6 Narratives Subject: TRAFFIC STOP/OVI Type Date Time Author Approving Officer Initial Report 08/02/ POWELL, JOHN GRAYBILL, ERIC G TRAFFIC STOP/OVI 1989, 1981, 1895, , 2084, 1538 Prior OVI's: (0) BAC Result:.134 This officer was stationary on Tiffin Ave. in the Cobbs Dairy Parking Lot, when the listed Toyota passed this officer at a speed that appeared to be greater than the posted speed limit of 35 mph. This officer got behind the vehicle and checked its speed using the Stalker Dual Radar Unit, and an audio doppler return was heard that corresponded to the visual estimation and target speed reading of 46 mph. The vehicle was stopped and the driver was identified as Alexander Green. Alexander was advised the reason for the stop and he had no justified reason for same. While speaking with Alexander he had a strong odor of intoxicants on or about his person and his speech was slurred. Alexander admitted to consuming intoxicating beverages this date but said he had not consumed anything in almost (2) hours. Alexander was asked to step from the vehicle and he complied. As he did this he was noticed to be unsteady on his feet. Alexander was asked to submit to field sobriety tests and he complied. The first test given was the horizontal gaze nystagmus test. Alexander showed lack of smooth pursuit, nystagmus at maximum deviation and onset of nystagmus prior to forty five degrees in both eyes. Alexander was then shown and explained the one leg stand test. Alexander said he understood the test and began. Alexander failed to look down at his foot while counting and had to be instructed to do this during the test. He then placed his foot down on count fifteen and he used his arms to balance himself. Alexander was then shown and explained the walk and turn(heel to toe) test. Alexander was not able to stand with his right foot in front of his left foot touching heel to toe while the test was being explained as he lost his balance. He again placed his right foot in front of his left foot and was explained the first step would be count "one". Alexander counted one prior to taking his first step so he was not able to perform the pivot as instructed and shown. He also failed to touch heel to toe on step one on the way down and one step 3 on the way back. Alexander was then offered a Portable Alco Sensor III test and he refused to take same. Due to the observations made by this officer, Alexander was placed under arrest for speed and OVI. The vehicle was parked on private property so it was not towed. Alexander was then transported on station and secured in holding facility #2. Once the necessary observation time was met, Alexander was read and shown the BMV 2255 Form. Alexander agreed to take the BAC Datamaster Breath Test and had a result of.134. Once Alexander was served with his citation and paperwork, he was released to a sober friend,
7 Allison Gehres at 0515 hrs. At 0526 hrs. a traffic crash was reported at Tiffin Ave. near George St. The caller advised a vehicle struck something and then went and parked to the rear of the bank on Venice Rd. Ofc. Gilliam located the vehicle and it was Alexander's vehicle that this officer had stopped earlier. The vehicle had fluid leaking from it and it had heavy front end damage. A vehicle inventory was completed and Wilson's Towing towed the vehicle from the area. Ofc. Gautschi and Ofc. Peters located a street sign knocked down on the Southwest corner of George St. and Tiffin Ave. The tires tracks continued through the grass and ended at a guardrail that had heavy damage to it. Photographs of the vehicle and area were taken. This officer made contact with Alexander via public service at approximately 1930 hrs. and he was asked about the accident. He said he was advised by his attorney to not talk to this officer until he was present. He was advised another citation maybe forth coming due to the accident and he said he understood. This officer made contact with Sandusky City Prosecutor, Lynn Gast-King and she was advised of the situation and time lapse. She authorized, OVI, driving under OVI suspension, fail to control motor vehicle and leaving the scene of an accident for Alexander. The citation was prepared and placed in the OIC Office for processing. The citation will be served on Alexander when he arrives for court on 08/04/2014.
