21 The legal basis for Z.T.L. Italy is the sole European country providing a legal basis on national level to introduce zones limited to traffic in urban areas and to enforce infringements (penalties/fines) Codice della Strada (road traffic provisions), as the basic legislative piece. Regulates next to speeding, incorrect parking, passing red traffic lights, drink driving also the disciplinary proceedings for accessing a Z.T.L without authorization Homologation of Z.T.L systems on basis of centralized certification assures respect of Data Protection Directive (95/46/EC) No discriminatory treatment of residents and foreigners (cross-border enforcement). 20

22 Benefits of Z.T.L. for a city Reduction of motorized private transport, less congestion, time-reliable accessibility for eligible motorists More available parking lots for local residents and increased use of public transport Reduced air pollution and noise; residential environment of improved living conditions Attractive ground zones by dismantled traffic infrastructure and restoration measures Experience in Italy with Z.T.L systems has shown access zones into city centres regarded positively in most respects and not perceived as a limitation in mobility Manufacturing, maintenance and operating costs commonly pay off the first year of operation, on the sales of entry permits and the penalties imposed for not having any 21

23 Z.T.L. vs Parking management Coexistence or contradiction? Both traffic control systems (Z.T.L. and Parking Management) cover different fields of application (traffic in flow <-> parking). A Z.T.L. does not replace Parking management and vice versa Combination of both measures is useful A Z.T.L. with a reasonable framework considers city-specific initial prerequisites and entry requirements a fine is issued to vehicle owners in case of non-compliance Parking management in Italy follows a categorization of parking areas ( colour theory ) not marked parking space -> usable for all with a valid entry permit yellow marked parking space -> reserved for the category of residential neighbours Blue marked parking space -> Short-term parking zone (payable) 22
