6 Twn f Whitby Parking Study Final Reprt, Executive Summary Page i f xi EXECUTIVE SUMMARY 1.0 INTRODUCTION The Twn f Whitby retained MMM Grup Limited t undertake a cmprehensive parking study and t make recmmendatins t update the Twn s zning by-law parking requirements and standards. The current parking requirements are detailed in the tw parent zning by-laws (1784 and 2585), alng with separate prvisins fr Dwntwn Whitby and the Village f Brklin (referenced as Dwntwn Brklin), Oak Ridges Mraine, and varius site specific amendments. The primary purpse f the study was t assess the current parking standards and recmmend new standards as needed t update the Twn s zning by-law t ensure a level f cnsistency thrughut the municipality. Furthermre, tw specific issues regarding cmmercial vehicle parking in residential znes and recreatinal vehicle parking in residential znes were examined. Finally, design related standards and guidelines were reviewed. The study included public and stakehlder cnsultatins, a review f the standards f ther municipalities, industry standards, ther studies undertaken by MMM, as well as site specific parking utilizatin surveys where necessary. The principles which guided the study recmmendatins include: Cnsistent standard wherever pssible, Cnsideratin f cntemprary best practices, Standards expressed as ne space per unit f measure, and Standards expressed per 100 m 2 rather than 93 m DEVELOPMENT OF NEW TOWN-WIDE PARKING STANDARDS 2.1 Residential Uses With respect t lwer density, grund riented residential uses, the recmmended standard is 2.0 parking spaces per dwelling unit, with tandem parking permitted (e.g. ne in garage and ne in driveway), with exceptins fr residential uses with individual garages/driveways. This recgnizes the availability f n-street parking fr visitrs. Fr higher density and sme ther residential uses varius issues were identified and apprpriate standards develped as discussed belw: Blck twnhuses The main cncern related t blck twnhuses is the availability f designated visitr parking spaces. Fr blck twnhuses with individual garages/driveways, a standard f 2 spaces per dwelling unit plus 0.25 spaces per dwelling unit f designated visitr parking

In rder t be cnsistent, it is recmmended t revise the standard t be based n flr area, nt practitiners, recgnizing that it is easier t mnitr. One parking space per 17 m 2 f GFA (6 spaces per 100 m 2 ) is recmmended. Office/Public buildings: The current by-law standards are relatively lw as cmpared t thse f ther municipalities and industry standards. Therefre, a slight increase in the standards t 1.0 space per 30 m 2 f GFA (3.3 spaces per 100 m 2 ) is recmmended. Hwever cnsideratin shuld be given t reductins in areas identified fr intensificatin, thrugh site specific studies. Bank/Financial Institutin: The main issue related t banks/financial institutins is that there is currently n distinctin in lcal by-laws between banks with and withut a drive-thru ATM. Parking requirements fr banks with drive-thru ATMs shuld be reduced t reflect a lwer parking demand. The existing lcal by-law standard (1 space per 23 m 2 ) shuld nly apply t the standalne banks withut drive-thru ATM s. One space per 30 m 2 f GFA is recmmended fr banks with drive-thru ATM s. Htel/Mtel As many f tday s htels have accessry uses (e.g. banquet halls, restaurants, cnference rms, etc.), a parking requirement f 1.0 space per guest rm/suite, plus 1.0 space per 10 m 2 f GFA devted t accessry uses is recmmended. Eating Establishment The current by-law des nt clearly utline the distinctin between fast fd and ther restaurants. Typically fast fd restaurants require mre parking than that needed by standard restaurants, particularly as cmpared t fine dining restaurants. 1 space per 19 m 2 f GFA and 1.0 space per 11 m 2 f GFA are recmmended fr standard restaurant and fast fd restaurant, respectively. Shpping Centre/Shpping Plaza There are currently n distinctive requirements fr different sizes f the shpping centres. It shuld be recgnized that smaller shpping centres require less parking n a per square ft r metre basis than larger shpping centres. T address this issue, the industry standards fr shpping centres are recmmended, with a further mdificatin t accunt fr smaller plazas.

Rather address them at the site plan apprval stage thrugh discussins/negtiatins with the applicant, and pssible requests fr site specific studies t be undertaken by the applicant at that time.

12 Twn f Whitby Parking Study Final Reprt, Executive Summary Page vii f xi 3.0 ACCESSIBLE PARKING REQUIREMENTS The existing requirements fr accessible parking are fairly new, and are neither t nerus nr unrespnsive t current needs. These requirements fall within the ranges f thse f ther municipalities, and recgnize the higher needs at hspitals, medical centres, clinics, retirement hmes, and senirs cmmunity centres. Hwever, the current wrding f the by-law is smewhat difficult t interpret as t whether the requirements are additive; this needs t be clarified. It is recmmended that the current standards be retained, with clarificatin that the requirements are nt additive. 4.0 COMMERCIAL AND RECREATIONAL VEHICLE PARKING IN RESIDENTIAL AREAS Tw specific issues addressed in this study cncern cmmercial vehicle parking and recreatinal vehicle parking in residential znes. In bth cases the recmmendatins attempt t balance the varying viewpints between thse wh view the parking f recreatinal and/r cmmercial vehicles in residential znes as a necessity and/r right, and thse wh view this as an issue f safety and/r aesthetics. Recmmendatins related t the parking f cmmercial and recreatinal vehicles in the residential znes are utlined belw: Parking f cmmercial vehicles in residential znes Balancing the varius cnsideratins the fllwing is recmmended: The prvisins shuld apply t all residential znes and shuld be cnsistent. Cmmercial vehicle shuld be defined as any vehicle having advertising n its exterir (excluding that related t the type f vehicle and where it was purchased) and /r being used fr hire t transprt gds r peple. Only tw cmmercial vehicles are permitted t park n a prperty in any Residential Zne prvided that: The cmmercial vehicle des nt exceed either f the fllwing dimensins: 7.0 metres in length 2.2 metres in height measured frm the grund t the highest pint n the vehicle One f the cmmercial vehicles must be whlly enclsed in a garage r ther structure f a size, lcatin and ther specificatins that d nt vilate any ther by-law requirements The inclusin f ne attached trailer is permitted, prvided that the verall length inclusive f vehicle and trailer des nt exceed 12.0 metres. The trailer is in additin t the cmmercial vehicle. The height f the trailer must nt exceed 2.2 metres, measured frm the grund t the highest pint n the vehicle. Under n circumstances shuld the

Pedestrians need t be able t get by safely withut being required t g arund the vehicle n the rad. This applies equally t thse in wheelchairs. The cmmercial vehicle be n clser than 2 metres frm the curb f the rad t prvide sme visibility fr thse n adjacent prperties wh may be backing ut f driveways. It shuld be nted that technically parking is nt allwed within the bulevard area in any event. A cnsistent enfrcement plicy whereby if a cmplaint is received nt nly wuld the vehicle invlved in the cmplaint be investigated, but als any ther vehicles that are bserved t be in cntraventin in the area. This shuld als include practive peridic randm mnitring in additin t cmplaint based enfrcement, recgnizing that additinal staffing levels and budget will be required t achieve this. Hwever, it is expected that additinal csts wuld be ff-set by the additinal revenues received thrugh additinal fine revenues. Based n the abve, the parking f certain vehicles, such as vans, pick-up trucks and ther related vehicles wuld be allwed, but wuld exclude panel trucks (i.e. delivery trucks), cabs f transprt trucks and schl buses. The abve recmmendatins wuld apply t all relevant by-laws including the Oak Ridges Mraine By-law. Parking f recreatinal vehicles in residential znes These recmmendatins represent a balanced apprach t the parking f recreatinal vehicles in Residential Znes: The parking f recreatinal vehicles that are generally used in the summer mnths such as bats, mtr hmes and travel trailers, in Residential Znes shall be permitted frm May 1st t Octber 31st. The parking f snwmbiles and winter related recreatinal vehicles shall be permitted frm Nvember 1st thrugh t April 30th. The abve is restricted t the fllwing n a residential prperty: N mre than ne mtr hme, r ne bat n a trailer, r an empty trailer, r tw snwmbiles, r tw terrain vehicles n a trailer, with a cmbined maximum length f 13.5 metres inclusive f the vehicle pulling the mtr hme r trailer, r with a maximum length f 7.0 metres exclusive f the vehicle pulling the mtr hme r trailer. These vehicles may be parked in the garage r driveway prvided that:

It cannt displace the standard parking requirements fr the principal dwelling (i.e. tw spaces). The vehicle is parked n clser than 1 metre frm a side lt line. The vehicle des nt extend nt the sidewalk. The vehicle is lcated n clser than 2 metres frm the curb f the rad. Cnsistent enfrcement is put int place, nt just enfrcement n the basis f cmplaint. This is fr reasns f fairness and equality acrss the twn. If adpted, this plicy will increase the peratinal csts (i.e. additinal csts t hire mre staff t enfrce). The Twn determined that it is nw apprpriate t undertake a cmprehensive review f the Twn s ff-street parking standards t update them t ensure a level f cnsistency within each by-law. The parking standards fr the string f cmmercial vehicles and recreatinal vehicles in residential areas was als identified fr review. MMM Grup Limited has been retained t undertake this parking study and make recmmendatins t update the Twn s zning by-law parking requirements and standards. This wrk has been cmpleted under the directin f a Technical Steering Cmmittee. Tw stakehlder and public cnsultatin meetings held n February 21 and Nvember 24 f 2008 have been integral elements f this study, as discussed in Sectin 2.1. In additin, the Twn f Whitby prepared and submitted a staff reprt in June f 2008, regarding the Status f Parking Study t Review and Update Zning Standards and Prvisins. The primary purpse f the study was t examine the apprpriateness f the Twn s current parking standards and then develp new standards as needed. Parking standards need t be renewed peridically in view f changes in use, practice and applicatins. Three examples include: Places f wrship n lnger service nly a lcal neighburhd r cmmunity where many f the wrshippers walk t the site; wrshippers are nw drawn frm a brad area, including ther municipalities, resulting in a higher demand fr parking than in the past. The delivery f services at hspitals is changing frm an inpatient care fcus t an utpatient care fcus, thus making parking ratis based n the number f beds n lnger relevant. A greater prprtin f parents are driving their children t/frm schl which increases the demand fr drp-ff, pick-up and parking facilities. As nted, tw specific issues t be addressed in this study are cmmercial vehicle parking in residential znes and recreatinal vehicle parking in residential znes. The recmmendatins related t these tw matters are addressed in Sectins 4.0 and 5.0, respectively. In bth cases the recmmendatins attempt t balance the varying viewpints between thse wh view the parking f recreatinal and/r cmmercial vehicles in residential znes as a necessity, r a right, and thse wh view this as an issue f safety and/r aesthetics. This review has fcused n reviewing these types f uses as well as thse where issues had been identified by Twn staff, fr example related t grup hmes, high density residential uses and cmmercial uses. This included a review f the standards f ther municipalities, industry standards, ther studies undertaken by MMM, as well as site specific parking utilizatin surveys where necessary. Where n issues were identified with the current standards and where they appeared t be cnsistent with thse f ther municipalities; the current standards were retained. The final cmpnent f the study has been a review f design related standards and guidelines. Of particular cncern t the Twn have been issues related t the size f the garage generally in

Each f these is discussed belw. 2.1 PUBLIC AND STAKEHOLDER CONSULTATION The first rund was held early in the study in rder t better understand the issues and t receive input, which has been cnsidered in the frmulatin f the recmmendatins. Vehicles have been bserved t park n the lcal rads fr a lng perid f time every day.* Sme rads are t narrw t accmmdate tw-way traffic flws and t prvide nstreet parking alng bth sides.* Overnight parking is an issue fr visitrs since the current by-law des nt permit vernight n-street parking.* Residents have difficulty backing ut frm their driveways when the sightlines are blcked by the vehicle parked n-street. Residents are nt sure whether they are permitted t park n the prtin f the driveway between the sidewalk and the curb/radway. May have mre than ne family living in ne huse. Thus, nt enugh parking t accmmdate all f the vehicles based in the same huse. Many nn-cmmercial vehicles are larger than cmmercial vehicles. Size f vehicle and length f driveway shuld be prprtinal. Sccer is mre ppular nwadays as cmpared t the last decade and mre peple are using the sccer pitches. Park users are nt willing and are discuraged frm carpling due t liability issues. Parking is an issue during large sprts turnaments and trade shws at arenas. Parking is nt prvided in sme new parks. Parking requirements related t parks tend t vary frm site t site which makes it difficult t establish requirements that wuld apply t all. Suggestins The twn shuld purchase additinal lands in the vicinity f the parks t prvide additinal parking spaces. Cnsider shared use pprtunity with schl bards and churches. (One f the ptential prblems with shared uses is the liability.) Cnsider interim use agreements fr future develp sites (i.e. future schl). Cmmunity Centres Stakehlder Cmments: Hspitals Stakehlder Cmments: Current parking supplies can accmmdate all regular activities. Parking is nt an issue. 27 Twn f Whitby Parking Study Final Reprt Page 11 f DEVELOPMENT OF NEW TOWN-WIDE PARKING STANDARDS 3.1 CURRENT PARKING STANDARDS Whitby s current parking requirements are detailed in the tw parent zning by-laws (1784 and 2585), alng with separate prvisins fr the Dwntwn Whitby & Village f Brklin (referenced as Dwntwn Brklin) areas, Oak Ridges Mraine, and varius site specific amendments. 3.2 SURVEY OF OTHER MUNICIPALITIES As nted in Sectin 2.2, questinnaires were sent t 20 municipalities, with 15 municipalities respnding t the questinnaire. 3.3 PARKING UTILIZATION SURVEYS As nted in Sectin 2.4 with the assistance f members f the Technical Steering Cmmittee, land uses requiring parking utilizatin surveys, alng with ptential sites t survey, were identified. The uses included: Multi-unit residential Small shpping centres that include restaurants Grup hmes The surveys were undertaken ver several days when the peak parking demands were anticipated t ccur. Fr example, grup hmes were surveyed during the shift change perid. 3.4 RESIDENT INTERVIEWS A ttal f 150 interviews were undertaken with residents f single, semi-detached and street twnhuses. Once again with the assistance f the Technical Steering Cmmittee areas t be surveyed were identified t ensure representatin acrss the three categries nted, in different gegraphic areas f the twn, and reflecting different ages in the husing stck. 3.5 TRANSPORTATION TOMORROW SURVEY The findings f the 2006 Transprtatin Tmrrw Survey (TTS) indicate that the average vehicle per husehld in GTA fr huse, twnhuse and apartment are 1.73, 1.37 and 0.75, respectively. Whereas, the average vehicle per husehld in Whitby fr huse, twnhuse and apartment are 1.94, 1.48 and 0.84, respectively. These numbers are slightly higher than the verall average fr the GTA.

There were many persuasive arguments presented n bth sides f the issue. Fr thse wh may have been ticketed fr parking cmmercial vehicles n their prperties perhaps ne f the biggest cmplaints indicated was related t fairness, bth within their lcalized area, as well as acrss the municipality as a whle. The by-law prvisins need t be enfrced cnsistently acrss the municipality, nt just n the basis f cmplaint. In reviewing the current practices and in develping a new plicy framewrk fr cmmercial vehicle parking in residential areas there have been three ver-riding cnsideratins: Safety cannt be jepardized. Individual prperty rights are imprtant but they cannt disregard thse f thers, wh have equal rights. Fairness and equality are required acrss the municipality, nt just in terms f the plicy itself, but als in terms f enfrcement. It is recgnized that it will nt be pssible t entirely satisfy everyne based n the diverse pinins that have been expressed. The recmmended plicy framewrk represents a cmprmise. It must als be recgnized that cmmercial vehicle parking in residential areas and recreatinal vehicle parking in residential areas share many f the same issues, s the recmmended appraches related t the tw have been crdinated. Zning By-law deals with site specific zning fr a neighburhd which is situated suth f Nichl Avenue and east f Thicksn Rad Suth. Sectin 1 (S) (c) (iv) states that parking spaces and areas required under this By-law shall be used fr the parking f passenger vehicles nly and shall nt be used fr the parking r strage f any cmmercial mtr vehicles in excess f ½ tn capacity. By-law N that deals with certain lands wned by the Twn regulates the parking f vehicles n such lands. Althugh this des nt deal with the parking f cmmercial vehicles n residential prperties it is f sme relevance in that it has yet anther definitin f cmmercial vehicle. Here cmmercial mtr vehicle means a mtr vehicle having permanently attached theret a truck r delivery bdy and includes buses and tractrs used fr hauling purpses n the highways. These varius prvisins cntribute t the cnfusin REPORT TO PLANNING AND DEVELOPMENT COMMITTEE, JUNE 25, 2007 On June 25, 2007 a reprt (Item PL 80-07) was presented t Planning and Develpment Cmmittee cncerning Zning By-law Review (1784 & 2585) Parking r Strage f Cmmercial Mtr Vehicles, Trailers and Recreatinal Vehicles in Residential Znes. The reprt was precipitated by tw minr variance applicatins t permit the strage/parking f a cmmercial mtr vehicle and a cmmercial trailer respectively, in a Residential Zne. Bth applicatins had been filed by prperty wners in respnse t letters that they had received frm By-law Enfrcement stating that they were in vilatin f the Zning By-law with respect t the use f parking spaces and areas. Planning staff had recmmended denial f bth applicatins. The matters were tabled at Cmmittee f Adjustment in rder t allw the matter t be reviewed further by Cuncil. The Cuncil decisin arising frm this reprt included fur cmpnents: 1. That a Study f Municipal Parking Standards fr Zning By-laws 1784 and 2585 be undertaken n a pririty basis; 2. That the Cmmittee f Adjustment be advised f Cuncil s decisin in this matter; 3. That the Cmmittee f Adjustment be requested t nt cnsider its applicatins A/06/07 and A/07/07 until the Twn s Study is cmpleted; and, 4. That the prvisins f the Twn s Zning By-laws 1784 and 2585 respecting parking and trailer strage nt be enfrced until the Parking Standards Study is cmplete.

A cmmercial mtr vehicle includes a truck r highway tractr with a grss weight r registered grss weight f mre than 4,500 kg r a bus with a seating capacity fr ten r mre passengers. Exceptins are nted in Sectin 16(1) f the Highway Traffic Act. Cmmercial vehicle includes cmmercial mtr vehicles and the trailers they may tw. 4.3 RELATED PROVISIONS IN OTHER MUNICIPALITIES The majrity f the municipalities that have been surveyed d permit the parking f cmmercial vehicles in the residential areas, except fr Miltn, St. Catharines and Barrie. In Ajax mtr vehicles belw ne tnne r less than 7 metres in length are permitted t park in a residential zne. In Pickering the parking f a cmmercial vehicle in residential znes is nly permitted if it can be parked within a fully enclsed building r structure. There are currently n restrictins n the heights f the cmmercial vehicles permitted t park in residential znes under the current by-law. In Richmnd Hill the parking f cmmercial vehicles in residential znes is nly permitted if it can be parked entirely within a whlly enclsed building r carprt. In Guelph n mtr vehicle, excluding an autmbile and a RV shall be parked in a residential zne when such a vehicle exceeds a vehicle empty weight f 2290 kg. r if the vehicle r the vehicle and any attached equipment, exceeds a height f 2.2 metre abve the grund surface. The nly cmmercial vehicles allwed are fr trades persns. If the vehicle is smaller than the parameters, then n actin is taken. In Edmntn it depends n the weight f the vehicle. It means any vehicle s cnstructed that it is suitable fr being attached t a mtr vehicle and capable f being used fr transprting gds, materials, equipment r livestck ntwithstanding that such vehicle is jacked up r that its running gear is remved. Claringtn: Claringtn defines cmmercial vehicle based n Highway Traffic Act. 4.5 RESIDENT SURVEYS A ttal f 150 residents were surveyed via dr t dr interviews undertaken in a sampling f varius residential areas in the Twn f Whitby. A cpy f the survey questins is prvided in Appendix C. Of the 150 wh were surveyed nly 6 respndents (4 percent) were fund t nrmally have a cmmercial vehicle parked at their residence. In mst cases this was a single cmmercial vehicle, but in ne case this included three cmmercial vehicles n ne residential prperty. Just under half f the respndents (74 ut f 150) indicated that they were nt ppsed t having cmmercial vehicles parked n residential prperties (with 76 ppsed). This was cntingent n having certain cnditins met. In descending rder f imprtance these cnditins included the fllwing: The vehicle des nt verhang nt the sidewalk r street The vehicle des nt exceed a certain length r height The vehicle is als needed fr persnal use There is n trailer with the cmmercial vehicle The advertising n the vehicle is limited It can be parked elsewhere n the site, fr example in the backyard In additin, 91 ut f 150 respndents indicated that they are ppsed t the parking f mini schl buses n residential prperties. 4.6 CONSIDERATIONS The varius cnsideratins and related cmments cncerning cmmercial vehicle parking in residential areas are summarized belw. They reflect all f the input received at the stakehlder and public meetings, as well as review f the written materials:

Are difficult fr bth residents as well as staff at the Twn t interpret. Rely n cmplaint based enfrcement, therefre raise issues f fairness as t wh gets fined. A basis fr permitting the parking f sme cmmercial vehicles n residential prperties, recgnizes: That the same vehicle that is used fr emplyment related purpses may als be the primary vehicle which is als used fr persnal use. The tls/equipment stred in the cmmercial vehicle can generally be stred mre securely at hme than in a parking lt. (Hwever the cunter argument can be made that if smene is determined t steal smething frm a vehicle then it can als be readily dne s parked at hme). The parking f a cmmercial vehicle elsewhere adds t the travel time, incnvenience, fuel cnsumptin and emissins. These factrs need t be weighed against ther cnsideratins including:

The annyance resulting fr neighburs, including fumes when vehicle idle, the unsightliness f sme cmmercial vehicles, etc. This review has attempted t balance thse cnsideratins. As nted at the nset f this discussin, the three ver-riding cnsideratins are: Safety cannt be jepardized. Individual Prperty Rights are imprtant but that they cannt disregard the rights f thers wh have equal rights. Fairness/Equality are required acrss the municipality nt just in terms f the plicy itself, but als enfrcement. As nted, apprximately half f the residents surveyed are nt ppsed t the parking f cmmercial vehicles n residential prperties, prvided that certain cnditins are met. Fr the mst part there des nt appear t be an issue with small cmmercial vehicles such as pick up trucks and vans that have sme cmmercial advertising r lettering. These are essentially the same size as private passenger vehicles, cars and SUV s. Similarly, there wuld nt appear t be issues related t cmmercial vehicles regardless f size that are hidden away within garages. This is the apprach that has been taken by sme f the municipalities that have been surveyed. Hwever, mst garages are typically t small t accmmdate anything mre than a vehicle crrespnding t passenger car dimensins. Vertical clearance may als be an issue in the case f sme van sized vehicles. The real issue is cmmercial vehicles that are larger than thse typically used fr private resident use and which cannt be parked in a garage. As nted, this study has attempted t balance the diverse pinins related t thse vehicles. 4.9 RECOMMENDATIONS Balancing the varius cnsideratins the fllwing is recmmended: The prvisins shuld apply t all residential znes and shuld be cnsistent. Cmmercial vehicle shuld be defined as any vehicle having advertising n its exterir (excluding that related t the type f vehicle and where it was purchased) and /r being used fr hire t transprt gds r peple. Only tw cmmercial vehicles are permitted t park n a prperty in any Residential Zne prvided that:

The trailer is in additin t the cmmercial vehicle. The height f the trailer must nt exceed 2.2 metres, measured frm the grund t the highest pint n the vehicle. Under n circumstances shuld the vehicle (and trailer) extend ver the sidewalk. Pedestrians need t be able t get by safely withut being required t g arund the vehicle n the rad. This applies equally t thse in wheelchairs. The cmmercial vehicle be n clser than 2 metres frm the curb f the rad t prvide sme visibility fr thse n adjacent prperties wh may be backing ut f driveways. It shuld be nted that technically parking within the bulevard area is nt allwed in any event. A cnsistent enfrcement plicy whereby if a cmplaint is received nt nly wuld the vehicle invlved in the cmplaint be investigated, but als any ther vehicles that are bserved t be in cntraventin in the area. Survey results indicate that sme residents are nt ppsed t the parking f small cmmercial vehicles prvided that there are sme restrictins in place. Plicies shuld be enfrced in a manner that achieves fairness and equality, acrss the municipality.

95 Twn f Whitby Parking Study Final Reprt Page 79 f RECREATIONAL VEHICLE PARKING IN RESIDENTIAL AREAS The parking f recreatinal vehicles such as mtr bats, mtr hmes, camper vans and trailers n residential prperties presents many f the same issues as the parking f cmmercial vehicles n residential prperties. These include cncerns regarding safety, fr example related t trailer hitches ver hanging the sidewalk, and large mtr hmes bstructing visibility. Aesthetics are als an issue, but again acceptability is in the eye f the behlder. What is acceptable t ne resident may nt be acceptable t anther resident. Again, this review has attempted t balance the varius cnsideratins, with a fcus n the fllwing cnsideratins: Safety Prperty Rights Ease in interpretatin Fairness/Equality Cnsistency with the cmmercial vehicle parking in residential areas recmmendatins, recgnizing that the tw g hand in hand. Similar t the cmmercial vehicle parking in residential areas, the enfrcement f the current prvisins has been temprarily suspended, as a result f the July 3, 2007 Cuncil decisin, pending the findings f the subject study. The nly exceptin is if safety is jepardized, in which case enfrcement is undertaken. 5.1 EXISTING POLICIES/PROCEDURES BY-LAW PROVISIONS By-law 2585 Sectin 6(24)(b) states that the parking r strage f any trailer (as defined under the Highway Traffic Act) r bat is nt permitted in any Residential Zne. The reprt ntes that it is staff s pinin that the current general prvisins are utdated and d nt reflect the current residential activities, and that the enfrcement f the prvisins is nt practical. With respect t the Dwntwn Whitby prvisins staff recmmended that a review f the strage f unlimited recreatinal vehicles in a private garage be undertaken as there is a ptential t eliminate the minimum tw residential parking spaces per lt. Richmnd Hill is the nly municipality that replied t the survey that des nt permit recreatinal vehicle parking in residential znes. The fllwing is a summary f input received frm municipalities that respnded t the survey: Twn f Miltn: Recreatinal vehicle parking is permitted prvided that it prvides fr shrt term ccupancy intended and used exclusively fr recreatinal travel and vacatining, designed t be twed r prpelled by a mtr vehicle r self-prpelled, and includes such vehicles cmmnly knwn as travel trailer, truck camper, camper trailer, mtr hmes, bats r ther similar vehicles but des nt include a mbile hme. Parked in a side/rear yard, maximum permissible height is 3.5m and length is 8.0m. Vehicles parked in a side/rear yard must be set back a minimum f 1 metre frm the nearest lt line. Vehicles parked in a side yard must nt prject int the frnt yard f the lt unless it is parked n a driveway. N part f any frnt/flankage yard except a driveway is t be used fr the parking r strage f vehicles and n vehicle is t encrach nt any rad allwance. City f Guelph: N bat shall be parked r stred except in a garage r rear yard. N recreatinal vehicle shall be parked r stred except in a garage, side yard r rear yard. Ntwithstanding these prvisins, the parking f recreatinal vehicles is allwed in the driveway fr up t 48 hurs, t allw fr the parking and unpacking f gds. Guelph has experienced prblems related t these prvisins and ideally wuld like t restrict the parking f recreatinal vehicles t the rear yard nly. They have received cmplaints abut the parking f recreatinal vehicles being parked in side yards.

City f Barrie: Recreatinal vehicle parking is permitted. The by-law is silent n the details. Ntwithstanding this, it has nt been a prblem. City f Oshawa: N persn shall in any Residential Zne park r stre a recreatinal vehicle greater than 6.0 m in length r greater than 2.6 m in height in any part f a frnt yard r exterir side yard, nr in that prtin f any rear yard f a crner lt which abuts an imprved street r 0.3 m reserve fr that distance frm the street which is equal t r less than the depth f the exterir side yard. 104 Twn f Whitby Parking Study Final Reprt Page 88 f 105 Municipality f Claringtn: Recreatinal vehicle means a vehicle that is used predminantly fr recreatinal purpses, including recreatinal trailers, snwmbiles, mtrized and nn-mtrized bats, persnal watercraft, all-terrain vehicles and recreatinal mtr vehicles. 5.5 RESIDENT SURVEYS The majrity f the residents surveyed (63.3 percent r 95 ut f 150) indicated that they are nt ppsed t the parking f recreatinal vehicles n residential prperties, prvided that certain cnditins are met. In rder f imprtance these cnditins include the fllwing: If the length f the vehicle is shrter than the length f the driveway If the vehicle des nt exceed a certain length r height Only if parking is fr shrt perids f time such as ne day t pack and unpack. Of far less imprtance were tw ther cnsideratins: Only if the vehicle can be parked in the garage If the vehicle can be parked elsewhere, fr example in the backyard. 5.6 CONSIDERATIONS The cnsideratins related t recreatinal vehicle parking n residential prperty are similar in many respects t thse related t cmmercial vehicle parking in a similar setting. They include: Fairness/Equality Lack f cnsistency in the standards acrss the municipality Number and Type f Vehicles Strage Lcatin Safety Temprary versus permanent strage Hw t equalize (e.g. des ne bat equal t tw ski-ds?) If the recreatinal vehicle is parked in the garage then the passenger vehicle cannt be parked in the garage. Overhang f hitches nt the street. Obstructin f sightlines. Difference between thse wh may stre n a seasnal basis, versus thse wh very seldm mve the vehicle, versus thse wh need t have the vehicle n site nly temprarily (e.g. t lad and unlad).

Is ne type f recreatinal vehicle aesthetically pleasing, while anther is nt? 5.7 ASSESSMENT RECREATIONAL VEHICLE PARKING IN RESIDENTIAL AREAS As nted, many f the same cnsideratins apply t the parking/strage f bth recreatinal and cmmercial vehicles n residential prperties. The ne key difference is that cmmercial vehicles are typically related t emplyment/livelihd, whereas recreatinal vehicles are related t discretinary activities. It is clear that the current prvisins are difficult fr the public t understand and fr the municipality t administer. Based n the input received there is generally acceptance related t the need t lad and unlad these vehicles, prvided that the lading and unlading des nt ccur n a neighbur s prperty and prvided that it des nt result in any safety cncerns fr the neighburs, as well as the general public. A key cncern relates t large recreatinal vehicles which are parked fr extended perids f time, r year rund. Generally a cncern des nt exist with vehicles which are hidden ut f view, fr example in the rear yard, r in a garage. Hwever the parking f a recreatinal vehicle in a garage ptentially displaces ne r mre passenger vehicles which shuld therwise be parked there. Use f tarps and ther cverings can further aggravate the issue f aesthetics. 5.8 RECOMMENDATIONS These recmmendatins represent a balanced apprach t the parking f recreatinal vehicles in Residential Znes: The parking f recreatinal vehicles that are generally used in the summer mnths such as bats, mtr hmes and travel trailers, in Residential Znes shall be permitted frm May 1 st t Octber 31 st. The parking f snwmbiles and winter related recreatinal vehicles shall be permitted frm Nvember 1 st thrugh t April 30 th. The abve is restricted t the fllwing n a residential prperty:

It cannt displace the standard parking requirements fr the principal dwelling (i.e. tw spaces). The vehicle is parked n clser than 1 metre frm a side lt line. The vehicle des nt extend nt the sidewalk. The vehicle is lcated n clser than 2 metres frm the curb f the rad. Cnsistent enfrcement is put int place, nt just enfrcement n the basis f cmplaint. This is fr reasns f fairness and equality acrss the twn. If adpted, this plicy will increase the peratinal csts (i.e. additinal csts t hire mre staff t enfrce). Hwever, it is expected that this additinal csts wuld be ffset by the additinal revenues received thrugh additinal fine revenues. The abve allws eligible residents t park their recreatinal vehicles fr the 6 mnths perid when they wuld typically need access t thse vehicles, withut impsing the visual impacts assciated with year rund strage f thse vehicles, n their neighburs. In that study MMM recmmended 2.7 metres by 5.8 metres fr perpendicular and angled parking spaces. A review f parking standards fr Trnt resulted in adptin f a standard f 2.6 metres in width by 5.6 metres in length, prvided that the minimum aisle width is 6.0 metres. Wider parking spaces were identified fr aisle widths f less than 6.0 metres. Wider spaces were als recmmended when ne r bth sides f a parking space are bstructed (2.9 metres with ne side bstructed and 3.2 metres if bth sides are

If a side is bstructed and the aisle width is less than 6.0 metres the space width increases t 3.3 metres at minimum. ASSESSMENT The length and width f a parking space need t be cnsidered in cnjunctin with the aisle width since tgether they determine the ability t be able t maneuvre int and ut f a parking space. The prprtin f micr cars in the verall vehicle fleet is still relatively small, althugh this may change in the future depending n the cst f fuel and ther envirnmental cnsideratins. SUV s and ther large vehicles still represent a significant prprtin f the verall vehicle fleet, althugh this t may change in respnse t fuel csts. Hwever in the shrt term, the standards need t cnsider the mix f vehicles fund n the rad netwrk. The prvisin f a minimum parking space area, in additin t length and width, is redundant. RECOMMENDATION A minimum f 2.7 metres in width by 5.8 metres in length, (with a 6.0 metre wide aisle as discussed in Sectin 6.5). 6 RATIONALE Is in the middle f the range. Prvides sme reductin ver existing minimum area requirements since are likely headed twards an increase in the prprtin f smaller vehicles in the verall vehicle fleet due t energy/envirnmental reasns. 6.2 PARALLEL PARKING SPACE DIMENSIONS CURRENT PROVISIONS Dwntwn Whitby and Dwntwn Brklin require a minimum f 2.75 metres in width by 6.7 metres in length fr a parallel parking space. 6 Dimensins fr private garages are addressed separately since they have been identified as an issue.

RECOMMENDATIONS Minimum f 2.7 metres in width by 6.7 metres in length which is very similar t existing. Increase the width t 2.9 metres in case f an bstructin such as a wall n ne side. RATIONALE Similar t ther municipalities in the case f the basic requirements. Marginal increase (similar t City f Trnt at 2.9 metres) in the case f an bstructin n ne side t facilitate passenger dr pening. 6.3 PRIVATE PARKING GARAGES STANDARD FOR SINGLES, SEMI- DETACHED AND TOWNHOUSE UNITS As a part f this study, the Twn f Whitby undertk a garage site survey in January, The purpse f the garage site study was t investigate whether garage sizes shuld be regulated, in rder t ensure that standard/average size vehicles can be accmmdated and that there is adequate space t stre nrmal husehld garage type items such as lawn mwers. The findings f the garage site survey have been cnsidered in the assessment herein.

Hwever, it shuld be nted that furring walls that enclse duct wrk are nt shwn n building permit plans. OTHER MUNICIPALITIES RESPONDING TO THE SURVEY Fr sme f the municipalities surveyed the minimum parking space dimensins als apply t garages. Ajax has initiated new garage dimensins t ensure that the vehicles culd be accmmdated fully in the garage. The minimum bstructin free dimensins fr a required parking space within a private garage are 3.1 metres in width by 6.5 metres in length. Where mre than ne parking space is prvided within a private garage all subsequent parking spaces shall prvide a minimum width f 2.5 metres. This has addressed resident cmplaints regarding staircases impeding the accmmdatin f vehicles within the garage. In Miltn a single garage r a duble garage with a separating wall shall have minimum dimensins f 2.9 metres in width by 6.0 metres in length and 2.1 metres in height. A duble garage with n separating wall shall have a minimum width f 5.5 metres, with the same minimum length and height requirements. With either garage type, 5.3 metres in length shall be unbstructed with the exceptin f ne stair. They have fund that in sme cases due t grading t many stairs encrach int the available space in which the vehicle can be parked. Althugh Newmarket des nt have minimum garage space dimensins, they smetimes find that the stairs prject int the garage space, resulting in issues. In Richmnd Hill maximum standards apply, with the maximum size f a private parking garage being 37 m 2 and the maximum height being 4.5 metres.

A stair t an access dr int the dwelling is allwed t prject 0.8 m (2 8 ) int the required 3 metres by 6 metres space. Edmntn des nt have any separate requirements fr garages, but requires that the vehicular space be unbstructed. St. Catharines requires a minimum f 2.75 metres by 5.5 metres, hwever this is nt imbedded in the zning by-law. Cambridge has a minimum width f 2.9 metres and a minimum length f 5.5 metres. Steps withut handrails may prject 0.5 metres int the required size f the parking space, and a wall may prject 0.5 metres int ne side f the required size f the parking space, having a maximum length f 1.5 metres frm the back r frnt wall nly f the garage. In mst cases private garage dimensins have nt been a prblem with the municipalities surveyed. GARAGE SITE SURVEY The garage site survey undertaken by the Twn f Whitby investigated the current level f cmpliance with the existing parking garage requirements. The survey results reveal that: All sites surveyed seemed t meet the minimum parking space size requirements. Certain single car garages that had prjecting furring walls bxing in duct wrk culd be at the edge f nn-cmpliance. Certain huses with walls r bulk head prjectins culd cmprmise the full utilizatin f the length f the garage, althugh the length f the garage wuld still accmmdate vehicles within lengths f under 5.0 metres. OTHER STUDIES Nthing specifically related t this tpic. ASSESSMENT Current issues with garages are generally as a result f tw factrs: strage stairs Garages are nt cnsidered t be part f the usable space f a huse. Increasing the size f the garage likely means a reductin in the usable space in the huse, resulting in a trade-ff between mre strage space in the garage and usable space within the huse.

RATIONALE The width is marginally wider than what is being recmmended fr a parking space with an bstructin n ne side. This is als the same as that fr ne f the ther municipalities that was surveyed (eg. Guelph fr a garage r carprt). The recmmended length (6.0 metres) is slightly lnger than that being recmmended (5.8 metres) fr a typical parking space which will accmmdate mst passenger cars, standard size vans and pick-up type vehicles. This recgnizes that sme clearance is required at the frnt f the vehicle. The length is cmparable t that in Guelph, and is a balance between sme f the thers (eg. midway between thse f St. Catharines/Cambridge and Ajax). Limits intrusins by stairs int this defined space s that the integrity f the parking space is maintained. Hwever, stair prjectins f 2 r 3 risers (0.6 metres) are permitted t encrach since they d nt nrmally interfere with the ability t park a vehicle. Any surplus width/length created by the stairs can be used fr strage.
