That I am the bidder (if the bidder is an individual), a partner, (if the bidder is a partnership), or an officer or employee of the bidding corporation having authority to sign on its behalf (if the bidder is a corporation); 2. Any agreement or collusion among bidders or prospective bidders which restrains, tends to restrain, or is reasonably calculated to restrain competition by agreement to bid at a fixed price or to refrain from bidding, or otherwise, is prohibited. 2. Any person who violates any provisions of KRS 45A.325 shall be guilty of a felony and shall be punished by a fine of not less than five thousand dollars nor more than ten thousand dollars, or be imprisoned not less than one year nor more than five years, or both such fine and imprisonment. Any firm, corporation, or association which violates any of the provisions of KRS 45A.325 shall, upon conviction, be fined not less than ten thousand dollars nor more than twenty thousand dollars. SWORN STATEMENT OF COMPLIANCE WITH CAMPAIGN FINANCE LAWS In accordance with KRS45A.110(2), the undersigned hereby swears under penalty of perjury that he/she has not knowingly violated any provision of the campaign finance laws of the Commonwealth of Kentucky and that the award of a contract to a bidder will not violate any provision of the campaign finance laws of the Commonwealth of Kentucky. CONTRACTOR REPORT OF PRIOR VIOLATIONS OF KRS CHAPTERS 136, 139, 141, 337, 338, 341 & 342 The contractor by signing and submitting a bid on this invitation agrees as required by 45A.485 to submit final determinations of any violations of the provisions of KRS Chapters 136, 139, 141, 337, 338, 341 and 342 that have occurred in the previous five (5) years prior to the award of a contract and agrees to remain in continuous compliance with the provisions of the statutes during the duration of any contract that may be established. Final determinations of violations of these statutes must be provided to the University by the successful contractor prior to the award of a contract. CERTIFICATION OF NON-SEGREGATED FACILITIES The contractor, by submitting a bid on this Invitation, certifies that he/she is in compliance with the Code of Federal Regulations, No. 41 CFR (b), that prohibthe maintaining of segregated facilities. 11 INVITATION NO. K PAGE 11 SPECIAL TERMS AND CONDITIONS Pre-Delivery: Copy of check list is to accompany the vehicle. Each unit must be completely serviced by the successful bidder in accordance with the manufacturer's recommendations. The crankcase, differential and transmission must be filled as recommended by the manufacturer. Each vehicle must have no less then five (5) gallons of fuel and be in first class operating condition at time of delivery. Factory Warranty: Manufacturer's standard guarantee against defective parts and engineering to apply in accordance with stated policy. Advertising: Each unit is to be entirely free of any and all advertising attachments of the dealer, such as clips, license brackets, or other devices bearing vendor's name. Literature: Each unit shall be accompanied by an owner's manual properly filled out with the warranty procedures. Exceptions to Specifications: Any variation from the requirements of this specification made part of the bid invitation must be listed and attached to the bid. This sheet shall be labeled as such. Failure on the part of the bidder to comply with any and all requirements and conditions of this specification may be reason to reject bid. If no exceptions or deviations are shown, the bidder will be required to furnish materials exactly as specified. The proof of compliance with this specification will be the responsibility of the vendor. Models of another manufacturer will be considered for approved equal if it is in accordance with detailed specifications set forth herein and certain features are equal to the minimum comparable feature of model and manufacturer requested. Delivery Requirements: Any vehicle furnished in compliance with subject bid shall be delivered within the delivery period as designated by the contractual document unless otherwise authorized by the Division of Purchasing. Should the contractor be unable to deliver as specified, written notice must be submitted to the Division of Purchasing prior to the termination of the delivery period specified. Notice shall detail the reason(s) for non-compliance with the delivery commitment and offer a revised delivery date for acceptance by the Division of Purchasing. Failure to deliver as specified shall be just cause for the Division of Purchasing to cancel the contractual agreement. INVITATION NO. K PAGE 12

12 Delivery Area: Vendor will deliver vehicle to University of Kentucky, Management and Operations Shop Area on Maine Chance Farm, Lexington, Kentucky for all departments except Community Colleges and the Physical Plant Department which will be delivered to Physical Plant Areas. The vehicle(s) will then be inspected and specifications checked before turning vehicle(s) over to the requesting department. Vehicle Transaction Record: Vendor is required to complete the Seller's Section and Certified Inspector Section of Vehicle Transaction Record before delivery of vehicle is made. These records are to be sent to University of Kentucky, Equipment Inventory Department, Room 301 Peterson Service Building, Lexington, Kentucky Payment: This is to advise all bidders that you should not expect payment to be received until approximately three (3) weeks after delivery of vehicle and the appropriate documents. If vehicle received does not meet specifications, payment will be further delayed. Vendors will not be allowed to pick up checks. NOTE: Bidder is required to submit with bid all standard and optional equipment which will be on the vehicle quoted. Bidder failing to include this list will not be considered. All standard and optional equipment must be bid as factory installed on vehicle, NOT DEALER INSTALLED. Alternate bid must be noted on bid.
