1 EUROPEAN COMMISSION ENTERPRISE DIRECTORATE-GENERAL Consumer goods Automotive industry Brussels, 16 January 2006 DG ENTR/F/5/AL Draft minutes of the meeting of the Motorcycle Working Group 12 th July 2005 (Borschette Building, rue Froissard 36, Brussels) The Chairman, Mr. Schneider (EC, DG Enterprise, Unit F1), welcomed the participants and informed on interpretation arrangements (see Annex: Attendance List). 1. APPROVAL OF THE AGENDA UK asked for an additional item concerning foot rest on the agenda. The amended agenda was adopted. 2. EXCHANGE OF VIEWS ON THE ANTI-TAMPERING STUDY AND A PROPOSAL FOR AN AMENDMENT OF DIRECTIVE 97/24/EC; (TÜV STUDY - MCWG AND DOCUMENT MCWG-05-02, DOCUMENT FROM FRANCE - MCWG-05-06) The Commission introduced the discussion by presenting the results of the TÜV study on anti-tampering which was completed at the end of This study had to cope with the lack of vehicles complying with Directive 97/24/EC since the latter only became mandatory in June Consequently, the study only proposes simple measures, namely to extend the scope of anti-tampering measures to motorcycles above 125 cm 3 and to 3 and 4 wheelers, to amend the measures against simple manipulation of today s electronic technologies (without proposing requirements on that point) and to modify the requirements of Chapter 9 on noise. The majority of these measures were taken into account in the draft amendment to Directive 97/24/EC (MCWG-05-02). ES, ACEM and FEMA could not support the conclusions of TÜV because the proposed measures are not based on a cost-effectiveness assessment. ACEM and IT referred to the discussion on driving licences and proposed to wait for the end of this discussion before taking new measures concerning antitampering. The Chairman assured that contact will be kept with DG TREN, which is in charge of driving licences (NB : Discussions on driving licences are suspended for the moment) but the discussion on anti-tampering measures should not be delayed. ES and UK supported the extension of the scope of anti-tampering measures to all two and three wheelers whereas FR, IT and ACEM stressed that the scope should not be extended to quadricycles because most of them have diesel engines which do not use the same technology (2 stroke petrol engines) that is used for mopeds or Commission européenne, B-1049 Bruxelles / Europese Commissie, B-1049 Brussel - Belgium.. 2 motorcycles. ES, supported by FR, proposed to extend the scope only to those petrol engines using the technology of mopeds or motorcycles. FR presented a further draft proposal on anti-tampering based on type-approval experience. The proposal foresees requirements regarding manipulations on the transmission ratio, the exhaust system, electronic management. Furthermore, it is proposed to enhance the requirements on conformity of production, marking, and limitation of P max and V max. This latter point was supported by IT Many Member states and FEMA asked for more time to reflect on the French proposal. The Chairman concluded that this matter needs further discussion and proposed to try to combine the 2 proposals from the Commission and from France and discuss it in the next meeting. 3. EXAMINATION OF A DRAFT DIRECTIVE (DOCUMENT MCWG-05-02) MODIFYING DIRECTIVE 93/14/EEC ON THE BRAKING, DIRECTIVE 93/34/EEC ON STATUTORY MARKINGS, DIRECTIVE 95/1/EC ON THE MAXIMUM DESIGN SPEED, MAXIMUM TORQUE AND MAXIMUM NET ENGINE POWER, DIRECTIVE 97/24/EC ON CERTAIN COMPONENTS FOR AND CHARACTERISTICS OF TWO-OR-THREE WHEEL MOTOR VEHICLES Most of the measures proposed in this draft directive were discussed during previous meetings and were supported by Member States and stakeholders. The amendment: aligns Directive 97/24/EC with UN/ECE Regulation 78 on braking; exempts vehicles without speed limitation from measuring the top speed during type approval; clarifies requirements that apply to bodied vehicles; simplifies requirements on statutory markings; introduces new requirements on anti-tampering. As discussed before the measures on anti-tampering need further discussions and will be removed from this proposal in order not to delay its adoption. The modified proposal will be presented to the CATP 4. EXCHANGE OF VIEWS CONCERNING STATUTORY MARKINGS ON EXHAUST SYSTEMS (LETTER FROM NETHERLANDS - DOCUMENT MCWG-05-03) NL proposed to harmonise markings of the exhaust sytem (silencers and catalytic converters) for original replacement parts (replacement parts sold by the motorcycle manufacturer) and original parts mounted on a new vehicle. 2
3 The solution was supported by the majority of Member States, ACEM was not in favour. In conclusion, it was agreed to propose marking of all exhaust silencers and catalytic converter being mounted on a new vehicle or sold as a replacement part by the vehicle manufacturer as follows: e mark + country code; the vehicle manufacturer name or trade mark; the make and identifying part number. The Chairman announced that this solution will be presented to the CATP. 5. EXCHANGE OF VIEWS CONCERNING THE COHERENCE BETWEEN DIRECTIVE 97/24/EC AND DIRECTIVE 2002/24/EC REGARDING COUPLING DEVICES (LETTER FROM GERMANY - MCWG-05-04) According to Germany, the scope of directive 97/24/EC concerning the typeapproval of coupling devices is not sufficiently clear. An amendment would be necessary to clarify whether the directive should apply to technical units. A first draft was presented during the meeting In principle, the participants were in favour of a clarification. But as the amendment was just presented during the meeting, more time was requested to reach a clear position. The Chairman proposed that the participants send their comments on the German proposal within two months following the meeting. 6 EXCHANGE OF VIEWS CONCERNING THE DIMENSIONS OF QUADRICYCLES (AFQUAD PROPOSAL - MCWG-05-05), TYPE APPROVED KARTS (MCWG-05-07) Karts The Chairman presented the case of a kart which was type approved as a quadricycle whereas it is clearly not designed to be used on publics roads (see picture on MCWG-05-07). Most of the participants agreed that this type of vehicles should not be typeapproved and that its use is dangerous on publics roads. In order to avoid such type approvals in future two possible solutions were discussed: One solution could be to define technical requirements which exclude such vehicles for safety reasons, for instance, define a minimum height for the vehicle. This could be introduced by new requirements regarding field of vision or under run protection that are derived from requirements applicable for other categories of vehicles. 3
4 The second solution could be based on the new Article 28 introduced in the recast of the Framework Directive for motor vehicles (70/156/EEC). This article allows Member States to refuse the registration or the sale of vehicles, systems, components, or technical units that present a serious risk to road safety, environment or public health. The Member State using this procedure shall inform the Commission. The Chairman expressed his preference to the second solution which would be in coherence with what is used for cars and covers the maximum number of possible cases. But technical provisions could also be added if it is justified from a safety point of view. Dimensions of quadricycles A draft amendment to directive 93/93/EEC was presented by AFQUAD. This amendment proposes: to add requirements regarding masses in order to better differentiate vehicles intended for the carriage of goods and vehicles for the transportation of passengers. to have coherence between the unladen mass and the number of seats of the vehicle to ensure that the dimensions of quadricycles remain small compared to cars The group expressed concerns about the risk of increasing the authorized mass of those vehicles and the implication of such modification for type approved quads. The main issue was how to distinguish type-approved quads (vehicles mainly for off-road use) with classical quadricyles. The Chairman concluded that further reflection is needed on that matter. The Commission will study the possibilities to distinguish quads from classical quadricyles 7 ANY OTHER BUSINESS UK raised the issue that EC directives do not include requirements on foot rests. UK will prepare an amendment to 93/32/EEC on passenger hand-holds on that matter for an exchange of views during the next meeting ACEM asked for clarification about the purpose of the corrigendum of Directive 93/31/EEC concerning stands (published on the Official Journal L 239, 09/07/2004 P ). The Chairman explained that the purpose of the corrigendum was only to align the English and the Swedish versions to the other linguistic versions. As there was no further comment, the Chairman closed the meeting. Annex: Attendance list 4
