BACKGROUND INFORMATION: Citywide Curb Ramps 2018 Project (WAC013) The City of Elk Grove (City), proposes to remove accessibility barriers to persons using wheelchairs or other personal assistance devices by reconstructing existing curb ramps to meet current Americans with Disabilities Act (ADA) slope and access requirements. The project also includes the installation of new pavement markings and traffic signs/posts as needed. A total of 67 ADA-accessible curb ramps will be installed at 30 locations throughout the City. Typical locations include intersections and marked and unmarked crosswalks. 1

Pavement Resurfacing 2018 Project (WPR018) The project includes approximately 1.06 million square feet of microsurfacing and approximately 634,000 square feet of slurry seal. This work encompasses 36 existing street segments throughout the City. The project is needed as part of annual street surface improvement and maintenance. A Project Location Map is provided as Attachment 3. ENVIRONMENTAL REVIEW: The California Environmental Quality Act (Section 21000, et. seq. of the California Public Resources Code, hereafter CEQA) requires analysis of agency approvals of discretionary projects. A project, under CEQA, is defined as the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. Both the Citywide Curb Ramps 2018 Project (WAC013) and the Pavement Resurfacing 2018 Project (WPR018) are defined as projects under CEQA. Staff has reviewed both the Citywide Curb Ramps 2018 Project (WAC013) and the Pavement Resurfacing 2018 Project (WPR018) to determine the required level of review under CEQA. Both the Citywide Curb Ramps 2018 Project (WAC013) and the Pavement Resurfacing 2018 Project (WPR018) are exempt under CEQA Categorical Exemption 15301(c) (Class 1: Existing Facilities). This exemption applies to projects involving the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency s determination. The Citywide Curb Ramps 2018 Project (WAC013) includes removal of accessibility barriers to persons using wheelchairs or other personal assistance devices by reconstructing 67 existing curb ramps to meet current ADA accessibility requirements. The Pavement Resurfacing 2018 Project (WPR018) includes microsurfacing and slurry seal. This work encompasses 36 existing street segments throughout the City. No special circumstances exist that would create a reasonable possibility that either 2

Therefore, both projects qualify for the identified exemption, and no further environmental review is required. Because of the use of federal funding for the Citywide Curb Ramps 2018 Project (WAC013), the Project also qualifies for review under the National Environmental Policy Act (42 U.S.C et seq, hereinafter NEPA). The Department of Housing and Urban Development (HUD) is the NEPA lead agency for the Project. CEQA compliance is being completed for this Project prior to the completion of NEPA. HUD will prepare a Categorical Exclusion for the Project pursuant to NEPA, following the completion of CEQA compliance. FISCAL IMPACT: There are no fiscal impacts associated with adoption of the resolution. The budget associated with each Project were included in the Capital Improvement Program Five-Year Plan A CIP budget amendment was previously approved per resolution to primarily add funding from SB1 Local Partnership (Fund 228) to both projects up to the California Transportation Commission (CTC) approved amount. The current budgets are shown in Table 1 and Table 2. WHEREAS, both the Citywide Curb Ramps 2018 Project (WAC013) and the Pavement Resurfacing 2018 Project (WPR018) are defined as projects under California Environmental Quality Act (Section et seq. of the Public Resources Code, hereinafter referred to as CEQA) which requires that cities consider the environmental consequences of their actions before approving a project; and WHEREAS, due to the use of federal funds for the Citywide Curb Ramps 2018 Project (WAC013), the project qualifies for review under the National Environmental Policy Act (42 U.S.C et seq., herein after NEPA); and WHEREAS, the Citywide Curb Ramps 2018 Project (WAC013) is a project under CEQA and NEPA; and WHEREAS, Section 15301(c) (Class I: Existing Facilities) of the State CEQA Guidelines (Chapter 3 of Division 6 of Title 14 of the California Code of Regulations) provides an exemption from CEQA for projects involving the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency s determination; and WHEREAS, CEQA must be completed prior to requesting California Transportation Commission (CTC) Construction Funding for both the Citywide Curb Ramps 2018 Project (WAC013) and the Pavement Resurfacing 2018 Project (WPR018); and WHEREAS, the Projects are included in the approved Capital Improvement Program 5 Year Plan. 5
6 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Elk Grove hereby finds both the Citywide Curb Ramps 2018 Project (WAC013) and the Pavement Resurfacing 2018 Project (WPR018) exempt from CEQA pursuant to pursuant to section 15301(c) of the State CEQA Guidelines and approves the Projects.
