EXECUTIVE SUMMARY The Government of India (GOI) through Ministry of Shipping Road Transport & Highways (MOSRT & H) is contemplating to enhance the traffic capacity and safety for efficient transportation of goods as well as passenger traffic on the heavily trafficked National Highways. The Government of India had entrusted National Highways Authority of India (NHAI) for the development, maintenance and management of National Highway No.205 including section from Km to Km (63.23 Km) in the state of Andhra Pradesh and from Km to Km (61.47 Km) in the state of Tamil Nadu. In order to provide a better level of service to the vehicular traffic and to augment the capacity of NH 205 by widening the existing 2 lane to 4 lanes divided carriageway facility including strengthening of the existing 2 lane, it has been decided to carry out the works on Design, Build, Finance, Operate and Transfer (DBFOT) Toll Basis Under NHDP, Phase- III. 2. SCOPE OF THE PROJECT The scope of the project shall include the following during the concession period: Construction of the project highway on site as set forth in Schedule A and as specified in Schedule B together with provision of Project Facilities as specified in Schedule C and standards as set forth in Schedule D of the Concession agreement. Operation and Maintenance of the project highway in accordance with the provisions of the concession agreement. Performance and fulfillment of all other obligations in accordance with the provisions and matters incidental thereto or necessary for the performance of any or all of the obligations of the concession agreement by the Concessionaire. 5 3. PROJECT MILE STONES (SCHEDULE-G) 1 st Mile Stone: 180 days from appointed date i.e % of the Project Cost Rs Crores. MILE STONE ACHIEVED Comment of IE: Expended Rs. 65 Crores (11.38%) Crossed the mile stone. 2nd Mile Stone: 365 days from appointed date i.e % of Project Cost Rs. 200 Crores, shall have started all bridges. MILE STONE NOT ACHIEVED Comment of IE: Expended Rs.217 Crores (38%) but works on some bridges yet to start. 3 rd Mile Stone: 640 days from appointed date i.e To be expended 70% of the Project Cost i.e. 400 Crores and shall have commenced all Project facilities. MILE STONE NOT ACHIEVED Comment of IE: Crossed the 3 rd Mile stone. Expended Rs. 500 Crores (87.56%) upto December 2012 but all project facilities yet to start as per schedule-c of Concession Agreement. Scheduled Two lane with Paved Shoulders/Four-Laning Completion Date: The Scheduled Four Laning date i.e., shall occur on the [910 th (Nine Hundred and Ten) day from the appointed date. On or before the Scheduled Four laning date, the Concessionaire shall have completed Four laning and also the sections where two lane with Paved Shoulders are allowed in accordance with this agreement. Comment of IE: Completion date crossed-mile STONE NOT ACHIEVED Extension of Time (EOT) : The EOT is granted upto excluding the stretches where making available unencumbered land is delayed due to land Acquisition or Court Intervention where the work will be completed within 12 months from the date of such unencumbered land made available. However, there shall be no extension in Concession Period on account of this extension of time and it shall remain as 30 years from the Appointed Date i.e. from to [IE s MPR, March ] Page 2

GFC drawings are to be submitted by the Concessionaire duly attending to these comments. Pending with the concessionaire. (2) CEI-Pj/NHAI/ /Design/551, dt: The IE has reviewed the designs and drawings for super structure and returned the drawings to the Concessionaire with remarks marked in Red. GFC drawings are to be submitted duly attending to the comments. Pending with the Concessionaire. Page 14

The Concessionaire states that the project site is more than 15 km. away from sea coast and hence the same is not required. 2 Major bridges at Ch and 310x095 were approved by the PD and the same are adopted here also. It is stated that the reason for not considering the same were explained in the meeting from to The cross section provided are as per the drawings approved by the PD for Major bridges at and Service roads not shown as they are not approved. Status of Review by Head office (1) The IE vide Ltr.No. CEI- Pj/NHAI/ /Design/0443, dt: has reviewed the Designs and drawings for substructure and foundations and returned the same to the Concessionaire with comments marked in RED. GFC drawings are to be submitted by the Concessionaire duly attending to these comments. Pending with the concessionaire. (2)CEI-Pj/NHAI/ /Design /551,dt: The IE has reviewed the designs and drawings for super structure and returned the drawings to the Concessionaire with remarks marked in Red. 37 8.6 Method Adopted in Construction. The method of construction adopted is being regularly checked and reviewed by the IE duly conducting field and laboratory tests on compaction and whether materials used are in compliance with specifications and standards. IE regularly checking the works through RFI s raised by Concessionaire. IE attending minimum 10% RFI s for checking the works. 8.7 Conformity of Construction Works The source of materials used for construction works are being regularly checked by IE for conformity with the specifications and standards. Routine checks are being regularly conducted by the IE field team. The Team Leader and Key Personnel have also attended some tests like Concrete Cube strengths testing, Core thickness, Gradations, Bituminous Extractions tests etc. during their site visits. Castings of RCC/PSC girders are in progress at bridge locations and regularly inspected by IE field team. 8.8 Defects and Deficiencies The IE supervising staff are regularly visiting site and Laboratory. Any major defects in respect of materials/construction when noticed are being reported in the MPR.

Maintenance of the Existing 2- lane highway The Competent Authority of NHAI has approved the proposal for handing over the Existing Lanes of Bypassed stretches of NH-205 in the State of Tamil Nadu to Highways Deportment, Govt.of Tamil Nadu and the same has been Complied by PD,PIU,NHAI.vide Letter no NHAI/18011/97X/09/ PIU. Chennai/698 dt The Authority vide Lr.no.NHAI/18011/97/PIU.Chennai/2316 dt informed the Superintending Engineer (R&B), Chittoor Circle that the Existing old Vadamalapeta Road was deemed to be handed over to R&B Dept. with effect from as the traffic is plying on the bypass road. Regarding the balance existing stretches, proposals are awaited from Concessionaire for handing over to R&B Dept. Govt. of AP Road Accident Report Concessionaire is neither obtaining Accident occurring Reports from Police Stations nor submitting to IE in FIR reporting format. 61 15. COMMENTS OF TEAM LEADER: 1. Progress: The cumulative financial progress reported by Concessionaire up to March is % (Rs Crores). Break up details are not submitted by the Concessionaire in spite of several reminders. Concessionaire completed Kms (80.85%) of and Kms (79.60%) of. Concessionaire commenced and completed the Service Road Works up to level (Not covered in CA but recommended by IE to the Client as Change of Scope for an extra width of Thiruchanoor VUP at Ch Puttur VUP at Ch Punch list items: There is no initiative from Concessionaire for commencement of punch list items. Regular pursuation with Concessionaire vide Letter no CDM/CEI/ /865 dt and CEI- Pj/NHAI/TRP/ /2015/ 1265 dt does not yield any result. An amount of Rs 3,42,60,000/- is worked out towards recovery of damages from the Concessionaire for the period from to ie for 120 days which period is allowable, beyond the initial period of 90 days as per Clause of CA and reported to the Authority vide lr.no CEI-Pj/ NHAI/TRP/ /2015/1351 dt with a request to recover damages from Concessionaire and also to issue an intention of Termination Notice to the Concessionaire under Clause of CA. As no notice was issued to the Concessionaire, the Authority was once again requested to take necessary action against the Concessionaire vide Lr.no CEI-Pj/ NHAI/TRP/ /2015/1370 dt Since there is no response from the Concessionaire for commencement of Punch list items, and also as no action is taken by the Authority against to Concessionaire an amount of Rs8,82,19,500/- is worked out towards damages for the Period from to ,for not complying the Punch list items beyond the admissible period and informed the Authority to recover the damages from the Concessionaire vide Lr no CEI-Pj/ NHAI/TRP/ /2016/1469 dt In addition to it, the IE strongly recommended to the Authority to issue Termination notice to the Concessionaire. 3.Non Submission of MPRs: Concessionaire stopped submission of MPRs since July There is no response to IE s Letter no CEI-Pj/NHAI/TRP/ /2014/1082dt , Letter no CEI-Pj/NHAI/TRP / /2015/1220 dt and Letter no CEI-Pj/NHAI/TRP/ /2015/ 1235 dt and Letter.no CEI-Pj/NHAI/TRP/ /2015/ 1286 dt ,cei-pj/nhai/ TRP/ /2015/1321 dt ,cei-pj/nhai/trp/ /2015/1342.dt , CEI-Pj/ NHAI/TRP/ /2015/1356.dt ,CEI-Pj/NHAI/TRP/ /2015/1376.dt , CEI-Pj/NHAI/TRP/ /2015/1386.dt , CEI-Pj/NHAI/TRP/ /2016/ dt , CEI-Pj/NHAI/TRP / /2016/ dt ,CEI-Pj/NHAI/TRP / / 2016/1446. dt and CEI-Pj/NHAI/TRP / / 2016/1470. dt Authority is requested to direct the Concessionaire for submission of same to the IE. 4. Non-Closure of NCRs: 15 Nos. are still pending for closure by Concessionaire. Even though sufficient time lapsed, there is lukewarm response from the Concessionaire for attending to the same.

62 5.Utility Shifting: Concessionaire reported that Utilities Shifting is to be done in some stretches and Land Acquisition is to be done by NHAI in some stretches. Both activities are kept in progress by NHAI & Concessionaire. 6. Extension of Time: Concessionaire has submitted representation for Revision of Mile Stones and for completion of works. Details were called for by IE vide Lr.no CEI-PJ/NHAI/TRP/ /2013/ 792. dt Concessionaire has submitted the desired details for Revision of Mile stones and Interim Extension of time vide Lr.no:TTTCTPL/SPV/Milestone/2014/685.dt: for 719 days i.e., up to IE recommended interim EOT for 384 days ie., up to vide Lr.no.CEI- Pj/NHAI/TRP / /2014/995.dt duly considering the delays attributable to Authority for not handing over of the land within 90 days from the appointed date. The EOT is granted upto excluding the stretches where making available unencumbered land is delayed due to land Acquisition or Court Intervention where the work will be completed within 12 months from the date of such unencumbered land made available. However, there shall be no extension in Concession Period on account of this extension of time and it shall remain as 30 years from the Appointed Date i.e. from to Change of scope: IE recommended the COS for service roads with rough cost estimate to Authority vide letter No. CEI-Pj/NHAI/TRP/ /2014/812 dt authority vide letter no. NHAI/1801/97/09/ PIU. Chennai/2952 dated sought clarifications on this issue. Replies submitted to Authority vide Lr.No: CEI/CDM/ /1275 dated: duly recommending for an extra width of 1.50M Service Road as COS. Regarding junctions COS, compliance to be received from Concessionaire. Regarding Major Bridges, Minor Bridges, VUP and Box Culverts COS, the proposals are not tenable. Hence not recommended duly informing to Authority vide letter no: CEI- Pj/NHAI/TRP/ /2013 /743 dt: The Project Highway crosses the State Highway (SH 57) which is 4 lane width at Km Hence it is proposed to increase the span length of VUP at Km from 11.60m to 25.00m.Net financial implication involved due to increase in length of span and also for providing extra width of 1.50m of Service road worked out to Rs.3.59 Crores and the Authority vide Lr.no. CEI/CEI/ /1497dt: was informed to consider the same under Change of Scope to the Concessionaire. Based on the representation of Public of Ayathur Village and also due to necessity, one VUP at Km costing about Rs Crores was reported to the Authority vide Lr.no. CEI-Pj/NHAI /TRP/ /2016/1417 dt: On the representation of Public of Veppampattu Panchayat and also due to necessity, one PUP at Km costing above Lakhs was reported to the Authority for considering it under change of Scope vide Lr.no. CEI-Pj/NHAI/TRP/ /2016/ 1418 dt: During site visit on by Chairman, NHAI, New Delhi, it was orally directed to initiate proposals for construction of VUP at Km ie., near KLM Junction. It is costing about Rs Crores (approximately) and report was submitted to the Authority vide Lr.no. CEI-Pj/NHAI/ TRP/ /2016/1442 dt: As per directions of PD, PIU, NHAI, Chennai, a report was submitted to Authority for Construction of Km vide this Office Lr.no CEI-Pj/NHAI/ TRP/ /2016/1465 dt: under COS.

63 8.Provisional Completion Certificate: Authority conveyed In-principle approval of Executive Committee (EC) during 196 th meeting on at Delhi vide letter no:nhai/18011/97/piu.chennai/1900 dated: for issue of PCC for the completed operational length of Km(76.97%) only subject to completion of balance works listed in Annexure-A. Concessionaire has completed all balance works. IE issued the recommendation for issue of Provisional Completion Certificate vide letter no: CDM/CEI/ /806 dt: Authority conveyed to IE for issue of Provisional completion Certificate vide Lr.no. NHAI/18011/97/09/PIU.Chennai/555 dt and IE issued Provisional Certificate vide Lr.no. CDM/ CEI/ /865 dt Tests: No test were conducted for Construction items during the month due to no progress. 10. Design & Drawings: The status of Review of Designs & Drawings furnished by IE Head Office & Site office are given vide page numbers from GFC drawings, Cross sections and Compliance to IE s comments are pending since a long time. Concessionaire failed to submit the same in time. 11. Force Majeure Event: Force Majeure Event notice has been given by Concessionaire vide Lr.no.. TTTCTPL/SPV /Bandh/2013.dt However, the Concessionaire has been informed to furnish the details as per the requirements of CA vide Lr.no CEI-PJ/NHAI/TRP/ /2013/706. dt details are awaited. Concessionaire vide Lr.no TTTCTPL/SPV/Toll Operations/2015/821,dt received in the office on reported, about stoppage of Toll operations by local Public at Toll Km without following the procedure setback for Force Majeure Event vide Clause of CA. 12. Road Safety: Concessionaire has not submitted Compliance for RSC observations for Work Zone Audits Oct-2011 to May-2014 (Total #10 Audit reports) and Accident Analysis report 2 audit reports. M/s HAKS RSC conducted Comprehensive Road safety Audit in PCC stretches on and submitted the report vide Lr no NHAI/18011/97/09/PIU. Chennai/112,dt IE submitted the observations on RSC Audit report to Authority vide Lr.no CEI-Pj/NHAI/ TRP/ /2015 /1197,dt Concessionaire submitted the compliance report on audit vide Lr.no TTTCTPL/SPV /Safety Report/2015/815, dt IE forwarded the Concessionaire compliance report on Safety Audit with IE comments to Authority vide Lr.no CEI-Pj/NHAI/TRP/ /2015 /1209,dt IE vide Mail dt has informed the Concessionaire to submit detailed report regarding compliance on the observations made by M/s HAKS, Road safety consultant vide Lr.no. 2015/HAKS/CSAR#F/RSC_39/NHAI/2625.dt But till today the Concessionaire has not submitted action taken report. IE vide Lr.no.CEI-Pj/NHAI/TRP/ /2015 /1209,dt /1264.dt has informed the Concessionaire that one Black spot exists at Km (Curve Portion) in TN section and requested to take up remedial action to avoid Accidents. But there is no response from the Concessionaire till to date.

64 IE and Concessionaire conducted the 27 th Road Safety week 2016 successfully in the Project Highway with slogan of Road Safety Time for Action The report with all activities conducted during celebration submitted to Authority vide Lr.no. CEI-Pj/NHAI/TRP/ / 2016/1419, dt CGM (PQ) Compliance Testing: Concessionaire conducted the tests for, layers by extracting cores and by collecting sample through the agency engaged Anna University, Chennai on in compliance to CGM (PQ) observations during their visit on Oct Test Report was submitted by Concessionaire to IE for review. IE forward the test reports to Authority vide Lr.no. CEI-Pj/NHAI/TRP/ /2014/1168 dated for necessary action. 14. ETC Lanes, WIM, Static Weigh Bridge: CGM (RO) Chennai conducted meeting at Chennai on regarding provision and implementation of ETC lanes at Toll Plazas. Concessionaire is directed to provide ETC lanes, WIM at each lane and Static Weigh Bridge vide IE Letter no CEI-Pj/NHAI/TRP/ /2014/1085 dated ETC lanes work not started in AP&TN section so far. Regarding non provision of weigh in motion systems in each lane, a detailed Justification Report was submitted to Authority vide Lr.no.CEI-Pj/NHAI/TRP/ /2014/1182 dated Inspite of continuous pursuation, Concessionaire is not coming forward for completion of ETC Lanes, Weigh in Motion Systems in all lanes (4nos provided in AP section but not functioning) and installation of Static Weigh Bridges 2 nos. in AP section and 2 nos. in TN section. Concessionaire was informed about Non functioning of 4 Nos. WIM at Toll Plaza at Km and Non functioning of 2 Nos. Static Weigh Bridges at Temporary Toll Plaza at vide Lr.no.CEI-Pj/NHAI/TRP / /2016/1406 dated But, there is no response from the Concessionaire. 15. Traffic Aid Posts/Vehicle Rescue Posts/Mobile Police Squad/Highway Patrol Units/Cranes and Medical Aid Posts : As per Article 20 & 21 of CA, Concessionaire is directed to provide Traffic Aid Post, Medical Aid Post, Vehicle Rescue Post, Mobile Patrol Squads, Cranes vide IE Lr.no. CEI-Pj/ NHAI/RP/ /2014/1083 dated & IE Lr.no. CEI-Pj/NHAI/ TRP/ /2014/ 1084 dated Temporary Posts for Traffic Aid, Medical Aid are completed at AP & TN Toll plazas. Concessionaire mobilized 2 nos Route Patrol Vehicles,2nos Ambulances and 2 nos Cranes at Toll plazas on the date of PCOD. O&M centre also made available at the base camp Km at AP Section. Concessionaire not taken any action for replacement of substitute Vehicle provided in TN section with Standard Route Patrol Vehicle as pointed out vide our Lr no CEI-Pj/NHAI/TRP/ /2015/1308 dt Crane is not available at Temporary Toll Plaza at Km and hence a report was submitted to Authority vide this Office Lr.no CEI-Pj/NHAI/TRP/ /2016/1475 dt to issue notice to the Concessionaire. 16. Maintenance of PCOD stretches, Existing lanes, Diversion roads, etc., Concessionaire stopped all maintenance activities and no machinery and no Maintenance Manpower is available at site. There is no response from the Concessionaire to the notices served by IE and to the instructions issued during site visits except attending some minor repair works in half way condition during the periods from to and from to , from to , from to , from to , from to ,from to , from to , from to , and that too not to the specifications.

65 17. Flood damages in the month of November and action taken by Concessionaire during March : Due to heavy and uninterrupted rains from 14 th to 16 th of November, the existing old Major Km and the existing old Cause Km were over flown with flood water and the traffic was completely stopped on & After receding of flood water, it is observed that many of the vents of Bridge & Causeway were blocked with large bushes and parapet walls of the Bridge and Cause way were washed away for a length of 4M and 24.00M respectively. Wearing coat over the deck slabs of these structures was damaged at some places. The District Administration has informed the Concessionaire not to allow traffic on the Km till furnishing of Assurance Certificate by the Authority to the effect that this Bridge is fit to allow traffic. Hence, traffic was diverted to ply from Km.25/6 to Km.343/6(Arakonam Junction) via Thiruvalangadu. As per the arrangement made by the Concessionaire Mr.Nageswara Rao, Professor, IIT, Chennai has inspected the Bridge on The Professor has given report on recommending for plying of vehicular traffic over the Bridge as no damage occurred to the Bridge and the Bridge is in sound condition. Based on the recommendation of the Professor, traffic was restored with effect from Am on However due to sudden release of flood water from Ammapalle tank near pallipattu on upstream side, these structures were again over flown on and the traffic was stopped. The flood water receded at 9.00 AM on and as per the instructions of the District Administration, only Light vehicles were being allowed over these 2 structures. All types of vehicles are allowed since During the rainy period, nowhere in the AP & TN sections of Project Stretch, Highway breached except formation of Pot Holes and also except at the above 2 locations, traffic was not interrupted at any other place. Due to heavy rains, the sides of deep cut portions from Km to Km were collapsed and earth was fallen on MCW and affected the free passage of traffic. Earth on MCW and Shoulders was removed and traffic restored. Slope protection works are not yet attended. Minor erosions in the berms and slopes of the embankment occurred at some places and the same are yet to be attended by Concessionaire. The Concessionaire attended reconstruction of damaged parapet walls for the Bridge and Causeway. Patches in the damaged portions of wearing coat are not yet attended by Concessionaire.
