STATEMENT OF THE CASE c ^ The Cniissin published in the Pennsylvania Bulletin dated Octber 19, 2013 a Prpsed Ruleaking Order t: (1) eliinate the vehicle list requireents fr taxis and liusines in Sectins (c) and (d); (2) eliinate the waiver exceptin fr vehicle age liitatin fr taxis in Sectin (d); and (3) replace the vehicle age liitatin fr liusines in Sectin (e) with a vehicle ileage liitatin. The publicatin ntice invlving the Prpsed Ruleaking Order prvided that written cents had t be subitted within 30 days fr the date f publicatin, which wuld be by Nveber 18,2013. These Cents are being filed n behalf f Classic Liusine Transprtatin, LLC (hereinafter "Classic Liusine") in ppsitin t (3) abve invlving replacing the vehicle age liitatin fr liusines in Sectin (e) with a ileage liitatin f 200,000 iles. This prpsed change shuld be rejected.

FACTS INVOLVING CLASSIC LIMOUSINE Classic Liusine has ffices lcated at 1001 Third Avenue, Craplis, PA Classic Liusine was first certificated t prvide liusine service n Nveber 26, Classic Liusine perates sedans, as well as SUV's (seating capacity f 5 r 6 passengers) and larger liusines and ther larger vehicles at that facility. Classic Liusine keeps its vehicles in tp perating cnditin. Classic Liusine serves any crprate accunts, sprts teas and entertainent accunts. They are very happy with its fleet and service. Classic Liusine's fleet is clean and well aintained. It has a full tie echanic that des a cplete safety inspectin, il change, tire rtatin r replaceent etc. n all vehicles in its fleet every 4,000 iles. III. POSITION OF CLASSIC LIMOUSINE The Cissin's Prpsed Ruleaking Order wuld replace the vehicle age liitatin with a vehicle ileage liitatin f 200,000 iles. It is respectfully subitted that this change wuld have a draatic adverse effect n existing liusine cpanies, including Classic Liusine, particularly in cnnectin with the use f sedan liusines and SUV's, which are used n a daily basis priarily fr repeat custers. Larger cpanies that have big crprate accunts accuulate a lt f iles n a yearly basis. Classic Liusine's fleet has 6 sedans and SUV's that either have r will sn have 200,000 iles. Having t eliinate these vehicles culd put Classic Liusine ut f business.

4 Classic Liusine seties has had safety prbles with vehicles that were brand new and/r had lw ileage. It is nt just higher ileage vehicles that can have prbles. Classic Liusines believes that a well aintained vehicle in its industry can run safely at least up t at least 300,000 iles. Classic Liusine wuld have n issue with a 300,000 ile liitatin but believes the pssibility f a 200,000 ile liitatin will nt nly jepardize Classic Liusine and the alst 50 ffice staff and drivers currently wrking fr it but a lt f ther gd cpanies and their staff. Classic Liusine bjects t the ileage liitatin f 200,000 iles insfar as it applies t sedans and SUV's since thse are subject t higher ileage. Classic Liusine averages apprxiately 50,000 t 60,000 iles per year n each f its sedans and 40,000 t 50,000 n each f its SUV's. If the 200,000 ile liitatin were applied t sedans and SUV's, Classic Liusine wuld have t replace the sedans and SUV's n average every 4 years r less. This is nt ecnically feasible and des nt ake sense since any f the sedans and SUV's have a uch lnger useful life than 200,000 iles. IV. ALTERNATIVE PROPOSAL If the Cissin is cnvinced that a ileage liitatin is required, Classic Liusine suggests that the ileage liitatin shuld be at least 300,000 iles.

5 V. CONCLUSION Fr the reasns set frth herein, the prpsed change t replace the vehicle age liitatin fr liusines with a ileage liitatin f 200,000 iles shuld be rejected.
