N. 201 Third Revised Page N. 19Z.8 Canceling Secnd Revised Page N. 19Z.8 ACT 129 COMPLIANCE RIDER - PHASE 1 The Phase 1 Act 129 Cmpliance Rider (ACR 1) shall be applied, n a nn-bypassabie basis, t charges fr electricity supplied t custmers wh receive distributin service frm the Cmpany under this Tariff. The Rider will be implemented by applying a charge t bills f custmers beginning January 1, The ACR 1 shall be cmputed separately fr each fthe fllwing three custmer classes: (1) Residential: Cnsisting f Rate Schedules RS and RTS (R), (2) Small Cmmercial and Industrial (Small C&l): Cnsisting f Rate Schedules GS-1, GS-3, IS-1 (R), BL, SA, SM (R), SHS, SE, TS (R), Sl-1 (R), and GH-2 (R), and (3) Large Cmmercial and Industrial (Large C&I): Cnsisting f Rate Schedules LP-4, LP-5, LPEP, and LSS. The ACR 1 will be cmputed fr each custmer receiving distributin service frm the Cmpany using the frmulae described belw. Fr residential custmers, the ACR 1 charge shall be included in the distributin charges f the mnthly bill. Fr all ther custmers, the ACR charge shall be listed as a separate charge n the mnthly bill. All charges shall be recnciled n an annual basis fr undercllectins and vercllectins experienced during the previus year. Charges set frth in the residential rate schedules in this tariff have been adjusted t reflect applicatin f the currently effective ACR 1. The ACR 1 fr the Residential class and the Small C&l class shall be cmputed using the fllwing frmula: ACR 1 = [ACc/S - E/S] X 1 / (1-T) The ACR 1 fr the Large C&l class shall be cmputed using the fllwing frmula: Where: ACR 1 = [ACc/D - E/D] X 1 / (1-T) (C) ACc = A levelized annual budget f all csts required fr the Cmpany t implement its Cmmissinapprved Phase 1 Energy Efficiency and Cnservatin (EE&C) Plan during a cmpliance year. A cmpliance year is the 12-mnth perid beginning June 1 f each calendar year and ending May 31 f the fllwing calendar year, except the first cmpliance year which begins n January 1, 2010 and ends n May 31, The levelized annual budget amunt is the sum f all direct and indirect csts (including all deferred design and develpment csts, general administrative csts, and applicable statewide evaluatr csts) required t implement the Cmpany's EE&C Plan divided by the number f mnths during which the Cmpany's EE&C Plan will be in effect multiplied by the number f mnths in the cmpliance year. The csts f each EE&C prgram available t nly ne custmer class will be directly assigned t that custmer class. Csts f EE&C prgrams which cannt be directly assigned t ne custmer class will be allcated t the custmer classes benefiting frm thse prgrams using an allcatin factr determined by dividing the EE&C csts directly assigned t each custmer class by the ttal fthe Cmpany's EE&C Plan csts directly assigned t all custmer classes. The ttal Pennsylvania grss receipts tax rate in effect during the billing perid, expressed in decimal frm. The ACR 1 shall be filed with the Pennsylvania Public Utility Cmmissin (Cmmissin) by May 1 (C) f each year. The ACR 1 charge shall becme effective fr distributin service prvided t all custmers n r after the fllwing June 1, unless therwise rdered by the Cmmissin, and shall remain in effect fr a perid f ne year, unless revised n an interim basis subject t the apprval f the Cmmissin. Upn determinatin that a custmer class's ACR 1, if left unchanged, wuld result in a material ver r undercllectin f Phase 1 Act 129 Cmpliance csts incurred r expected t be incurred during the cmpliance year, the Cmpany may file with the Cmmissin fr an interim revisin f the ACR 1 t becme effective ten (10)) days frm the date f filing, unless therwise rdered by the Cmmissin. At the cnclusin f the Phase 1 EE&C Plan n May 31, 2013, cllectins under the ACR 1 fr (C) each custmer class will be recnciled t the ttal cst f the EE&C Plan allwed by the Cmmissin fr that custmer class. Overcllectins r undercllectins will be reflected in the E factr, defined abve, and will be refunded r recvered thrugh applicatin f the ACR 1 E factr thrugh May 31, Ifany ver/under cllectin balance remains after May 31, 2014, the cllectin perid may be extended beynd May 31, 2014 t ensure the balance is eliminated. Minimum bills shall nt be reduced by reasn f the ACR 1, nr shall charges hereunder be a part f the mnthly rate schedule minimum. The ACR 1 shall nt be subject t any credits r discunts. The State Tax Adjustment Surcharge (STAS) included in this Tariff is applied t charges under this Rider. Charges under ACR 1 and ACR 2 will be cmbined fr billing purpses nly. The Cmpany shall file a reprt f cllectins under the ACR 1 within thirty (30) days fllwing the (C) cnclusin f each cmpliance-year quarter. These reprts will be in a frm prescribed by the Cmmissin. The third-quarter reprt shall be accmpanied by a preliminary frecast f the ACR 1 fr the next cmpliance year. Applicatin f the ACR 1 shall be subject t review and audit by the Cmmissin at intervals it shall determine.
