5 Foreword This report provides an overview of juvenile court dispositions in Pennsylvania during 2009 and preceding years, and summarizes juvenile court statistical data provided by county juvenile probation departments. Without the support of the courts and juvenile probation departments, this report would not be possible. Although the report focuses primarily on delinquency dispositions, information has again been included on dependency cases that have been referred to juvenile probation departments. While county children and youth agencies handle the overwhelming majority of cases involving dependent children in the Commonwealth, some juvenile probation departments provide services to children who are alleged to be dependent on the basis of ungovernability or chronic truancy. The information contained in this report is of value to all individuals, agencies and organizations having an interest in the Pennsylvania juvenile justice system. However, it is not intended to reflect the total workload of juvenile courts or juvenile probation departments. It is with great pleasure that we dedicate this report to the judges, probation officers, victim advocates, district attorneys, service treatment providers, and other professionals who work on a daily basis in the Pennsylvania juvenile court system. 7 Preface This report is a compilation of the data collected from the juvenile probation departments in the Commonwealth of Pennsylvania. As in the past, to avoid confusion regarding the unit of count used in tabulating juvenile court statistics and to improve the understanding of how data can be interpreted please note: 1. The primary unit of count is the disposition. A disposition is defined as an allegation disposed of by the juvenile probation department and/or the court. Within a single delinquency allegation, a youth may be charged with a number of offenses that may result in multiple petitions. Any one youth may be involved in a number of dispositions within a calendar year. In addition, a youth may be referred on more than one occasion and receive only one disposition. Dependency dispositions include only those referrals to probation departments alleging dependency that are not accompanied by allegations of delinquency. Therefore, one is cautioned NOT to attempt to interpret dispositions as: a) the number of youth who are processed by the court; b) the number of offenses charged to juveniles. 2. There are times when you will see the word case used to describe the data. In this report, the word case is used interchangeably with the word disposition; 3. The unit of count refers to a case disposed of by a juvenile court and/or juvenile probation department. The term disposed means that a definite action/decision has been implemented or that a treatment plan has been decided upon or begun; 4. The statistical system is constructed to collect up to the seven (7) most serious offenses per delinquency disposition; 5. The Commission collects additional information on placement reviews, disposition reviews, and selected special conditions attached to a disposition. A disposition review is a hearing conducted before the court regarding a previous disposition which did not result in out-of-home placement. The data in the secure detention section of this report were collected in conjunction with the JCJC Standards Governing the Use of Secure Detention. 13 Center for Juvenile Justice Training & Research Highlights of the 2009 Disposition Report The 41,561 delinquency dispositions in Pennsylvania in 2009 represent a 5.0% decrease from Consent Decree was the most frequently utilized disposition, representing 19.0% of all delinquency dispositions, followed in descending order by Probation (18.0%), Informal Adjustment (13.6%), Fines/ Costs (9.8%), Complaint Withdrawn (7.2%), and Placement (6.6%). (See pages 4 and 5) Placements (including those as a result of disposition reviews) decreased 11.7%, from 7,444 in 2008 to 6,576 in Placements as a percent of dispositions also declined, from 9.5% in 2008 to 8.5% in (see pages 24-25). Delinquency placements to private institutions, including those resulting from disposition reviews, comprised 43.1% of the 6,576 total delinquency placements in 2009, followed in descending order by placements to drug and alcohol programs (12.9%), group homes (11.5%), Secure (8.4%), Boot Camps (7.7%) and Wilderness Based Programs (7.3%). (See pages 26 and 27) 51 substantiated rape charges represent a 13.3% increase from 2008, while 670 substantiated robbery charges represent a 6.0% decrease from Substantiated drug charges decreased by 5.2% and substantiated aggravated assault charges decreased by 4.2% from (See page 33) Juvenile court dispositions in Pennsylvania continue to primarily involve males. In 2009, males accounted for 75% of all juvenile court dispositions, 80.8% of probation dispositions, 88.6% of dispositions involving placement, and 98% of transfers to criminal proceedings. (See page 42) Of the 31,176 juvenile delinquency dispositions involving males in 2009, 44.8% involved White, Non- Hispanic youth, and 40.9% involved Black, Non-Hispanic youth. Similarly, of the 10,383 dispositions involving females, 42.4% involved White, Non-Hispanic youth and 42.7% involved Black, Non-Hispanic youth. (See pages 44-47) In Pennsylvania, the majority of the 41,561 delinquency dispositions involved White youth (52.7%), followed in descending order by Black youth (43.4%). The additional category of Multi-Racial has been added for Delinquency Dispositions by Race. In 2009, 751 delinquency dispositions involved Multi-Racial youth (1.8%). (See pages 48-49) 26.6% of the 41,561 delinquency dispositions in 2009 involved seventeen year olds, followed in descending order by sixteen year olds (22.2%) and fifteen year olds (16.8%). (See pages 54-57) 56.1% of delinquency dispositions in 2009 involved juveniles whose biological parents were either Never Married or Divorced, while 17.1% involved juveniles whose biological parents were Married. (See pages 62-63) 44.6% of delinquency dispositions in 2009 involved juveniles who lived with only their mother, while 17.4% involved juveniles who were living with both parents. There was a 5.0% decrease in delinquency dispositions from 2008 to Dispositions involving new allegations in Philadelphia County decreased by 9.5% and Allegheny County dispositions increased by 0.6%. 15 Center for Juvenile Justice Training & Research Frequencies of Statewide Delinquency Dispositions, 2009 There were 41,561 delinquency-related dispositions in Pennsylvania during Consent Decree was the most frequently utilized disposition (7,887, 19.0%) followed in descending order by Probation (7,484, 18.0%), Informal Adjustment (5,673, 13.6%), Fines/Costs Ordered (4,058, 9.8%),Complaint Withdrawn (3,007, 7.2%), Other Dispositions (2,923, 7.0%),Placement (2,732, 6.6%), Warned, Counseled, Case Closed (2,709, 6.5%) All remaining dispositions totaled 12.2%. 24 Juvenile Court Judges Commission Type of Attorney Representation in Delinquency Proceedings, 2009 This chart presents a summary of the data included in the table found on page 15. The Court Appointed column of the table includes those cases where counsel, other than the public defender, was appointed by the court. Attorney representation at the court hearing may be waived. These cases are reflected in the table as well as in the chart below. The data on attorney representation include only the 25,598 dispositions made as a result of a hearing before a master or a judge. Informally handled cases, reviews, and dependency cases are not included. Legal representation in delinquency proceedings, during 2009, was most often provided by public defenders, who were involved in 69.8% of the delinquency dispositions involving hearings. Court appointed attorneys provided legal representation in 17.5% of delinquency dispositions involving hearings, followed by private attorneys at 11.9%. Legal representation was waived in 0.7% of delinquency dispositions involving hearings. 46 Juvenile Court Judges Commission Secure Detention The Juvenile Court Judges Commission s Standards Governing the Use of Secure Detention Under the Juvenile Act were developed to guide decision making regarding juvenile detention usage in Pennsylvania s juvenile justice system. Compliance with these standards is required for counties participating in the Commission s Grant-in-Aid Program, with the exception of Philadelphia. Detention information appearing in this Disposition Report was extracted from the secure detention database at the Center for Juvenile Justice Training and Research. In accordance with the Standards Governing Secure Detention, all counties, except Philadelphia, report their secure detention use to the Juvenile Court Judges Commission. This is accomplished statewide through the detention centers. Each month, all juvenile detention centers, with the exception of the Youth Study Center in Philadelphia, report their detention admissions along with the Statement of Facts and Reasons that must accompany every probation-authorized admission to secure detention. Philadelphia County is not included in this reporting system. When interpreting the data contained in these tables, the reader should note the following: 1. The unit of count is the admission of a juvenile to a secure detention center; 2. A juvenile who is admitted to a secure detention center and subsequently transferred to another secure detention center without release is counted as two admissions.
