In so doing, the three-judge appel late divi - sion panel reversed an ear lier judg ment of the appel late divi sion in Alameda, Kern, Orange, San Bernadino and San Mateo coun ties. Los Angeles County Judge Sanjay T. Kumar wrote, As explained below, it is our view that pho to graphs taken by an Automated Traffic Enforcement System may be admis si ble even if the tes ti fy ing offi cer was not a per cip i ent wit ness to the vio la tion and was not per son ally respon si - ble for set ting up the camera. Back ground: On March 13, 2009, a notice to appear was issued to appel lant pur su ant to the auto - mated traf fic enforcements stat ues, alleg - ing she failed to stop at a red sig nal light at the inter sec tion of Centinela Ave. and Beach Ave. in the city of Inglewood. Fol - low ing a court trial in which pho to graphic evi dence from an auto mated traf fic enforce ment sys tem (ATES) was admit - ted, appel lant was con victed. The appel lant appealed the con vic tion, con tend ing: (1) the pho to graphs were inad mis si ble because no foun da tion was estab lished that the pho to graphs were a rea son able rep re sen ta tion of what they were alleged to por tray, and they con sti - tuted hear say; (2) the yel low light inter val did not con form to the require ments of the Vehi cle Code; (3) the pros e cu tion s use of pho to graphic evi dence vio lated appel - lant s Sixth Amend ment right to con front wit nesses; and (4) the pros e cu tion failed to Copen ha gen Devel op ing Cycle Super Highways A Total of 26 Routes Will Have an Overall Length of 186 Miles On your bike! is the mes sage being directed at cit i zens liv ing in and around Copen ha gen, Den mark. 2 THE URBAN TRANSPORTATION MONITOR, APRIL 11, 2011, VOL. 253, NO. 3 Page 2 Superbus Prototype Developed by Delft University of Technology Runs on Dedicated Concrete Roads The Delft Uni ver sity of Tech nol ogy is pre - sent ing its pro to type of the Super bus in Dubai on the first day of the 59th In ter na - tional As so ci a tion of Pub lic Trans port (UITP) Con gress and World Ex hi bi tion, April 10-14, The Super bus Pro ject is an in no va tive pub lic trans port ef fort and a new con cept for safe, flex i ble and sus tain able mo bil ity. Started in 2004, the re search and de vel op - ment team is led by Dutch as tro naut and Delft Uni ver sity Pro fes sor Dr. Wubbo Ockels. It is funded by the Dutch gov ern - ment and other spon sors. Im ple men ta tion of the Superbus is planned for The Super bus con cept con sists of a new vehicle, new type of dedicated infrastruc - ture and new lo gis tics, ac cord ing to the pro ject team. In this con cept, all of the in - tel li gence and in no va tion is put into the ve - hi cle. In con trast, the ded i cated in fra struc - ture, where the Super bus runs at 250 km/h (155 miles per hour), is made of rel a tively cheap concrete roads. Super bus is a high-speed ve hi cle that is some where be tween a bus and a sports car, Dr. Ockels has said. By in te grat ing ex ist ing high-speed au to mo tive tech nol - ogy with ex ist ing aero space en gi neer ing tech nol ogy, Super bus will travel with a cruis ing speed of 250 km/h with out any di - rect CO2 and NO2 emissions. The Super bus uses aero space tech nol - ogy in com bi na tion with For mula 1 tech - nol ogy to cre ate a light weight struc ture with a low drag shape that is sta ble and con - trol la ble at high speed. The pro to type is elec tri cally pow ered with a 1,000-1,200kg re charge able bat tery pack, mak ing it sus - tain able. Since the pro to type is light weight and has a highly stream lined con struc tion, it also has low energy consumption. At 15 m long and 2.5 m wide (49.2 feet and 8.2 feet), the Super bus has sim i lar di - men sions to a reg u lar pub lic tran sit bus. But the height of the Super bus is just 1.7m. (5.4 feet), which makes the bus ap pear lon - ger. Also, in stead of a few large doors, the Super bus has eight or more doors along both sides of the ve hi cle to al low di rect ac - cess to all seats to increase comfort. Super bus is planned to go be yond the con cept of a fixed sched ule. Thus the vehicle trans - ports pas sen gers from their or i gin to their des ti na tion with out the need for changeovers. Be side all this, Super bus is de signed to pro vide a sen sa tional travel ex pe ri ence through high speed, er go nomic in te rior de sign and per sonal mul ti me dia equip - ment for each in di vid ual passenger. Super bus is de vel oped in the Neth er - lands, but it can be re garded as a global in - vest ment since the Neth er lands will sub - se quently be able to mar ket it world wide, ac cord ing to the Super bus pro ject website. It would set stan dards for ju ris dic tions that choose to im ple ment golf cart or di nances and al low res i dents to use them for lo cal trans por ta tion. The bill has been called a jobs bill for an in dus try that has three man u fac tur ers in Geor gia. The leg is la tion has strong back - ing from the Na tional Golf Car Man u fac - turers Association. If signed, the Act shall be come ef fec tive on January 1, The bill, passed first by the Geor gia Sen ate on March 16 and then by the Geor - gia House of Rep re sen ta tives on March 31, would amend Ti tle 40 of the Of fi cial Code of Geor gia An no tated, re lat ing to mo tor ve hi cles and traf fic, so as to cre ate a new class of mo tor ve hi cles to be known as per sonal trans por ta tion ve hi cles. The legislation defines per sonal trans por ta - tion ve hi cle to mean any motor vehicle: with a min i mum of four wheels, ca pa ble of a max i mum level ground speed of less than 20 miles per hour, with a max i mum gross ve hi cle unladen or empty weight of 1,375 pounds, and ca pa ble of trans port ing not more than eight per sons. Per sonal trans por ta tion ve hi cles would not in clude mo bil ity aids, in clud ing power wheel chairs and scoot ers, which can be used in doors and out doors for the ex press pur pose of en abling mo bil ity for a per son with a dis abil ity. The term also does not in - clude any all-ter rain ve hi cle. The bill spec i fies that, to travel on the road, per sonal trans por ta tion ve hi cles would have to have spe cific safety equip - ment in clud ing: A brak ing sys tem suf fi cient for the weight and pas sen ger ca pac ity of the ve - hi cle, in clud ing front brakes and a park - ing brake. Seat belts A re verse warn ing de vice func tional at all times when the di rec tional con trol is in the re verse po si tion. A main power switch. When the switch is in the off po si tion, or the key or other de vice that ac ti vates the switch is re - moved, the mo tive power cir cuit shall be in op er a tive. If the switch uses a key, it shall be re mov able only in the off po - sition. The current legislation would exempt cities and coun ties that had golf cart or di - nances in place be fore the bill takes ef fect from the stan dards set in the leg is la tion. In the past, sim i lar leg is la - tion was in tro duced, which would have re stricted golf cart driv ing to per sons age 16 and above and li censed driv ers. That ver sion was ve toed by then-gov er nor Sonny Perdue last year. If en acted, lo cal gov ern ments will have the fi nal say as to whether golf carts are permitted in their communities. The BIXI To ronto pro gram was ap proved by the City Coun cil last May. The BIXI To ronto pro gram is an ex cit - ing new cy cling ini tia tive that will en cour - age more bi cy cle trips in the down town core. It is also a great ex am ple of pub - lic-pri vate part ner ship to ben e fit To ronto res i dents and vis i tors," said Coun cil lor Denzil Minnan-Wong, chair of the City s Pub lic Works and In fra struc ture Com mit - tee, in a March press release. The Pub lic Bike Sys tem Com pany (PBSC) is the or ga ni za tion be hind the con - cept, de vel op ment and op er a tion of award-win ning BIXI - which op er ates bike shar ing sys tems on three con ti nents and is the first large-scale bike shar ing sys tem in North America. We are happy to count To ronto among the three Ca na dian cit ies where the BIXI ser vice will be avail able in 2011," said Roger Plamondon, chair man of the PBSC board. More than 1,200 Torontonians pur chased an an nual mem ber ship last fall, five months be fore the pro gram s launch. We are con vinced that Torontonians will quickly adopt the BIXI bikes as a con ve - nient and eco nom i cal way to get around. De signed to com ple ment pub lic tran sit, the BIXI bikes are in tended to be used for one-way trips of less than 30 min utes. BIXI bikes can be picked up or dropped off at any of the 80 down town bi cy cle dock ing sta tions 24 hours a day, seven days a week. Bérengère Thériault, a spokes woman for the Pub lic Bike Sys tem Com pany, said other com pa nies are con tracted to re dis - trib ute BIXI bikes among the bike sta tions us ing trucks 24 hours a day. She said that more trucks are used dur ing the morn ing and eve ning rush hour pe ri ods when there is the most use of the bikes. Thériault noted that many of the bike sta tions in To ronto and other cit ies are lo - cated near pub lic tran sit sta tions to al low cy clists to plan multi-modal trips. To ronto is Can ada s larg est city and sixth larg est gov ern ment, and home to about 2.6 mil - lion peo ple. Reg u lar us ers of the sys tem will pur - chase a pass for pe ri ods of time rang ing from one month to one year and will re - ceive a BIXI key. Mem bers can use their BIXI key to take out a bike at any sta tion in the net work. Non-mem bers can pur chase a 24-hour pass. There is no trip fee if the bi - cy cle is re turned to a bike sta tion within 30 min utes. A fee is charged for any trip lon - ger than 30 min utes. A per son will be able to use the bikes for $95 a year, $40 a month or $5 a day. There will be ad di tional fees, how ever, for rides that are longer than 30 minutes. Con tin ued from Page 1 Copenhagen Area Developing Cycle Super Highways Super High way is a cy cle high way, where the com mu ters needs have been given the high est pri or ity. A Cy cle Super High way is de fined both by its lo ca tion as well as its phys i cal qual i ties, he ex plained. The high way should con nect ar eas with many work ers and stu dents to their homes and to public transportation possibilities as well. The high ways should be fast, mean ing as di rect as pos si ble and with as few stops as pos si ble. Fur ther more the high ways have to be com fort able and safe. Com fort is se - cured by a high qual ity of as phalt and main te nance. Se cu rity is achieved, for in - stance by clear mark ings and dis tance to cars and by suf fi cient light ning. The 26 planned Cy cle Super High way routes have a to tal length of 300 ki lo me ters (186 miles). Ac cord ing to Jantzen, the es - ti mated po ten tial of the routes are about 52,000 com mu ters a day. Both com mu ters and oth ers will use the routes, he said, but the main fo cus is on commuters. The pro ject started in 2010 and has great am bi tions, ac cord ing to Maria Streuli, man ager of the pro ject sec re tar iat, which re ceives sup port from a na tional fund that pro motes cy cling ac tiv i ties. Our vi sion is to make the Co pen ha gen re - gion the best cy cling re gion in the world, she says. The tar get group is com mu ters cy cling long dis tances to work. Most bi - cy cle com mu ters only cy cle up to five ki lo - me ters (approx. 3 miles), so we need to reach out to those who have fur ther to go to work. Ac cord ing to Jantzen, the pro ject s main ob jec tive is to get more peo ple to use bikes in stead of cars for dis tances from 5 to 20 ki lo me ters (about 3 to 12.4 miles). He stressed, We want peo ple to per ceive these routes as a se ri ous al ter na tive equal to tak ing the car, bus or train. This will have a big im pact on the en vi ron ment, with an es ti mated po ten tial of a re duc tion of 7 tons of carbon dioxide each year." The north ern Eu ro pean con sult ing group COWI, which has ex per tise in cy cle traf fic, is serv ing as con sul tant to the sec - re tar iat. Hen rik Grell, a traf fic plan ner at COWI, says the pro ject seeks to cre ate routes that of fer fast, comfortable and safe ser vice for cy clists trav el ing long distances. To a great ex tent, the routes will make use of cur rent roads and paths, but the routes will have to be op ti mized to Please turn to Page 6

A. war rant re ver sal of the judg ment (Peo ple v. Khaled), Los An geles County Judge Sanjay T. Kumar wrote. Spe cif i - cally, Khaled held pho to graphs from an ATES pur port ing to show the de fen dant driv ing through a red light were in ad mis si - ble because the testifying officer: (1) was not a per cip i ent wit ness and there fore, could not es tab lish that the photo was a rea son able rep re sen ta tion of that which it is al leged to por tray, or (2) could not es tab lish the time the cam era was set to re - cord and the method used to re trieve the pho to graphs. In ad di tion, Khaled held the pho to graphs con sti tuted in ad mis si ble hear say in that they were not ad mis si ble busi ness re cords or of fi cial re cords. We re spect fully dis agree with Khaled, Kumar wrote. She added, We con clude the ac cu racy of the pho to graphs is sub ject to a rebuttable pre sump tion pur su - ant to Ev i dence Code. More over, apart from such a pre sump tion, the pho to graphs may be au then ti cated by a law en force ment of fi cer who has knowl edge about the meth - ods used by the ATES to trans mit the pho to - graphs to the of fi cer s law en force ment agency. Fi nally, the data and im ages on the pho to graphs did not con sti tute hear say be - cause they did not amount to a statement from a human declarant. Dis cus sion: Kumar wrote that Ev i dence Code sec tions 1552 and 1553 es tab lish a pre sump tion that the data and dig i tal im ages from the ATES were an accurate representation of the in - for ma tion or im ages con tained therein. The optimization measures may in volve a num ber of op tions, in clud - ing new or wider bike paths, reg u la - tion of traf fic lights, im proved sign - age and au to matic cycle pumps. In ad di tion, an other im por tant part of the pro ject is the pub lic re la - tions cam paign which will oc cur parallel to the actual implementation of the routes. The open ing of the first route in 2011 will be ac com pa nied by an in ten sive cam paign pe riod, and fur ther dis sem i na tion and in for - ma tion activities are planned. The pur pose of the hear say rule is to sub ject the declarant to cross-ex am i na tion in or - der to bring to light any fal si ties, con tra - dic tions, or in ac cu ra cies that may not be discernible in the declarant s out-of-court statement. Re gard ing the du ra tion of the yel low light interval, the intersection was tested twice and both tests re sulted in av er age yel low light in ter vals of more than the man dated in ter val of 3.9 sec onds based on a prima fa cie speed limit of 40 miles per hour for ap proach ing vehicles. Re gard ing the Sixth Amend ment, dur - ing the pro ceed ings, the ap pel lant did not at any time claim that the use of pho to - graphs from the au to mated sys tem vi o - lated her right to con front and cross-ex - am ine wit nesses. There fore, the con fron - ta tion clause claim is for feited on ap peal. More over, pho to graphs and vid eo tapes are dem on stra tive ev i dence, de pict ing what the cam era sees. There are not tes ti - mo nial ev i dence and they are not hearsay evidence. The ap pel lant claimed that the pros e - cu tion was re quired to pro duce a clear pho to graph of the driver of the ve hi cle and that the driver s face in the photo was ob - scured by the rear view mir ror. The trial court found that the mir ror cov ered about 20 per cent of the driver s face and de - clined to hold that, as a mat ter of law, a trier of fact is un able to de ter mine the iden tity of a per son in a pho to graph be - cause ap prox i mately 20 per cent of the person s face is obscured. The orig i nal judg ment was af firmed.

VanderKlipp told UTM that, de spite the tough econ omy, peo ple still need to find their des ti na tions. Mak ing it eas ier for vis i tors to find their way is par a mount for any in sti tu tion be it a hos pi tal, cul tural cen ter, ed u ca tional in sti tu tion, cor po ra - tion, city or re gion. Vis i tors who feel com - pe tent and con fi dent in an en vi ron ment are more likely to have good mem o ries and come again. This leads to return visits and increased revenue. Ac cord ing to VanderKlipp, wayfinding ties to gether ver bal and vi sual cues, us ing sign age, but also by work ing through ar - chi tec ture, in te ri ors, light ing and land - scape de sign. It cre ates tools to sup port a variety of navigation preferences. Visu - ally, use of a sim i lar graphic ap proach to map ping and the pre sen ta tion of in for ma - tion will build fa mil iar ity with the pro gram and make wayfinding tools rec og niz able, whether on line, in a mobile device, or on a sign, he said. Asked about new di rec tions for wayfinding, VanderKlipp said that re gions are re al iz ing that a shared ap proach to at - tract ing busi ness, res i dent and tour ist dol - lars will be a net ben e fit. Towns and des ti - na tions may have been com pet ing for the same tour ist dol lars for gen er a tions. To re - al ize the ben e fits of wayfinding, stake - holders must over come this cul tural hur dle at the be gin ning of the pro cess. A con sol i - dated ap proach to wayfinding uni fies a re - gion both ver bally and vi su ally, and gives vis i tors the tools they need to nav i gate suc - cess fully. Most im por tantly, the in for ma - tion pro vided to vis i tors can make them feel like in sid ers be cause they can dis - cover unique events, at trac tions and des ti - na tions on their own. At the same time, wayfinding can build awareness among residents to all that their region has to offer. VanderKlipp de scribed three cur rent Corbin De sign wayfinding pro jects: Ra - leigh, North Carolina; Cen tre City, Cal - gary; and Georgetown, South Carolina. Con nect ing Phys i cal to Dig i tal: Raleigh, NC As a state cap i tal and one of the fast est grow ing U.S. cit ies, Ra leigh de vel oped a wayfinding sys tem for its 370,000 res i - dents and 11.5 mil lion yearly vis i tors. Corbin worked closely with the Down - town Ra leigh Al li ance, a non profit eco - nomic de vel op ment or ga ni za tion, to im - prove wayfinding while better brand ing the city. The re sult ing sys tem was de signed as a util ity for di rec tion giv ing and to help en - hance the city s mar ket po ten tial. For ex - am ple, us ing a new ParkLink logo that Corbin de vel oped to rep re sent pub lic park - ing, the sys tem pro vides better di rec tion to and iden ti fi ca tion of ven ues. Un der the con tract, INIT will pro vide the RTD with a fully in - te grated Com puter-aided Dis patch/au to - matic Vehicle Location System with pas - sen ger in for ma tion dis plays, on-board an - nounce ments and Mo bile Data Ter mi nals. In ad di tion, INIT will sup ply a new P25-based voice ra dio sys tem and in te - grated data ra dio sys tem to the Dis trict s transit system, replacing RTD s obsolete an a log ra dio. INIT spokes woman Ann Derby told UTM that the Den ver RTD con tract is worth more than $30 mil lion and will be im ple mented ac cord ing to a sched ule of about 24 months. The con tract calls for the setup of an au - tomated vehicle management system and pas sen ger in for ma tion sys tems on about 1,000 buses with ad di tional au to matic lo - ca tion ser vice for ap prox i mately 150 sup - port/se cu rity ve hi cles, and GPS en abled por ta ble ra dios for ap prox i mately 370 sup - port per son nel. Along with the new tech - nol ogy on the buses, 170 light rail ve hi cles and more than 320 para tran sit ve hi cles will be equipped with dig i tal voice radios for increased communications and safety. The in stal la tion of the new sys tem will sup port RTD s daily op er a tions by pro vid - ing pow er ful tools to help track and mon i tor the lo ca tion of ve hi cles within their multi-modal net work.
