2 BYLAW NO. 2007/24/D BYLAW TO REGULATE THE DEVELOPMENT AND USE OF LAND AND BUILDINGS WITHIN THE TOWN OF DRAYTON VALLEY WHEREAS and pursuant t Part 17, Divisin 5 f the Municipal Gvernment Act 2000 being Chapter M 26 f the Revised Statutes f Alberta, the Cuncil f a municipality must pass a Land Use Bylaw; AND WHEREAS Sectin 692 f the Municipal Gvernment Act, being Chapter M f the Revised Statutes f Alberta, requires the Cuncil f a municipality t hld a public hearing and advertise such a Bylaw in accrdance with Sectins 203 and 606 f the Act respectively; AND WHEREAS Cuncil deems it apprpriate that the current Land Use Bylaw shuld be updated and amended as required; NOW THEREFORE, the Cuncil f the Twn f Draytn Valley, duly assembled, hereby enacts as fllws: 1. TITLE This bylaw may be cited as the Land Use Bylaw f the Twn f Draytn Valley. 2. PURPOSE The purpse f this bylaw is t regulate and cntrl the use and develpment f land and buildings within the municipality t achieve the rderly and ecnmic develpment f land, and fr that purpse, amng ther things, t divide the municipality int districts; t prescribe and regulate fr each district the purpses fr which land and buildings may be used; t establish the ffice f Develpment Authrity; t establish a methd f making decisins n applicatins fr develpment permits including the issuing f develpment permits; t prescribe a prcedure t ntify wners f land likely t be affected by the issue f a develpment permit; and t establish a prcedure fr appeals against the decisins f the Develpment Authrity. 3 3. DEFINITIONS In this bylaw: Abut r abutting means immediately cntiguus t r physically tuching, and when used in respect f a lt, means that the tw abutting lts share a prperty line. Accessry building means a building separate and subrdinate t the main building, the use f which is incidental t that main building and is lcated n the same lt. An accessry building attached t a main building, and a deck higher than 0.3 metres abve grund level, are deemed t be part f the main building. Accessry buildings include garages, carprts, sheds, strage buildings, permanently installed private swimming pls and ht tubs, radi antennas, ples, satellite dishes and twers. Accessry use means a use custmarily incidental and subrdinate t the main use r building and lcated n the same lt with such main use r building. Act means the Municipal Gvernment Act and the regulatins pursuant theret. Act means the Municipal Gvernment Act, Revised Statutes f Alberta 2000, Chapter M-26 and amendments theret. [added by Bylaw 2012/20/D] Adjacent land(s) means land that is cntiguus t the parcel f land that is subject f an applicatin and includes land(s) that wuld be cntiguus if nt fr highway, rad, river r stream and, in the pinin f the Develpment Authrity, any ther land. [added by Bylaw 2012/20/D] Adult business means any establishment r peratin t which persns under the age f eighteen (18) years are nt admitted r t whm gds r services are nt prvided, but excludes Retail Liqur Stres (as defined belw), and places r peratins where in the pinin f the Municipal Planning Cmmissin the adult part f the ttal activity is nt the primary functin f the business. Examples f adult businesses include but are nt limited t: (a) strip clubs r live perfrmance(s) which have nudity, r partial nudity, f any persn; (b) smke shps r ther shps dedicated primarily t selling prducts related t smking; (c) (d) escrt r dating services; stres which include the sale f drug paraphernalia, ther than licensed pharmacies r medical r veterinary practices. [amended by Bylaw 2012/25/D] Adult entertainment means any live r cinematic perfrmances held, r reprductins and recrds are shwn r displayed, the central feature f which is any sexual r sexually explicit act r display f nudity. Such activities may include adult mini-theatres and ertic dance. Agriculture means all frms f farming except fr intensive livestck facilities. Agricultural, retail means a cmmercial agricultural peratin that includes retail sales t the public including market gardens and u-picks. [added by Bylaw 2012/20/D] Agricultural, supprt service means a use, which prvides nn-industrial, agriculturally riented gds and services t the cmmunity. This must include the retailing, servicing, sales and/r repairing f agricultural implements and gds such as farm machinery dealers, grain elevatrs and fertilizer sales. [added by Bylaw 2012/20/D] Amusement arcade means an establishment r a place cntaining electrnic r mechanical games that may be played by a custmer fr a fee. Animal care/service facilities means develpment fr the purpses f treatment, barding r grming f animals and includes retail sales f assciated prducts. This may include thse uses defined within this Bylaw as veterinary clinic, as well as grming services, barding and breeding kennels, impunding and quarantine facilities and animal shelters, but des nt include the sale f animals. 4 Apartment building means a building cntaining at least three separate dwelling units which share a cmmn entrance frm utside the building. Applicant means an wner, agent r any persn, firm, r cmpany required t btain r having btained a develpment permit. Applicatin means an applicatin fr a develpment permit made under sectin 10 f this bylaw. Area Structure Plan means a plan adpted by Cuncil under sectin 633 f the Act. Athletic and/r sprting facilities means a building r pen space designed fr the purpse f playing sprts r ther recreatinal activities. Auctin mart r auctineering establishment means a building r an inside r utside place where livestck r ther items are bid n in cmpetitin n a regular basis. Autmbile sales means the use f a prperty fr the sale f mtr vehicles (including cars, trucks, vans, trailers, and recreatinal vehicles) and includes all assciated activities and land uses including displays and the repair and maintenance f autmbiles. Autmbile service means the maintenance and repair f mtr vehicles but excludes bdy shps and paint shps. Autmtive bdy shp r paint shp means a building r place, either freestanding r part f a larger building r place, used fr the repair r imprvement f the bdywrk f mtr vehicles. Basement means a prtin f a residential building which is situated partly r cmpletely belw grade. [added by Bylaw 2012/20/D] Bed and breakfast establishment means a business perated in an wner ccupied detached huse, in which up t three rms are made available fr rent t shrt-term paying guests. Billbard means a freestanding sign attached permanently and securely t the grund, engineered and maintained t the satisfactin f the Develpment Authrity. Barder r ldger means a persn wh is unrelated t the husehlder and wh pays fr accmmdatin, but wh des nt ccupy a secndary suite r surveillance suite. This definitin includes emplyees f a cmpany which wns r rents a building r suite fr the use f the emplyees. Barding/Ldging facility means a use cnsisting f sleeping facilities which may be in additin t the husehld accmmdatin and where cking and/r sanitary facilities are nt develped in additin t thse in the dwelling unit cntaining the barding facilities. N mre than fur (4) rms may be used fr the purpse f accmmdating guests n site. [added by Bylaw 2012/20/D] Building permit means a permit authrizing cnstructin issued under the Safety Cdes Act. Bulk and unattended fuel sales r bulk il and chemical strage means a develpment where refined r crude il r liquid r slid chemical is stred utdrs r undergrund. Such chemicals may include fertilizer, gasline, prpane, petrleum prducts, flammable and/r cmbustible liquids r hydrcarbn prducts, whether manufactured r generated elsewhere thrugh resurce and/r ther industry activities, including but nt limited t water, salt water r any ther liquid stred fr ilfield cnsumptin. [added by Bylaw 2012/20/D] Bylaw Vilatin Tag means a tag r similar dcument issued by the Twn pursuant t the Municipal Gvernment Act R.S.A c M-26 as amended r repealed and replaced frm time t time. 5 Campgrund r campsite means an area designated fr temprary vernight ldging in tents, travel trailers, r recreatinal vehicles. Cemetery means an area cntaining graves, tmbs, r funeral urns. Clubs and assciatins mean a grup f persns rganized t meet fr scial, literary, athletic, plitical, r ther purpses, whether public r private in nature. Cmmercial means a land use except residential, institutinal r industrial. Cmmercial turist develpment means a building r facility whereby attractins, exhibits, gds and merchandise and/r recreatinal facilities are individually r cllectively prvided t the turist market n a cmmercial basis. [added by Bylaw 2012/20/D] Cmplete applicatin means that all infrmatin required under this Bylaw has been supplied r where, in the pinin f the Develpment Authrity, the quality f the material supplied as adequate t prperly evaluate the applicatin r a decisin can be made withut all f the infrmatin required under this Bylaw. [added by Bylaw 2012/20/D] Cnvenience stre means a small retail establishment with extended hurs which cmmnly sells grceries, cnfectinary, tbacc, newspapers, and persnal care items. Cnventin centre means a building used fr meetings r frmal assemblies r representatives r delegates t discuss matters f cmmn cncern. Cnventinal cnstructin means n-site cnstructin, althugh sme pre-built cmpnents such as rf trusses, engineered beams, and wall sectins may be used. Cuncil means the Cuncil f the Twn f Draytn Valley. Crematrium means an establishment which cntains a furnace fr cremating r retrting human remains. Curb cut means a place where vehicles crss a curb, even if there is n built curb. Day care facility means an establishment which prvides care, maintenance, and supervisin fr fur r mre children, by a persn nt related t the children by bld r marriage, fr perids f less than 24 cnsecutive hurs. Demlitin means the pulling dwn r destructin r remval f a structure. Density is a measure f the intensity f use f a Lt, measured as the number f persns, buildings, dwelling units, r flr area f buildings per unit f Lt area. Detached huse means a building which cntains ne dwelling unit and which may als cntain ne suite. Develper means a persn, agent, firm, r cmpany required t btain r having btained a develpment permit. Develpment has the meaning set ut in the Act, and is t be interpreted as including Demlishing a building, Mving a building frm ne place t anther, Grading, excavating, clearing, filling, r remving large numbers f trees frm land, fr the purpse f erecting building(s) Operating a hme ffice r hme business, Occupying a mtr hme r recreatinal vehicle fr lnger than five days. Develpment permit means a dcument authrizing develpment issued under this bylaw. Twn f Draytn Valley Land Use Bylaw 4

6 Directr f Emergency Management (als referred t as DEM ) means the persn appinted by Cuncil reslutin as the Directr f the Municipal Emergency Management Agency. [added by Bylaw 2012/20/D] Discretinary use means the use f land r a building prvided fr in this bylaw fr which a develpment permit may be issued upn an applicatin having been made. Duble frnting means adjacent t tw streets (but nt lanes). Drive-in r drive-thrugh business means a mtin picture theatre, fd service establishment, bank, r ther facility in which patrns are served while in autmbiles. Driveway means a hard-surfaced area used fr parking vehicles n private prperty, ften cnnecting a huse r garage with a public rad. Driveways must be cnstructed f asphalt, cncrete, paving stnes, r cmpacted gravel. [added by Bylaw 2012/20/D] Drug paraphernalia means any prduct, equipment, thing r material used r intended t be primarily used t prduce, prcess, package, stre, inject, ingest, inhale r therwise intrduce int the human bdy, r t disguise r hide the presence f, a cntrlled substance as defined in the Cntrlled Drugs and Substances Act, R.S.C.; Duplex means a building cntaining tw dwelling units, sharing a cmmn wall, with separate utside entrances fr each dwelling unit. Dwelling unit means a self-cntained living premises with cking, eating, living, sleeping, and sanitary facilities fr dmestic use by ne r mre individuals, and (unless mre clsely defined fr the purpses f ne sectin f the bylaw) includes manufactured and mdular hmes. Attached decks, sundecks, patis, prches and balcnies are deemed t be a part f a Dwelling Unit. Easement means a right t use land, generally fr access t ther prperty, r as a right-f-way fr a public utility. Emergency Management Plan means a detailed set f steps and prcedures that the peratr f a cmmercial r industrial business shall fllw in the event that an emergency riginates frm the business. This shall include any spills, fires, unauthrized mixtures, envirnmental cntaminatin r ther event deemed t be an emergency by the DEM. [added by Bylaw 2012/20/D] Envirnmentally significant area means an area f land which is vital t the lng-term maintenance f bilgical diversity, physical landscape features and/r ther natural prcesses at multiple spatial scales. The recgnitin f ESAs is essential t help identify and priritize areas that may be imprtant t cnserve, r that require special management cnsideratin, r because f its bi-physical features such as steep slpes, unstable sil structure, distinct wildlife habitat, and wetlands, cannt supprt intensive land uses. Fr example, areas f envirnmental imprtance may represent under-prtected r vulnerable resurces such as frests, riparian areas, lakes, creeks and culees. [added by Bylaw 2012/20/D] Excavatin means any breaking f grund except fr gardening and grund care. Extensive agriculture means the use f land r buildings fr the purpse f planting, raising, grwing, prductin and sale f crps, livestck, pultry, wildlife, game, hney, dairy and eggs, but des nt include game farming, game ranching fr viewing turism r recreatinal purpses, market gardening r sd prductin. [added by Bylaw 2012/20/D] Extensive recreatin means uses which capitalize n natural physical features t prvide fr utdr recreatinal activities. [added by Bylaw 2012/20/D] Family care unit means a dwelling unit used t accmmdate persn(s) wh reside in anther dwelling unit n the same parcel, and wh wuld prvide persnal care t r require persna care frm that resident(s), prvided that such care is necessary due t age, physical and/r mental disability. 7 structure, which may include a manufactured hme r mdular hme and is capable f being remved r decmmissined frm the parcel when the persnal care is n lnger required, and may be cntained within a principal r accessry building, pursuant t Alberta Building Cde requirements. [added by Bylaw 2012/20/D] Farmstead means the riginal residential site with ther imprvements used in cnnectin with the raising r prductin f crps, livestck, pultry and ther agricultural pursuits. [added by Bylaw 2012/20/D] Fence includes wall. Finishes (a building) means the exterir f a building (whether principal r accessry) must be cvered with a suitable material designed fr that purpse and includes, but is nt limited t stucc, brick, and/r plastic, cedar r aluminum siding. A suitable exterir material des nt include OSB, plywd, unfinished cncrete, tar paper r vapur barrier. Wd, ther than cedar, must be stained, painted r treated with a clear cat. [added by Bylaw 2012/20/D] [Fire pit definitin deleted by Bylaw 2013/12/D] Flanking street means a street adjacent t the side f a lt. Flanking yard means the prtin f a site extending frm the side wall f the main building t a flanking street, measured at right angles t the side prperty bundary. Fld plain means the area f land brdering a watercurse r water bdy that is subject t peridic inundatin. The current design standard in Alberta is the 1-in-100-year fld, defined as a fld whse magnitude has a ne (1%) per cent chance f being equalled r exceeded in any year. The 1-in-100-year fldplain f a watercurse is part f a water bdy, and the 100 metre setback distance fr develpment is established frm the uter edge f the fldplain, r as determined by Alberta Envirnment. [added by Bylaw 2012/20/D] Flr area f a building means the aggregate area f all finished flrs n all levels. Fundatin means the prtin f a building cnstructed belw grund level which bears the weight f the building and transmits it t the underlying grund. Furplex means a building cntaining fur dwelling units, sharing cmmn walls, each with its wn utside entrance. Fragmented parcel means a parcel that is separated frm the balance f a quarter sectin by a natural barrier such as a river r culee, r by a physical barrier such as a radway, highway r a drainage curse that has been registered by plan f survey. [added by Bylaw 2012/20/D] Frnt means, in the case f a crner lt, the shrter side. Frnt yard means that prtin f the site extending acrss the full width f the lt frm the frnt prperty bundary f the lt t the nearest prtin f the exterir wall f the building, and shall be measured at right angles t the frnt prperty bundary. Where a lt abuts tw r mre streets, the narrwest frntage is deemed t be the frnt f the lt. Garage means an accessry building r part f a main building intended fr the strage f mtr vehicles. Gas bar assciated with retail sales means an establishment selling retail mtr fuels in cnnectin with a cnvenience stre. Gasline and ther fuel sales means a business selling mtr fuels t the public, and includes freestanding service statins, gas bars, and the fuel sales cmpnent f any autmbile supply r service business, but des nt include key lck r bulk fuel sales. 8 Glf curse includes driving ranges, putting greens, club huses, and facilities fr the maintenance f a glf curse. Gvernment ffice means any building used fr the peratin f federal, prvincial, r municipal gvernment, including curthuses and the administrative functins f a schl bard. Grade (f a lt) means the elevatin f the existing grund in an undisturbed natural state r an apprved design grade as described in a cmprehensive grading plan apprved by lt the Twn Engineer. Green space means multi-functinal spaces fr gardening, recreatin, and leisure which prvide scial, ecnmic, and envirnmental benefits t urban residents. [added by Bylaw 2012/20/D] Grup care facility means a facility which prvides residential services t seven r mre individuals f whm ne r mre are unrelated and wh require supervisin because f their age, disability, r need fr rehabilitatin, and where qualified staff are present at all times. Grup hme means grup care facility which prvides accmmdatin fr less than 7 peple, but des nt include a fster hme r a day care service where the ccupant cares fr n mre than three children in additin t the ccupant s wn family, a psychiatric care facility, r a half-way huse r an pen care facility assciated with the justice system. Guest ranch means a develpment f a private wner-ccupied ranch huse which includes sleeping facilities that are rented n a daily basis t registered guests and meals are prepared in the residential kitchen. [added by Bylaw 2012/20/D] Hall r Auditrium means a large rm r building used fr meetings, cncerts, r similar public events. Handicapped parking stall means a hard-surfaced area at least 6 metres in length and 3.9 metres in width, reserved fr the parking f mtr vehicles bearing a handicap tag. Hazardus area means an area which, in the pinin f the Develpment Authrity, is unstable. This may include lands prne t flding, shreline ersin r slpe instability vulnerability r any aspect that may result in lss f life r injury, prperty damage, scial r ecnmic disruptin r envirnmental degradatin. Examples include but are nt limited t fldplain, fldway, lands in prximity t water bdies and water curses with slpes greater than ten (10%) per cent. [added by Bylaw 2012/20/D] Height (f a building) means the vertical distance frm grade level t the highest pint n the rf f the building, but excluding chimneys and aerials. Hme business means a business, trade, craft ccupatin, strage activity, r ther cmmercial peratin in a residential building n a scale greater than a hme ffice. Hme ffice means an ffice in a dwelling which is nt visited by a significant number f clients, des nt change the external appearance r residential character f the dwelling, and is carried n nly by the residents f that dwelling. Hspice means an establishment prviding accmmdatin and palliative care fr seriusly r terminally ill peple. Htel r mtel means an establishment ther than a Bed and Breakfast establishment, prviding cmmercial ldging t travellers r lng term visitrs, and usually having restaurants and/r meeting rms which may be pen t the general public. 9 Health care facilities and hspitals mean institutins prviding medical and surgical treatment and nursing care t sick r injured peple. Huse r husing means a place fr human habitatin. Industrial, light means thse industrial uses which d nt create a significant adverse impact r nuisance beynd the bundaries f the site and may include indr display, ffice, technical r administrative supprt, r sales peratin accessry t the light industrial use. Light industrial uses include the fllwing: [added by Bylaw 2012/20/D] (a) (b) (c) (d) the manufacturing r assembly f gds, prducts r equipment; the cleaning, servicing, repairing r testing f materials, gds and equipment assciated with industrial r cmmercial businesses r cleaning, servicing and repair peratins t gds and equipment assciated with persnal r husehld use; the strage r shipping f materials, gds and equipment, including petr-chemical prducts and supplies; r the training f persnnel in light industrial peratins. Industrial, heavy means thse industrial uses which require large tracts f land and may have a significant detrimental effect n adjacent r nearby sites as a result f its nrmal peratins by way f nise, vibratin, smke, emissins, dur r ther element. This categry includes, but is nt limited t, large scale manufacturing r prcessing f raw r finished materials including pulp and paper mills, asphalt r gravel crushing plans, il refineries, and industrial waster recycling. [added by Bylaw 2012/20/D] Intensive agriculture means a cmmercial agricultural peratin, nt including cnfined feeding peratins, which may require smaller tracts f land due t the intensive nature f the peratin including, but nt limited t, nurseries, greenhuses, market gardens, tree farms, specialty crps and apiaries. [added by Bylaw 2012/20/D] Internal rad means a rad which is unregistered and is maintained by a private landwner. [added by Bylaw 2012/20/D] Kennel means a cmmercial peratin in which three (3) r mre dgs ver six (6) mnths f age are maintained, barded, bred, trained r cared fr r kept fr purpses f sale r services. [added by Bylaw 2012/20/D] Land farm means a site used fr the treatment f sil cntaminated by hydrcarbns and nn-hazardus rganic ilfield waste, whereby the sil in questin is safely remedied thrugh aeratin r cultivatin. [added by Bylaw 2012/20/D] Landfill means the Sanitary Landfill wned and perated by the Twn f Draytn Valley at SE ¼ W5M. [added by Bylaw 2012/20/D] Landscaping means the installatin and maintenance f lawns, trees, plants and ther grund cver. Lane means a public thrughfare shwn n a registered plan which prvides a secndary means f access t a lt. Liqur stre means an establishment licensed by the Alberta gvernment where alchlic beverages are sld fr cnsumptin ff the premises. Live entertainment means a variety f acts, ften including music and cmedy skits r related entertainment (i.e. Cmedians, Hypntists, Live Bands, Tribute Bands etc). This definitin des nt include thse uses r items as defined under the Adult entertainment definitin. Twn f Draytn Valley Land Use Bylaw 8

10 Livestck means hrses, cattle, sheep, r any ther animal nrmally kept n a farm r ranch, and excludes dmestic pets. Lading space means a space used fr the lading r unlading f vehicles and nt situated n a rad r lane. Ldge means the meeting place f a fraternal r similar rganizatin. Lng term care facility means an institutin prviding medical treatment and nursing care fr an extended perid f time. Lt means an individual lt r parcel (including a cndminium lt) fr which a title has been issued under the Land Titles Act, r, where tw r mre lts are tied fr assessment purpses, r are included in a single title, the area encmpassed by the tw r mre lts. Where the cntext requires (fr example when determining parking requirements), lt includes a cndminium unit. Lt depth means the distance between the frnt and rear f a lt, where the frnt is the side f the lt adjacent t a public rad. Where a lt is adjacent t tw rads, the depth shall be defined by the Develpment Authrity. Lt width means the width f a lt n that part f the lt at the frnt f the main building. Main building means a building in which is cnducted the main r principal use f the lt n which it is erected. Manufactured hme, huse r husing means a residential building cntaining ne dwelling unit, built in a factry and transprted in ne r tw sectins t a suitable site. Manufactured hmes are typically lng and narrw, with a simple rectangular ftprint, lw-pitched rfs, and narrw eaves. Manufactured hmes were at ne time called mbile hmes. Manufacturing industry means the prductin, assembling, finishing r packaging f gds intended fr sale and may include indr and/r utdr strage f materials and prducts. [added by Bylaw 2012/20/D] Manufacturing, prcessing, and fabricatin describe the prcess f making gds n a large r cmmercial scale. Meat prcessing plant means an establishment where animals which have been killed at anther lcatin are butchered fr fd. Minr day care peratin means the care f up t three children in a private hme, fr less than 24 cnsecutive hurs per day, where thse children are nt related by bld r marriage t the husehlder. Mdular hme, huse, husing, r residence means a huse which is built ff site, either entirely r in parts, and which when cmpleted appears indistinguishable design, quality and finish frm a site-built huse, and includes an RTM (Ready-t-Mve) huse. Mved-in building means a building which was previusly in use at anther lcatin and which is mved t a new lcatin, but des nt include manufactured r mdular husing. Municipal Develpment Plan means a plan adpted under sectin 632 f the Act. Municipal Planning Cmmissin means the bdy appinted under Bylaw 2006/14/D. Municipality means the Twn f Draytn Valley. Museum means a building r place where wrks f art, histrical artefacts, scientific specimens, r ther bjects f permanent value are kept r displayed. Nursing hme means an institutin where aged r chrnically ill peple are cared fr. Twn f Draytn Valley Land Use Bylaw 9

11 Off street parking means parking cnstructed entirely ff any rad r lane. Oilfield supprt services means a develpment that prvides cleaning, servicing, repairing r testing f materials, gds and equipment nrmally assciated with the il and gas industry and may include the strage r shipping f such materials, gds and equipment, including petr-chemical prducts and supplies prvided such strage is in accrdance with all applicable prvincial and federal statutes. This definitin applies t il and gas industry supprt peratins and includes, but is nt limited t, seismic and surveying, well servicing, ilfield haulers, pipeline cntractrs and welding peratins, but excludes bulk il and chemical strage. [added by Bylaw 2012/20/D] Owner means, in additin t the meanings set ut in the Act, a purchaser f the fee simple estate in the land under an agreement fr sale that is the subject f a caveat registered against the Certificate f Title f the land, and any assignee f the purchaser's interest that is the subject f a caveat registered against the Certificate f Title. Park means an area f land, whether in a manicured r natural state, fr the enjyment f the public, having facilities fr rest and/r recreatin, which is wned and maintained by the Twn; [added by Bylaw 2012/25/D] Parking stall means an area set aside exclusively fr the parking f a mtr vehicle. Panhandle/flag lt means any parcel which gains rad frntage thrugh the use f a narrw strip f land which is an integral part f the parcel. The strip f land prviding access must nt be included when determining site area. [added by Bylaw 2012/20/D] Pati means a paved area cnstructed at grund level in the yard f a dwelling unit. Pawn shp means an establishment ffering mney t peple n security f articles f value which are nrmally held n the premises. Permitted use means the use f land r a building prvided fr in this bylaw, and fr which, if it cmplies in every way with this bylaw, a develpment permit shall be issued with r withut cnditins as prvided fr in this bylaw. Persnal service establishment means a business which prvides services t individuals, including but nt limited t hairdressing, fitness training, she repair, tailring, and dry cleaning. Place f wrship means a building and grunds used fr religius ceremnies. Playgrund means an area used fr utdr play r recreatin, especially by children, and cntaining recreatinal equipment such as slides and swings. [added by Bylaw 2012/25/D] Principal building means a building which, in the pinin f the Develpment Authrity: [added by Bylaw 2012/20/D] (a) (b) (c) is the primary r main building amng ne r mre buildings situated n the site; cnstitutes, by reasn f its use, the primary purpse fr which the site is zned; r ccupies the majrity area f the site. Principal use means the primary purpse, in the pinin f the Develpment Authrity, fr which the building r site is used. N mre than ne (1) principal use must be lcated upn a site unless specifically permitted therwise in this Bylaw. [added by Bylaw 2012/20/D] Private ldge/club means a develpment used fr the meeting, scial r recreatinal activities f members f nn-prfit, philanthrpic, scial service, athletic, business r fraternal rganizatins. 12 Prfessinal services mean services prvided t individuals r businesses by dctrs, lawyers, accuntants, chirpractrs, r members f any ther self-regulating prfessin, but excludes veterinary services. Prject accmmdatin means a residential cmplex used t huse camp wrkers by varius cntracting firms n a temprary basis, and withut restricting the generality f the abve, the camp is usually made up f a number f mbile units, clustered in such fashin as t prvide sleeping, eating, recreatin and ther basic living facilities. The units may be dismantled and remved frm the site frm time t time. [added by Bylaw 2012/20/D] PTMAA means the Petrleum Tank Management Assciatin f Alberta. [added by Bylaw 2012/20/D] Public parks and recreatin areas means land wned r managed by a gvernment r municipality and used by the public fr athletics, recreatin and entertainment. Public rad means a rad which is registered r which is maintained by the Twn. [added by Bylaw 2012/20/D] Public use means the use f land r a building by a gvernment agency, schl bard, r reginal health authrity. Public utility building means a building used by a public utility as defined in the Act. Rear yard means that prtin f the site extending acrss the full width f the lt frm the rear prperty bundary f the lt t the nearest prtin f the exterir wall f the building, and shall be measured at right angles t the rear prperty line. Recycling dept means a develpment used fr the purchase and temprary strage f recyclable materials, where all strage is cntained within an enclsed building. [added by Bylaw 2012/20/D] Registered wner f a prperty means the wner as defined in the Act. Residential sales centre means develpment f a shw hme r temprary building used fr a limited perid f time fr the purpse f marketing residential land and buildings. [added by Bylaw 2012/20/D] Restaurant means an establishment where meals are served t custmers. Retail means the sale f gds t the public, but excluding the sale f mtr vehicles r gasline. Retail Liqur Stre means develpment used fr the prvincially licensed retail sale f any and all types f alchlic beverages t the public fr cnsumptin ff the premises. Rad means the entire width f the right-f-way f a rad r lane shwn n a twnship plan, rad plan, r plan f subdivisin, and nt nly the built travelling surface. Rw husing means a residential building cntaining at least 3 dwelling units, each with direct utside access at grund level, and may als be referred t as twn husing. Salvage business means a scrap metal merchant, paper recycler, battery recycler, r any ther business which recvers useful r valuable material frm waste. Sea-Can Units [deleted by Bylaw 2008/16/D] Secndary suite means a secnd self-cntained dwelling unit that it lcated within the primary dwelling unit, where bth dwelling units are registered under the same land title. 13 Secnd-hand stre means a business which sells used articles t the public, but des nt include a salvage business. Service statin means a business selling mtr fuels t the public, and includes freestanding service statins, gas bars, and the fuel sales cmpnent f any autmbile supply r repair business, but des nt include bulk fuel sales, r unattended fuel sales such as key r card lck peratins Setback means the distance between the clsest part f the ftings f a building and the frnt, side, r rear prperty line f the lt, measured at right angles t that prperty line. Schl means an establishment where children frm kindergarten t grade 12 are educated, and includes bth tax-supprted and independent schls. Shreline means the line r cntur depicting the mean high water mark f a permanent watercurse r water bdy. [added by Bylaw 2012/20/D] Side yard means that prtin f the site extending frm the frnt yard t the rear yard and lying between the side prperty bundary f the lt and the nearest prtin f the exterir wall f the ftings f the building, measured at right angles t the side prperty bundary. See als flanking yard. Sign means an bject r device primarily intended t advertise r call attentin t any persn, matter, thing, r event. Site means ne r mre lts fr which a single develpment permit is made, and may include streets, lanes, walkways, and ther land n which develpment is prpsed. Site built huse r hme means a dwelling which is cnstructed n site, but which may include sme prefabricated cmpnents such as rf trusses r wall sectins. Site cverage means the percentage f the site cvered by buildings, but despite the definitin f "building" in the Act, driveways, parking pads, grund level patis, and ther hard surfaces at grund level are nt included in the calculatin f site cverage. Slaughterhuse means a place where animals are killed befre being butchered fr fd. Stacked Twn Huse means develpment cnsisting f rw husing, except that dwelling units may be arranged tw deep, either vertically s that dwelling units may be placed abve thers, r hrizntally s that the dwellings may be attached at the rear as well as the side. Each dwelling units shall have separate and individual access, nt necessarily directly t grund level, and such access shall nt be lcated mre than 5.5 metres abve grund level. This use class includes duplex husing and rw husing. Scial care facility means develpment f a detached dwelling as a facility which is authrized, licensed r certified by a Prvincial authrity t prvide rm and bard fr fster children r physically, mentally, scially, develpmentally r behaviurally challenged persns, r fr the rehabilitatin f its residents either thrugh independent r prfessinal care, guidance and supervisin. The residential character f the develpment must be maintained. [added by Bylaw 2012/20/D] Spectatr sprt facility means develpment prviding facilities intended fr sprts and athletic events, which are held primarily fr public entertainment, where patrns attend n a recurring basis. [added by Bylaw 2012/20/D] Staff husing means living quarters fr the accmmdatin f emplyees wrking n site. Stall means, when used in the cntext f a manufactured husing park, the area alltted t an individual renter and his unit. Strage Shed means any metal r wd prefabricated r site built structure used fr the strage f cmmercial r industrial gds, t be installed accessry t a cmmercial r industrial business. 14 Strey means the habitable space between the upper face r ne flr and the lwer face f the next higher flr. A basement shall be cnsidered a strey if the upper face f the flr abve it is mre than 1.8 metres abve grund level. Tank farm means a strage facility cnsisting f ne r mre strage tanks fr bulk r large amunts f il, chemicals r ther substances. [added by Bylaw 2012/20/D] Temprary building means a building which will be n site fr n mre than six mnths, r such lnger time as may be written in a develpment permit issued by the Municipal Planning Cmmissin. Nte: a canvas cvered frame r similar building is nt a temprary building if it remains n site fr mre than six mnths. Tp f bank means the upper break f the bank defining the mst distinct ridge f tpgraphic discntinuity in slpe between the upper plateau and the valley wall. [added by Bylaw 2012/20/D] Trade wrkshp means a building where a plumber, electrician, r ther tradesmen carries n his business and stres his supplies. Triplex means a building cntaining three dwelling units, sharing cmmn walls, each with its wn utside entrance. Use means a use f land r a building as determined by the Develpment Authrity, r n appeal by the Subdivisin and Develpment Appeal Bard. Utility building means a building in which the prprietr f a utility cmpany maintains his ffice(s) and/r maintains r huses any equipment used in cnnectin with the utility. Veterinary clinic means an establishment prviding medical and surgical treatment t animals. Vilatin Ticket means a ticket issued pursuant t Part II f the Prvincial Prcedures Act S.A c P-21.5 as amended r repealed and replaced frm time t time (hereinafter the POPA) and regulatins thereunder. [added by Bylaw 2013/12/D] Warehuse r warehusing means a building r part f a building used fr strage f gds, but excludes small scale strage n the site f a retail r service business. Whlesaling means the sale f gds in quantity t retailers. Yard means the pen space between the utside ftings r grund level wall f the main building n a lt, and the bundaries f that lt. All ther wrds have the meanings assigned t them by sectins 1 and 616 f the Act, r cmmn dictinary definitins. 4. INTERPRETATION 4.1. Any dubt as t the meaning f a wrd, r the bundaries f a land use district shwn n Schedule C shall be settled by a reslutin f Cuncil Where a prperty bundary is adjusted by subdivisin, r by the inclusin f clsed rad r ther land nt previusly assigned a land use class, the land use district bundary fllws the new prperty bundary. 4.3 Where this bylaw allws the exercise f discretin, r requires interpretatin, that discretin r interpretatin shall be exercised by the Develpment Authrity. 15 4.4 In accrdance with Alberta Land Titles prcedures, all measurements in this bylaw are metric, and where an imperial measurement is als give it is fr cnvenience nly, and has n legal status. 4.5 In the case where this bylaw cnflicts with the Alberta Building Cde, the Alberta Building Cde shall prevail. 4.6 All develpment within the Twn f Draytn Valley municipal bundaries, which is nt subject t the terms f annexatin, must cmply with this Bylaw. [added by Bylaw 2012/22/D] 4.7 Cmpliance with this Bylaw des nt exempt any persn undertaking develpment frm cmplying with all applicable municipal, prvincial and federal laws, and respecting any easements, cvenants, agreements r ther cntracts affecting the land r develpment. [added by Bylaw 2012/22/D] 4.8 If any part f this Bylaw is held t be invalid by a decisin f a Curt f cmpetent jurisdictin, that decisin will nt affect the validity f the remaining parts f this Bylaw. [added by Bylaw 2012/22/D] 4.9 Cmpliance with the plicies in this Bylaw shall be interpreted and applied as fllws: shall means mandatry cmpliance shuld means cmpliance in principle, but is subject t the discretin f the Develpment Authrity where cmpliance is impracticable r undesirable because f relevant planning principles r circumstances unique t a specific applicatin; may means discretinary cmpliance r a chice in applying plicy. [added by Bylaw 2012/22/D] 4.10 Where a regulatin invlves tw (2) r mre cnditins, prvisins r events cnnected by a cnjunctin, the fllwing shall apply: and means all the cnnected items shall apply in cmbinatin; r indicates that the cnnected items may apply singly r in cmbinatin; and/r indicates the items shall apply singly r in cmbinatin, at the discretin f the Develpment Authrity. [added by Bylaw 2012/22/D] 5. DEVELOPMENT AUTHORITY 5.1. The Develpment Authrity is hereby established and shall be: the Chief Administrative Officer r ne r mre persns designated by him and wh may be referred t as the Develpment Officer; and the Municipal Planning Cmmissin The Develpment Officer shall: maintain a cpy f this bylaw as amended, and make it available t any persn at a nminal price, Twn f Draytn Valley Land Use Bylaw 14

16 5.2.2 maintain a register f all applicatins, the decisins made n them, and the reasns fr thse decisins, and make it available t any persn at n charge, except therwise prvided in this bylaw, review and prcess all applicatins fr a develpment permit, and make and issue a decisin in accrdance with this bylaw, issue letters certifying whether r nt a building r land use cmplies with this bylaw, enfrce this bylaw in cnfrmance with the Act, including issue f Stp Orders, and carry ut the ther duties impsed n him by this bylaw and the Act Fr the purpses f sectin 210 f the Act, the Develpment Officer is a Designated Officer f the municipality. 5.4 Fr the purpses f sectin 542 f the Act, the Develpment Officer is an authrized persn f the municipality. 5.5 The functins f Develpment Authrity, pursuant t s , shall be exercised by the Municipal Planning Cmmissin: where the bylaw requires that a decisin be made by the Municipal Planning Cmmissin, r where it is necessary t exercise discretin r t grant a variance f the bylaw, r where the Develpment Officer elects t refer a matter t the Municipal Planning Cmmissin fr a decisin. 6. SUBDIVISION AND DEVELOPMENT APPEAL BOARD The Subdivisin and Develpment Appeal Bard established by Bylaw shall hear and decide upn appeals against the decisin (r lack f decisin) f the Develpment Authrity. 7. CONTROL OF DEVELOPMENT N develpment ther than that listed in sectin 8 shall be undertaken within the municipality unless an applicatin fr it has been apprved and a develpment permit has been issued. Attentin is drawn t the definitin f Develpment in sectin 3 f the bylaw. 8. DEVELOPMENT NOT REQUIRING A DEVELOPMENT PERMIT Ordinarily, the fllwing types f develpment shall nt require a develpment permit: 8.1 any use f land r a building which is exempt under sectins 618 f the Act r under any ther federal r prvincial legislatin, 8.2 the cmpletin and use f a building which was lawfully under cnstructin r fr which a develpment permit had been issued and was still valid at the date f adptin f this bylaw, 8.3 an existing use f land which was authrized under a previus bylaw, 8.4 maintenance f r repair t any building, prvided that such wrks d nt include structural alteratins, and such wrk which des nt impact exits and/r fire separatins, Twn f Draytn Valley Land Use Bylaw 15

17 8.5 internal renvatins r alteratins t a building, prvided that these alteratins d nt result in a change f use r intensity f use (but nte that a permit may still be required under the Safety Cdes Act), 8.6 landscaping and paving, prvided that grades and verland water flws are nt substantially altered, 8.7 the cnstructin r maintenance f any utility, wrk, r imprvement undertaken by the municipality r a utility in a street r utility lt, 8.8 a temprary building r sign, the sle purpse f which is incidental t the erectin r alteratin f a building, fr which a permit has been issued under this bylaw, 8.9 new single strey buildings accessry t a residential use and cmplying with all yard and setback rules, prvided they are nt n permanent fundatin, d nt encrach n any easement, and are under square metres in (110 square feet) size, 8.10 public rads and assciated imprvements, prvided that authrizatin is given by the Twn Engineer r his designate, 8.11 uncvered decks, where the walking surface is less than 0.3 metres abve grund level (cvered decks and thse with a higher walking surface require develpment and building permits), and 8.12 the ccupatin f a mtr hme, travel trailer, r recreatinal vehicle n private prperty fr a perid f less than five days, and 8.13 the cnstructin r installatin f a fire pit, which shall be in cmpliance with Draytn Valley/Brazeau Fire Services Bylaw 2013/08/P and amendments theret, [amended by Bylaw 2013/12/D] 9. NON-CONFORMING BUILDINGS AND USES If a building r land use is nt allwed in this bylaw, but was legally in existence at the date f passage f this bylaw, it may cntinue legally as a nn-cnfrming use and be maintained, pursuant t sectin 643 f the Act, but it may nt be enlarged r replaced except pursuant t sectin 13.6 f this bylaw. 10. APPLICATION FOR A DEVELOPMENT PERMIT 10.1 An applicatin fr a develpment permit shall be made t the Develpment Authrity in writing n the apprpriate frm, signed by the wner r his authrized agent, and shall be accmpanied by: the legal descriptin and municipal address f the prperty, a current cpy f the land title, a statement f the frmer, present, and prpsed use f the lt and any buildings n it, a site plan r plans drawn t scale and shwing: the bundaries f the lt, the adjacent streets and their names, the lcatins f existing and prpsed buildings and rf verhangs, any frnt, rear, and side yards, prvisin fr ff-street lading and vehicle parking, and access and egress pints t the site, easements and utilities, and the prpsed cnnectins t utilities, existing and prpsed fire hydrants, the existing and prpsed site grading and drainage, Twn f Draytn Valley Land Use Bylaw 16

18 prpsed landscaping, any il r gas wells r pipelines within 100 metres, the estimated cmmencement and cmpletin dates f any cnstructin, in the case f a manufactured hme, its CSA number r ther unique identifier, the estimated cst f the prject r cntract price, permissin fr the Develpment Authrity t enter the site, and the apprpriate fee The Develpment Authrity may als require drawings r renderings f any prpsed building with details f the finish f the building and the landscaping f the lt, a real prperty reprt drawn by an Alberta Land Surveyr, if there is any dubt as t the bundaries f the lt, engineering and ther reprts t prve the safety and suitability f the site fr the purpse intended, including a declaratin that the site is free frm cntaminatin, a traffic impact assessment, and any ther infrmatin which he deems necessary t make an infrmed decisin n the prpsed develpment Pursuant t sectin 640(5) f the Act, when an applicatin fr a develpment permit r change f land use designatin has been refused, the Develpment Authrity may refuse t accept anther applicatin n the same prperty and fr the same r similar use f the land by the same r any ther applicant fr six mnths after the date f previus refusal, unless the circumstances have changed sufficiently t warrant therwise. 11. DIRECT CONTROL DISTRICTS Cuncil may by reslutin delegate t the Develpment Authrity the pwer t decide applicatins fr develpment permits in the Direct Cntrl district, with directins which it cnsiders apprpriate Where n such reslutin has been passed, the authrity t decide n applicatins in the Direct Cntrl district remains with cuncil. 12. PUBLIC CONSULTATION PRIOR TO DECISION 12.1 Befre deciding n an applicatin fr a develpment permit fr a discretinary use, r befre relaxing r waiving any part f the bylaw beynd the amunt allwed by sectin , the Develpment Authrity may cnsult the wners f land within 60 metres by mail, r by advertising in the lcal newspaper, and if the neighburing landwners reply within 14 days f the date f the ntice, the Develpment Authrity shall cnsider their cmments and recmmendatins befre issuing a develpment permit. 13. DECISION BY THE DEVELOPMENT AUTHORITY Twn f Draytn Valley Land Use Bylaw 17

19 13.1 Except as prvided in sectin 11, the Develpment Authrity shall decide n all applicatins fr a develpment permit The Develpment Authrity shall issue a decisin within 40 days f receiving a cmplete applicatin An applicant fr a develpment permit may authrize the Develpment Authrity, in writing, t take a lnger perid f time t issue a decisin An applicatin fr a develpment permit may, at the ptin f the applicant, be deemed t be refused when a decisin is nt issued by the Develpment Authrity within 40 days after receipt f the cmplete applicatin by the Develpment Authrity, and the applicant may appeal as if the applicatin had been refused In the case where a prpsed specific use f land r a building is nt prvided fr in any district in this bylaw, the Develpment Authrity may determine that such use is similar in character and purpse t a use prescribed fr that district in Schedule B, and apprve it as a discretinary use Cnsistent with sectin 640(6) f the Act, the Develpment Authrity may apprve an applicatin fr a develpment permit, ntwithstanding that the prpsed develpment des nt cmply with this bylaw, if, in his pinin, the prpsed develpment wuld nt unduly interfere with the amenities f the neighburhd, r materially interfere with r affect the use, enjyment, r value f neighburing Lts, and the prpsed develpment cnfrms with the use prescribed fr the land r building in this bylaw, and this pwer extends t nn-cnfrming buildings pursuant t sectin 643(5)(c) f the Act The Develpment Authrity may at his discretin relax any required setback by up t 30% If the amunt f the relaxatin is nt mre than 10%, the relaxed dimensin is deemed t meet the requirements f this bylaw, and despite sectin 17 the relaxatin need nt be advertised If the amunt f the relaxatin is mre than 10%, the relaxatin is deemed t be an exercise f discretin and must be advertised under sectin In making a decisin, the Develpment Authrity may apprve the applicatin uncnditinally, r impse cnditins cnsidered apprpriate, permanently, r fr a limited perid f time, r refuse the applicatin When the Develpment Authrity refuses an applicatin fr a develpment permit, the decisin shall cntain reasns fr the refusal Fr a discretinary r permitted use requiring a variance in excess f the Develpment Authrity s pwer as established within this Bylaw, Twn Cuncil may either refuse r apprve an applicatin fr a develpment permit. Apprval may be subject t: Any f thse cnditins listed in subsectin 14; and Any cnditins that Twn Cuncil may deem apprpriate t ensure cmpatibility with the amenities f the surrunding neighburhd and the use, enjyment and value f the neighburing parcels f land, including but nt limited t the fllwing: (i) limiting the time f peratin including hurs f the day, days f the week, and parts f the year; Twn f Draytn Valley Land Use Bylaw 18

20 (ii) limiting the number f patrns; (iii) requiring attenuatin r mitigatin f nise f any ther nuisances that may be generated by the prpsed develpment; (iv) the lcatin, character and appearances f buildings; (v) the grading f the site r ther matters as are necessary t prtect ther develpments frm the site; (vi) establishing the perid f time during which a develpment may cntinue [added by Bylaw 2012/22/D] 14. CONDITIONS ATTACHED TO DEVELOPMENT PERMITS The Develpment Authrity may issue a develpment permit subject t the cnditin that the applicant: 14.1 amends the prpsal t cnfrm with this r ther bylaws, r with any easement, caveat, cvenant, r ther instrument registered n the title t the land, including changes necessary t make the design and appearance f the develpment cmpatible with nearby land uses, 14.2 pays an ff-site levy r redevelpment levy impsed by bylaw, 14.3 enters int an agreement pursuant t the Act cncerning servicing f the site, 14.4 registers an easement t prtect a utility line, 14.5 fences a site during cnstructin, 14.6 repairs any municipal imprvements that may be damaged as a result f the develpment, 14.7 submits a real prperty reprt when the ftings have been pured, but befre starting wrk n the building abvegrund level, 14.8 finishes a building, 14.9 grades a lt, landscapes r paves a lt, prvides parking t meet the requirements f the bylaw, registers a restrictive cvenant cncerning architectural cntrls and/r landscaping, enters int an agreement t remediate the site when the use cmes t an end, cnsents t a naming and number scheme acceptable t the municipality, and, during cnstructin, psts the municipal address f the site and, where applicable, the name f the develpment, depsits a letter f credit r cash guaranteeing that any f the abve cnditins are met, requiring the restring r decntaminating a site after the prpsed use cmes t and end, btains apprvals under the Safety Cdes Act and ther legislatin, meets ther requirements f this bylaw and ther municipal bylaws and plicies and/r cmply with such ther requirements as are necessary t make the prpsed use suitable fr the lands. 15. ISSUANCE OF DEVELOPMENT PERMITS Twn f Draytn Valley Land Use Bylaw 19

21 15.1 A develpment permit des nt cme int effect until 14 days after the date f issue If a valid appeal is made pursuant t this bylaw, a develpment permit which has been granted shall nt cme int effect until the appeal has been determined and the permit may be mdified r nullified thereby A decisin f the Develpment Authrity n an applicatin fr a develpment permit shall be given in writing and a cpy f it sent t the applicant and t any persn wh has expressed an interest in the matter. 16. SUSPENSION OR CANCELLATION OF A DEVELOPMENT PERMIT 16.1 If the develpment authrized by a permit is nt cmmenced within 90 days frm the date f issuance f the develpment permit, r carried ut with reasnable diligence, the permit is vid, unless an extensin has previusly been granted by the Develpment Authrity If a develpment permit was issued in errr r was btained thrugh misrepresentatin, the Develpment Authrity may revke it by sending a ntice t the applicant by registered mail r by hand delivery. 17. NOTICE OF EXERCISE OF DISCRETION When a permit has been granted fr a discretinary use, r pursuant t sectins 13.5, 13.6, r , the Develpment Authrity 17.1 may [amended by Bylaw 2008/11/D] immediately mail a ntice in writing t; the registered wners f all land within 60 metres f the prpsed develpment, r such greater distance as the Municipal Planning cmmissin may require, any persn r authrity wh has the right t be infrmed under an inter-municipal agreement, and any ther persn wh may, in the pinin f the Develpment Authrity, be affected, and 17.2 shall [amended by Bylaw 2008/11/D] immediately publish in a newspaper circulating in the municipality a ntice stating the lcatin f the prperty fr which the applicatin has been made and the use apprved; and 17.3 may pst a ntice f the decisin cnspicuusly n the prperty fr which the applicatin has been made, and the ntice shall set ut the rights f persns t appeal against the issuance f the develpment permit The Develpment Authrity, in cnsidering applicatins fr secndary suites, shall nt be required t refer applicatins fr existing secndary suites, but shall refer the applicatin fr new secndary suites t the adjacent landwners within a 60 metre radius f the subject parcel.[added by Bylaw 2008/11/D] 18. 22 18.1 An appeal against a decisin f the Develpment Authrity shall be launched by filing ntice, with the apprpriate fee, with the Secretary f the Subdivisin and Develpment Appeal Bard Upn receipt f an appeal, the secretary shall immediately advise the develper that all cnstructin must cease until a decisin has been made by the Bard The prcedure fr hearing and determining appeals against a decisin f the Develpment Authrity is set ut in sectins 684 t 687 f the Act N appeal lies against a develpment permit fr a permitted use unless the bylaw was relaxed, varied, r misinterpreted In making its decisin, the Develpment Appeal Bard is bund by the uses f land set ut in this bylaw, and shall have regard fr all ther parts f this bylaw and all statutry plans. 19. JUDICIAL REVIEW A decisin f the Subdivisin and Develpment Appeal Bard is final and binding subject nly t an appeal upn a questin f law r jurisdictin pursuant t sectin 688 f the Act. 20. AMENDMENT (3) By mail addressed t the registered ffice f the crpratin 21.1 A persn may apply t have this bylaw amended, by applying t the Develpment Officer in writing, giving reasns in supprt f the applicatin, and paying the apprpriate fee An applicatin t change the district f any land may be initiated nly by the wner f that land, r by the municipality An amendment t this bylaw must be cnsistent with the Act and Regulatins, the Municipal Develpment Plan, and any area structure plan that has been adpted by bylaw A prpsal t amend the bylaw must be advertised in accrdance with s. 606 f the Municipal Gvernment Act. 22. FORMS AND FEES 22.1 Ntwithstanding the repeal f Bylaw 96-24, frms and fees established under the frmer bylaw cntinue t apply until new frms and fees are adpted by bylaw f cuncil. 23. CONTINUATION OF CONTROLS 23.1 A cnditin attached t a develpment permit issued under a frmer bylaw cntinues under this bylaw. 24. REQUIREMENTS OF OTHER AUTHORITIES 24.1 A develpment authrized under this bylaw is subject t federal and prvincial law (including rders by the Municipal Gvernment Bard), ther bylaws, statutry plans, inter-municipal agreements, and any easements, caveats, cvenants, and ther encumbrances n the title t the land in questin, whether r nt the develpment permit refers t these ther requirements Nthing in this bylaw remves the bligatin f a persn t btain ther permits, licences, r apprvals under ther legislatin. 25. LAND USE DISTRICTS AND REGULATIONS 25.1 All develpment is regulated as set ut in Schedule A, Regulatins fr All Districts Fr the purpses f this bylaw the municipality is divided int districts set ut in Schedule B, Land Use District Regulatins Within individual districts, develpment is regulated as set ut in Schedule B. 25 25.4 The bundaries f land use districts are as set ut n the map which frms Schedule C Schedules A, B, and C frm part f and have full frce in this bylaw Rads and lanes are nt included in any land use district. 26. ANNEXED LANDS 26.1 As set ut in sectin 135(1)(d) f the Act, land annexed t the municipality cntinues t be gverned by the land use bylaw in effect in the frmer municipality n the date f annexatin, and that cntinues until this bylaw is amended t change the rules applying t the annexed land. Attentin is drawn t rder-incuncil 533/2002 which limits the authrity f the municipality in this regard until 31 December REPEAL OF PREVIOUS BYLAWS 27.1 Bylaw and all bylaws amending that bylaw are repealed. 28. 26 SCHEDULE A REGULATIONS FOR ALL DISTRICTS A1 ACCESS TO MAJOR ROADS 1. On a Lt adjacent t an arterial r cllectr rad (as identified in a Municipal Develpment Plan, Master Transprtatin Plan, r Area Structure Plan adpted by bylaw), the Develpment Authrity may refuse t issue a permit fr a building r use which will result in 1.1 vehicles backing in t the rad, r 1.2 an excessive number f curb cuts r access pints, r 1.3 any situatin which is his pinin may be dangerus t traffic safety. A2 ADULT BUSINESSES AND ADULT ENTERTAINMENT [amended by Bylaw 2012/25/D] 2.1 N adult business r adult entertainment peratin shall be lcated within: metres f the bundary f any existing r intended: (a) schl r schl reserve lands; (b) park r playgrund; (c) residentially-zned lands; (d) place f wrship; (e) day care facility; r (f) hall. RETAIL LIQUOR STORE 2.2 A retail liqur stre shall: at the discretin f the Develpment Authrity, require lighting, signage r screening measures that make the prpsed develpment cmpatible with adjacent r nearby residential, mixed use r cmmercial develpment; and nt be frnting any bundary f a (a) schl r schl reserve lands; (b) playgrund; r (c) day care facility; hwever, sites which are greater than 4 acres in size and which are zned C2, M r RI are exempted frm this restrictin if frnting any f the abve, nt be lcated clser than 150 metres frm the bundary f any: (a) schl r schl reserve lands; (b) playgrund; r (c) day care facility; hwever, sites which are greater than 4 acres in size and which are zned C2, M r RI are exempted frm this restrictin. 27 A3 BOARDERS AND LODGERS 3.1 Barders and ldgers are nt a permitted use in any dwelling unit which includes a secndary suite. 3.2 Subject t the abve, up t tw barders r ldgers may be accmmdated in any dwelling unit withut a develpment permit, but any larger number requires a permit as a discretinary use. (See als Schedule A regarding parking) A4 CONDOMINIUMS 4. In this bylaw, n distinctin is made between rental units and cndminiums. Cntrl is ver types f building, nt types f wnership. A5 CONTAMINATED AND HAZARDOUS SITES 5. If it appears t the Develpment Authrity that the site may be cntaminated as a result f a frmer use, the applicant shall supply evidence that the site is free f cntaminatin and suitable fr the prpsed use, and lacking such evidence, the Develpment Authrity may refuse the applicatin. A6 DESIGN GUIDELINES 6.1 Cuncil may, by reslutin, adpt architectural design guidelines fr all r any part f the municipality. 6.2 The Develpment Authrity shall fllw the architectural design guidelines when deciding n an applicatin fr a develpment permit. 6.3 Cuncil may, by reslutin, appint a design cmmittee t advise the Develpment Authrity in the interpretatin f the architectural design guidelines. A7 DESIGN, CONSTRUCTION, AND TREATMENT OF STRUCTURES 7. As a cnditin f issuing a develpment permit, the Develpment Authrity may require changes t a prpsed building r structure if in his pinin the design, cnstructin, r treatment is incmpatible with the neighburing buildings, even if the building in questin is a permitted use under Schedule B f the bylaw. A8 DEVELOPMENT ON OR NEAR SLOPES 8. Except as prvided belw, n buildings shall be cnstructed n any land with a slpe f 15% r greater, r n land within 10 metres f such a slpe, unless the plans fr the building have been prepared r reviewed by a prfessinal engineer and are specific t the site in questin. GREEN SPACE IN HIGH DENSITY RESIDENTIAL AREAS 8.17 Every high density residential develpment f ten (10) r mre residential units n a lt r site shall prvide its wn dedicated green space which may include a playgrund and/r a play structure. The green space shall be a minimum f ne (1) metre square fr each dwelling unit n the site r lt and shall be cnsidered part f the landscaped area. 28 A9 DOUBLE FRONTING AND CORNER LOTS 9. The frnt yard setbacks set ut in Schedule B apply t all sides f a lt which are adjacent t a rad, but the Develpment Authrity may relax the required setbacks n flanking streets t the extent necessary t allw develpment which in his pinin is cmpatible with that n adjacent lts, and, despite sectin 5.5, such relaxatin need nt be referred t the Municipal Planning Cmmissin fr a decisin. A10 DRIVE IN BUSINESSES 10.1 Lcatin: Despite their being listed as a permitted r discretinary use in a land use district, drive in businesses shall be permitted nly where passing traffic will nt be significantly impeded, and traffic entering r leaving the business will nt endanger pedestrians Vehicle access pints: vehicle access pints shall be situated nly at lcatins apprved by the Develpment Authrity, and n clser than 12 metres t the curb intersectin f tw streets Hard surfacing: All parts f the site t which vehicles have access shall be hard surfaced and drained t the satisfactin f the Develpment Authrity Parking and stacking: The lt shall be large enugh t accmmdate all necessary parking, and prvide rm fr vehicles awaiting service s that they d nt back up int the adjacent street, and each bay r service pint shall have space fr at least three vehicles awaiting service. A11 DRIVEWAY ACCESS TO ROADS 11. Where a develpment requires access frm a rad, the Develpment Authrity shall ensure that it is lcated in a safe lcatin and that the lss f n-street parking is minimized. A12 EASEMENTS 12. N permanent r temprary building shall be placed n land which is subject t an easement withut the written cnsent f the easement hlder. A13 EMERGENCY VEHICLE ACCESS 13. The Develpment Authrity shall ensure that Lts are designed and buildings are laid ut t affrd safe and unrestricted access fr fire fighting vehicles and persnnel in accrdance with the requirements f municipal and prvincial fire authrities. A14 FENCES IN RESIDENTIAL AREAS 14.1 A fence requires a develpment permit, but n fee shall be charged N fence shall be higher than 1.8 metres in side and rear yards, and n higher than 1 metre in frnt yards The height limits fr fences in frnt yards apply t any side f a lt facing r flanking a street The maximum fence height des nt apply t swimming pls, which are gverned by the Alberta Building Cde. A15 FENCES IN NON-RESIDENTIAL AREAS 15.1 A fence requires a develpment permit, but n fee shall be charged Fences shall be f material and design acceptable t the Develpment Authrity, and the prvisins f Schedule A (Design and Appearance) apply t fences Barbed wire may be used nly fr fences surrunding land n which the grazing f livestck is a permitted r discretinary use, and as the tp strand f a fence in a cmmercial r industrial district, and where the tp strand is at least 2.0 metres abve grund level N electric fence shall be cnstructed except as an internal crss-fence n land n which grazing f livestck is a permitted r discretinary use. A16 FUEL SALES 16.1 An applicatin fr a develpment permit fr mtr fuel sales r strage shall be referred t the Fire Chief, and the Develpment Authrity shall be guided by his recmmendatins when making a decisin n the permit. 30 16.2 If the Fire Chief believes that the lcatin is unsafe, r the site layut cnflicts with the Safety Cdes Act r ther safety legislatin, the Develpment Authrity shall nt issue a develpment permit, even if the use f land is permitted r discretinary fr that land use district A lt n which mtr fuel is sld shall have a rad frntage f at least 30 metres Fuel pumps and abve-grund fuel strage tanks shall be set back at least 12 metres frm the prperty line and at least 6 metres frm the side and rear prperty lines A develpment permit fr a service statin r ther mtr fuel sales des nt allw aut bdy wrk, aut wrecking, r the sale f vehicles, unless this is specifically written in the develpment permit The requirements f Schedule A, Drive-in Businesses, als apply t mtr fuel sales. A17 GARAGE LOCATION 17.1 In residential districts, garages shall be lcated s that there is a 6.5 metre clear space between the garage dr and any built r planned sidewalk, lane r curb s that vehicles can be parked in frnt f the garage drs withut verhanging a pedestrian r vehicle travel surface Despite the freging, garages in the R1N and R1Z districts may be lcated with a clear space f between 1 and 3 metres between the garage drs and the lane. A18 GARBAGE CONTROL 18. In all districts, garbage shall be stred in weather-prf cntainers, screened frm adjacent Lts and public thrughfares, and in a lcatin easily accessible fr pickup withut disrupting the flw f traffic n adjacent rads and lanes. A19 GRADING AND DRAINAGE OF LOTS 19.1 Water riginating n ne lt shall nt be allwed t flw n t anther lt withut the written cnsent f the wner f the receiving lt In new subdivisins, lts shall be graded s that water flws n t the adjacent rad r lane, and nt n t an adjacent lt In residential areas where there is n lane, a swale shall be cnstructed alng the rear f all lts t carry water t a rad r drainage curse, and the swale shall be prtected by an easement in favur f the twn The Develpment Authrity may require, as a cnditin f a Develpment Permit, that a Develper submit a lt grading plan t the Twn fr apprval. [added by Bylaw 2012/22/D] 19.5 Grading f a lt assciated with an apprved develpment shall cnfrm t the lt grading plan apprved by the Twn. [added by Bylaw 2012/22/D] 19.6 If a persn alters the apprved lt drainage n/frm a site s that water drains nt adjacent parcels, that persn shall be respnsible fr crrective drainage structures, including retaining walls, t divert water frm neighburing prperties. [added by Bylaw 2012/22/D] 19.7 Any retaining wall ver 1 metre in height must be designed and inspected after cnstructin by a prfessinal engineer. 31 bearing the seal and signature f a prfessinal engineer, within thirty (30) days f cnstructin f the retaining wall. [added by Bylaw 2012/22/D] A20 HIGH BUILDINGS 20. Where a building is being replaced by a new building which is significantly higher than either the building which it replaces, r than the neighburing residential buildings, the Develpment Authrity may require that it be set back frm prperty lines by mre than the distances set ut in Schedule B. A21 NUMBERING OF HOUSES AND BUSINESS PREMISES 21. The civic address assigned under Bylaw shall be clearly displayed n all huses and business premises, and this requirement applies during cnstructin as well as after cmpletin. A22 LANDSCAPING OF NEW DEVELOPMENT 22.1 Landscaping t the satisfactin f the Develpment Authrity shall be prvided t separate residential land uses frm industrial and cmmercial land uses Landscaped areas shall have at least 7.5 cm f tpsil In cmmercial land use districts, ff-street parking lts shall be landscaped by the planting f at least ne tree r shrub fr every 185 m2 f parking lt area. Trees and shrubs shall be f a size and type satisfactry t the Develpment Authrity, and shall nt impede mvement r visibility f pedestrians and traffic Landscaping will be required t the satisfactin f the Develpment Authrity having regard t adjacent land uses and may include slid screen fencing (chain link with privacy slats, wd, metal, etc.), the planting f trees, shrubs and/r ther vegetatin and the cnstructin f a landscaped berm. [added by Bylaw 2012/22/D] A23 LANDSCAPING OF EXISTING DEVELOPMENT 23.1 Every develped lt shall be landscaped and maintained t a standard which in the pinin f the Develpment Authrity is reasnably cmpatible with neighburing prperties Every undevelped lt shall be maintained t a standard which in the pinin f the Develpment Authrity is reasnably cmpatible with neighburing prperties. A24 LIGHTING 24. The Develpment Authrity may require that the lighting f a cmmercial, industrial, r institutinal site be designed and maintained s as avid glare n adjacent residential sites. A26 LOADING 26.1 Where a business r a facility is likely t receive large quantities f gds, r frequent deliveries, the Develpment Authrity may require that an ff-street lading dck be prvided, adequate t accmmdate the expected traffic withut disrupting the flw f vehicles n adjacent streets Access t a lading dck shall be lighted, drained, and hard surfaced and, where required by the Develpment Authrity, screened frm view N lading space is required if, in the pinin f the Develpment Authrity, lading frm the street r lane will nt unreasnably disrupt traffic flw. A27 MOVED IN BUILDINGS 27.1 A persn wishing t mve an existing building n t a lt shall make an applicatin fr a develpment permit in the usual way and as part f the applicatin shall als prvide: phtgraphs shwing all sides f the building, a statement f the type f cnstructin, cnditin, and age f the building, and a statement f prpsed imprvements with an estimate f csts The Develpment Authrity may inspect the building which is prpsed t be mved in, r have anther qualified persn d s, and in either case the expenses f such inspectin, including the inspectr's time, shall be paid by the applicant befre any develpment permit is issued The Develpment Authrity shall cnsider whether the building is cmpatible with the character f the neighburhd in which it is prpsed t be set, and may refuse a develpment permit if, in his pinin, the building is unsuitable The Develpment Authrity may issue a develpment permit subject t such cnditins, as he believes necessary t bring the building up t a suitable standard within 12 mnths frm the date f issuance f the develpment permit The Develpment Authrity may require security t guarantee cmpletin f any wrk required under this sectin This sectin des nt apply t new strage sheds, r t temprary buildings authrized under sectin 8 f the bylaw, r t new manufactured hmes being mved in t a district where they are a permitted r discretinary use. A28 OUTSIDE STORAGE IN RESIDENTIAL AREAS N persn shall keep r stre in any part f a yard in a residential land use district: 28.1 any dismantled r wrecked vehicle; Twn f Draytn Valley Land Use Bylaw 31

33 28.2 any bject r chattel which, in the pinin f the Develpment Authrity, is unsightly r tends t adversely affect the amenities f the district; 28.3 any excavatin, strage r piling up f materials required during the cnstructin stage unless all necessary safety measures are undertaken, and the wner f such materials r excavatins assumes full respnsibility t ensure the situatin des nt prevail any lnger than reasnably necessary t cmplete a particular stage f cnstructin wrk; r 28.4 a laded r unladed cmmercial vehicle with a maximum weight in excess f 5500 kg N mtr vehicle shall be parked in a frnt yard, except n an apprved driveway. Any mtr vehicle parked n an apprved driveway shall be in a mveable cnditin. [added by Bylaw 2012/22/D] A29 OUTSIDE STORAGE IN NON-RESIDENTIAL AREAS 29. The Develpment Authrity shall regulate the utside strage and display f raw materials, cmpnents, unfinished gds and waste prducts s that they d nt reduce the enjyment r value f adjacent prperties, and in rder t d this, may require that gds and materials be fenced, screened, r stred in specific lcatins. A30 OVERHANGS AND ENCROACHMENTS WITHIN A LOT 30.1 Balcnies and bay windws may encrach up t 1.5 metres int frnt and rear yards but shall nt encrach int the setbacks required in side yards Decks n higher that 0.3 metres abve grund level are nt subject t yard and setback regulatins Other features attached t a building such as chimneys, eaves, pen steps, and sills may encrach int the yards required by Schedule B by the fllwing distances: metres int yards f 1.5 metres r mre, and metres int yards f less than 1.5 metres. A31 OVERHANGS AND ENCROACHMENTS INTO ROADS 31.1 N sign r building may encrach ver r nt a rad unless the persn respnsible fr the encraching bject has signed an encrachment agreement with the municipality, and agrees in writing t accept any liability arising frm the encrachment This sectin des nt apply t fascia signs and canpies which are at least 4 metres abve grund level and which encrach less than 0.3 metres ver a rad. 36 A34 RECREATIONAL VEHICLES, TRAVEL TRAILERS, AND MOTOR HOMES 34.1 Except in a campsite, n persn shall ccupy a recreatinal vehicle, travel trailer, r mtr hme n a lt, whatever the zning, fr mre than five cnsecutive days unless a develpment permit has been issued N recreatinal vehicle, travel trailer, r mtr hme shall be parked in a frnt yard f a huse One recreatinal vehicle and ne utility trailer may be may be kept n a residential lt, s lng as the recreatinal vehicle r utility trailer, r bth, are nt permitted t encrach nt adjacent lands, including but nt limited t municipal lands, such as lanes and rights-f-way. A36 SEQUENCE OF DEVELOPMENT The Develpment Authrity may refuse t issue a develpment permit fr an accessry use if there is n main building n a lt. A37 STORAGE SHEDS 37.1 Strage Sheds are accessry buildings nly n thse lands highlighted in yellw n the attached Schedule C and are prhibited n all ther lands Strage Sheds used fr the limited purpse f cnstructin r seasnal cmmercial strage are subject t Temprary Develpment Permit apprval. Thugh nt required t pay a security depsit, the applicant shall be required t screen the Strage Shed t the satisfactin f the Develpment Officer All Strage Sheds, nt used fr the limited purpse f cnstructin, shall adhere t the cnditins cntained within, r attached as a Schedule t the Develpment Permit issued by the Twn. Said cnditins may include, but shall nt be limited t, the fllwing: Twn f Draytn Valley Land Use Bylaw 35

37 The Strage Shed must be placed in accrdance with the apprved site plan, shwing the Strage Shed t be situated t restrict its visibility, and must meet all setbacks required under Land Use Bylaw 2007/24/D. All exterir wrk must be cmpleted within 45 days frm the date f issuance f the Permit Upn satisfactry exterir finishing f the Strage Shed, the Twn shall issue the Develper a Twn lg decal, which shall be displayed n the drs f the Strage Shed and shall indicate cmpliance with the Develpment Permit The Develper shall nt, during r after placement f the Strage Shed, impede, bstruct r change any existing drainage patterns utside f the subject prperty withut prir apprval f the Twn Engineer This permit is subject t any/all required Federal, Prvincial r Municipal Permit apprvals including, but nt limited t, Health, Building and/r Safety Cde Permits Shuld the business relcate, r cease t perate, the Strage Shed must be remved immediately. Relcatin f the Strage Shed shall be subject t Develpment Permit apprval fr any new site r new wnership. A Develpment Permit is required fr a Strage Shed t remain n site fllwing a change f business r land wnership, and shall be subject t the same cnditins as indicated abve and in this clause The Applicant fr the Develpment Permit shall prvide t the Twn a security depsit f $2, t be held pending cmpletin f the abve cnditins. Shuld the landwner r applicant refuse t maintain the Strage Shed t the Twn s satisfactin, Administratin f the Twn f Draytn Valley may have the Strage Shed and any cntents remved frm the site; the cst f remval and any strage csts shall be brne by the landwner r applicant. Such cst may be added t the prperty tax rll, shuld that cst remain utstanding fr a perid f mre than 30 days frm the date f invicing Shuld the landwner r applicant fail t remve the Strage Shed frm the site, as per the Develpment Permit cnditin r pursuant t a directin frm the Administratin f the Twn f Draytn Valley, Administratin may have the Strage Shed remved frm the site. A39 SURVEILLANCE SUITES 39.1 A surveillance suite is a single residential unit in an industrial area, secndary t the main industrial use, used t accmmdate a guard r watchman A develpment permit fr a surveillance suite will be issued nly if it is clearly subrdinate t and cmpatible with the main use f the land r building, and with nearby land uses The design, appearance, and lcatin f the surveillance suite shall be as required by the Develpment Authrity N mre than ne surveillance suite shall be lcated n a lt In additin t the number f parking stalls required fr the principal use under sectin A32 f this Bylaw, tw (2) additinal parking stalls shall be prvided fr the surveillance suite. [added by Bylaw 2012/22/D] 39.6 A surveillance suite may be lcated in a manufactured r mbile hme, but shall nt be lcated in a recreatinal vehicle. [added by Bylaw 2012/22/D] A40 UTILITY BUILDINGS AND EQUIPMENT The Develpment Authrity may waive r relax siting and yard regulatins where this is necessary fr the efficient peratin f a public utility system, and this waiver r relaxatin des nt need t be advertised. A41 WELLS AND PIPELINES Despite any ther prvisin f this bylaw, the develpment authrity shall nt issue a develpment permit fr a building r structure clser t an il r gas well r pipeline than the distance established by the Subdivisin and Develpment Regulatins and by the Alberta Energy and Utilities Bard. A42 PROJECT ACCOMMODATION (ALSO KNOWN AS WORK CAMPS ) [added by Bylaw 2012/22/D] 42.1 All prject accmmdatins require a Develpment Permit A Develpment Permit fr a prject accmmdatin shall be temprary and may be issued fr up t ne (1) year, after which a new Develpment Permit apprval is required An applicatin fr a Develpment Permit fr prject accmmdatin must prvide the fllwing infrmatin: the lcatin, type and purpse f the camp; Twn f Draytn Valley Land Use Bylaw 37

39 adjacent land uses; the methd f supplying water, sewer and waste dispsal t the camp. The prpsed methd f prviding such service must meet with the requirements f the Twn, the Reginal Health Authrity and, if applicable, the Alberta Private Sewage Treatment and Dispsal Regulatin; the number f persns prpsed t live in the camp; the start date fr develpment, date f ccupancy by residents, and the remval date fr the camp; and reclamatin measures nce the camp is n lnger needed, at the discretin f the Develpment Authrity Prject accmmdatin must be linked t a specific prject fr which a valid and current Develpment Permit has been issued and can nly accmmdate wrkers fr this prject Prject accmmdatin must: prvide adequate n-site parking fr private vehicles t the same standards as a htel (this parking shall be in additin t that require fr the principal use f the land); be remved frm site when the prject is cmpleted r when the Develpment Permit expires, whichever shall first ccur; pst security with the Twn f Draytn Valley sufficient t remve and/r reclaim the site if the prject accmmdatin remains n site after the Develpment Permit has expired, r prject is either cmpleted r if wrk has stpped t the extent that the Twn n lnger feels the prject accmmdatin is necessary t the prject, r t reclaim the site if needed after the prject accmmdatin has been remved frm the site; be separate frm adjacent land uses; and be inspected by and have apprval frm the Draytn Valley/Brazeau Cunty Fire Chief r his designate, prir t ccupancy Prject accmmdatins must be secured by: the installatin f apprpriate fencing arund the prject accmmdatin; and n-site security staff Prject accmmdatin using recreatinal vehicles as the residential cmplex is nt permitted Prject accmmdatin may be subject t inspectins at the discretin f the Develpment Authrity The Twn f Draytn Valley reserves the right t mnitr the ccupancy f prject accmmdatin and as such the wners shall prvide the Twn, upn request, verificatin f emplyment fr all ccupants within the prject accmmdatin. Such requests may be made semi-annually, at the discretin f the Develpment Authrity Water and sewer services are t be installed fr each unit at the sle cst f the wner/applicant r cntractr, including any changes in service lcatin, capacity and pressure. The Twn f Draytn Valley may charge the wner/applicant fr any ff-site levies fr municipal services t the site and may further require security, in the Twn f Draytn Valley Land Use Bylaw 38

40 frm f an Irrevcable Letter f Credit, in an amunt t be determined by the Twn Engineer and t be held until the remval f the prject accmmdatin is cmpleted t the Twn s satisfactin. A43 TANK FARMS[added by Bylaw 2012/22/D] 43.1 New and existing tank farms lcated within the Twn shall be required t meet the fllwing standards: Industrial standards, including: (i) cntainment areas (such as berms, dikes, retaining walls and the like) must meet the minimum setback requirements as set ut within the specified land use zning; (ii) (iii) fire hydrants must be lcated within 45 metres f the prpsed tank farm site. Any deviatin frm this required distance shall be subject t Fire Department review and apprval; prir t cmmencing peratin f the tank farm the peratr must btain written apprval frm bth the Draytn Valley-Brazeau Cunty Fire Department and PTMAA; Energy Resurces Cnservatin Bard (ERBC) Strage Requirements fr Upstream Petrleum Industry; Alberta Fire Cde; Alberta Building Cde; PTMAA; and any ther existing and future legislatin, cdes r standards regarding bulk strage f ilfield r industrial generated fluids, either petrleum prducts, flammable and/r cmbustible liquids r hydrcarbn prducts, whether manufactured r generated elsewhere thrugh resurce and/r ther industry activities, including but nt limited t water, salt water r any ther liquid stred fr ilfield cnsumptin All crpratins, their management and emplyees r any ther entities wh are engaged in the bulk strage f fluids r slids are respnsible fr ensuring that the strage facilities cnfrm within the rules, regulatins, standards and laws which are required by current r future statute, cdified law r Twn Bylaw T ensure that lcal, prvincial and federal requirements are met, the Twn requires as fllws: Develpment Permit must be btained frm the Twn fr the prpsed site lcatin fr a new tank farm, prir t any cnstructin taking place; the prpnent r develper must btain all ther necessary prvincial and/r federal apprvals r licenses fr the tank farm; if a Develpment Permit is apprved, cnstructin f the facility must meet the requirements f all permits, apprvals, applicable cdes and licenses; and if a Develpment Permit is apprved, prir t cmmencing peratin f the tank farm the peratr must prvide tw (2) cpies f a detailed Emergency Respnse Plan t the DEM and the Fire Chief. If the Emergency Respnse Plan is unacceptable, the peratr will be required t delay cmmencing peratin until an acceptable plan is prvided Where existing facilities d nt meet current standards r requirements the tank farm will be cnsidered fr apprval prviding that the fllwing cnditins are met: Twn f Draytn Valley Land Use Bylaw 39

41 an applicatin fr acceptance f an existing tank farm is submitted t the Develpment Authrity, accmpanied by cnfirmatin frm PTMAA that the existing tanks are registered with their Assciatin and are in satisfactry cnditin; test results f the sil arund and immediately adjacent t the tank farm, shwing base-level readings, must be cmpleted within sixty (60) days f the review date fr the tank farm; engineered drawings r plans f the existing site, including any dikes r berms, certified by a P.Eng., certifying the facility t be in cmpliance with relevant regulatins and standards and in cmpliance with Twn setback requirements; a detailed Emergency Respnse Plan, pursuant t sectin abve; a list f existing tanks and their manufacturers and applicable ULC and API standards, as well as a descriptin f the cntents stred within each tank; any and all ther dcumentatin and infrmatin required by the Twn Existing tank farms which d nt cmply with existing legislatin may be given time t cmply, as determined n a case-by-case basis. Cnsideratin f envirnmental risk and risk t adjacent prperties shall be a determining factr Shuld an existing tank farm peratin nt cmply within the given time, their Develpment Permit fr the tank farm may be suspended r revked, which may result in the levy f a fine, under the Municipal Gvernment Act, r as determined by ther applicable legislatin.
