1 Tennessee Title 55 - Mtr and Other Vehicles "Manufactured hme," "Mbile hme r huse trailer," "ple trailer," "semitrailer" and "trailer" defined. (a) "Manufactured hme" means any structure, transprtable in ne (1) r mre sectins, which, in the traveling mde, is eight (8) r mre bdy-feet in width r frty (40) r mre bdy-feet in length, r when erected n site, is three hundred twenty (320) r mre square feet, and which is built n a permanent chassis and designed t be used as a dwelling with r withut a permanent fundatin when cnnected t the required utilities, and includes the plumbing, heating, aircnditining and electrical systems cntained therein. The term includes any structure that meets all f the requirements f this subsectin (a) except the size requirements and with respect t which the manufacturer vluntarily files a certificatin required by the United States secretary f husing and urban develpment and cmplies with the standards established by title 42 f the United States Cde. As defined in this subsectin (a), "manufactured hme" als has the same meaning as "mbile hme," as defined in title 68, chapter 126, and "manufactured hme," as defined in (b) "Mbile hme r huse trailer" means any vehicle r cnveyance, nt self-prpelled, designed fr travel upn the public highways, and designed fr use as a residence, ffice, apartment, strehuse, warehuse, r any ther similar purpse. "Mbile hme r huse trailer" includes any "manufactured hme" as defined in subsectin (a). (c) "Ple trailer" means every vehicle withut mtive pwer designed t be drawn by anther vehicle and attached t the twing vehicle by means f a reach, r ple, r by being bmed r therwise secured t the twing vehicle, and rdinarily used fr transprting lng r irregularly shaped lads such as ples, pipes, r structural members capable, generally, f sustaining themselves as beams between the supprting cnnectins. (d) "Semitrailer" means every vehicle withut mtive pwer and nt a mtr vehicle as defined in this sectin, ther than a ple trailer, designed fr carrying persns r prperty and fr being drawn by a mtr vehicle and s cnstructed that sme part f its weight and that f its lad rests upn r is carried by anther vehicle. (e) "Trailer" means every vehicle with r withut mtive pwer, ther than a ple trailer, designed fr carrying persns r prperty and fr being drawn by a mtr vehicle and s cnstructed that n part f its weight rests upn the twing vehicle.

2 Safety chains fr trailers -- Penalty -- Exceptins. (a) In additin t any ther attachment, any trailer, semitrailer, r ple trailer perated n the highways f Tennessee shall be attached t the twing vehicle by a chain, securely attached t bth vehicles, and reasnably capable f maintaining the attachment in the event f failure by any ther attachment device. (b) The respnsibility fr prviding safety chains fr trailers rented, leased, r laned t farmers by persns custmarily ding s fr the haulage f farm supplies r crps shall be with the persn s renting, leasing, r laning the trailer. (c) Failure t cmply with this sectin shall subject the ffender t a fine f fifty dllars ($50.00) n a first ffense, that may be submitted by the ffender t the clerk f the curt that has jurisdictin f the ffense in the cunty in which the ffense charged was alleged t have been cmmitted, in lieu f appearance in curt by the ffender. On secnd and subsequent ffenses, the fine shall be nt less than fifty dllars ($50.00) nr mre than five hundred dllars ($500). (d) (1) This sectin des nt apply t farm implements used in tillage, harvesting, r seeding, if the implements were nt equipped at the time f manufacture with safety chains, and if the implements are being twed n state r lcal rads at a speed f less than twenty-five miles per hur (25 mph), except this exemptin shall nt apply t farm trailers. (2) This sectin als des nt apply t any mtr vehicle with an attached gseneck type trailer r semitrailer with a fifth wheel Maximum length f vehicles. See the Cmpiler's and Amendment Ntes.] (a) Fr purpses f this sectin, "truck tractr" means the nncarg carrying pwer unit that perates in cmbinatin with a semitrailer r trailer, except that a truck tractr and semitrailer engaged in the transprtatin f autmbiles may transprt mtr vehicles n part f the pwer unit. (b) N mtr vehicle as defined in cnsisting f a straight truck whse length, including any part f its bdy r lad, exceeds frty-five feet (45') and n straight truck with trailer attached, the ttal length f which cmbinatin, including any part f the bdy r lad, exceeds sixty-five feet (65') shall be perated n any highway. (c) Mtr vehicles cnsisting f a truck-tractr and semitrailer r trailer cmbinatin shall be permitted t perate ver the federal and state highway system; prvided, that the twed vehicle

3 shall nt exceed fifty feet (50') in length frm the pint f attachment t the tractr, except that this length may be increased t fifty-tw feet (52') when the lad n the vehicle cnsists f livestck, mtr vehicle parts, autmbiles and/r mtr vehicles. If the twed vehicle exceeds frty-eight feet (48') in length frm the pint f attachment t the tractr and the lad n the vehicle des nt cnsist f livestck, mtr vehicle parts, autmbiles and/r mtr vehicles, the distance between the kingpin and the rearmst axle r a pint midway between the tw (2) rear axles, if the tw (2) rear axles are a tandem axle, shall nt exceed frty-ne feet (41'). (d) Mtr vehicles cnsisting f a truck-tractr and twin trailer cmbinatin shall be permitted t perate n the interstate system and ther federal-aid highways designated by the cmmissiner f transprtatin; prvided, that neither f the twed vehicles shall exceed twenty-eight feet six inches (28' 6'') in length. (e) N twin trailer truck authrized by this chapter shall be perated n any highway designated as a scenic highway under the authrity f title 54, chapter 17. The interstate system and ther federal-aid highways designated by the cmmissiner shall nt be cnsidered scenic rutes fr purpses f this chapter. (f) The limitatin as t length stated in this sectin shall nt apply t lads f ples, lgs r timber in single length pieces; prvided, that n mtr vehicle, including any part f the bdy r lad, transprting such material shall be in excess f seventy-five feet (75') in length unless a permit has first been btained as authrized in (g) The length limitatins described in this sectin shall be exclusive f safety and energy cnservatin devices designated by the cmmissiner except that n device excluded frm the limitatins f this sectin shall have by its design r use the capability t carry carg. (h) [Amendment perative n advisement by federal mtr carrier safety administratin. See the Cmpiler's and Amendment Ntes.]. It is nt a vilatin f the length limits set frth in this sectin when any therwise prperly titled and registered vehicle, which is in cmpliance with applicable length requirements, is disabled n the highways and requires a tw r ther assistance in prceeding t an exit r a repair r terminal facility within ne hundred (100) miles f the pint where the vehicle became disabled, and the cmbined lengths f the disabled vehicle and the tw vehicle exceed the limits in this sectin. This exemptin shall nly apply t vehicles disabled while perating n the highway, and nly when authrized by the wner, terminal manager, wner's agent, r law enfrcement fficial Maximum width and height. (a) (1) N mtr vehicle as defined in r any trailer r semitrailer, whse width,

4 including any part f the lad, exceeds eight feet (8') (that is, fur feet (4') n each side f the center line f the vehicle), r whse height, including any part f the lad, exceeds thirteen and ne-half feet (13 1/2'), shall be perated n any highway; prvided, that this sectin shall nt apply t farm tractrs r farm machinery temprarily mving n any highway. (2) Subdivisin (a)(1) relating t maximum width restrictins n trailers and semitrailers shall nt apply t a trailer r semitrailer utilized fr transprting seed cttn r rlled hay bales; prvided, that the width f any such trailer r semitrailer, including any part f the lad, shall nt exceed ten feet (10') (that is five feet (5') n each side f the center line f the trailer, r semitrailer), and such mvement is perfrmed during daylight hurs within a radius f fifty (50) miles f the pint f rigin, and n part f the mvement is upn any highway designated and knwn as a part f the natinal system f interstate and defense highways r any fully cntrlled access highway facility r ther federal-aid highway designated by the cmmissiner f transprtatin. (3) In the event federal law and regulatins permit the peratin f passenger buses f widths in excess f eight feet (8') n the natinal systems f interstate and defense highways, then there may be perated n highways with fur (4) r mre lanes, and such ther highways as are designated and apprved by the cmmissiner within the state, passenger buses, the width f which d nt exceed eight feet six inches (8' 6''), r such width, nt exceeding eight feet six inches (8' 6''), as is permitted under the federal rules and regulatins. (4) It is nt a vilatin f this part t transprt a husebat eighteen feet (18') in width, r less, n the highways, but any husebat in excess f eight feet (8') shall be subject t the fees prvided in (b) The apprval f the cmmissiner fr buses in excess f eight feet (8') t perate n streets and rads shall be inperative unless apprved by the legislative bdy f any city with a ppulatin f ne hundred seventy thusand (170,000) t tw hundred fifty thusand (250,000), accrding t the 1970 federal census. (c) Mtr vehicles nt exceeding eight feet six inches (8' 6'') in width are permitted t perate ver the interstate system and ther federal-aid highways designated by the cmmissiner. Incidental appurtenances and retracted awnings, where the width des nt exceed six inches (6''), and safety devices, as designated by the cmmissiner, shall be excluded frm the measurement f width and the prvisins cntained in Within the limitatins as prvided in this chapter, any such vehicles may use and must cnfine themselves t the shrtest reasnable rute t and frm the interstate system, ther designated highways, and terminals; r, in the case f husehld gds carriers, t and frm pints f lading and unlading. Access t facilities in interchange areas adjining these highways fr fd, fuel, repairs and rest shall nt be denied. (d) Ntwithstanding the limitatins in subsectin (a), a mtr vehicle, as defined in , r a trailer r semitrailer, whse width, including any part f the lad, des nt exceed eight feet

5 six inches (8' 6'') (that is, fur feet three inches (4' 3'') n each side f the center line f the vehicle), and whse height, including any part f the lad des nt exceed thirteen feet six inches (13' 6''), may be perated n the federal and state highway system. Any such vehicles may use and must cnfine themselves t the shrtest reasnable rute t and frm the federal and state highway system, and terminals; r, in the case f husehld gds carriers, t and frm pints f lading and unlading. Access t facilities in interchange areas adjining these highways fr fd, fuel, repairs and rest shall nt be denied. (e) (1) Ntwithstanding the limitatins set frth in subsectin (a), between ne (1) minute past midnight (12:01 a.m.) n the first Friday in March and eleven fifty-nine p.m. (11:59 p.m.) n the first Sunday in Nvember each year, a mtr vehicle carrying rafts r rafting apparatus used by an peratr fr cmmercial whitewater rafting purpses, when the driver f such mtr vehicle pssesses written dcumentatin frm the department f revenue that such peratr is in cmpliance with the plicy f liability insurance prvisins in (b), and having a height, including any part f the lad, that exceeds thirteen feet (13') but des nt exceed seventeen and ne half feet (17 1/2') may perate n the fllwing state highway segments: (A) State Rute 40 (United States Highway 64) in Plk Cunty between State Rute 33 (United States Highway 411) east f Cleveland and State Rute 68 in Ducktwn (Ocee River); and (B) Interstate 40 in Ccke Cunty between the Fthills Parkway and the Tennessee-Nrth Carlina brder (Pigen River); and within five (5) miles f such highway segments upn any additinal public rad as necessary t travel t and frm such peratr's place f business t such highway r t and frm such highway t such peratr's river access pint, s lng as the lad is secured and the vehicle is perated in a safe manner at all times. (2) Nthing in this sectin shall be cnstrued t require the department f transprtatin r any ther entity t design, cnstruct, r maintain verhead structures n r alng such highways r public rads with a clearance in excess f thirteen feet (13') r any therwise applicable design standard Breakaway frm twing vehicle Brakes t be applied autmatically and prmptly Trailers Class 2 misdemeanr. Every trailer, semitrailer, and ple trailer equipped with air r vacuum actuated brakes and every trailer, semitrailer, and ple trailer with a grss weight in excess f three thusand punds, manufactured r assembled after July 1, 1967, shall be equipped with brakes acting n all wheels and f such character as t be applied autmatically and prmptly, and remain applied fr at least fifteen minutes, upn breakaway frm the twing vehicle. A vilatin f this sectin is a Class 2 misdemeanr.

6 Lighting devices and reflectrs n vehicles having width in excess f 80 inches, truck tractrs, and trailers -- Lamp r flag n prjecting lad -- Penalties. (a) Every mtr vehicle ther than any passenger car, any rad rller, rad machinery r farm tractr having a width f eighty inches (80'') r mre shall be equipped with at least the fllwing lighting devices and reflectrs: (1) On the frnt, at least tw (2) headlamps, an equal number at each side; tw (2) turn signals, ne (1) at each side; tw (2) clearance lamps, ne (1) at each side; three (3) identificatin lamps, munted n the vertical centerline f the vehicle, r the vertical centerline f the cab where different frm the centerline f the vehicle, except that where the cab is nt mre than frty-tw inches (42'') wide at the frnt rfline, a single lamp at the center f the cab shall be deemed t cmply with the requirements fr identificatin lamps. N part f the identificatin lamps r their muntings may extend belw the tp f the vehicle windshield; (2) On the rear, tw (2) tail lamps, ne (1) at each side; tw (2) stp lamps, ne (1) at each side; tw (2) turn signals, ne (1) at each side; tw (2) clearance lamps, ne (1) at each side; tw (2) reflectrs, ne (1) at each side; and three (3) identificatin lamps, munted n the vertical center line f the vehicle; prvided, that the identificatin lamps need nt be lighted if bscured by a vehicle twed by the truck; and (3) On each side, ne (1) side-marker lamp at r near the frnt, ne (1) sidemarker lamp at r near the rear; ne (1) reflectr at r near the frnt, and ne (1) reflectr at r near the rear. (b) Every truck tractr shall be equipped as fllws: (1) On the frnt, at least tw (2) headlamps, an equal number at each side; tw (2) turn signals, ne (1) at each side; tw (2) clearance lamps, ne (1) at each side; and three (3) identificatin lamps, munted n the vertical centerline f the vehicle, r the vertical centerline f the cab where different frm the centerline f the vehicle, except that where the cab is nt mre than frty-tw inches (42'') wide at the frnt rfline, a single lamp at the center f the cab shall be deemed t cmply with the requirement fr identificatin lamps. N part f the identificatin lamps r their muntings may extend belw the tp f the vehicle windshield; and (2) On the rear, ne (1) tail lamp; ne (1) stp lamp; tw (2) reflectrs, ne (1) at each side; and, unless the turn signals n the frnt are s cnstructed (duble faced) and lcated as t be visible t passing drivers, tw (2) turn signals n the rear f the cab, ne (1) at each side.

7 (c) Every semitrailer r full trailer eighty inches (80'') r mre in verall width, except cnverter dllies, shall be equipped as fllws: (1) On the frnt, tw (2) clearance lamps, ne (1) at each side; (2) On the rear, tw (2) tail lamps, ne (1) at each side; tw (2) stp lamps, ne (1) at each side; tw (2) turn signals, ne (1) at each side; tw (2) clearance lamps, ne (1) at each side; tw (2) reflectrs, ne (1) at each side; and three (3) identificatin lamps, munted n the vertical centerline f the vehicle; prvided that the identificatin lamps need nt be lighted if bscured by anther vehicle in the same cmbinatin; (3) On each side, ne (1) side-marker lamp at r near the frnt; ne (1) sidemarker lamp at r near the rear; ne (1) reflectr at r near the frnt; ne (1) reflectr at r near the rear; and, in case f semitrailers and full trailers thirty feet (30') r mre in length, at least ne (1) additinal side-marker lamp at ptinal height and at least ne (1) additinal reflectr, the additinal sidemarker lamp r lamps and reflectr r reflectrs t be at r near the center r at apprximately unifrm spacing in the length f the vehicle; and (4) Fr the purpses f these regulatins, "cnverter dlly" is a mtr vehicle with a fifth wheel lwer half r equivalent mechanism, the attachment f which vehicle cnverts a semitrailer t a full trailer. Each dlly, when twed singly by anther vehicle, and nt as part f a full trailer, shall be equipped with ne (1) stp lamp, ne (1) tail lamp, and tw (2) reflectrs n the rear. N lighting devices r reflectrs are required n the frnt r sides f any dlly. (d) (1) Except as prvided in subdivisin (d)(2), frm ne half (1/2) hur befre sunset t ne half (1/2) hur after sunrise and at all ther times when lights are required t be displayed, there shall be attached t the rearmst extremity f any lad that prjects fur feet (4') r mre beynd the rear f the bdy f the mtr vehicle, r at any tailbard r tailgate s prjecting, r t the rearmst extremity f any lad, carried n a ple trailer, at least ne (1) red lamp, securely fastened theret, which shall be visible frm a distance f five hundred feet (500') t the sides and rear under nrmal atmspheric cnditins. At all ther times ne (1) red flag, at least eighteen inches (18'') square, made f clth, synthetic r man-made material, shall be s displayed. (2) This subsectin (d) shall apply nly t: (A) Any nncmmercial mtr vehicle transprting prperty intrastate; and (B) Any cmmercial mtr vehicle having a grss vehicle weight rating (GVWR) r a grss cmbinatin weight rating (GCWR) f twenty six

8 thusand punds (26,000 lbs.) r less when such mtr vehicle is transprting prperty intrastate. (3) Title 65, chapter 15, and all applicable federal rules shall apply t all cmmercial vehicles having a GVWR r a GCWR f mre than twenty six thusand punds (26,000 lbs.). (e) Frm ne half (1/2) hur befre sunset t ne half (1/2) hur after sunrise and at all ther times when lights are required t be displayed, any mtr vehicle r trailer transprting intrastate a lad f lgs, lng pulpwd, ples, r psts that prjects fur feet (4') r mre beynd the rear f the bdy r bed f such vehicle, when the vehicle is perated n any highway r parked n the shulder r immediately adjacent t the traveled prtins f such highway, shall have securely affixed as clse as practical t the end f any such prjecting lad either: (1) One (1) amber strbe-type lamp, cmplying with SAE J595, equipped with a multidirectinal type lens s munted as t be visible frm the rear and bth sides f the prjecting lad. If the munting f ne (1) amber strbe lamp cannt be accmplished s that it is visible frm the rear and bth sides f the prjecting lad, multiple amber strbe lights, cmplying with SAE J595, shall be utilized s as t meet the visibility requirements f this subdivisin (e)(1). The amber strbe lamp shall flash at a rate f at least sixty (60) flashes per minute and shall be plainly visible frm a distance f at least five hundred feet (500') t the rear and sides at a radius f ne hundred eighty degrees (180 degrees) f the prjecting lad. At all ther times ne (1) red flag, at least eighteen inches (18'') square, made f clth, synthetic r man-made material, shall be s displayed; r (2) One (1) amber light-emitting dide (LED) light, cmplying with SAE J595, equipped with a multidirectinal type lens, munted s as t be visible frm the rear and frm bth sides f the prjecting lad. If the munting f ne (1) amber LED light cannt be accmplished s that it is visible frm the rear and frm bth sides f the prjecting lad, multiple amber LED lights, cmplying with SAE J595, shall be utilized s as t meet the visibility requirements f this subdivisin (e)(2). The amber LED light shall flash at a rate f at least sixty (60) flashes per minute and shall be plainly visible frm a distance f at least five hundred feet (500') frm the rear and sides at a radius f ne hundred eighty degrees (180 degrees) f the prjecting lad. Any LED light shall be cnstructed f durable, weather resistant material and may be pwered by the vehicle's electrical system r by an independent battery system, r bth. If the LED light is pwered by an independent battery system, the driver f the vehicle shall have in the driver's immediate pssessin charged, spare batteries fr use in case f battery failure. Any slid state LED lighting that cnsists f multiple LED lights shall nt have less than eighty-five percent (85%) f the LED lights in perable cnditin. At all ther times ne (1) red flag, at least eighteen inches (18'') square, made f clth, synthetic r man-made material, shall be s displayed.
