(S) ON ANY HIGHWAYS OR ROAD ALLOWANES UNDER THE ONTROL OF THE MUNIIPALITY OF NORTHERN BRUE PENINSULA WHEREAS pursuat to the MuiP Act, 2001, S.O 2001, c. 25 as ame Sectios 8 (1) ad 9 provide that the powers of a MuiciPaIitY uder this or ay other Act shall be terpret broadly so as to cofer broad authority o the muicpalty to eable the muicipality to gover its attar5 as it co5ders appr0pte ad to ehace the mucipauitys ability to respod to muicipal ssue5 ad has the capacity right5 powers ad privileges of a atural perso for the purpose of erci5ig its authority uder this or ay other Act; AND WHEREAS Sectio (3) of the Highway Traffic Act, R.S.O 1 190, ch.8, as ameded, authorizes the oucil of a icipality to pass by-laws operatio of off-road vehicles (ATV s) o ay highway withi the permitti9 the icipahty that i5 AND WHEREAS Sectio 1 1 (1) (3) of the Muicipal Act, 2001, , c. 25, as uder the 1urisdictio of the icipaiity or o ay pa or pa5 of such highway; ameded, gives broad authority to lower-tier muicipalities to provide ay service or thig that the icipality cosiders ece55a or desirable for the public ad respectig matters withi the sphere of traffic o highways; urisdicti0 highways cludig parkig ad NOW THEREFORE the oucil of the orporatio of the peisula eacts as follows: icipality of Noher Bruce Sectio 1 : Defiitios (a) ATV meas a off road vehicle that: 1. Has four wheels, the tires of which are i cotact with the groud 2. Has 5teerig hadle bars 3 Has a seat that is desiged to be straddled by the driver 4. Is e5iged to carry a driver oly 5 Has adlight5, tail light5 which must be o at all times 6. Must have operatig brake light 7. Has allterrai vehicle licece plate ad isurace 8. Widshields must meet requiremet of torcycle widshields b) For the purpose of this By-laW ATV vehicle does ot iclude due buggies, Side by Side ATV, Two-UP ATV or vehicles propelled or drive other tha by muscular power or wid. (e) No driver of a ATV vehicle shall operate o ay Muicipal road covered by this by-law without licesig such vehicle. (f) No driver shall operate a ATV except i same directio as traffic. (g) All drivers shall operate ATV s o the shoulder of road except usafe. if the shoulder is (h) No perso shall operate a ATV i ay park that is uder the jurisdictio of the Muicipality of Norther Bruce Peisula. Sectio 3: Exemptios Schedule A lists perso(s) or compaies exempt from this by-law. Sectio 4: Pealty ad Eforcemet 1. Ay perso(s) who cotravees ay provisio of this by-law is guilty of a offece ad upo covictio is liable to a fie or pealty for each offece, exclusive costs ad upo covictio is liable to a fie as set out i the Provicial Offeces Act, R.S.O. 1990, hapter P No perso(s) shall willfully obstruct, hider or otherwise iterfere with a Officer i the performace of the Officer s duties, right, fuctios, powers or authority uder this by-law. 3. Where a Officer has reasoable grouds to believe that a offece uder this by-law has bee committed by a perso(s), the Officer may require the ame, address ad proof of idetity of that perso(s), ad the perso(s) shall supply the required iformatio. 4. If, for ay reaso, ay sectio, clause or provisio of this By-law is deemed by a cout of competet jurisdictio to be ivalid, the same shall ot affect the validity of the by-law as a whole or ay pat thereof other tha the part which was declared to be ivalid.
