1 REQUEST FOR PROPOSAL 24/2010 Supply and Deliver One (1) New Four Wheel Drive (4WD) RUBBER TIRED BACKHOE LOADER -- For The Corporation of the City of Thunder Bay, Facilities and Fleet Department Page 1 of 20 The Corporation of the City of Thunder Bay, Facilities and Fleet Department, invites proposals for the Supply and Delivery of One (1) New Four Wheel Drive (4WD) Rubber Tired Backhoe Loader, all in accordance with the following Schedule of Prices, Specifications/Requirements, General Requirements and Terms of Reference. Submissions should include, but not necessarily be limited to, the following: 1. Cost to the City of Thunder bay, F.O.B. Destination, (GST and PST Extra); 2. A brief description of your firm its clients, its history, its projects, its staff; 3. A company description, exact location and address; 4. A summary of your understanding of this proposal; 5. An outline of the product(s) and services to be provided; 6. Your firm s experience in similar projects; 7. Addressing all aspects in regards to the Scope of Work/Terms of Reference; 8. Client References and a list of clientele; 9. Contact persons, c/w phone numbers - communication; 10. Service and parts location and availability; 11. Warranty Details and Location; 12. Ergonomic and Safety Features; 13. Details of any Training and Instruction to be offered to the City of Thunder Bay in the use of the equipment; 14. Delivery Schedule; 15. Any other supporting information you may wish to include with your submission. Address each and every paragraph and item in reference to the specifications of this proposal. Point by point response is requested. Proponents shall fill out confirmation and/or comments of each and every corresponding item as indicated. Failure to complete such confirmation may result in the unacceptability of the proposal.

2 Page 2 of 20 Proposal Document Fee: There is a $35.00 non-refundable charge for the proposal documents payable by cheque, cash or Debit Card. Cheques are to be made payable to the City of Thunder Bay. QUALIFICATIONS Proposals will be evaluated from firms or individuals that can demonstrate that they have the necessary staffing, facilities, experience, ability and financial resources to perform the work in a satisfactory manner. Proven track record must be demonstrated. The City of Thunder Bay reserves the right to inspect the bidder s facility and to perform such investigations as may be deemed necessary to insure that competent personnel and management will be used in the performance of this contract. INFORMATION FOR ALL PROPONENTS All proposals submitted to the Corporation of the City of Thunder Bay become the property of the Corporation, and as such, are subject to the provisions of the Municipal Freedom of Information and Protection of Privacy Act. This will confirm that the Corporation of the City of Thunder Bay will not use/disclose the information provided, without proper authorization, and will keep the information in a physically secure location to which access is given only to staff requiring access. Delivery I/We, hereby estimate Delivery of the Vehicles and Equipment in calendar days after notification of award of the contract. DELIVERY is of the essence and may be considered as part of the award. ENCLOSURES Standard Terms and Conditions for Tenders, Proposals and Contracts. Note: For clarification purposes of this document, the words tender and proposal are to be considered synonymous.

3 Page 3 of 20 SPECIFICATIONS IN GENERAL The Corporation of the City of Thunder Bay requires One (1) New 4WD, Rubber Tired Backhoe Loader. The model to be supplied must be new and the current year's model, 2010 or newer. The City of Thunder Bay requires proposals to be based on unit models such as, but not limited to John Deere 410J, Caterpillar 430D, Case 590 Super M Series II. Quotations on new older models will only be considered if offered as an alternate with the bid on the current year s manufacture. Bidders must certify that the model offered is the current year s manufacture. Note: All equipment/vehicles specified in this tender is subject to Budget Approval by City Council and quantities may be adjusted and/or items cancelled based on availability of funding. Where specific items are specified in regards to manufacturer and model, the Corporation will consider approved equivalents providing the make and model being offered are equal to or exceed the items being asked for in regards to design, quality, material, and performance. The equipment shall be new and the latest models available including the latest modifications available at the time of purchase. The specifications in this tender request are the basic minimum requirements that are necessary to obtain the desired performance, reliability and low cost of operation and maintenance. NOTE: Re: DELIVERY, ACCEPTANCE AND PAYMENT The City of Thunder Bay will not make any payment until all items/terms applicable to this tender have been included/completed to the entire satisfaction of the City of Thunder Bay. The City may request to inspect any vehicle/equipment/product at the local premises of the vendor/supplier (or representation of such) prior to the actual delivery. Delivery of such must be first approved by the City Representative listed (or designate) within this tender. Vendor(s) shall not assume that physical delivery to the City implies full acceptance of the unit.

4 Page 4 of 20 The Selection Committee reserves the right to be the sole judge of the acceptability of any equipment/material/service offered, and to purchase the equipment/material/service which in its opinion most closely meets the operating requirements of the project and organization. The decision of the Selection Committee shall be final and without recourse. Goods and Services Tax (GST) to be extra Ontario Retail Sales Tax (PST) to be extra. All taxes must be shown separately on invoicing i.e. Goods and Services Tax (GST) and Ontario Retail Sales Tax (PST). A cash discount of % will be allowed if accounts are paid within days after the receipt of the bill for goods that are acceptable.
