4 ITEM 4 YOSEMITE AREA REGIONAL TRANSPORTATION SYSTEM (YARTS) JOINT POWERS AUTHORITY MINUTES April 10, 2017 The regular meeting of the Yosemite Area Regional Transportation System (YARTS) Joint Powers Authority Board was held Wednesday, April 10, 2017, at Merced County Association of Governments, Front Conference Room, 369 W. 18th Street, Merced, CA and conducted by video/teleconference at the Fresno Council of Governments, 2035 Tulare Street, Suite 201, Fresno, CA, and Sierra Center Mall, Board of Supervisors Conference Room, Third Floor, 452 Old Mammoth Road, Mammoth Lakes, CA, and was called to order by Director Corless at 1:05 P.M. Public Hearing YARTS Fiscal Year 2017/2018 Budget Cindy Kelly gave a review of the YARTS Fiscal Year 2017/2018 Budget. A public hearing was opened to receive comments regarding the YARTS Fiscal Year 2017/2018 Budget. Public hearing opened: 1:30 p.m. Public hearing closed: 1:31 p.m. After a public hearing, where no comments were received, Director McDaniel moved to approve the YARTS Budget for Fiscal Year 2017/2018. Mariposa County Annual Contract for Services Director O Banion moved to approve the Contract for Services between YARTS and the County of Mariposa and authorize the Executive Director to execute the Contract for Services on behalf of YARTS. Seconded by Director Smallcombe. Ayes Directors Menetry, Corless, McDaniel, O Banion, Smallcombe, Gardner Noes None MOTION CARRIED UNANIMOUSLY. 8. YARTS/MCAG Agreement for Services Director O Banion moved to approve the YARTS Joint Powers Authority: a. Authorize the Chair to sign the Agreement for Services between the Yosemite Area Regional Transportation System and the Merced County Association of Governments for a period of one year from July 1, 2017 through June 30, 2018; or b. Provide direction to staff on how to proceed to secure the services specified in the existing contract. Seconded by Director McDaniel. YARTS FY Title VI Program Director Smallcombe moved to adopt the YARTS Title VI Program for FY 2018/2021. Seconded by Director McDaniel. Draft Amendment to NPS Cooperative Agreement Expanded Service Summer 2017 Director O Banion moved to approve the proposed Amendment to the Cooperative Agreement (CA) to fund the expanded summer service and authorize the YARTS Executive Director to execute the final version of the 2017 Amendment to the CA so long as it does not substantially very form the draft that was reviewed by the Board. 30 ACCIDENTS/INCIDENTS There were zero (0) YARTS accidents for the month of April 01-30, ROAD CALLS There were zero (0) road calls for the period of April 01-30, SERVICE DELAYS There were five (5) service delays during the month of April 01-30, Total on time service for all corridors was 99.78%. Hwy /01/17 Run 4 Run delayed 30 minutes due to train delays. 04/01/17 Run 11 Run delayed 30 minutes due to traffic. 04/04/17 Run 3 Run delayed 30 minutes due to passenger loading and delays. 04/13/17 Run 7 Run delayed 1 hour due to operational issue. 31 There were no extra runs during the month of April 01-30, MAINTENANCE VIA YARTS Buses are kept maintained regularly. Currently buses are rotated among runs to evenly distribute miles across the fleet. Regular buses are assigned to each route. Maintenance reports are submitted to YARTS Transit Manager for all service and repairs. CUSTOMER SERVICE A total of 322 YARTS customer inquiry calls were received in the VIA YARTS offices during the period from April 01-30, A comprehensive log of incoming calls by type, including calls regarding customer complaints, commendations, and recommendations is maintained and monitored continually. 167 Calls received on schedule issues and questions for Hwy 140 Corridor 98 Calls received on Fresno HWY 41 schedule information. 12 Calls received on Mammoth Lake schedule information. 10 Calls received on Sonora/Groveland schedule information. 98 Calls received on park information (lodging, tours, camping, etc.) 22 Miscellaneous calls (lost & found, hang up calls, etc.) 1 Calls received as customer complaints. 322 Total CUSTOMER COMPLAINTS AND FOLLOW UP ACTIONS There were three (3) complaints received during the month of April 1-30, 2017 by phone. When complaints arise, all operational issues are addressed and rectified so they can be avoided in the future. 4/4/17 Run 3 Family of customer ed in and said they had a tour scheduled for 10am. The bus was scheduled to arrive at 9:52am to Yosemite Valley Lodge, however the bus was about minutes late and they missed their tour. The family wanted a refund of their $200 they paid for the tour. Follow up showed that the bus was delayed due to construction and unforeseen issues in the park. Additionally, the bus currently goes to Half Dome Village first due to the detour and then to the remaining Valley Floor locations. YARTS Staff advised customer that the schedule does say to allow at least 15-minutes for unexpected delays, so therefore no refund would be appropriate. 4/19/17 Run 8 Received complaint from family of a rider disembarked Run 8 at the Roadside rest. The family said the rider told the driver she was going to use the rest room and would be back. The family said that while the mother was in the restroom the driver of Run 8 left the mother stranded and she missed a very important appointment, and had also left her bag on board. The family said when the passenger contacted the YARTS line; the responders were rude and said the passenger was at fault. Family was requesting a refund and an apology from the driver.

32 Follow up showed that the rider never informed the driver that she was disembarking or made any such communications with the driver. The driver also searched for the bags to be able to return them at Amtrak, but there were no bags on board, and the family members were not there to meet the bus and retrieve luggage as they had said. The Operations Manager for the contractor actually heard all conversations pertaining to this call and said that at no time was either of the employees who answered the YARTS line and interacted with this passenger rude. They were professional as usual and aimed to be helpful. One of them never even spoke directly to the passenger, but talked to the driver of Run 4 and communicated through him to the passenger to find out what happen and make suggestions on how to get back to Merced on later runs. At no point did either of the employees point fault at the rider, but informed her that since the driver was not aware that she was returning, he left on schedule, which is the normal protocol. The family and passenger were referred to YARTS staff for more information. 4/19/17 Run 4 Caller was currently on Run 4 and was upset that the driver had spent minutes assisting a person who had been left behind on the other bus. The rider said they had paid their money for transit and the driver should be running on schedule and not assisting other people not riding the route. Caller requested a refund. The person answering the phone advised the caller that the driver was providing good customer service in assisting a passenger that was stranded with information on the YARTS routes and schedules to help her get to her destination, as well as Amtrak contact information so she could change her reservation. Told caller this was proper protocol, and the driver would be back on route shortly. Caller continued the transit run into Yosemite as scheduled. Wheel Chair Requests There were no wheelchair requests filled for the month of April 01-30, There have been regular unannounced wheelchair riders on various YARTS runs. Eighteen (18) wheelchair buses (YARTS owned and VIA supplemental fleet) are available to accommodate YARTS passengers on all corridors in accordance with ADA guidelines. Cal-Trans/Park Road Closures, Traffic & Construction Delays There were 5-minute to 2-hour delays on Hwy 140 route throughout the month due to construction, traffic congestion, non-yarts traffic accidents, road closures and conditions, and high passenger counts. With less parking for cars, traffic congestion is increasing in the park. The bus lane is currently open and lanes are clearly marked with large signs posting violation costs. This seems to be deterring cars from driving in the bus lane and has allowed a smooth flow for buses in the park. Easter Weekend and Earth Day On April 15-16, 2017 Runs 3 and 10 were added for the weekend to accommodate the high expected passenger counts for Easter and the free park entrance weekend. On April 22-23, 2017 Runs 3 and 10 were added for the weekend to accommodate the high expected passenger counts for Earth Day weekend.

33 YARTS 2017 Spring/Summer Schedules Summer 2017 schedules for Hwy 41, Hwy 140, Hwy 120 Tuolumne County and Hwy 120/395 Mono County are now available online. Printed schedules are also currently available. The reservation system has also been opened for all four summer schedules, and is being monitored by YARTS staff. YARTS Resevations YARTS staff trained the contractor staff on use of the new tablet reservation ticket scanning function. Drivers were provided detailed printed instructions, and tablets for each corridor. Drivers will be able to scan tickets, and the tablet will give drivers information as to whether the tickets are valid or not. The scanning will take effect as of May 15, 2017.

66 CUSTOMER COMPLAINTS AND FOLLOW UP ACTIONS There were eight (8) complaints received during the month of May 01-31, 2017 by phone and . When complaints arise, all operational issues are addressed and rectified so they can be avoided in the future. 05/01/17 Caller said he witnessed a YARTS bus on Hwy 140 between 8 and 9 pm in the River Canyon driving like a race car, at speed in excess of what the other traffic was doing and passing vehicles using the eastbound lane. He had concerns because his daughter has taken YARTS. YARTS Staff reviewed the video and found that on this date, at no time did the bus go over 57 mph, and driver used turnouts to let other cars go by, never once passed another vehicle on the left; and had no racing behavior. YARTS Staff followed up with caller and advised him of the findings. YARTS Staff then received another call stating he had given staff the wrong date. YARTS Staff pulled video for the new date, but video was inop. Though no video evidence existed, contractor followed up with driver of the route. 05/03/2017 A rider called from El Portal Post office about Run 3 being delayed. GPS showed the driver was in Midpines area. Later follow up showed delays were due to very high passenger counts. 05/08/17 Caller said they were at Yosemite View Lodge waiting for the Run 3 bus to connect with a 10am tram tour at Yosemite Valley Lodge. The bus arrived to the View Lodge late at 9:45am, and additionally, the driver was talking to a passenger and slowing down along the route for the passenger to take pictures, which further delayed their arrival. The guests said the driver the day prior suggested they take the Run 3 which normally arrives at 9:45am. They missed their non-refundable tour and were requesting a refund from YARTS. YARTS Staff followed up with guests and pointed out that the schedule says to allow for 15-minute delays. There were construction delays, so using Run 3 was cutting it close to be able to disembark and get to their tour. YARTS Staff reviewed the video and found that the driver was, in fact, slowing down to allow passenger to take pictures. The contractor did follow up with all drivers to remind them YARTS is public transit, and to follow the schedule as printed without unwarranted delays. 05/17/17 Tenaya Lodge contacted YARTS Staff to clarify correct pick up locations for their guests. There was a guest waiting at the North bound bus stop location adjacent to Timberloft when the YARTS bus drove right by him. The guest rode with another hotel guest into the park. Follow up showed the driver had followed protocol and contacted Tenaya Lodge to see if they had any guests for the park. They had none, so the driver continued without stopping. However this guest did not go through the front desk, but went to the stop on their own. Operations now realizes that YARTS bus needs to stop at these locations whether or not Tenaya Lodge has riders since the public is becoming aware of the stops and using them as well. All drivers were informed to make regular stops at the designated stop times on all runs to avoid future incidents. 05/17/17 Rider said that never in their whole life had they experienced the kind of treatment they received from one of the drivers. Said the driver displayed aggressive treatment, made them feel unwelcome and gave snappy answers. Said the driver snatched cash out of his hand and was disrespectful.

67 YARTS Staff reviewed video and found none of this behavior to be evident during any of the interactions. Driver was never rude or aggressive, answered the questions, handed the guest their cash, realized he was short, so held on and added the remaining change. At no point was the driver disrespectful or inappropriate. So the perception seemed unfounded. 05/17/17 Caller said that she and others were trying to redirect cars to slow down coming around the corner in Mariposa due to a car accident, but the driver did not slow down and flipped her off. YARTS Staff pulled video for review, but video produced no results for follow up. 05/31/17 Caller said they called YARTS line and someone hung up on them 4 times. Follow up showed that this was totally inadvertent and unknown to the staff answering the YARTS lines. The line may have been disconnecting due to long distance issues since call was incoming from Ireland. YARTS Staff asked caller to communicate by for further assistance. KUDOS The following complimentary feedback was received on the YARTS service. GREAT TRIP!! My best friend and I travelled from Fresno to Yosemite yesterday with driver.. The trip was even better because of him and his outstanding customer service. I am hoping this service will continue year round. Thank you for having this service. Had the best time..yesterday was a perfect day. We had the coolest driver and treated us great. Especially we had a handicapped with us..he looked like he enjoyed his job. With my classmates that came from Canada, All parts of US and Philippines they were impressed. I had 35 guest at my party, it was a success and lots of work, but we had a ball. Thank you for going beyond your job in helping us. Our driver on the YARTS bus from Sonora, was excellent. She had a good attitude, was happy and friendly and displayed professional driving skills. Compliments on accessibility and driver, My wife who uses a mobility scooter and I who uses a power wheelchair recently rode the bus from el portal to the park and returned. Not only was the bus very accessible, the driver,.., made the ride entertaining and educational. We were very impressed. Thank you for your service and keep up the good work. Wheel Chair Requests There were no wheelchair requests filled for the month of May 01-31, There have been regular unannounced wheelchair riders on various YARTS runs. Eighteen (18) wheelchair buses (YARTS owned and VIA supplemental fleet) are available to accommodate YARTS passengers on all corridors in accordance with ADA guidelines. Cal-Trans/Park Road Closures, Traffic & Construction Delays There were 5-minute to 2-hour delays on Hwy 140 route throughout the month due to construction, traffic congestion, non-yarts traffic accidents, road closures and conditions, and high passenger counts.

68 Roundabout construction was completed in time for Memorial Day weekend. YARTS drivers have found the flow to be smooth within the park since the construction was completed. Hwy 140 Effective May 15, 2017, Hwy 140 summer schedule began, with additional runs operating. Hwy 120 Sonora Effective May 15, 2017 Sonora summer schedule began with one run per day. Two additional runs went into effect on May 27 th, for a current total of 3 runs daily. Hwy 41 Effective May 15, 2017, Hwy 41 began the summer schedule with a total of 5 roundtrip runs per day. Hwy 120/395 The Mammoth route was supposed to begin effective May 27 th. However Tioga Pass remains closed due to snow pack. Reservations were changed or refunded by request to YARTS Staff. Riders were directed to monitor the website for updated information on this route s operation.

Mariposa County Annual Contract for Services Candy O Donel-Browne moved to recommend the YARTS Joint Powers Authority approve the Contract for Services between YARTS and the County of Mariposa and authorize the Executive Director to execute the Contract for Services on behalf of YARTS. Seconded by Steve Smallcombe. MOTION CARRIED UNANIMOUSLY. 7. YARTS/MCAG Agreement for Services The committee agreed by consensus to recommend the YARTS Joint Powers Authority: a. Authorize the Chair to sign the Agreement for Services between the Yosemite Area Regional Transportation System and the Merced County Association of Governments for a period of one year from July 1, 2017 through June 30, 2018; or b. Provide direction to staff on how to proceed to secure the services specified in the existing contract. MOTION CARRIED UNANIMOUSLY.

122 ITEM 6 MEMORANDUM DATE: JULY 17, 2017 TO: FROM: RE: YARTS JOINT POWERSA AUTHORITY CINDY KELLY, STAFF ANALYST FEDERAL LANDS ACCESS PROGRAM GRANT In May 2017, staff applied for Federal Lands Access Program (FLAP) grant funding through the Federal Highway Administration (FHWA) to operate a three-year demonstration project: YARTS free service to Yosemite on NPS free gate days, which if awarded, would start in November 2017 and conclude in September The demonstration project would provide free transit service to Yosemite National Park on free NPS gate days from all service corridors operating at those times. The total project cost over three years is estimated to cost $183,388. Staff applied for $162,353 from the FLAP grant, with an agency share cost of $21,035. The notification of award is expected to be released in August 2017, with the funding cycle starting on October 1, Since the JPA will not meet again until October 23, 2017, staff is asking that the JPA authorize the Executive Director to sign and execute an agreement with, and to accept funding from FHWA for the Federal Lands Access Program (FLAP) grant, if awarded. A budget amendment will be included on the agenda at the October 23, 2017, if awarded. REQUESTED ACTION Authorize the Executive Director to sign and execute an agreement to accept funding from the Federal Highways Administration for the Federal Lands Access Program (FLAP) grant, if awarded.

123 ITEM 7 MEMORANDUM DATE: JULY 17, 2017 TO: FROM: RE: YARTS JOINT POWERS AUTHORITY DICK WHITTINGTON, TRANSIT MANAGER AMTRAK THRUWAY CONTRACT Attached is a proposed Amendment of Services Contract for your review and approval. The agreement is for a period of three years from July 1, 2017 through June 30, As proposed, the agreement would maintain the current rate of payment for the first year and then be adjusted upward by 3% each of the final two years. Originally, the conversation was for a reduction in the rates that Amtrak pays to YARTS, but a compromise was reached with the proposal as now written. 124 AMENDMENT OF SERVICES CONTRACT Between NATIONAL RAILROAD PASSENGER CORPORATION And Yosemite Area Regional Transportation System This Amendment is entered into as of the day of June, 2017 by and between Yosemite Area Regional Transportation System (YARTS), a joint powers authority of the State of California, with its principal office located at 369 West 18 th Street, Merced, CA ( Contractor ) and the National Railroad Passenger Corporation, a corporation organized under 49 U.S.C et seq. and the laws of the District of Columbia, with its principal office located at 60 Massachusetts Avenue, N.E., Washington, DC ( Amtrak ) (collectively referred to herein as the Parties ). WHEREAS, the Parties entered into Contract No. S , dated June 1, 2007, (the Contract ) pursuant to which Contractor agreed to provide Dedicated Thruway Bus Service Route 15; and WHEREAS, the Parties now desire to amend the Contract as set forth below. 127 MEMORANDUM ITEM 8 DATE: JULY 17, 2017 TO: FROM: YARTS JOINT POWERS AUTHORITY DICK WHITTINGTON, TRANSIT MANAGER RE: YARTS/FRESNO COUNCIL OF GOVERNMENTS AMENDMENT NO. 1 TO AGREEMENT FOR SERVICES CONTRACT The original contract between YARTS and the Fresno Council of Governments (FCOG) was for year-round service and for a period of two years. During the second year, the decision was made by FCOG to suspend the service at the end of September and turn the service into a summer-only operation (May 15 through September 15). An amendment to the original contract was approved by FCOG and the YARTS Board of Directors at that time. The attached Amendment provides an agreement for the service for the second summer of summer-only service. It has been reviewed by Counsel and pronounced acceptable. REQUESTED ACTION Approve the agreement as submitted to YARTS and authorize the Executive Director to sign and execute the document. 133 MEMORANDUM ITEM 9 DATE: JULY 17, 2017 TO: FROM: RE: YARTS AUTHORITY ADVISORY COMMITTEE DICK WHITTINGTON, TRANSIT MANAGER YARTS/NATIONAL PARK SERVICE COOPERATIVE AGREEMENT UPDATE In April of 2017, the US Secretary of the Interior issued a memorandum calling for a temporary review process for grants and cooperative agreements above $100,000 be conducted by his office. See attached memorandum. That process is continuing and the Cooperative Agreement (CA) between the National Park Service (NPS) and YARTS remains in that review process. The CA was sent from the regional NPS office to Washington D.C. on June 1, 2017 and forwarded to the Department of the Interior (DOI) on June 2, Around the 20 th of June, staff made a call to the office of the Secretary and was referred by the person who answered that phone to a phone at NPS following a description of the reason for the call. The voice mail left on that phone did not produce a return call. In seeking to expedite the review/approval of the CA, on July 6, staff contacted the Roseville District Office of Congressman Tom McClintock and talked with the Congressman s District Director, Rocky Deal. He said he will be forwarding our concerns to the Congressman s Washington office asking them to contact DOI to find the status of the applications. In the meantime, YARTS continues to provide the services specified in the Cooperative Agreements, both the regular and the expanded service documents. The amounts in questions are: Regular funding $345,000 YARTS $345,000 Hwy 41 Expanded service: $603,337 All corridors REQUESTED ACTION For information and discussion only. APRIL - JUNE 2017 On Facebook, the average visitor engagement is 3665 hits per week during the report period, with return visitation comprising over 70% of total engaged visitors. Women comprise 55% of visitors, with men at 45%. For geographical location, the United States continues to be the first of the top 10 countries, with 23% of total engaged visitors. Visitation on the Facebook page has declined, and one of the main reasons is that staff was engaged with refunds for visitors on the Hwy 120/395 corridor. In addition, it was discovered that the MCAG/YARTS/TheBus Facebook account had been hacked and will no longer accept updates unless via the Facebook app on a tablet or smartphone. The YARTS website has averaged over 30,649 visits per month. Almost 66% of the visitors are using yarts.com for the first time. The average session time is 4 minutes 12 seconds. The average bounce rate (the rate at which a person leaves the website through other links and returns) is over 36%. As with the YARTS Facebook page, the United States continued to be first of the top 10 countries that comprised the majority of user sessions, with over 81% of total users. 143 ITEM 11 MEMORANDUM DATE: JULY 17, 2017 TO: FROM: RE: YARTS JOINT POWERS AUTHORITY CINDY KELLY, YARTS STAFF ANALYST YARTS ONLINE RESERVATIONS UPDATE DISCUSSION For the past two years, YARTS staff had previously attempted to initiate an online reservations system. The challenges that needed to be overcome were the inability of reservation companies to design a system that would accommodate YARTS complex schedules and fare structures. After three failures with other companies and three months of preparation, YARTS launched a twomonth pilot for online reservations for the Hwy 140 service on October 16, The pilot, provided by Betterez Inc., Online Reservations Systems, allowed for a set number of passengers per bus, per day, the option to reserve and pay for their YARTS tickets in advance for both inbound and outbound trips to any of the stops along its route. YARTS promoted the service through a softopening -- marketing was limited to social media posts and information on the website. After the initial success of the pilot, YARTS and Betterez entered into a one-year contract starting December 17, On December 19, 2016, reservations were opened for all YARTS routes. On July 5 th, 2017, Winter schedules were opened for reservations for the Hwy 140 service. In April, staff reached out to passengers who had reservations for the Mono County service. Due to the delayed opening of Tioga Road, 299 refunds (out of 308) were issued for that service for reservation dates from May 27 - July 1, In June, due to the rockslide that closed access to the park via Hwy 140, YARTS issued 66 refunds (out of 119) and moved the remaining reservations to either Hwy 41 or Hwy 120 (Tuolumne County) with the passengers consent.
