4 Page 4 Agency: PCSO Author: BAKER, ADAM Incident No: Title: NARCOTICS Report Type: I Date Entered: 11/24/2013 On November 24, 2013 at 0349am Deputy Baker was traveling east on Interstate 30 and noticed a vehicle in front of him with a flashing clear light. As Deputy Baker got closer he noticed the flashing light was malfunctioning license plate lights. Deputy Baker also noticed the vehicle to be traveling 71 mph in a 65 zone. Deputy Baker was able to confirm the speed using his radar. Deputy Baker was able to follow the vehicle for approximately three to four miles and actually paced the vehicle up to 76mph in a 65 mph zone. Deputy Baker activated his blue lights and made a traffic stop on the vehicle and made contact with the driver, later identified as Rashad James. Deputy Baker also noticed that there was a Texas license plate in the dash of the vehicle. There was no plate attached to the front bumper of the vehicle as required by state law. Upon contact Deputy Baker could smell a very strong odor of air fresheners and noticed five or six air fresheners on the mirror. Deputy Baker advised James why he was being pulled over and asked James where he was coming from. James stated that he was coming from Henderson College and going to Memphis. Deputy Baker asked James why he was coming from Henderson College and had been staying there for a few days with a friend to look at the college. Deputy Baker noticed that the front of the vehicle had a lived in look and trash in the inside. There was two separate gas station sacks with empty bottles and food trash as if James had been driving a long time. Deputy Baker knew that Henderson College was only just over an hour away and it seemed very odd to have so much trash in the front seat to only be driving for an hour. Deputy Baker also noticed that the vehicle had no other luggage or clothing in the interior of the vehicle. The vehicle owner was not present and the vehicle returned to a known source area for heavy narcotics traffic. Due to Deputy Bakers drug interdiction training and the signs Deputy Baker began to ask for consent to search the vehicle. Deputy Baker asked James if he had any weapons or narcotics in his vehicle and he stated no. Deputy Baker then asked James if he would allow him to check the vehicle for contraband. James advised he did not care and stated Deputy Baker could check the vehicle. Deputy Baker then asked again" Do you mind me checking in here real quick? To make sure nothing is in here" James advised " no, I don't care". Due to the weather and the outside air temperature Deputy Baker advised James he could stay in the vehicle and asked James to pop the trunk so Deputy Baker could check the trunk. James used a key fob located in the vehicle and opened the trunk. Deputy Baker went to the trunk that James had opened and noticed four cardboard boxes in the trunk. Deputy Baker opened one of the boxes and noticed a large bundle of suspected marijuana inside the box. At this time Deputy Baker went to the front driver s side of the vehicle and told James to step out of the vehicle. Deputy Baker placed James in custody for the suspected marijuana. Deputy Baker advised James of his rights at which time he stated he understood. The vehicle was transported to the Pulaski County Sheriff s Office via Routh Wrecker. James was also transported to the Narcotics Division. James was interviewed by NARC LT. ( See NARC LT Supplement)
5 Page 5 Once at the Sheriffs Office Deputy Baker completed a search of the vehicle and took the contraband from the vehicle. Deputy Baker was able to use a field test kit of the substance which tested positive for marijuana. A total weight of the suspected marijuana was 116.8lbs total.
