2 BOARD OF PARKING COMMISSIONERS MINUTES Regular Meeting: Friday: May 29, 2015: The Regular Meeting of the Board of Parking Commissioners of the City of Fargo, North Dakota, was held in the City Commission Room at City Hall at 8:00 o'clock a.m., Friday, May 29, The Parking Commissioners present or absent were as follows: Present: Absent: Chairperson Commissioner Mike Williams, Randy Thorson, Tracy Walvatne Margie Bailly, Brian Hayer Chairperson Commissioner Williams called the meeting to order. Item 1: Approve Order of Agenda Member Thorson motioned to approve the Order of Agenda as presented. The motion was seconded by Member Walvatne. The motion was unanimously approved. Item 2: Minutes: Regular Meeting of April 24, 2015 Member Thorson motioned to approve the minutes of the April 24, 2015 Parking Commission meeting. The motion was seconded by Member Walvatne. The motion was unanimously approved. Item 3: Consider Fargo Parking Logo and Brand Manual: APPROVED Andy Renfrew, Interstate Parking, presented updated illustrations of the proposed parking logo submitted by Kandor Design based on suggestions made by the Board during April s meeting. He stated Interstate Parking is recommending option A the design of the black tire bordered by black tread, and the international symbol for parking capital letter P in the center surrounded by the same blue color used in the existing City of Fargo logo. Further discussion by the Board included positive comments on the revised logo as well as conversation on the merit of delineating or identifying contract lots differently from lots that accommodated hourly/transient parkers. Member Walvatne motioned to approve the logo design in Fargo blue surrounded by the black tire and black tire tread as presented by Kandor Design. The motion was seconded by Member Thorson. The motion was unanimously approved.

3 Parking Commission May 29, 2015 Page No. 2 Item 4: Review Enforcement Policy with Consideration to Implementation of Digital Pay Stations and Opportunities for Technology and Automation Improvements Planner Joe Nigg provided an update on the proposed ordinances that will provide the City the ability to enforce parking violations within the City-owned off-street parking facilities which accommodate contract and hourly parking. Mr. Nigg stated the ordinances are scheduled for a second reading at the upcoming City Commission meeting on June 8, and will go into effect upon the City Commission s final approval. He noted a final draft of the Off-Street Parking Enforcement Policy is included in the packet for the Board s review and approval. Mr. Nigg added staff is also requesting direction from the Board regarding the implementation of digital pay stations at the NP Avenue and Second Avenue North parking facilities. Andy Renfrew (Interstate Parking) provided a summary of the alternatives as outlined in the packet. The Board discussed the enforcement policy as it pertains to each parking facility and the specific options and recommendations from Interstate Parking regarding placement of the pay stations. Upon further discussion the Board determined the need to approve these items individually as follows: Off-Street Parking Enforcement Policy (final draft): APPROVED Member Thorson motioned to approve the Off-Street Parking Enforcement Policy as presented. The motion was seconded by Member Walvatne. The motion was unanimously approved. 2nd Avenue North Lot Enforcement Procedure/Policy Option A or B Configuration: OPTION A APPROVED Member Walvatne motioned to approve Option A which would allow the re-configuration of the 2 nd Ave (north lot) to accommodate both contract and transient parking. The motion was seconded by Member Thorson. The motion was unanimously approved. NP Avenue Lot Configuration as recommended by staff: APPROVED Member Walvatne motioned to accept the proposal for the NP Avenue Lot as presented. The motion was seconded by Member Thorson. The motion was unanimously approved. Item 5: Discuss Request for Proposals (RFP) for Advertising within City Parking Facilities: APPROVED Mr. Nigg briefly discussed a presentation given during the April meeting by Ramp Ads, a company offering advertising options within parking facilities. Mr. Nigg stated that based on direction from the Parking Commission city staff has drafted a RFP to seek advertising services. Mr. Nigg stated that staff is looking for direction on whether to proceed with issuing the RFP. Member Walvatne suggested that language is added to the RFP that states all advertisements would be required to go through City approval before being installed. She also shared her concern about monitoring where specific types of advertising are

4 Parking Commission May 29, 2015 Page No. 3 placed in regards to the type of business and any possible conflict of interest. Planning Director Jim Gilmour stated these recommendations will be addressed by staff in the final version of the RFP prior to issuance. Member Thorson motioned to approve the RFP with the changes as requested by Member Walvatne. The motion was seconded by Member Walvatne. The motion was unanimously approved. Item 6: Downtown Circulator Update Planner Joe Nigg stated the downtown circulator will officially begin operating on Monday, June 1. Mr. Nigg referred to a map in the packet illustrating the circulator route and hours of operation, and noted preliminary promotional materials will be available to the public on Monday. He stated both the Fargo City Commission and the Moorhead City Council have approved and signed a Memorandum of Understanding (MOU) which establishes the framework for operations of this circulator. Item 7: Cities for People Presentation (Mike Zimney) Member Williams introduced Mike Zimney from the Kilbourne Group. He shared his presentation on the Value of Urbanism which focused on the basic fundamental design principles of designing good cities and good neighborhoods and why we should care as taxpayers. Item 8: Interstate / Operator Report Andy Renfrew presented the April operations report. Item 9: Introduction to Fargo Parking Technology Plan Paul Schnettler, Interstate Parking, introduced a proposed Parking Technology Plan which conceptually outlines the goals and objectives for all off-street downtown parking facilities; as well as projected costs. Mr. Nigg added this information is for the Board to review and will be discussed in greater detail at a subsequent meeting. Item 10: Updates a. 2nd Avenue North Lot Rehab Project Joe Nigg stated the project to overlay this parking lot is currently underway and projected to be completed by next Monday, June 1. He added the existing lighting issue in this lot will also be addressed. b. Implementation Plan Phase II On-Street Time Zone Concept (4hr) Mr. Nigg reported staff will be working with the Downtown Community Partnership (DCP) to coordinate a public input meeting to be held in June. He stated staff will return with a formal recommendation on the concept at the June meeting and the documentation will include a summary of comments and feedback received.

5 Parking Commission May 29, 2015 Page No. 4 Item 11: Downtown Skating Rink Update Planner Derrick LaPoint shared an update on the downtown skating rink idea that has been recently discussed. Mr. LaPoint stated that city staff has been working collaboratively with the DCP and Park District and that a final recommendation will be submitted to the City Commission in the next few months. Item 12: Other Issues or Public Comments No other issues or public comments were addressed. The time at adjournment was 9:47 a.m.

6 TO: Parking Commission FROM: Interstate Parking DATE: June 19, 2015 RE: Validation Program Pay Stations & Validation. With the implementation of the Digital paystatons set to be completed by July 1 st, we are moving from a post-pay to a pre-pay program. This has significant ramifications to our POP validation program as there will no longer be an attendant there to accept the tickets and parkers will be required to pay before visiting the merchant to collect POP tickets. On the positive side, the Digital Luke II machines and the Passport application offer many more options and flexibility to ease this transition as well as opportunities to establish a more comprehensive and robust program. The week of June 22 nd I will begin going doorto-door, starting with our current POP users to train and assist them with the new program. The current POP program is intended to provide convenient and affordable hourly/transient parking to downtown customers. The program provides a downtown customer with a FREE hour of parking and the city invoices the corresponding business at a reduced rate for each ticket collect; effectively a 25% discount. Moving forward, Interstate Parking is recommending that the city continue to incentivize the validation program with a 25% discount. To note, the Civic Ramp will continue to be a manual validation program until technology improvements are pursued at this location. Hourly Rates. The hourly/transient rates are currently as follows. 2 nd Ave N (South Lot) and Civic Ramp - $1.50 an hour, $7.50 daily maximum between the hours of 8 AM 5 PM, Monday through Friday. NP Ave - $1.00 an hour, $5.00 daily maximum between the hours of 8 AM and 5 PM, Monday through Friday. As the Parking Commission adds hourly parking and a Digital paystation in the 2 nd Ave N (north lot) in July Interstate Parking would like to confirm that the same rate will be utilized within the 2 nd Ave N (north lot) at $1.50 per hour and a $7.50 daily maximum. 7 Interstate Parking would also like to suggest that the Parking Commission start thinking about raising the hourly rates in the Civic Ramp and both 2 nd Avenue lots. At this time, Interstate Parking does not recommend raising the rates at the NP lot due to lower usage patterns. Because of the high demand for parking in these three locations, as evidenced by them coming full multiple times a week, higher rates could be justified from an economic, revenue generation and facility management perspective. Recommendations: 1. To confirm and continue to incentivize the validation program at a 25% discount. 2. To approve hourly rates of $1.50 per hour and a $7.50 daily maximum for hourly parking within the 2 nd Ave N (north lot) consistent with the current rate structure for the Civic Ramp and 2 nd Ave N (south lot). 11 MEMORANDUM PLANNING AND DEVELOPMENT 200 Third Street North Fargo, North Dakota Phone: (701) Fax: (701) TO: FROM: Parking Commission Joe Nigg, Planner Attachment 3 DATE: June 19, 2015 RE: Review On-Street (4-Hour) Time Zone Concept Phase II Implementation Background. At the October (2013) retreat the Parking Commission spent a significant amount of time discussing and exploring a range of issues and priorities. The highest priority identified (at that time) focused on the development of an on-street parking strategy that would simplify the system and make better use of underutilized on-street capacity in fringe blocks. The 2012 Parking Evaluation Study and 1999 Downtown Parking Study strongly indicate that there is a need to simplify on-street parking in the downtown area. The Parking Commission has been working over the last two years to develop an on-street time zone concept and in general, the concept transitions a majority of the on-street parking to 4-hour time zones other than Broadway, Roberts St, 5 th Street N, 8 th St S and 7 th St S which would remain 90 minute zones. There would also be a few pockets of 2 hour time zones in a couple specific areas. With this concept, the re-park ordinance would continue to apply and in regards to the 4-hour time zones a vehicle would still need to move at minimum once per day. In September (2014) the Parking Commission initiated implementation of Phase I which included the area from 5 th Street to the Red River and from the railroad tracks to 2 nd Street S. Phase I was identified as more of a trial, since limited public input and outreach had been completed. The trial period allowed the city the ability to monitor the change and look for any unforeseen issues before pursuing implementation of the entire concept within the downtown core. Phase I was completed in December (2014) and by all accounts it appears the change is working as anticipated. As a reminder, the rationale for these rather aggressive changes included the following considerations: - A majority of the fringe blocks have an on-street utilization number at or well below 50%. - A majority of city owned parking facilities are at or over capacity and there is limited hourly or transient parking available in these off-street locations. - Complexity of the existing time zone system (see attached map). - Consistency and efficiency from an enforcement perspective. - Supplemental longer term parking that is proximal to the downtown core. Public Outreach and Input. In 2013 a task force was formulated by the Parking Commission to develop this time zone concept; which included representatives from the business community, police department and DCP. The concept has also been reviewed and supported by the Traffic Technical Advisory Committee (TTAC). Additionally, on June 11 th and 16 th the Parking Commission in collaboration with the DCP hosted two (2) public input meetings to provide an opportunity for downtown residents, merchants, property owners and stakeholders to review and provide feedback on the concept. The meetings were attended by approximately 40 individuals and there was good discussion at each. Attached is a copy of all written comments received to-date. Outlined below are a few highlights from the discussions: - Overall, feedback specific to the 4-hour concept was very positive. A simplified approach and the ability to effectively communicate the on-street program to the public seemed to be important selling points.

12 - If the intent is to simplify time zones downtown why not eliminate the 90 minute zones and only have 2 hour and 4 hour time zones? The Fargo Police Department provided similar feedback primary from an enforcement perspective. - The re-park ordinance continues to produce a lot of negative feedback. In particular, attendees questioned why the ordinance needs to apply to all areas in the downtown core. As an example of the impact of the re-park ordinance, attached are two (2) photos submitted that show only a handful of cars on 1 st Ave S during the peak hour. - Signage some attendees were aware that the Parking Commission has casually explored a signage concept that would be more intuitive and would more effectively communicate overnight parking restrictions. They questioned why the Parking Commission would not implement these signage changes at the same time that all the on-street signage was either transitioning to 4 hour zones or being cleaned up. Implementation. A tentative implementation schedule would be as follows: Parking Commission Review / Recommendation June 26, 2015 Traffic Technical Advisory Committee Review July 1, 2015 City Commission July, 2015 Signage Changes / Implementation late July and early August 2015 Maps & Attachments. Two (2) maps are attached for your reference: (1) Existing Time Zones; (2) Proposed Downtown Concept. In addition, the following items are included: - Copy of the public input notice and all written comments received to-date - Summary of the on-street and off-street parking program in the downtown core - Summary of the on-street signage and overnight parking restriction issues Recommendation. To approve the on-street time zone changes as depicted in the attached map.

14 Dynamics of Downtown Fargo Parking (On-street & Off-street) General Overview: In 1948 North Dakota voters approved a ban on parking meters as part of a statewide initiative. This law restricts municipalities from operating on-street parking meters (N.D.C.C ). As such, the City has utilized time zones to establish an environment in the downtown core where there is adequate turn-over of parking spaces to support a healthy retail and business environment. On-Street Parking: As shown in the attached exhibit, there are a number of time zones in the downtown core with a large percentage of the corridors at 90 minutes. On-street time zones are enforced between 8 a.m. and 5 p.m. Monday through Saturday. Parking studies completed by the City strongly suggest that onstreet parking in the core needs to be simplified (too many time zones) and that there is a significant amount of on-street parking that is underutilized in fringe blocks. Outlined below are a few additional factors that apply to on-street parking in the core: Overnight Restrictions: By City code and within the Central Business District (CBD) it is unlawful to park between the hours of 2 a.m. and 7 a.m. on streets and avenues, dependent upon the day. This is a year-around restriction to accommodate snow removal and street sweeping; unlike other core areas of the city that have restrictions from 1 a.m. to 7 a.m. between November and April. North/South Streets restricted between 2 a.m. and 7 a.m. on Tuesday, Thursday, Saturday East/West Avenues restricted between 2 a.m. and 7 a.m. on Monday, Wednesday, Friday and Sunday Downtown Residential Parking Pass Program (DRP3): This permit program allows downtown residents the ability to park on-street and not be subject to time zone restrictions. Permits are not valid on Broadway or critical retail corridors and residents are still subject to overnight restrictions per above. These permits are $25 per month and require proof of residency in the downtown core. Re-Park Ordinance: The City of Fargo has had language in the municipal code addressing reparking or short moves since the early 1960 s. In short, the city does not allow drivers to move their car from one parking space to another space on the same block to avoid receiving a parking ticket. The re-park ordinance and signage state that a vehicle must move off the block face and not return for a minimum of 4 hours. Enforcement of the re-park ordinances was problematic until the city transitioned to digital handheld units about 10 years ago. The City currently uses Automatic License Plate Recognition (ALPR) software which has further improved the efficiency of enforcement in the downtown core. 4HOUR CONCEPT: The Parking Commission has been working over the last year (+) to develop an onstreet time zone concept for the downtown core that would simplify the system and also make better use of underutilized on-street capacity in fringe blocks. In general, the concept suggests making a majority of the on-street parking 4 hour time zones other than Broadway, Roberts Street and 5 th Street which would remain as 90 minute time zones. The Parking Commission and City Commission decided to implement an initial phase between 5 th Street and the Red River which was completed in November (2014). To note, the re-park ordinance would continue to apply and in regards to the 4-hour time zones a vehicle would still need to move at minimum once per day. Off-Street Parking: The City owns and operates seven (7) surface parking lots and three (3) structured parking facilities which equates to approximately 1,600 off-street spaces. NP Avenue (surface lot), the Civic Center Ramp and both 2 nd Avenue North surface lots accommodate limited hourly/transient parking with rates ranging between $1.00 to $1.50 per hour and daily rates between $5.00 to $7.00. Parking is free in all city off-street surface lots between 5 p.m. and 8 a.m. (other than during special events). Plenty of Parking POP Program: The current POP program is intended to provide convenient and affordable hourly/transient parking to downtown customers. The program provides a downtown customer with a FREE hour of parking and the city invoices the corresponding business at a reduced rate ($0.75) for each ticket collected. This program will be changing as the city transitions in the next year to digital pay stations (kiosks) at parking facilities that accommodate hourly/transient parking.

19 To the members of the City of Fargo Parking Commission, Warm greetings from your friends at the historic Fargo Theatre. I am writing today to request that the Parking Commission and City Planning Department consider implementing a 2- hour time limit for on- street parking on Broadway and surrounding core blocks. At a recent meeting, Joe Nigg offered a purposed plan for new on- street time limits that included more 4- hour parking areas. The Fargo Theatre team supports the addition of 4- hour areas, but are asking that the Commission consider also extending the main core from 90 minutes to two hours. This change would have a tremendous impact on Theatre operations and we believe it would positively impact the entire downtown retail and restaurant community. Fargo Theatre event and cinema operations are currently hindered by the 90- minute parking restriction. Increasing the limit to two hours would enable our organization to expand matinee programming options. The average runtime of a new- release motion picture is approximately 1 hour 45 minutes. As you can imagine, patrons are not eager to leave a film to move their cars. By increasing the limit to two hours, the Theatre could comfortably offer matinees and daytime events while on- street parking would still have frequent turnover. The Theatre team believes the two- hour limit would be beneficial for all or most downtown core businesses. Increasing Fargo Theatre programming drives more traffic downtown. The extension would provide the extra bit of time needed to visit shops and retailers after having lunch or meetings. If the vast majority of on- street parking fell under two time zone options (being two or four hour), the downtown parking situation would be streamlined, simplified, and easy to explain via marketing and signage. For 89 years, the Fargo Theatre has been lighting up Broadway with live entertainment and silver screen icons. 30 On-Street Parking Signage Time Zone Limits & Overnight Parking Restrictions Background. Previous parking studies completed by the City strongly imply that on-street parking in the downtown area needs to be simplified. To make better use of underutilized capacity on fringe blocks, in 2014 the Parking Commission finalized a concept that would convert a majority of the on-street parking to 4 hour zones other than Broadway and Roberts Street which would remain 90 minute zones. The Parking Commission and City Commission decided to implement an initial phase between 5 th Street and the Red River which was completed in November (2014). With this decision and the pending implementation of a similar strategy for the remainder of the downtown core it was apparent that the timing would be right to address parking signage issues. Complaints. In terms of complaints received, I d submit that a majority are either related to the re-park ordinance or not understanding the overnight restrictions and how they apply. Overnight Restrictions. By city code ( ) and within the Central Business District it is unlawful to park between the hours of 2 a.m. and 7 a.m. on streets and avenues, dependent upon the day of the week. This is a year around restriction to accommodate snow removal and street sweeping, unlike other core areas of the city that have restrictions from 1 a.m. to 7 a.m. between November and April. Note that downtown residents that have a DRP3 are still required to follow the below restrictions. The specifics: The issue: North/South Streets restricted between 2 a.m. and 7 a.m. on Tuesdays, Thursdays and Saturdays East/West Avenues restricted between 2 a.m. and 7 a.m. on Mondays, Wednesdays, Fridays and Sundays What this actually means is that for an avenue (for example) you shouldn t park your vehicle on-street at night on Tuesdays, Thursdays, Saturdays or Sundays. It s very confusing and non-intuitive. Existing Signage. This is Fargo s current template for communicating time zone restrictions and the re-park ordinance in the downtown core. This sign is 18 tall by 12 wide. In addition, typically the time zone/re-park sign is coupled with a second sign that outlines the overnight restrictions. Sometimes, as shown in the second photo, a separate sign pole is placed to display the overnight restrictions. You will see lots of these extra sign posts in the downtown core. Proposed Signage (most-current version). Planning and Traffic Engineering have been exploring some different signage concepts in an attempt to: 1. Provide improved and more intuitive signage 2. Reduce confusion on overnight parking restrictions 3. Improve ADA and MUTCD compliance 4. Reduce sign clutter (most of these single-use poles could be removed) 5. Coordinate on-street signage enhancements with time zone changes First Draft. Based on some design ideas that have been implemented in other cities this was the first attempt. Feedback on this sign was positive although there were some negative comments as well. It turned out the sign had some flaws that were fatal so we have continued to explore similar ideas and variations. Current Draft. This is the most current idea that Planning and Traffic Engineering have explored. This would be an example of an avenue sign and would more intuitively describe overnight restrictions. For commercial loading zones, you would be able to add that in between 8-10 a.m. without adding an additional sign to a post

31 PLANNING AND DEVELOPMENT 200 Third Street North Fargo, North Dakota Phone: (701) Fax: (701) MEMORANDUM TO: FROM: Parking Commission Joe Nigg, Planner Attachment 4 DATE: June 19, 2015 RE: Update on Downtown Shuttle / Circulator Route (LinkFM) Ridership In late May (2015) the cities of Fargo and Moorhead finalized a Memorandum of Understanding (MOU) that established the framework for operating a downtown circulator. The intent of the service is to provide improved access to businesses and destinations in both downtown areas. A few route operational details are highlighted below: - Operating hours: Monday-Friday from 7 a.m. to 7 p.m. and Saturdays from 10 a.m. to 5 p.m.; - 15 minute frequency; - Circulator service is fare free and free transfers to other routes are allowed; - 10 designated stop locations (6 in Fargo and 4 in Moorhead); - The route travels east-bound on NP Avenue and west-bound on 1 st Ave N. The route began operating on Monday June 1, Thus far, ridership numbers have been quite low (see attached) although this was somewhat expected as there were only minimal marketing and promotional efforts completed prior to start-up. In the next few weeks and prior to the Street Fair (July 16-18) there will be a comprehensive marketing effort to bring attention to the circulator. Attached is a copy of the logo that will be used for the circulator, ridership statistics over the last two (2) weeks as well as an example of the preliminary marketing materials that are currently available.

35 TO: Parking Commission FROM: Interstate Parking DATE: June 19, 2015 RE: Financial and Operations Report for May 2015 Operations We continue to add parkers in the southern portion of the downtown core and still have a surplus of spaces in this area. Transient revenue has slowed across all the lots due to the better weather conditions and school being out. Electronic Transactions Credit Card transactions accounted for 33% of all transient revenue. We expect another step increase in electronic payments when the Digital Paystations are operating in July. Financial Report As mentioned above, transient revenue has decreased slightly across all lots while contract revenue has remained steady and even increased in the 4 th Street lot. Included in this month s expenses are the invoices for the new logo and the demolition of the old attendant shack on 2 nd Avenue North. I would also like to point out the Special Event Payroll at the 2 nd Ave. S. and NP lots. Because the contract between Interstate Parking and the City of Fargo was written with the assumption that the attendants would have been pulled from these two lots at the end of April, the City has reimbursed Interstate Parking for the cost of labor. As per the contract with Interstate Parking the NP Avenue and 2 nd Ave N (south lot) will be automated starting July 1, There will no longer be an attendant present at these facilities as digital pays stations will be implemented although there will be an Interstate Parking presence in these lots through on-foot parking violation enforcement. Based on a number of actions taken by the Parking Commission over the last several months Interstate Parking is planning to have the a soft launch on June 29 th and the system should be fully operational by July 1. Outlined below is the current implementation schedule: - Concrete pad and electrical rough-in to be done 6/23 - Paystation install by Skidata to be completed 6/25 - Software build-out to be completed by 6/26 - Soft launch scheduled 6/29, full go-live 7/1 - Interstate Parking is also recommending that awnings be installed over the paystations that would draw attention to the paystation and further build the parking brand. These cost $2160 each. Enforcement. Based on recommendations from the Parking Commission - the City Commission finalized and approved two (2) ordinances in June (2015) which together allow the city the ability to write tickets for illegally parked vehicles in city parking lots. As a result, in the next few weeks enforcement of parking violations within city off-street lots will be started. The initiation of enforcement efforts will also run parallel with pay station implementation. Initially, all enforcement will be handled by Interstate Parking consistent with terms within the existing management contract. In the future, the ability does exist to capitalize on existing city investments and enforce parking violations off-street using LPR software and hardware. Parking tickets issued by Interstate Parking will look a little different than a city issued on-street parking ticket, as they will be issued through a different ticketing application (Passport). As previously discussed, first time offenders will receive a warning citation and parking ticket fines will be the same as a city issued on-street ticket ($15 with $5 late fee).
