2 SECTION I. GENERAL CONDITIONS Union County is requesting bids for one (1) tandem axle dump truck. Any deviation from specifications must be clearly indicated on Section II Specification Form or attached. Costs must include all manufacturer charges including delivery to the Union County Transportation Garage, 610 Patton Avenue, Monroe, NC, and is the total invoice cost to Union County excluding taxes. Bids Bids must be made in conformance using the Invitation for Bid (IFB) forms provided herein. All blank spaces for bids must be filled in properly. Numbers must be written in ink or typewritten, and the completed form shall be without erasures, lineations, or alterations. In accepting the proposal, the County will assume that no alterations have been made, and if they appear afterward, they shall not be binding on the County. The vendor shall fill in the form as follows: If the documents are executed by a sole owner, that fact shall be evidenced by the word owner appearing after the signature of the person executing the document. If the documents are executed by a partnership, that fact shall be evidenced by the words Co- Partner appearing after the signature of the person executing them. If a corporation executes the documents, the documents must be executed in the corporate name by the president or vice-president of the corporation and the corporate seal must be affixed and attested by the secretary or assistant secretary. All names and titles must be typed or printed below the signatures. Application of North Carolina General Statutes The General Statutes of North Carolina regarding purchasing and competitive bidding (G.S ) are made a part herein and will govern the bidding process. Award of Contract The County reserves the right to reject any and all bids, the right to waive informalities, and the right to disregard nonconforming or conditional bids or counter proposals. If the contract is to be awarded, it will be awarded to the lowest responsive and responsible bidder, taking into consideration quality, performance and the time specified in the proposals for the performance of the contract. The County may award the truck purchase with or without including Option A in the contract, depending entirely on what the County considers to be in its best interests. The County shall have a period of 60 days after opening of bids in which to award the contract. A Purchase Order may serve as the contract for the purpose of this award. 3 Deviations Any deviations from specifications and requirements herein must be clearly pointed out by bidder. Otherwise it will be considered that equipment offered is in strict compliance with these specifications and requirements, and successful bidder will be held responsible therefor. Deviations must be explained in detail below or on an attached sheet. However, no implication is made by Union County that deviations will be acceptable. Bidder is advised that the response (or lack thereof) on this question does not take precedence over specific responses or non-responses provided elsewhere in this bid. Specifications The attached specifications and requirements are drawn around equipment, which the County has evaluated and determined that the size, construction, design layout, special features and performance are necessary. Several specifications pertaining to size, wheel cut and BBC length, are required to meet County requirements for truck use in tight quarters, such as culde-sacs. Bidders are requested to offer only equivalent comparable units, which will provide the features and performance needed and implied. Note Because of the differences between manufacturers in the design, materials and construction methods, the County reserves the right to evaluate all bids and to vary from these specifications when in its opinion, such variances is in the County s best interest. This includes the approval of substitutions by the bidder for one item for another as being equal in construction, performance and quality. The specifications and requirements described are to indicate certain features requested by the County and are in no way to be construed to be restrictive to eliminate any item or items which are necessary to provide a complete, safe and fully functional system. Delivery Charges FOB destination. The vendor to whom the contract is awarded shall be responsible for the cost of delivery for one (1) truck with body from manufacturer to 610 Patton Avenue, Monroe, NC IFB Expenses Expenses for developing the bids are entirely the responsibility of the vendor and shall not be chargeable in any way to the County. Modification or Withdrawal of Bids Bids may be withdrawn at any time prior to opening. All other withdrawals must be in accordance with the North Carolina General Statutes. Only written requests for the modification or correction of a previously submitted bid that are addressed in the same manner as bids and are received by the County prior to the closing time for receiving bids will be accepted. The bid will be corrected in accordance with such written requests, provided that any such written request is in a sealed envelope that is plainly marked Tandem Axle Dump Truck # Oral, telephone or fax modifications or corrections will not be recognized or considered. 4 Right of Cancellation Any contract agreement entered into with the County that requires ongoing payments after the end of the fiscal year in which the equipment is purchased is cancelable by the County in the event that continuing funds are not appropriated. Vendor Declaration The vendor must state that the bid was made without connection with any other person, company, or parties making a similar bid and that it is in all respects fair and in good faith without collusion and fraud. Disputes In case of any doubt or differences of opinion as to the items to be furnished hereunder, the decision of the County shall be final and binding upon both parties. Response to the IFB Submittals shall be sealed and labeled on the outside Tandem Axle Dump Truck # IFB s are to be received by the Union County, Procurement Division by 2:00 p.m., September 15, 2016 at which time and place they will be publicly opened. Mail or hand-deliver submission packets to: Union County Government Building Administrative Services, Procurement Division 500 North Main Street, Suite #709 Monroe, NC Attention: David Shaul, Procurement Specialist The vendor shall complete the enclosed Specification Form (Section II) and Bid Form (Section III). Vendor shall exclude from the bid amount applicable North Carolina sales tax. Electronic ( ) or facsimile submissions will not be accepted. There is no expressed or implied obligation for Union County to reimburse firms for any expenses incurred in preparing bids in response to this request. All bids submitted in response to this request shall become the property of Union County and, as such, may be subject to public review. Questions regarding the request for bids shall be in writing and directed to David Shaul via e- mail to: david.shaul@unioncountync.gov. 5 Addendums Should a proposer find discrepancies or omissions in this RFP or any other documents provided by Union County, or should a proposer have questions about or need clarification of this RFP, the proposer should immediately notify the County in writing via as noted above. General The purpose and intent of this specification is to describe a tandem axle dump truck suitable for work within the Union County Public Works Department. The truck shall be the latest standard new production model at the time of delivery. The truck with dump body shall conform to the minimum specifications listed below. All parts and attachments not specifically listed, but which are necessary to furnish a complete ready-to-work unit, shall be provided. All manufacturers standard equipment for the model quoted shall be provided. Truck must be delivered complete to Union County.
