2 Addenda 2 October 9, Committee Report: Infrastructure, Transportation and Safety: Motion by THAT Item 5.2 of the Infrastructure, Transportation and Safety Committee dated October 9, 2018 be adopted as follows: 5.2 Noise By-law Exemption for Romeo Street North at Vivian Line and north leg of Gregory Crescent (ITS18-049) THAT an exemption from Noise Control By-law be granted to Wightman Telecom Ltd. on Thursday, October 11, 2018 from 1:00 a.m. to 6:00 a.m. INFRASTRUCTURE, TRANSPORTATION AND SAFETY COMMITTEE ADDENDA 5.0 Report of the Project Engineer: 5.1 Noise By-law Exemption for the Tom Patterson Theatre Construction Project (ITS18-047): The Festival Theatre has now requested that this matter be deferred. Committee recommendation: Motion by THAT the request for a noise by-law exemption for the Tom Patterson Theatre Construction Project be deferred 5.2 Noise By-law Exemption for Romeo Street North at Vivian Line and north leg of Gregory Crescent (ITS18-049) *Item 5.2 to also be dealt with at the reconvene Council meeting. 3 BY-LAW NUMBER OF THE CORPORATION OF THE CITY OF STRATFORD BEING a By-law to authorize the entering into and execution of an agreement with Festival Hydro Services Inc., Festival Hydro Inc., Stratford Economic Enterprise Development Corporation, Automotive Parts Manufacturers Association and The Corporation of the City of Stratford Connected Car / Automated Vehicle Project. WHEREAS Section 8.(1) of the Municipal Act, 2001, S.O. 2001, c.25 as amended, provides that the powers of a municipality under this or any other Act, shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality s ability to respond to municipal issues; AND WHEREAS Section 9 of the Municipal Act, 2001, provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS Section 10(1) of the Municipal Act 2001 provides that a single-tier municipality may provide any service or thing that the municipality considers necessary or desirable for the public; AND WHEREAS Automotive Parts Manufacturers Association (APMA) is Canada s national association representing OEM producers of parts, equipment, tools, supplies, advanced technology and services for the worldwide automotive industry; AND WHEREAS the automobile industry in North America has been increasingly becoming more and more advanced including but not limited to the development of autonomous vehicles; AND WHEREAS the Province of Ontario is the first province to test automated vehicles and related technologies on municipal streets; AND WHEREAS AMPA entered into an agreement with the Province of Ontario and the Ontario Centres of Excellent (OCE) for the purposes of establishing and managing a robust demonstration site wherein connected and automated vehicle technologies from Ontario based Small and Medium Sized Companies (SMEs), Original Equipment Manufacturers (OEM) Multi National Enterprises (MNE) and other potential participants are able to test their technologies, products, services and applications in real life and time scenarios and weather conditions using demonstration vehicle demonstration vehicle platforms such as city buses, fleet vehicles and OEM vehicles;

4 AND WHEREAS the City of Stratford is uniquely situated as it is the appropriate size and geography for the demonstration and testing of automated vehicles, and the City through Festival Hydro Services Inc. provides an extensive Wi-Fi network; AND WHEREAS the City, Festival and APMA have agreed to enter into an agreement for the Automated Vehicle Project; AND WHEREAS APMA has been allocated a conditional amount of up to $5,000,000 by the Province of Ontario for the purposes of establishing a robust demonstration site to test Automated Vehicles; AND WHEREAS Festival Hydro Services Inc., Festival Hydro Inc., Stratford Economic Enterprise Development Corporation, Automotive Parts Manufacturers Association and The Corporation of the City of Stratford intend to enter into an agreement for the Connected Car / Automated Vehicle Project; NOW THEREFORE BE IT ENACTED by Council of The Corporation of the City of Stratford as follows: 1. That the Agreement for the Connected Car / Automated Vehicle Project dated the 9th day of October, 2018 between Festival Hydro Services Inc., Festival Hydro Inc., Stratford Economic Enterprise Development Corporation, Automotive Parts Manufacturers Association and The Corporation of the City of Stratford, be entered into and the Mayor and Clerk or their respective delegates be and the same are hereby authorized to execute the said agreement and all documents necessary on behalf of and for this Corporation and to affix the corporate seal thereto. 5 Infrastructure and Development Services Department MANAGEMENT REPORT Date: October 9, 2018 To: Infrastructure, Transportation and Safety Committee From: Ed Dujlovic, Director of Infrastructure and Development Services Report#: ITS Attachments: None Title: Noise By-law Exemption for Romeo Street North at Vivian Line and north leg of Gregory Crescent Objective: To obtain an exemption to Noise By-law to allow Wightman Telecom Ltd., working on behalf of Festival Hydro, to work on Thursday, October 11, 2018 from 1:00 a.m. to 6:00 a.m. Background: Wightman Telecom Ltd. has been retained by Festival Hydro to replace temporary fibre optic connections on their fibre network at the south west corner of Romeo Street North and Vivian Line and at the south west corner of Romeo Street North and the north leg of Gregory Crescent. In order to minimize the disruption to their customers, Festival Hydro would like to carry out the work from 1:00 a.m. to 6:00 a.m. on Thursday, October 11, Noise By-law prohibits the operation of any equipment in connection with construction in a residential zone from 7:00 p.m. to 7:00 a.m. Analysis: The noise exemption is for the generator that will be used to power the work trailer, 4 way flashing lights, and an arrow board (positioned at the back of the trailer for oncoming traffic). Wightman has indicated the generator generates noise at 60dB. This is equivalent to a residential air conditioner. The location of the work is adjacent to single family homes and an apartment style condominium. Financial Impact: There is no direct financial impact to the City of Stratford. Staff Recommendation: THAT an exemption from Noise Control By-law be granted to Wightman Telecom Ltd. on Thursday, October 11, 2018 from 1:00 a.m. to 6:00 a.m. Page 1
