1 ORIGINAL ORDINANCE NO. 71 AN ORDINANCE OF THE CITY OF WOODINVILLE, WASIllNGTON, ESTABLISIllNG A MOTOR VEIDCLES AND TRAFFIC CODE FOR THE CITY OF WOODINVILLE; ADOPTING NUMEROUS SECTIONS OF THE STATE MODEL TRAFFIC ORDINANCE (RCW CHAPTER 46.90) AND NUMEROUS STATE TRAFFIC STATUTES NOT CONTAINED IN THE STATE MODEL TRAFFIC ORDINANCE; ESTABLISIllNG THE CRIME OF DRIVING WIDLE UNDER THE INFLUENCE, INATTENTIVE DRIVING, DEFINITIONS, SPEED, LAWS, LAWS REGARDING "IMPOUNP", ABANDONED VEIDCLES, FIRE LAWS, PARKING LIMITS, AND VARIOUS OTHER TRAFFIC PROVISIONS, AND REPEALING ORDINANCE NUMBER 20 AND ALL OTHER ORDINANCES AND SECTIONS OR SUBSECTIONS OF ORDINANCES IN,.,CONFLICT WITH TIDS ORDINANCE, AND ESTABLISIllNG AN EFFECTIVE DATE. 3 Sectin 3. Driving While Under the Influence f Intxicating Ligur r Drug--What Cnstitutes. A persn is guilty f driving while under the influence f intxicating liqur r any drug if the persn drives a vehicle within the City while: A. The persn has 0.08 grams r mre f alchl per tw hundred ten liters f breath, as shwn by analysis fthe persn's breath, made under this rdinance; r B. The persn has 0.08 percent r mre by weight falchl in the persn's bld as shwn by an analysis f the persn's bld, made under this rdinance; r C. The persnis under the influence fraffected by intxicating liqurr any drug; r D. The persn is under the cmbined influence f r affected by intxicating liqur and any drug. The fact that any persn charged with a vilatin fthis sectin is r has been entitled t use such drug under the laws f this state shall nt cnstitute a defense against any charge f vilating this sectin. () Sectin 4. Actual Physical Cntrl f Mtr Vehicle While Under Influence f '.-J~ Intxicating Ligur r Drug-What Cnstitutes--Defenses. A persn is guilty f being in actual physical cntrl f a mtr vehicle while under the influence f intxicating liqur r any drug if the persn has actual physical cntrl f a vehicle within the City while: A. The persn has 0.08 grams r mre f alchl per tw hundred ten liters f breath, as shwn by analysis f the persn's breath made under sectin 3(C) fthis rdinance; r B. The persn has 0.08 grams r mre by weight f alchl in the persn's bld as shwn by an analysis fthe persn's bld made under sectin 3(C) fthis rdinance; r C. The persn is under the influence fr affected by intxicating liqur and any drug. D. The persn is under the cmbined influence f r affected by intxicating liqur and any drug. The fact that any persn charged with a vilatin fthis sectin is r has been entitled t use such drug under the laws f this state shall nt cnstitute a defense against any charge f TARSG9SJ..J.O -3-

4 vilating this sectin. N persn may be cnvicted under this sectin if, prir t being pursued by a law enfrcement fficer, he r she has mved the vehicle safely ffthe radway. Sectin 5. Persns Under Influence f Intxicating Liqur r Drug--Evidence--Tests- Infrmatin Cncerning Tests. A. Upn the trial f any civil r criminal actin r prceeding arising ut f acts alleged t have been cmmitted within the City by any persn while driving r in actual physical cntrl f a vehicle while under the influence fintxicating liqur r any drug, ifthe amunt f alchl in the persn's bld r breath at the time alleged as shwn by analysis f the persn's bld r breath is less than 0.08 percent by weight f alchl in his r her bld r 0.08 grams f alchl per tw hundred ten liters fthe persn's breath, it is evidence that may be cnsidered with ther cmpetent evidence in determining whether the persn was under the influence f intxicating liqur r any drug. B. The breath analysis shall be based upn grams f alchl per tw hundred ten liters f breath. The freging prvisins f this sectin shall nt be cnstrued as limiting the intrductin f any ther cmpetent evidence bearing upn the questin f whether the persn was under the influence fintxicating liqur r any drug. I U C. Analysis f the persn's bld r breath t be cnsidered valid under the prvisins f this sectin r sectins 1 r 2 fthis rdinance shall have been perfrmed accrding t methds apprved by the state txiclgist and by an individual pssessing a valid permit issued by the state txiclgist fr this purpse. Pursuant t RCW , the state txiclgist is directed by the State t apprve satisfactry techniques r methds, t supervise the examinatin f individuals t ascertain their qualificatins and cmpetence t cnduct such analyses, and t issue permits which shall be subject t terminatin r revcatin at the discretin f the state txiclgist. D. When a bld test is administered under the prvisions f RCW , the withdrawal fbld fr the purpse f determining its alchlic cntent may be perfrmed nly by a physician, a registered nurse, r a qualified technician. This limitatin shall nt apply t the taking fbreath specimens. E. The persn tested may have a physician, r a qualified technician, chemist, registered nurse, r ther qualified persn fhis r her chsing administer ne r mre tests in additin t any administered at the directin f a law enfrcement fficer. The failure r inability t btain an additinal test by a persn shall nt preclude the admissin f evidence relating t the test r tests taken at the directin f a law enfrcement fficer. Upn the request f the persn wh shall submit t a test r tests at the request f a law enfrcement fficer, full infrmatin cncerning the test r tests shall be made available t him r her r his r her attrney. Sectin 6. Persns Under Influence f Intxicating Liqur r Drug--Admissibility r Refusal Evidence. RCW including all future amendments, additins, r deletins IS reference. adpted by Sectin 7. Inattentive Driving. It is unlawful fr any persn t perate a mtr vehicle within the City in an inattentive manner. Fr the purpses fthis sectin, "inattentive manner" means the peratin f a mtr vehicle in a manner which evidences a lack f the degree f attentiveness required t safely perate the vehicle under the prevailing cnditins, including but nt limited t the nature and cnditin f the radway, presence f ther traffic, presence f ther pedestrians, and weather cnditins. The ffense f perating a mtr vehicle in an inattentive manner shall be cnsidered t be a lesser ffense than, but included in, the ffense f perating a mtr vehicle in a negligent manner. Sectin 8. Definitins. The fllwing definitins shall apply t the prvisins fthis rdinance: A. Street. "Street" as used in all sectins f this Ordinance means every city street and/r public highwaywithin the City limits fthe City fwdinville. B. Scrap Prcessr. "Scrap Prcessr" as used in all sectins f this Ordinance means any persn, firm r crpratin legally and currently licensed t demlish r destry autmbiles r autmbile hulks by lawful means including but nt limited t, crushing, shearing, hydraulic baling r shredding, fr recycling autmbile salvage. C. Mtr Vehicle Wrecker. "Mtr Vehicle Wrecker" as used in all sectins f this Ordinance means every persn, firm, partnership, assciatin, r crpratin engaged in the business f buying, selling, r dealing in vehicles f a type required t be licensed under the laws f the City f Wdinville r f this State, fr the purpse f wrecking, dismantling, disassembling, r substantially changing the frm f any mtr vehicle, r wh buys r sells integral secndhand Parts f cmpnent material theref, in whle r in part, and deals in secndhand mtr vehicle parts. 6 D. Abandned Vehicle. "Abandned Vehicle" as used in all sectins f this Ordinance means any abandned vehicle, any abandned autmbile hulks and any ther vehicle r parts theref nt defined as r amunting t abandned vehicle r autmbile hulk, whether n public r private prperty, whether r nt s left with r withut the permissin f the prperty wner theref. E. Abandned Junk Vehicle. As used in all sectins f this rdinance, means a vehicle meeting any tw fthe fllwing requirements: 1. Is three years ld r lder; 2. Is extensively damaged, such damage including but nt limited t any f the fllwing: a brken windw r windshield, r missing wheels, tires, mtr, r transmissin; 3. Is apparently inperable and has nt been mved ffthe prperty in ver six mnths; 4. Is withut a valid, currentregistratin plate; r 5. Has an apprximate fair market value equal nly t the apprximate value f the scrap in it. Sectin 9. State Speed Laws--Exceptins. The state traffic laws regulating the speed f vehicles at 25 MPH shall be applicable upn all streets within the City, except that the legislative authrity f the City, as authrized by state law, may declare and determine by rder, rule r regulatin, prperly adpted, that certain increased r decreased speed regulatins shall be applicable upn specified streets r in certain areas, in which event it is unlawful fr any persn t perate a vehicle at a speed in excess fthe speed s established when prper signs are in place giving ntice theref. A. Increasing State Speed Limit. Whenever cnditins are fund t exist upn an arterial street r highway which warrant an increase in the speed permitted by state law, the legislative authrity f this City, subject t the apprval f the State Highway Cmmissin in cases invlving state highways, shall determine and declare a reasnable and safe maximum speed limit fr such arterial street r highway, r prtin theref, nt t exceed 55 miles per hur. B. Decreasing State Speed Limit. Whenever it is deemed inadvisable fr vehicles t perate at the maximum speed allwed by state law at 25 MPH n any prtin f a street r public highway n accunt f a sharp curvatin, highway cnstructin r repairs, excessive traffic, any dangerus cnditin, r ther temprary r permanent cause, the legislative authrity f the City, subject t the apprval f the State Highway Cmmissin in cases invlving state highways, shall determine and fix a lwer maximum speed r therwise regulate a lesser speed; prvided that in n case shall the maximum speed be reduced t less than 20 miles per hur. 7 Sectin 10. Impundment and Redemptin f Certain Vehicles. King Cunty Cde Chapter 46.08, including any future additins t, and amendments and repeals theref, is hereby adpted by reference. Sectin 11. Autmbile Hulks: Abatement and Remval f Autmbile Hulks n Private Prperty--Cntents. A. The strage r retentin f an autmbile hulk r junk vehicle n private prperty is declared t cnstitute a public nuisance subject t remval and impundment. The Plice Department, shall inspect and investigate cmplaints relative t autmbile hulks, r junk vehicles, r parts theref n private prperty. Upn discvery f such nuisance, the Plice Department shall give ntice in writing t the last registered wner f recrd f the autmbile hulk r junk vehicle and als t the prperty wner f recrd, rdering remval f such autmbile hulks, junkvehicles, rparts theref. B. This sectin shall nt apply t: 1. An autmbile hulk, junk vehicle, r parts theref, which is cmpletely enclsed within a building in a lawful manner where it is nt visible frm the highway and/r radway r ther public r private prperty; r 2. An autmbile hulk, junk vehicle, r parts theref, which is stred r parked in a lawful manner n private prperty in cnnectin with the business f a licensed dismantler r licensed vehicle dealer, fenced accrding t the prvisins f RCW Sectin 12. Dispsitin fabandned Junk Vehicles. A. Ntwithstanding any ther prvisin f law, the Plice Department n its wn, r upn request frm a private persn having the right t pssessin f prperty upn which an abandned junk vehicle has been left, shall inspect and may authrize the dispsal f an abandned junkvehicle. The Plice Department shall recrd the make f such vehicle, the serial number ifavailable, and shall als detail the damaged r missing equipment t substantiate a fair market value as scrap nly. It shall prepare in duplicate fr each such abandned junk vehicle an authrizatin t dispse n a frm prvided by the directr. It shall issue the riginal cpy f such authrizatin t dispse t any registered dispser r scrap prcessr fr the purpse f acquiring an abandned junk vehicle: PROVIDED, that such acquisitin is fr the purpse f ultimate transfer t and demlitin by a licensed scrap prcessr. B. Any mnies received by the City frm the dispsal f abandned junk vehicles shall be depsited in the City General Fund. TARS699L~O -7-

8 I 8 \ i Sectin 13. Fire Lanes Established--Vehicle Obstrnctin and Impundment. A. Establishment f Fire Lanes. Fire Lanes in cnfrmance with this cde shall be established by the Building Official fr the City, r his r her duly authrized representative, and in cnjunctin with the Fire Chief. These lanes shall be referred t as "Designated Fire Lanes" in this rdinance. B. Definitin f Fire Lanes. The area within any public right-f-way, easement r private prperty designated fr fire trucks and ther fire fighting r emergency equipment t use, travel upn and/r park. C. Marking ffire Lanes. All Designated Fire Lanes t be marked frm this date frward, shall be clearly marked in ne fthe fllwing manners: 1. Vertical curbs six (6") inches in height shall be painted yellw n the tp and side, extending the length f the Designated Fire Lane. The pav~ment adjacent t the painted curbs shall be marked with blck lettering a minimum f eighteen (18") inches in height and with a three (3") inch brush strke reading: "NO PARKING FIRE LANE". Lettering shall be yellw and spaced at n mre than fifty (50') ft intervals, r 2. Rlled curbs r surface withut curbs shall have a yellw six (6") inch wide stripe painted, extending the length f the Designated Fire Lane. The surface adjacent t the strip shall be marked with blck lettering a minimum f eighteen (18") inches in height and with a minimum three (3") inch brush strke reading: "NO PARKING FIRE LANE". Lettering shall be in yellw and spaced at n mre than fifty (50') ft intervals, r 3. Fire Lane signs which shall be as fllws: a. Reflective in nature. b. Use red letters n white backgrund. c. Usethree (3") inch lettering, t read "N Parking, FireLane". d. A minimum ftwelve (12") inches wideby eighteen (18") inches tall. e. Spaced n mre than fifty (50') feet apart and psted n r immediately next t the curb r side fthe rad. f. Tp fthe sign t be nt less than fur (4') feet nr mre than six (6') feet frm the grund. g. Signs may be placed n a building when apprved by the Building Official in crdinatin with the Fire Chief. h. When psts are required fr signs, they shall be a minimum f tw (2") inch galvanized steel rfur (4") by fur (4") inch pressure treatedwd. i. Signs are t be placed s they face the directin fvehiculartravel. D. Obstructin f Fire Lanes Prhibited. 9 defmed in State Law and the Unifrm Fire Cde and be an immediate hazard t life and prperty. E. Alternate Materials and Methds. The Building Official, in crdinatin with the Fire Chief may mdify any f the prvisins herein, where practical difficulties may exist. The particulars f a mdificatin shall be decided by the Building Official and shall be entered int the recrds fthe FireDepartment, lcal PliceAgency and thebuildingdepartment. F. Exemptin t Sign Reguirements/Existing Fire Lane Signs and Markings. I. Previusly existing signs psted prir t this date, will be allwed t remain until there is a need fr replacement. When replaced, the new sign must then meet the requirements as set frth in this chapter. 2. Previusly existing markings will be allwed t remain until there is a need fr repainting. When repainted, the new markings must then meet the requirements as set frth in the chapter. G. Maintenance. Fire lane markings shall be maintained at the expense f the prperty wner(s) as ften as is deemed necessary t clearly identify the designated area as a FireLane., R, "--J H. Twing Ntificatin. Directly adjacent t where Fire Lanes have been designated, signs shall be psted as set frth in this chapter, in a clear, cnspicuus lcatin and shall clearly state "vehicles parked in Fire Lanes may be impunded." They shall als state the name, telephne number and address f the twing cmpany where the vehicle may be redeemed. There shall be at least ne sign per designated zne. 1. Prperty Owner Respnsibility. The wner, manager, r persn in charge f any prperty upn which designated Fire Lanes have been established, shall be respnsible fr, and nt allw, vehicles r ther bjects t park in suchfirelanes. J. Vilatin--Infractin--Penalty. Any persn wh fails t mark r maintain the marking f a Designated Fire Lane as prescribed in this rdinance, r wh parks a vehicle in, allws the parking fa vehicle in, bstructs r allws the bstructin fa Designated Fire Lane is guilty f an infractin. The maximum penalty fr failing t mark r maintain the marking f a Designated Fire Lane shall be nt mre than a fine f Three Hundred and Fifty ($350) Dllars. The maximum penalty fr parking a vehicle in, allwing the parking f a vehicle in, bstructing, r allwing the bstructin f a Designated Fire Lane, shall be nt mre than a fme f Three Hundred and Fifty ($350) Dllars. K. Impundment. Any vehicle r bj ect bstructing a Designated Fire Lane is hereby declared a traffic and fire hazard and may be immediately impunded pursuant t the applicable state law, and Unifrm Fire Cde, withut prir ntificatin t its wner. That the traffic engineer can declare an emergency and thus invke rad restrictins, deemed necessary by rad and/r weather cnditins, whichwuld r wuld be likely t damage streets, rads, alleys, r highways, if emergency rad limits, speed limits, and/r vehicle restrictins were nt immediatelyplacedupn such radway, streets, alleys, r highways. Sectin 15. Speed Limits. A. Speed Limit30 MPH. A speed limitf30 miles perhur is hereby established fr mtr vehicle traffic upn the fllwing streets, radways, highways and that n persn shall perate a mtr vehicle upn said streets, rads r highways in excess f 30 miles per hur: '1. NE 175th Street Between 131stAvenue NE and 140th Avenue NE; 2. Wdinville-Duvall Rad Between I40th Avenue NE and NE 178th Street; nd Avenue NE Between NE 175th Street and the Wdinville-Snhmish Rad; 4. Wdinville-Snhmish Rad Between 132nd Avenue NE and 140th Avenue NE; and thAvenue NE BetweenNE 171st Street and the Wdinville-Snhmish Rad. B. Speed Limit 35 MPH. A speed limit f35 miles per hur is hereby established fr mtr vehicle traffic n the fllwing streets, radways, highways and that n persn shall perate a mtrvehicleupn said streets, rads, r highways in excess f35 miles per hur: 1. Wdinville-Duvall Rad Between NE 178th Street and NE 190th Street; and 2. NE 185th (Wdinville-Duvall Rad) Between 156th Avenue NE and the East City Limits. D. The entry terminus f each street, radway, highway, with a speed limit in excess f 25 miles per hur shall be psted with a sign clearly indicating the established legal speed limit. Advisry signs, indicating a reduced speed zne ahead, near the exit terminus f said street, radway, highway, shall suffice as regulatry signs. Intersecting streets may be psted, where deemed advisable by the Traffic Engineer, with a sign indicating the legal speed limit n the intersecting streets, radway, highways. Intersectins and curves may be psted with reduced speed limits where deemed advisable by the Traffic Engineer. Sectin 19. Overnight Parking Prhibited in Residential Areas. A. It is unlawful t park, r therwise leave, vernight, between the hurs f 12:01 a.m., and 6:00 a.m., n any street 01- highway in the City f Wdinville within r abutting an area classified as residential (R-l thrugh R-48 zning cdes) by the fficial zning rdinance, the fllwing types ftrailers and/r vehicles: 1. All types ftrailers designed t be drawn by a mtr vehicle except recreatin trailers; 2. Buses and trucks used fr business purpses in whle r in part, excluding pickup r panel trucks f less than ne tn rated capacity. B. It is nt necessary that restricted parking r ther traffic signs be erected fr the purpse f enfrcing this sectin. Sectin 20. Penalties and Prcedure n Arrest--General Penalty. Unless anther penalty is expressly prvided in the fllwing sectin, every persn cnvicted f a vilatin f any sectin f this Ordinance shall be punished by a fine f nt mre than tw hundred fifty dllars ($250.00). Sectin 21. Dispsitin f Traffic Fines and Frfeitures. The City's prtin f any fmes and frfeitures cllected upn cnvictin r upn the frfeiture f any bail f any persn charged with a vilatin f any prvisins f this Ordinance shall be paid int the general fund fthe City. Sectin 22. Adptin Includes Amendments t the Law. Whenever a reference is made in this cde t any statute r sectin f the Revised Cde f Washingtn, r any prtin theref, the reference shall apply t all amendments, crrectins and additins heretfre, r hereafter made.
