nte: Maximum allwable is 100m²) Althugh 50% f the grss flr area is 124 m², the Secnd Unit (attached r detached) wuld be restricted t the maximum unit size f 100 m². 9

11 What are the entrance requirements fr a Secnd Unit? All Secnd Units must have their wn separate entrance. The separate entrance may be frm the frnt, side r rear f the building, but it must meet the fllwing requirements: The entrance cannt be frm a garage, unless a separate dr with direct utdr access is prvided; The entrance must be accessed by a minimum 1 metre wide path f travel between the building and any lt line; and, Safe entrance and exit f the Secnd Unit must meet the requirements f the Ontari Building Cde and Fire Cde. Hw many parking spaces d I need? Yu must supply parking fr the Secnd Unit in additin t the 2 ff-street parking spaces that are required fr yur hme (the principal dwelling). The number f additinal parking spaces depends n the size f yur Secnd Unit: If the Secnd Unit has 1 bedrm r less, yu must prvide at least 1 additinal ffstreet parking space n yur prperty (minimum 3 spaces ttal); r If the Secnd Unit has 2 r mre bedrms, yu must prvide at least 2 additinal ffstreet parking spaces n yur prperty (minimum 4 spaces ttal). Please nte the fllwing when determining the number f parking spaces n yur prperty: Parking spaces bth inside the garage r utside n the driveway can be cunted; Any spaces fr parking in the bulevard area between the street and yur frnt lt line will nt be cunted twards these requirements; Fr huses with Secnd Units, each parking space must be a minimum f 2.5 metres wide and 5 metres lng; If yur prperty cannt prvide enugh parking right nw, yu might be able t widen yur driveway t meet the required number f parking spaces; and, A minimum f 40% f yur frnt yard must be maintained as landscaped pen space and cannt be used fr driveway and/r parking purpses. Can I build a Secnd Unit n a privately serviced lt (i.e. individual well and septic)? Yes, but yu will be required t demnstrate that the system has sufficient capacity fr the Secnd Unit. The Ministry f the Envirnment has rules fr the quantity and quality f water that a private residential well must prvide. The capacity and design f a private septic system is regulated by the Ontari Building Cde. 10

12 D I need t cnsider n-site drainage? On-site drainage and strm water management must be maintained r imprved with the additin f a Secnd Unit. Fr example, the cnstructin f a side yard walkway has the ptential t alter the way surface runff flws t strm water management drains. A site grading plan may be required t limit the pssibility f flding and t ensure that any changes made t yur prperty d nt negatively impact grading and drainage n yur prperty r yur neighburs. What can I d if my prperty des nt meet the zning requirements? If yur prperty cannt meet the zning requirements fr Secnd Units, yu may have the pprtunity t apply fr a minr variance r a zning by-law amendment. These prcesses are summarized as fllws. Minr Variance Applicatin The minr variance prcess allws fr a prperty wner t seek relief frm a specific prvisin f the Twn s zning by-law. The Cmmittee f Adjustment is an independent bdy appinted by Cuncil and will cnsider apprval f yur applicatin. It will typically take abut 2 mnths fr yur applicatin t be prcessed. Additinal details and the applicatin frm are n the Twn s website: Zning By-Law Amendment If the requested relief frm the Twn s zning by-law is nt determined t be minr, a site-specific zning by-law amendment will be required, subject t Cuncil apprval. This prcess typically takes abut 4-6 mnths. Under the Ontari Building Cde, yu will need a building and/r a change f use permit. There are different scenaris that apply t Secnd Units under the Building Cde: Scenari 1: Building a Secnd Unit in a new hme r huse less than 5 years ld. Part 9 f the Building Cde applies. Submit a building permit applicatin. Scenari 2: Building a Secnd Unit in a huse mre than 5 years ld. Part 11 f the Building Cde applies. Submit a building permit applicatin. Scenari 3: Secnd Unit has already been built withut a building permit. Submit detailed flr plans t secure a change f use permit. Yu may als need t make renvatins t yur unit. Shuld I get help t draw my plans? It is strngly recmmended that yu hire a qualified designer. The Building Cde requirements fr Secnd Units are cmplex. A qualified designer will help ensure that yur plans meet all technical requirements, saving yu time and mney in the lng run. The designer may be an architect, engineer r a persn certified and registered with the Ministry f Municipal Affairs and Husing (MMAH). Designer qualificatins can be viewed n the Ministry s n-line Public Registry (QuARTS). Can my cntractr/designer apply fr the building permit n my behalf? Under the Ontari Building Cde, the wner is respnsible fr all cnstructin n yur prperty. If yu want yur cntractr r designer t apply n yur behalf, yu must prvide written authrizatin. 12

14 What des a cmplete building permit applicatin include? Once yu have checked that yur Secnd Unit meets the zning requirements, yu can submit yur building permit applicatin. Yur Secnd Unit must cmply with the Ontari Building Cde. Please cntact the Cmmunity Develpment Standards Branch ( ) t determine what dcuments will be required fr yur prject. Yur building permit applicatin will typically include the fllwing: A site plan shwing cmpliance with zning requirements such as the number f parking spaces and the entrance path t the Secnd Unit A flr plan f the existing r prpsed Secnd Unit Crss-sectin drawings f walls/ceilings and details f the materials and systems used Other items such as: Entrance and exit Rm sizes and heights Dr and windw sizes and types Fire separatins and sund transmissin ratings Heating and ventilatin system(s) Laundry facilities Plumbing facilities Hw lng will it take t get a building permit? After submitting yur cmplete building permit applicatin, it will typically take the Cmmunity Develpment Standards Branch abut business days t prcess it. Yu will be cntacted if further infrmatin is required. Yu can start cnstructin after btaining the permit. The building permit will expire six mnths after it is issued if an inspectin is nt bked. Hw much are building permit fees? Permit fees are reviewed annually and subject t change. All fees are utlined in the Twn s Fees and Charges By-law. 13

15 What shuld I cnsider in the exterir and interir design f my Secnd Unit? Yu shuld design yur Secnd Unit s that it blends in with yur neighburhd. Any urban design guidelines that affect yur prperty must be fllwed. The fllwing are sme things t keep in mind when designing yur unit s that will be functinal and blend in with yur hme and neighburhd: Design Cnsideratins: Match any new windws, drs and materials (e.g. siding, brick, plaster, shingles, etc.) t the current nes n yur hme, especially at the frnt f the huse Maintain current rflines if yu are adding n drmers r an additin t yur secnd stry (e.g. abve yur attached garage) Build a privacy fence r ther landscape screening between yur neighburs, especially if the Secnd Unit has a side r rear entry Use permeable surfaces when prviding additinal parking Prvide strage space fr husehld items and garbage facilities Prvide utdr amenity space (e.g. deck r pati) fr yur tenants Health and Safety Cnsideratins: Accmmdate individuals with mbility challenges with apprpriate hallway and dr widths, bathrm and kitchen fixture placement, stair cnfiguratin, etc. Pht: Ggle Maps Street View Example f a secnd dwelling unit with an entrance that blends in with the existing architecture Ensure yu have adequate utdr lighting, while still minimizing the prjectin f light nt neighburing prperties Prvide a hard/stable walkway t the Secnd Unit entrance if it is nt at the frnt f the huse Prtect the health f yur tenants and reduce maintenance csts by requiring that yur Secnd Unit be smke-free (it is legal fr a landlrd t adpt a n-smking plicy) 14

16 Step 3: Register Yur Secnd Unit 1. D Yur Hmewrk 2. Build Yur Secnd Unit 3. Register Yur Secnd Unit What are the benefits f registering my Secnd Unit? The benefits include: It prvides safety fr yu and the ccupants, by ensuring that the Secnd Unit meets zning, building, fire and electrical cde requirements; while emergency services will be aware that a Secnd Unit exists. It allws yu t btain prper hme insurance, which gives yu peace f mind that yu will be cvered if yu make a claim fr damage t yur hme and be prtected against persnal liability. Yu will receive a secnd municipal address, which in additin t identifying each unit fr emergency services, will allw fr bth the primary unit and the Secnd Unit t put ut garbage and recycling fr cllectin and fr a separate mailbx t be assigned t the Secnd Unit. When d I submit my registratin applicatin? After yu have built yur Secnd Unit and had yur final inspectin frm the Cmmunity Develpment Standards Branch, yu must apply t register yur Secnd Unit. A cmplete applicatin fr registratin includes the fllwing: Cmpleted Secnd Unit Registratin Frm* Cpy f yur Final Inspectin Reprt Legally Registered Secnd Unit *The prperty wner must declare the fllwing n the registratin frm: 1) That yu are the prperty wner and 2) That yu will be living in either the principal unit r Secnd Unit, unless yu meet the specific exemptins. 15

17 Hw much will it cst t register my Secnd Unit? Will I be required t renew my registratin? The Twn s Fees and Charges By-Law identifies registratin and renewal fees that are different depending n whether the wner is living at the prperty. The fllwing fees apply when the wner is living in the secnd unit r the principal dwelling: Registratin fee des nt apply $100 renewal fee every 5 years The fllwing fees apply when the wner is nt living at the prperty: $250 registratin fee $250 renewal fee every 3 years Are there fines if I d nt register my Secnd Unit? Yes, if an inspectin determines that the prperty is in vilatin f the Registratin By-Law, the fllwing minimum fines will apply: $350 inspectin/administratin fee fr first letter f nn-cmpliance; and $500 inspectin/administratin fee fr each fllw up letter f nn-cmpliance. Once I have registered my Secnd Unit, will it be assigned a separate address? Yes, nce yu register yur Secnd Unit it will be assigned a secndary address f Unit 2 (the address fr the primary dwelling will stay the same). The address f Unit 2 must be visible t identify the primary entrance int the Secnd Unit. This will help emergency services such as plice, fire and ambulance t act mre quickly in an emergency. It will als make mail and delivery services mre cnvenient and ensure that garbage and recycling is picked up frm bth residential units. Is a list f registered Secnd Units publically available? Yes, a list cntaining the addresses f legally registered Secnd Units is available nline and in persn at the Twn Hall. This list will make it easier fr tenants t identify whether a Secnd Unit is legal. Once I develp a Secnd Unit, what are my respnsibilities as a landlrd? The rights and respnsibility f a landlrd are utlined in the Residential Tenancies Act. This infrmatin fr landlrds in Ontari is available frm the Landlrd and Tenant Bard. All prperty wners must als fllw the Twn s Zning By-Law and Ontari Building Cde and Fire Cde prvisins, as well as the Twn s Prperty Standards By-law, which establishes standards fr the maintenance f prperties and buildings, such as snw remval and yard maintenance. 16
