1 NOTICE OF REQUEST FOR QUOTATIONS FOR A NEW 10,000 LB GVW REGULAR CAB SINGLE REAR WHEEL TRUCK WITH CTEC 9 LONG GENERAL PURPOSE DUMP STAKE BODY NOTICE IS HEREBY GIVEN that the City of Bellflower will receive quotations for the purchase of one 10,000 Lb GVW Regular Cab Single Rear Wheel Truck with CTEC 9 Long General Purpose Dump Stake Body (the Truck). Quotations will be received at the City Hall Reception Desk, Civic Center Drive, Bellflower, California, until 4:30 p.m. on January 10, All quotations must be clearly marked, CITY OF BELLFLOWER 10,000 LB GVW REGULAR CAB SINGLE REAR WHEEL TRUCK WITH CTEC 9 LONG GENERAL PURPOSE DUMP STAKE BODY, and will be delivered during the business hours of 8:30 a.m. to 4:30 p.m., Monday through Friday, except holidays and those Fridays on which City Hall is closed, to the City Hall Reception Desk. POSTMARKS WILL NOT BE ACCEPTED. Failure of, or disturbances in any mail service is not a legitimate reason for quotations submitted after the above due date. Facsimiles will not be accepted. The City may extend the deadline at its option. Submit three (3) copies of your Quotation. It should be understood that the final fee will be negotiated with the City. All submitted quotations will be reviewed and analyzed by City staff and the quotations which best meet the City s needs will be selected for further analysis and negotiation. The City reserves the right, in its sole discretion during the selection process, to reject any or all quotations or any portion without exception or explanation. It shall conform in all respects to the State of California Vehicle Code, Division of Industrial Safety Order and/or O.S.H.A. Standard Section (Powered Industrial Trucks). All separate units shall be installed and connected for operation. Proposers shall furnish complete information on equipment they propose to furnish, including descriptive literature. 2.0 QUOTE SUBMISSION PACKET All Quotations must be based on the blank Quote Submission Packet included herein. All Quotations must include the proposed price and must be signed by the proposer with their address and contact information. 3.0 TAXES Proposers must state in their respective Quotations whether or not any tax, which may be assessed under any existing law, is or is not included in the price bid. If a proposer fails to make a statement with reference to taxes, their bid price will be considered as including any and all applicable taxes. 4.0 REJECTIONS The City reserves the right to reject any and all Quotations and/or items of any Quotation, and to consider the relative merits of the respective apparatus or equipment submitted, to be the sole judge of any such relative merits and the City will award the contract or purchase order for furnishing the apparatus or equipment best suited to meet the needs of the City. 5.0 QUOTATION SELECTION SCHEDULE The City intends to utilize the following planning chart for the timetable and process of evaluating Quotations. The timeline is subject to change at City s discretion. Release of Request for Quotations: November 21, 2018 Proposals due and received (by 4:30 PM): January 10, 2019 City Review of Quotations: January 11-17, 2019 Vendor Selection by: January 18, 2019 Approval of Purchase Order: January 25, ISSUANCE OF PURCHASE ORDER The successful Proposer will be issued a Purchase Order by the City.

3 Notice of Request for Quotations New 10,000 Lb GVW Regular Cab Single Rear Wheel Truck City of Bellflower Page 3 of DELIVERY The successful Proposer shall deliver the specified Truck within ninety (90) days after the Proposer receives the Purchase Order for said vehicle. The vehicle, all equipment, spare parts and supplies, shall be delivered Free-On-Board (FOB) destination, delivery charges prepaid and added, to the following location: 8.0 EQUIPMENT CONDITION City of Bellflower Public Works Department Maintenance Yard 9944 Flora Vista Bellflower, CA The components used shall be new and unused current production items, with standard factory fittings, trim and accessories unless otherwise noted. It shall not have been used for demonstration or any other prior service. 9.0 INSPECTION Proposer shall provide access for City s Contract Representatives to inspect components and assemblies at various times deemed necessary during the vehicle conversion process CARE AND CUSTODY The Proposer shall be liable for all loss or damage to the equipment while in its possession or the possession of any of its agents. Proposer shall reimburse the City for any loss or damage to said equipment in its or its agent s care or custody LIQUIDATED DAMAGES Time is a critical factor. If delivery is not completed by the time stated previously for delivery, Proposer acknowledges and agrees that such delay would seriously affect the public welfare and the operation of the City. Damages for such delay would be impracticable or extremely difficult to determine. The parties agree that the sum of $50 per day for each day of delay for the unit shall be fixed as liquidated damages (and not as a penalty or forfeiture of breach). Liquidated damages shall apply where delivery is delayed beyond the time stated and where delivery of materials to replace materials deemed substandard or nonconforming by the City is delayed beyond the time specified for such replacement. Liquidated damages shall not apply to the time between the date Proposer delivers the unit(s) and the date that the City notifies Proposer that City has rejected the units due to substandard or nonconforming materials. Should the successful Proposer be obstructed or delayed in the work required to be done hereunder by changes in the work

4 Notice of Request for Quotations New 10,000 Lb GVW Regular Cab Single Rear Wheel Truck City of Bellflower Page 4 of 5 or by any default, act, or omission of the City, or by strikes, dire, act of God, or by the inability to obtain materials, equipment, or labor due to Federal Government restrictions, then the time of completion shall be extended for such period as may be agreed between the City and Proposer. The City may, at the time of acceptance of the work, waive liquidated damages which may have accrued for failure to complete on time due to any of the above reasons after hearing evidence as to the reasons for such delay and making a finding as to the cause of the same TERMINATION OF CONTRACT TO PURCHASE If at any time, in the opinion of the City, 1) the selected Proposer fails to conform to the requirements of this contract; or 2) the selected Proposer seeks relief under any law for the benefit of insolvents or is adjudicated bankrupt; or 3) any legal proceedings are commenced against the selected Proposer which may interfere with the performance of the contract; or 4) the selected Proposer has failed to supply material of proper quality, or has failed in any other respect to execute the work with the diligence and force specified and intended in the terms of the contract, notice thereof in writing may be served upon the selected Proposer, and should the selected Proposer neglect or refuse to provide means for a satisfactory compliance with the contract as directed by the City within the time specified in such notice, the City in any case shall have the right and power, at its option and without prejudice to any right it may have, to terminate the contract. Any excess of the cost arising therefrom will be charged against the selected Proposer and his sureties, who will be liable thereof. In the event of such termination, all monies due to the selected Proposer or retained under terms of the contract shall be forfeited to the City; but such forfeiture will not release the selected Proposer or his sureties from liability for failure to fulfill the contract TITLE Title to the equipment/material shall pass to the City at the FOB point designated under Section 6.0 Delivery, subject to the right of the City to reject upon inspection ACCEPTANCE AND PAYMENT Acceptance shall be made at the time all equipment/material is operational and in proper working order as determined by and to the satisfaction of the City. Acceptance of the equipment/material shall be determined on the basis of technical completeness, performance and adherence to the operational requirements and functions of the specifications. The City s payment terms are net 30 days, and payment will be scheduled within thirty (30) days upon complete delivery and acceptance of the vehicle and all equipment and receipt of an original and one (1) copy of an invoice complying with the terms and conditions of the award. The City reserves the right to withhold up to ten percent (10%) of the purchase price in the event there is a conditional acceptance.

Non-compliance with any one of the following requirements shall constitute a conditional acceptance: 1. Adherence to the specifications 2. Reasonable opportunity for vehicle inspection by the City 3. Receipt of manuals 4. Receipt of warranty statement 15.0 COMPLIANCE WITH LAWS AND REGULATIONS All equipment, materials or services provided pursuant to these specifications shall be in compliance with the laws and regulations of the State of California and OSHA. The selected Proposer shall, if requested by the City, supply certification and evidence of such compliance DETAILED SPECIFICATIONS It is the intent of these specifications to describe a fully self-contained and functional 10,000 Lb GVW Single Rear Wheel Regular Cab Truck with a CTEC Nine (9) Foot Long Stake Bed Dump Body. The vehicle must meet all CAL-OSHA requirements in effect at the time of bidding. Any exceptions must be clearly spelled out. The life expectancy of this vehicle must be ten (10) years. Complete the attached Quote Submission Packet. Failure to complete all blank spaces will deem the vendor to not meet the minimum specifications.
