3 DECISION NOTICE & FINDING OF NO SIGNIFICANT IMPACT EARLY SUCCESSIONAL HABITAT IMPROVEMENT USDA FOREST SERVICE, CHEQUAMEGON-NICOLET NATIONAL FOREST Ashland, Floence, Foest, Oconto, Pice, Sawye and Vilas Counties, Wisconsin Intoduction and Backgound Fom mid-1980 though ealy 1990 the foest and its wildlife consevation patnes identified a need to povide specific aeas of habitat on the Foest that would suppot ealy successional species, povide public demonstation aeas to display that habitat management and povide outdoo eceational oppotunities to the public. A numbe of sites wee identified, mapped, and established in coopeation with the Ruffed Gouse Society that became known as Ruffed Gouse management Aeas, o RGMAs. Young stages of ealy successional habitat (ESH) povide habitat to a ange of game and non-game wildlife species alike. It was ecognized that such stages of ESH ae vey shot-lived and tansient on the landscape, but could be maintained at desied levels by fequent management. The Foest in concet with its consevation patnes, set out to intensively manage these aeas to povide habitat fo focal species of concen. Both the 1986 Foest Plan and its 2004 evision ecognized the impotance of ealy successional habitat in poviding the desied divesity of habitat on the Foest (1986 CNF Plan pp IV-106 thu -116 and Appendix B-5; 1986 NNF Plan S&G p 67 and MA 1 p 87; and 2004 CNNF Plan p 2-15). In an effot to povide ealy successional habitat on a sustainable basis, the Foest patneed with the Ruffed Gouse Society. Numeous suitable locations acoss the Foest wee evaluated and ove fouteen aeas identified to establish RGMAs. At that time, management actions wee used by the Foest to ceate and impove ealy successional habitat. Howeve, afte the initial establishment and teatment in these aeas, little action has been taken to maintain age divesity ove the last decade. Since initial actions, species such as goldenwinged wable, Ameican woodcock, and to a lesse degee uffed gouse populations began a decline acoss thei anges, attibutable to lage scale loss of ESH. Age divesity is key to quality habitat. A matix of young ESH is impotant as keeping ESH poductive and thifty, and functions to maintain the desied foest species mix in each RGMA. Cuently a numbe of ESH species ae dominated by stands too old to maintain this divese matix. Rapid changes ae occuing in the RGMAs and thee is a need not only to initiate immediate teatments now, but to schedule easonably foeseeable futue teatments to insue habitat needs continue to be met. Impoving ESH on the Foest is impotant because its quality and amount is declining aound the Foest; these declines wee descibed in ecently completed Monitoing and Midtem Evaluation Repot (pp. 48, ), available online at: Declining tends in quantity of ESH ae seen thoughout nothen Wisconsin, as well as acoss the ange of seveal migatoy bid species in the Geat Lakes that utilize this habitat fo all o significant potions of thei life cycle. Thee Foest Plan goals suppot ou need to impove ESH on the Foest scale and fou National Consevation Plan goals suppot ou need to impove ESH as pat of a shaed landscape scale:

4 Thee Foest Plan Goals Plan Goal 1.4- Povide teestial ecosystems in a healthy, divese, and poductive condition to suppot the divesity of plant and animal communities and tee species. Plan Goal 1.5 Conseve habitat capable of suppoting viable populations of existing native and desied non-native species, and etain the integity and function of key habitat aeas. Plan Goal 2.7- Conseve habitat capable of suppoting state population objectives fo appopiate wildlife and fish species. Fou National Consevation Plan Goals Noth Ameican Woodcock Consevation Plan Goals (Wildlife Management Institute, 2008) ecove populations to 1970 s levels by sustaining and if possible inceasing aspen/bich and associated shub habitat in Bid Consevation Region 12. Uppe Geat Lakes Woodcock and Young Foest Habitat Landscape Initiative Goals (WMI and USFWS 2008) to sustain cuent and incease ealy successional foest habitat to ecove Ameican Woodcock to 1970 s population levels. Noth Ameican Ruffed Gouse Consevation Plan Goals(Association of Fish and Wildlife Agencies, 2006) to maintain male uffed gouse dumming density in Bid Consevation Region 12 by sustaining cuent and inceasing ealy sucessional foest habitat fo this species. Uppe Mississippi/Geat Lakes - Landbid Consevation Plan Goals (US Fish and Wildlife, 2007) to impove populations and habitat conditions fo Joint Ventue Focal Species including the Ameican Woodcock and Golden Wing Wable. Decision Based upon my eview of the envionmental issues, the effects to each issue, a compaison of easonable altenatives, and consideation of comments fom the public and othe agencies; I have decided to implement Altenative 2 as descibed within the ESHI Envionmental Assessment. Altenative 2 would manage twelve of the Foest s fifteen RGMAs, poviding up to 6,200 aces of young foest and shub habitat, maintain 145 aces of upland wildlife openings and impove steamside conditions on 350 aces bodeing tout steams and scenic ives. The majoity of these impovements will be though timbe havest. A table and map identifying site-specific actions in my decision is attached (Attachments A and B). I selected this altenative to implement because it made the geatest inoads to achieving the pupose and need while having no substantial impacts to envionmental issues of concen. It esponds best to public and othe agency wildlife concens fo impoving ESH species abundance and suppoting eceational hunting oppotunities. Based upon the comments I eceived on this poposal, thee is vey stong local and egional concens about the condition of ESH on the Foest. Although not a pat of ESHI s pupose and need, Altenative 2 best esponds to concens of affected counties and towns in its ability to povide a flow of timbe goods and sevices to local communities, suppoting economies and lifestyles in a time of national economic ecession. 5 decision would be implemented in thee enties ove about a 15-yea time peiod, poviding a long-tem flow of foest poducts locally. As mentioned in the backgound section above, ESH is a vey tansient and dynamic habitat condition. Changes away fom desied condition ae occuing ight now. I intend my decision to be somewhat adaptive by my bounding of the aces by using up to teminology. Fom my eview of the EA document it was clea that changes ae occuing apidly in a numbe of olde ESH stands and featues. Teatment modifications ae likely by the time of actual implementation in ode to meet the stand objectives identified in the EA. Fo example, many bich stands ae so old that the options fo seed tees ae cuently maginal and may disappea befoe implementation. Anothe silvicultual system may need to be employed to meet stand egeneation objectives. Futhe, some aeas poposed fo alde sheaing may no longe be suitable due to loss fom ove-matuity. In my decision, defeal o mino vaiations of the silvicultual system used to egeneate ESH stands ae allowed and would not ceate a substantial change in effects that would invalidate my findings in the FONSI discussed below. Examples of such vaiations include but ae not limited to: 1. Sheltewood seed cut changed to seed tee o cleacut because of loss of adequate shelte tees; 2. Seed tee changed to cleacut because of loss of seed tees; 3. Defeal of alde sheaing because conditions ae no longe suited to alde egeneation; 4. Ovestoy emoval changed to salvage because of motality and disease of ovewood; 5. Natual egeneation changed to planting because of loss of seed-beaing tees. Othe Altenatives Consideed In addition to the selected altenative, I consideed fou othe altenatives. One altenative action plus the No Action wee studied in detail (see EA section 2.2) and two othe altenatives wee consideed, but not studied in detail (see EA section 2.3). How I weighed each altenative studied in detail is descibed, below. A moe detailed, side-by-side compaison can be found in the EA, section Altenative 1 (No Action): Unde the No Action altenative, the poposed o altenative actions would not occu. ESH stands within the twelve RGMAs would not be impoved, leading to loss of habitat both in species composition and age stuctue. I did not select this altenative because it does nothing to move RGMAs towad desied conditions, but in fact continues an acceleating tend away fom desied conditions. This altenative would likely exacebate the decline of Species of Concen due to habitat losses and lead to foest conditions that would be moe difficult to estoe to ESH in the futue. Altenative 3 (maintain goshawk and maten habitat coidos): Altenative 3 esponds to public comments to potect existing conditions of unoccupied goshawk and maten habitat nea o adjacent to aeas of occupied goshawk and maten habitat. Although Altenative 3 esponds well to the pupose and need in ten of the twelve affected RGMAs, it essentially wites off ESH management in two of them. The attempt to sustain Ealy Successional Habitat DN/FONSI Page 3 of 7

6 goshawk and Ameican maten habitat coidos using old aspen foest would esult in neithe the desied coidos no ESH in a shot peiod of time. The cuent age of this aspen makes it vey ephemeal on the landscape and it would be lost athe apidly to natual aging. Once lost to aging, such foest would emain as non-suitable habitat fo at least 50 yeas. Hence, this tadeoff would be made based upon a peceived benefit that is not suppoted by neithe management expeience no demonstable science. Although Altenative 3 seeks to peseve old ESH habitat, thee is no evidence that maten o goshawk would measuably benefit fom this tadeoff. Both of these RGMAs occu in othewise lage expanses of aeas being managed fo late-successional habitat. Habitat fo goshawk and maten is aleady abundant in the adjacent landscape and ESH impovement actions in these two RGMA s povides impotant divesity fo meeting goals of welldistibuted habitat fo species of consevation concen (golden-winged wable, Ameican Woodcock) acoss the Foest. I did not select Altenative 3 because although vey simila to Altenative 2, the benefit of the tadeoff to be made was not clea fom the science o management expeience. Public Involvement Discussions concening the need fo this action have been occuing ove the last decade between the Foest and state and county wildlife manages and inteested wildlife consevation goups. Because of involvement and investment fom pivate wildlife/spotsmen goups in the establishment of RGMAs, discussions concening lack of Foest follow-though in RGMA management began shotly afte appoval of the 2004 plan. In 2008, the Foest began intedisciplinay eview of RGMA needs acoss the Foest and began collaboating with inteested goups to gain moe infomation on ealy successional species habitat needs (PF section 2A). Intenal and extenal scoping continued infomally with othe agency wildlife manages ove the next yea, but no specific poposal was developed until late Official equest fo public comments on the ESHI poposed action was initiated on Octobe 15, 2010 (PR doc 2B-07). One hunded-twenty-five esponses wee eceived. Thee esponses identified concens o suggestions with the poposal. The emaining wee fully suppotive o meely asked fo moe infomation (PR doc section 2C). I closely eviewed all the esponses with concens o suggestions, eviewed the analysis conducted on them by the intedisciplinay team, and consideed all impotant issues in eaching my decision. Finding of No Significant Impact Afte consideing the envionmental effects descibed in the EA, I have detemined that these actions will not have a significant effect on the quality of the human envionment. In my finding I have consideed both context and intensity of impacts (40 CFR ). Thus, an envionmental impact statement will not be pepaed. I base my finding on the following: Context: the setting of this action is limited to twelve widely scatteed sites acoss the Foest. Relevant advese effects ae confined to these smalle sites and local communities. They will not have widespead impacts at egional, state o national levels (EA Appendix C1, esponse to comment 105-2). 7 Intensity: My eview of the intedisciplinay analysis finds the intensity of effects fom implementing the selected action to be small and mino. I have consideed the following factos in evaluating the intensity of effects and coming to my finding: 1. Consideation of Beneficial Effects. My finding of no significant envionmental effects is not biased by the beneficial effects of the action. I have consideed and disclosed advese impacts individually to detemine significance and did not use beneficial impacts to balance out the significance of advese impacts (beneficial effects EA section 4.1, advese EA section 4.2). 2. Public Health & Safety. This type of action has been used many times on the Foest with no impact to public health and safety. Thee ae no cicumstances o conditions associated with my selected action to indicate thee would be unusual o substantial isks to public health and safety, it was not a concen in public comments, and hence it did not become an issue in the analysis. 3. Unique Chaacteistics. This action ties to pevious Foest Plan analysis that has eviewed the foest fo unique chaacteistics (histoic o cultual esouces, pak lands, pime famlands, wetlands, wild and scenic ives). The RGMAs do not lie within any aeas identified though pevious effots as unique. The intedisciplinay team membes made many on-the-gound condition veification visits to the affected RGMAs and identified no unique chaacteistics in the sites poposed fo teatment. Cultual and histoic esouces wee evaluated (EA section 4.2.4) and potected (EA section Cultual Resouces ). Thee would be no affect to unique chaacteistics. 4. Contovesy of Effects. I have eviewed the science behind the effects analysis and find little contovesy. The exception is on the esponse of foest systems to climate change. Pat of this contovesy elates to the inability of science to accuately to pedict climate change at the site-specific level. Yet that is the level of ou actions. I have eviewed the intedisciplinay analysis (EA section 3.2.1) and esponse to comments (EA Appendix C1, pp 1-3) egading esilience and adaptability of the desied foest conditions to moe geneal climate change pedictions, and I find that the best available science has been applied. I find thee is no indication that my selected action would ceate mal-adapted ecosystems, but athe would impove foest esilience fo the futue. On eviewing the science, I find little contovesy that younge and thiftie foests ae bette adapted to deal with change than the existing foests poposed fo management. 5. Uncetainty of Effects. The selected action is of a type long used and well-documented in effects. Thee is little uncetainty with effects elated to the elevant issues identified in the EA at section 1.6. No unique o unknown isks wee identified fom analysis of the effects (EA section 4.2) 6. Pecedent Setting. The selected action is unlikely to establish a pecedent fo futue actions with significant effects. It is not an action that would lead to a futue action without pecedent. Such actions have been independently implemented on the foest in the past without equiing subsequent actions that may have significant effects. Thee is no unusual cicumstance associated with this action that would indicate it is substantially diffeent fom actions in the past. Ealy Successional Habitat DN/FONSI Page 5 of 7

8 7. Cumulative Impacts. Cumulative impacts have been consideed in the EA (sections 4.2.1, 4.2.2, 4.2.5, 4.2.6; and PR docs 5-01, 02, 03, 04, 05 and 06). I found no substantial o significant cumulative effects. 8. Histoic Popeties. The action will have no significant advese effect on disticts, sites, highways, stuctues, o objects listed in o eligible fo listing in the National Registe of Histoic Places. The affected aea has been suveyed and inventoied (PR doc 5-09), and measues to avoid impacts ae pat of my selected action (EA section Cultual Resouces ). Consultation has been completed with the State Histoic Pesevation Office fo neaby sites (see cultual esouce epots, PR doc 5-09). 9. Theatened and Endangeed Species. The action will not advesely affect any endangeed o theatened species o its habitat that has been detemined to be citical unde the Endangeed Species act of Though the wolf has been ecently emoved fom fedeal listing, a detailed biological evaluation was conducted (EA section 4.2.6; PR doc 5-01) and found No Effect on the wolf o its then citical habitat. 10. Violation of Law. The action will not violate Fedeal, State, o local laws o equiements fo the potection of the envionment. Applicable laws and egulations ae noted in specialist epots fo each elevant issue, including: Endangeed Species Act: PR doc 5-01, pp 7-13; Executive Ode 13112: doc 5-05, p 1; Clean Wate Act: doc 5-06 pp 3, 28; National Histoic Pesevation Act doc 5-09 p 1. Findings Requied by Othe Laws and Regulations My decision is based on a eview of the ecod that shows consideation of elevant scientific infomation, including esponsible opposing views, and as appopiate, the acknowledgement of incomplete o unavailable infomation, scientific uncetainty, and isk. My decision implements the Chequamegon-Nicolet National Foests 2004 Land and Resouce Management Plan. As equied by NFMA Section 1604(i), I find this poject to be consistent with the Plan. I find this action fully addesses concens of the Endangeed Species Act (PR doc 5-01and 5-02) Executive Ode (PR doc 5-05), the Clean Wate Act (PR doc 5-06) and the National Histoic Pesevation Act (PR doc 5-09). Administative Review o Appeal Oppotunities This decision is subject to appeal in accodance with 36 CFR 215.
