Upon further investigation it was learned that Henrick Bailey and his girlfriend Kala Stephenson had broken up and Stephenson was returning to the apartment early Tuesday to retrieve her belongings. Stephenson was accompanied by three males and two females. Bailey slid Stephenson s belonging s to her through a slightly-opened door. As he was getting ready to close the door, one of the males tried to push it open. Bailey and his roommate were able to shut the door. Moments later though, one of the men accompanying Stephenson kicked the door open. At that point, everyone except one of the females- piled into Bailey s apartment. One of the males then pointed a gun at Bailey. Bailey told him to put the firearm away and that they should fight instead. The gun went off. one was hit. The pair continued struggling over the weapon when the second male who joined the fight pulled out his own gun and pointed it at Bailey. The fight stopped and the suspects bolted from the apartment. Stephenson the girlfriend and her party of five, took off in two cars. The suspects were all arrested on West International Speedway Boulevard at two different locations. (See attached reports.) Bowens then pointed a black semi-automatic 2 handgun at both victims and struck V- multiple times with a closed fist. During the disturbance, Bowens fired a round at V- which entered the laundry closet and into the dryer. Bowens has fourteen previous felony convictions and was in possession of a loaded firearm on this date. 4 5 On 5/29/8 at approximately 0707 hours, I was dispatched to 875 Derbyshire Rd 24 in reference to a shooting. Upon arrival I came into contact 6 with Henrick Bailey (V-) who signed a sworn statement and stated the following: 7 8 V- had been going through a break up in his relationship with his girlfriend (Kala Stephenson) of nine months. They lived together for approximately 9 nine months as a family unit. On 5/28/8 Kala Stephenson had left the house and was planning on returning the next day to take her belongings. 0 On 5/29/8 V- woke up to hearing a knock on the door. V- observed Stephenson standing outside with three unknown black males who were later identified as Jukerius Bowens, Kenneth Walker who was wearing a gray ski mask and O'Hadji Thorton. V- opened the door and slid Stephenson's 2 belongings to her through the door. At that point Bowens attempted to open the door as V- shut it. V-2 then ran to help V- and they were able to shut and lock the door. 4 Immediately after one of the males kicked open the door to the apartment. The three males entered the apartment along with Stephenson and Z. 5 Daniels at which point Bowens pointed a gun at V-. V- advised Bowens to put the gun down and fight him. Bowens and V- then began fighting. Statement(s) NTA Schedule Report Traffic Infraction(s) Charges: Defendant Arrest 6 Thorton had jumped in the fight and punched V- while the two were tussling. V- had knocked Thorton to the ground during the fight causing 7 Bowens to pull his gun back out. Bowens and V- were struggling over the gun and Bowens fired a round off at the side of V-'s head in the middle of 8 the hallway into the door of the laundry room. V- was still struggling over the gun with Bowens. During the struggle Walker pulled out his gun and 9 pointed it at V-. Walker advised V- to let go of the gun and then fled with Bowens and Thorton. During the incident Stephenson and Z Daniels 20 were inside the apartment. V- stated that all the parties left the scene Gray Chevrolet Equinox and had taken his and Stephenson's unregistered 2 gray Dodge Stratus and left Westbound through the apartment complex. 22 Officer Ramirez responded to the scene on 5/29/8 at approximately 0709 hours and upon arrival came into contact with Randy Green (V-2) who 2 signed a sworn statement and stated the following: 24 V-2 had heard a knock at the door and advised V- that Stephenson was at the door with three males and two females. The two females were later 25 identified as M. Daniels and Z. Daniels. Upon opening the door V-2 observed two of the males who were later identified as Jukerius Bowens and 26 Kenneth Walker had guns in their possession. V-2 saw the males attempt to enter the apartment. V-2 had closed the door on the males who were 27 trying to force their way in. 28 Immediately after, Bowens kicked the door in and pointed a gun at V- and V-2. Stephenson entered the apartment and advised Bowens to shoot 29 V-2. When Zariyah Daniels entered the apartment she advised Bowens to shoot V-. V- stated that he would rather fight Bowens hand to hand. At 0 this point Bowens had put his gun away and began fighting with V-. V-2 was observing the struggle and witnessed Michelle Daniels spray V- with mace during the fight. V-2 witnessed Bowens shoot a round at V- in 2 the hallway by the dryer. V-2 took this opportunity to run outside during the scuffle. V-2 observed both parties enter two separate vehicles leave the parking lot of the apartment complex. (See Officer Ramirez's Supplement) 4 A BOLO was put out in reference to the suspects and both vehicles involved in the incident. Officers located the gray Dodge Stratus bearing FL tag 5 495RTM at 2980 W International Speedway Blvd (BP Gas Station) and conducted a felony traffic stop. Officers on scene detained Stephenson, 6 Zariyah Daniels, Jukerius Bowens and Kenneth Walker pending a show up. V- and V-2 were separately brought on scene for the show up and 7 positively identified the above listed suspects as the ones who were involved in the incident. 8 9 The Gray Chevrolet Equinox bearing FL tag IHTV7 was later located and stopped at 2994 US-92 (McDonalds). Officers on scene detained M. 40 Daniels and Thornton. V- and V-2 were separately brought on scene for the show up and positively identified Thornton as the one of the males who 4 were involved in the incident. V-2 positively identified M Daniels as being involved in the incident as well. V- stated that he knows M Daniels but did 42 not see her on this date. 4 At 087 hours all defendants identified were placed into custody and transported to the Daytona Beach Police Department. Stephenson, M Daniels 44 and Z Daniels all spoke with detectives (See supplements) 45 During the interview with CID Sgt. Brown requested a criminal history on Bowens and identified him as having 4 felony convictions. (See CID 46 Supplement) 47 The scene was processed by Crime Scene and a spent casing was found in the living room. One projectile was found in the dryer. One projectile was 48 found in the bedroom on the back left side of the apartment. One projectile was found in the back right room of the apartment. (See Crime 49 scenesupplement) 50 This investigation was captured on my department issued AXON body camera. 5 firearms were located at this time. All Defendants were taken into custody without incident. Both vehicles were removed from the scene by 52 Daytona Wrecker Service. V- stated that he does wish to prosecute. Statement(s) NTA Schedule Report Traffic Infraction(s) Charges: Defendant Arrest 6 Bowens to pull his gun back out. Bowens and V- were struggling over the gun and Bowens fired a round off at the side of V-'s head in the middle of 7 the hallway into the door of the laundry room. V- was still struggling over the gun with Bowens. During the struggle Walker pulled out his gun and 8 pointed it at V-. Walker advised V- to let go of the gun and then fled with Bowens and Thorton. During the incident Stephenson and Z Daniels 9 were inside the apartment. V- stated that all the parties left the scene Gray Chevrolet Equinox and had taken his and Stephenson's unregistered 20 gray Dodge Stratus and left Westbound through the apartment complex. 2 Officer Ramirez responded to the scene on 5/29/8 at approximately 0709 hours and upon arrival came into contact with Randy Green (V-2) who 22 signed a sworn statement and stated the following: 2 V-2 had heard a knock at the door and advised V- that Stephenson was at the door with three males and two females. The two females were later 24 identified as M. Daniels and Z. Daniels. Upon opening the door V-2 observed two of the males who were later identified as Jukerius Bowens and 25 Kenneth Walker had guns in their possession. V-2 saw the males attempt to enter the apartment. V-2 had closed the door on the males who were 26 trying to force their way in. 27 Immediately after, Bowens kicked the door in and pointed a gun at V- and V-2. Stephenson entered the apartment and advised Bowens to shoot 28 V-2. When Zariyah Daniels entered the apartment she advised Bowens to shoot V-. V- stated that he would rather fight Bowens hand to hand. At 29 this point Bowens had put his gun away and began fighting with V-. 0 V-2 was observing the struggle and witnessed Michelle Daniels spray V- with mace during the fight. V-2 witnessed Bowens shoot a round at V- in the hallway by the dryer. V-2 took this opportunity to run outside during the scuffle. V-2 observed both parties enter two separate vehicles leave the 2 parking lot of the apartment complex. (See Officer Ramirez's Supplement) A BOLO was put out in reference to the suspects and both vehicles involved in the incident. Officers located the gray Dodge Stratus bearing FL tag 4 495RTM at 2980 W International Speedway Blvd (BP Gas Station) and conducted a felony traffic stop. Officers on scene detained Stephenson, 5 Zariyah Daniels, Jukerius Bowens and Kenneth Walker pending a show up. V- and V-2 were separately brought on scene for the show up and 6 positively identified the above listed suspects as the ones who were involved in the incident. 7 8 The Gray Chevrolet Equinox bearing FL tag IHTV7 was later located and stopped at 2994 US-92 (McDonalds). Officers on scene detained M. 9 Daniels and Thornton. V- and V-2 were separately brought on scene for the show up and positively identified Thornton as the one of the males who 40 were involved in the incident. V-2 positively identified M Daniels as being involved in the incident as well. V- stated that he knows M Daniels but did 4 not see her on this date. 42 At 087 hours all defendants identified were placed into custody and transported to the Daytona Beach Police Department. Stephenson, M Daniels 4 and Z Daniels all spoke with detectives (See supplements) 44 During the interview with CID Sgt. Brown requested a criminal history on Bowens and identified him as having 4 felony convictions. (See CID 45 Supplement) 46 The scene was processed by Crime Scene and a spent casing was found in the living room. One projectile was found in the dryer. One projectile was 47 found in the bedroom on the back left side of the apartment. One projectile was found in the back right room of the apartment. (See Crime 48 scenesupplement) 49 This investigation was captured on my department issued AXON body camera. 50 firearms were located at this time. All Defendants were taken into custody without incident. Both vehicles were removed from the scene by 5 Daytona Wrecker Service. V- stated that he does wish to prosecute.
