2 Background and Summary of Proposal A Conditional Use Permit for an Automobile Service Station and Car Wash was approved in 1988 for the site. Since that time, the site has been developed with a fuel canopy and fuel pumps, a convenience store and a car wash. In September 2017, a Conditional Use Permit for Motor Vehicle Rentals for up to four box trucks was approved by City Council. The applicant now requests that the condition that limits the number of rental trucks on the site to four be modified to allow for a total of eight. With this submittal, the applicant originally requested the ability to display up to 18 box trucks, but after discussing the request with Staff, he has modified his request to no more than eight total box trucks on the site. As depicted on the submitted site layout plan, the rental trucks will be parked on the west side of the convenience store and next to the car wash building. As with the existing operation, customers will rent the vehicles from space within the convenience store. 3 Evaluation and Recommendation This request for a Modification of a Conditional Use Permit for Motor Vehicle Rentals to offer up to eight box trucks to rent on this site is acceptable. The applicant worked with Staff to reduce the number of additional box trucks available for rent on site. In Staff s opinion, this use is compatible with the surrounding commercial uses. The number of parking spaces on the site exceeds the minimum parking requirement by 14; therefore, the display of up to eight box trucks for rent will not impact the ability of both customers and employees to safely access the fuel pumps, convenience store and car wash on the site. A condition is recommended that specifies the location of the eight box trucks in order to limit visibility of these vehicles from the rights-of-way. For the reasons stated above, Staff recommends approval of this application, subject to the conditions listed below. Recommended Conditions The Conditions of the Conditional Use Permit for Motor Vehicle Rentals dated September 19, 2017 are hereby replaced with the following Conditions: 1. There shall be no vehicle repair performed on the site. There shall be no storage of inoperable, wrecked or dismantled vehicles on the site. 2. There shall be no signs placed within the windows or the doors of the rental vehicles. There shall be no pennants, banners, streamers, or portable signs placed on the site or on the vehicles. 3. No more than eight box trucks for the purpose of renting shall be allowed on the site at any one time. Rental trucks shall only be located in the areas on the site that have been designated on the exhibit entitled, Proposed Site Layout as depicted on page 5 of this report. Rental trucks shall not be parked in such a way that impedes the internal vehicular circulation of the site. Further conditions may be required during the administration of applicable City Ordinances and Standards. Any site plan submitted with this application may require revision during detailed site plan review to meet all applicable City Codes and Standards. All applicable permits required by the City Code, including those administered by the Department of Planning / Development Services Center and Department of Planning / Permits and Inspections Division, and the issuance of a Certificate of Occupancy, are required before any uses allowed by this Use Permit are valid. The applicant is encouraged to contact and work with the Crime Prevention Office within the Police Department for crime prevention techniques and Crime Prevention Through Environmental Design (CPTED) concepts and strategies as they pertain to this site. Comprehensive Plan Recommendations The Comprehensive Plan identifies this site as being located within the Suburban Area. The general planning principles for the Suburban Area focus on creating and maintaining great neighborhoods through stability and sustainability; protecting and enhancing open spaces and places of cultural and historical significance; and creating and maintaining a transportation system that provides connectivity and mobility. Achieving these goals requires that all land use activities either maintain or enhance the existing neighborhood through compatibility with surroundings, quality and attractiveness of site and buildings, improved mobility, environmental responsibility, livability, and effective buffering with respect to type, size, intensity and relationship to the surrounding uses. 4 Natural and Cultural Resources Impacts The site is located in the Chesapeake Bay watershed. There are no known significant natural or cultural resources associated with this predominately impervious site, as it is developed with a convenience store with fuel pumps and a car wash. The limits of this project include roadway segment on Indian River Road from Providence Road to Level Green Boulevard. The improvements will include, but are not limited to, signal, road and pedestrian improvements.
