3 ARTICLE 1. GUARANTEED MAXIMUM PRICE (GMP) 1.1 Guaranteed Maximum Price (GMP): Design Builder guarantees that it shall not exceed a Guaranteed Maximum Price (GMP) of Nine Hundred Seventy-Six Thousand, One Hundred Eighty- Nine Dollars ($976,189.00) for the identified Sub-Project. 1.2 Basis of the GMP: Construction Documents: The Scope of Work for the GMP shall be as defined in the Contract Construction Documents, prepared by Design Builder. See attached Exhibit C-1, Section 02, List of Contract Documents for document titles and dates List of Construction Documents identified in Article 7 of this Guaranteed Maximum Price Amendment Exceptions, Clarifications and Exclusions: The Scope of Work defined in the Construction Contract Documents and/or Design Criteria package shall be modified and/or clarified as identified in Article 8 of this Guaranteed Maximum Price Amendment. ARTICLE 2. PROJECT TIME 2.1 Substantial Completion Date: Substantial Completion of the Work shall be achieved by January 5, Final Completion Date: Final completion of the Work shall be achieved by March 9, Project Schedule: Attached to this Amendment will be a schedule identifying the above noted completion times and intermediate milestone dates estimated for the Project. The proposed schedule shall be integrated into the Design Builder s Schedule upon approval of this Guaranteed Maximum Price Amendment. ARTICLE 3. DESIGN BUILDER FEE 3.1 Design Builder Fee: The Design Builder Fee for the Project shall be a Lump Sum of Forty- Three Thousand, Five Hundred Twenty-Three Dollars ($43,523.00). ARTICLE 4. REIMBURSABLE GENERAL CONDITIONS COSTS 4.1 General Conditions: General Conditions costs for the Project shall not exceed One Hundred Sixty Thousand, Nine Hundred Forty-Eight Dollars ($160,948.00). General Conditions costs shall be reimbursed at Design Builder s actual cost. General Conditions costs shall be in compliance with the General Conditions to the Agreement for Design Build Services (Exhibit A) and are identified in the attached document prepared by the Design Builder. ARTICLE 5. LIQUIDATED DAMAGES 5.1 Substantial Completion: Design Builder shall pay Owner One Thousand Dollars ($1,000.00) as liquidated damages for each day that Substantial Completion extends beyond the Substantial Completion Date. 4 5.2 Final Completion: Design Builder shall pay Owner Five Hundred Dollars ($500.00) as liquidated damages for each day that Final Completion extends beyond the Final Completion Date. ARTICLE 6. 9 1 SECTION 01 GMP Summary The project consists of the following District School Security Program enhancements of thirteen (13) schools located in Brevard County for Brevard Public Schools: 1. Atlantis Elementary School This project consists of providing fencing and public access control. The fencing scope of work creates a secure perimeter around the school, such that any access to classrooms or children is only through the front office. The access control scope of work consists of creating a single point of access in the front office for all arriving visitors of the school whom which upon entering will be required to follow a check-in procedure. Access control also consists of one camera with mount, one TV with mount, ADA compliant counter, remote lock down of front entry, one wireless AD400 lockset with hard wired push button and two remote release buttons. 2. Cambridge Elementary School This project consists of providing public access control only. The existing fencing creates a secure perimeter around the school, such that any access to classrooms or children is only through the front office. The access control scope of work consists of creating a single point of access in the front office for all arriving visitors of the school whom which upon entering will be required to follow a check-in procedure. Access control also consists of one camera with mount, one TV with mount, remote lock down of front entry, one wireless AD400 lockset with hard wired push button and two remote release buttons. 3. Challenger 7 Elementary School This project consists of providing fencing and public access control. The access control scope of work consists of creating a single point of access in the front office for all arriving visitors of the school whom which upon entering will be required to follow a check-in procedure. Access control also consists of one camera with mount, one TV with mount, ADA compliant counter, remote lock down of front entry, one wireless AD400 lockset with hard wired push button and two remote release buttons. The miscellaneous sitework is required due to a necessary change in traffic pattern for students entering and leaving the clinic during school hours. A new concrete sidewalk will be installed to provide access to the Clinic from within the secured interior perimeter of the school. 7. Enterprise Elementary School This project consists of providing fencing and public access control. The fencing scope of work creates a secure perimeter around the school, such that any access to classrooms or children is only through the front office. The access control scope of work consists of creating a single point of access in the front office for all arriving visitors of the school whom which upon entering will be required to follow a check-in procedure. 15 1 SECTION 03 Description of Work 3.2 Qualifications and Assumptions The following is a summary of additional Qualifications and Assumptions including the Qualifications and Assumptions listed in the specification listing: 1 No allowances for hazardous materials abatement have been included. In keeping with other projects where School Board of Brevard County (SBBC) has indicated any and all materials requiring abatement will be handled by SBBC, as required by the Design-Builder s project schedule; 2 Emergency Exit Signage and Fire Alarm modifications are included only where indicated; 3 New and impacted existing finish surfaces shall be completed in a manner to match existing conditions. Flooring and base repairs will be subject to available attic stock materials and product availability. Wall base basis of design shall be 4 Mercer Standard Wall Base Stock 1/4CL or equal, per the BPS Design Standards; 4 New interior doors shall be provided as field painted solid core doors with ½ lite. New door frames shall be provided as 14 gauge hollow metal knock down. Door hardware shall be installed per the BPS Design Standards and will contain egress hardware only where indicated; 5 Retrofitted Casework to receive new ADA compliant counter shall be coordinated with the Owner to match the existing laminate as closely as possible.
