3 Some of A.B.A.T.E. s accomplishments over the years: Successfully lobbied for legislation that created the Georgia Motorcycle Safety Program (GMSP), our state s rider education program that is available to all. Lobbied to have legislation passed to modify the existing mandatory helmet law to allow adults age 21 and older freedom of choice as to the wearing of a helmet. Successfully lobbied for legislation leading to the repeal of the Georgia law prohibiting use of speakers or headphones while riding a motorcycle. Fought and stopped legislation introduced in the 1992 Session of the Georgia General Assembly that would have made it illegal for kids age 10 and under to ride as passengers on motorcycles. Established May as Motorcycle Awareness and You month through a proclamation signed by the Governor and through resolutions passed by the Senate and House each year. This is an annual effort that raises public awareness of motorcycles. Successfully lobbied legislators to approve increased funding for the Georgia Motorcycle Safety Program, in the amount of $170,000 after the license tag rate was raised on all vehicles to $20. Successfully stopped proposed legislation that would have increased the size of motorcycle tags. Successfully lobbied for handicapped tags for motorcycles without further enabling legislation, by bringing it to the attention of the Department of Revenue that the code section was written in such a way that it was already authorized. Successfully lobbied for antique tags for motorcycles in the 1998 legislative session. Established a 15 District organization that has led to more participation locally, while raising our membership statewide. The more members we have, means the more clout we have at the State Capitol. Sponsor and promote the largest Swap Meet/Bike Show in Georgia, 5 times a year. Successfully forced prosecution of a trucker who, while making an illegal turn, killed fellow motorcyclist Mark Bonner. Successfully lobbied to pass the Frank-Lee (ROW) bill to enhance penalties to those who cause death or serious injury to a motorcyclists by failing to yield the right of way. Successfully lobbied to pass the Tag/Title bill SB-437 that allows for registration of kit/assembled bikes. WHAT IS A.B.A.T.E. OF GEORGIA, Inc.? The letters A.B.A.T.E. stand for American Bikers Active Toward Education. A.B.A.T.E. is composed of motorcyclists from all areas of the state, from all walks of life, and who ride all makes of bikes. A.B.A.T.E. is not a club, it is a non-partisan politically active organization working on motorcyclist s rights. We are affiliated with national rights groups like the American Motorcyclist Association (AMA), the Motorcycle Riders Foundation (MRF) and the National Coalition of Motorcyclists (NCOM). Our main focus is to keep motorcycle legislation in its proper perspective. Many restrictive laws are enacted by uninformed legislators. A.B.A.T.E. s goal is to keep our lawmakers informed of our members collective position on Motorcycle related legislation. Preventing unfair legislation from becoming law is easier than fighting to get the law repealed. Rider education and public awareness of motorcyclists are goals of A.B.A.T.E.. We are not against the wearing of helmets, and we encourage all riders to ride safely. An informed and educated rider is a safer rider. 6 Ned Williams, State Director Our newsletter ran late this month because we wanted to make sure we would be able to report to you on the signing of HB166. Tuesday April 26th, Governor Deal signed HB166 into law. By doing so owners of 41 separate models of motorcycles manufactured right now, went from unwitting law breakers to law abiding motorcycle riders. The previous iteration of Georgia s handlebar law had no legitimate reason for existence considering there has never been a study on safety of MOTORCYCLE handlebars that said handlebar height was a factor in motorcycle safety, despite that, leadership of Georgia government were adamantly opposed to a full on repeal, but after months of negotiation and presentation on the number of current production motorcycles that were being sold in Georgia that violated Georgia law from the factory, the leadership expressed a willingness to address this obvious problem in the law. So while we did not get everything we wanted, we did make several thousand Georgia motorcycles legal that were not before and we gave one less tool for the potential harassment of motorcycle riders by certain unscrupulous parties in this state. Next year we will look at what other laws we can change, along with our existing Legislative Agenda items. We are also looking at new possible grass roots public education campaigns to address concerns of motorcycle riders such as distracted driving. Without giving away information to be heard at the May Board of Directors meeting, our Griffin Swap Meet was a financial success so we will be able to keep the lights on for a few more months, but we need every district to help out. 11 CHAPLAIN S CORNER Eric Shumans CMA Georgia State Coordinator When I was growing up I went to church and received Jesus into my heart as my Lord and Savior and I believed that God had a call on my life and I wanted to serve him. However, during my teenage years, I began to experiment with drugs and alcohol and those quickly began to take control of my life and I spent the next years running from God. During this time I also got married and had two beautiful daughters who I loved very much but I was a terrible husband and father for the first seven or eight years of my marriage. During my early thirties I finally turned my life back over to God and was able give up the drugs and alcohol and thankfully as of this past April I have been clean and sober now for 28 years and I can tell you that it s been the best decision that I have ever made. But I do have regrets for the years that were wasted and for the lives of my family members that were affected as a result of that previous behavior and it took some time for God to help me mend those relationships and regain the trust. There s a story in the bible about a man named Jonah who also ran away from what God was asking of him and it nearly cost him his life and made a whole lot of trouble for those who were around him. Some of you are familiar with this story but if not, I would encourage you to read the book of Jonah in the bible to get a better understanding of the story. In the end, as a result of Jonah obeying God he actually ended up being able to save an entire town from complete destruction. Some things to think about are, who is affected by your life? We owe it to those that we are closest to, to follow God s plan for our life. They need the example and they need the encouragement. Do you know of a time in your life that God has moved on you, yet you played it off and continued on your own way? Who does that decision affect and do they deserve it? 12 Let s talk about Lane Filtering for a second. There has been quite a bit of confusion about what the difference is between Lane Filtering and Lane Splitting. We at ABATE hope this new infographic will better explain the difference between the two. We may have not gotten Lane Filtering through the 2015 session but we have FOUND A POTENTIONAL NEW SPONSOR for next session already! Lane Splitting Vs. Lane Filtering Lane Splitting is when a motorcycle rides between the lanes of traffic at speed when there is no impediment to travel and traffic is moving normally. Lane Filtering is when a motorcycle rides between the lanes of traffic from behind a pack of non moving cars to proceed to a fixed point in the roadway such as a red light ahead of the cars or a right turn lane.. 13 District One District News The April District One ABATE meeting was held on April 5, 2016, at Logan's Roadhouse in Dalton. There were 16 members and one guest present. Tami Culver and Dennis Warren, co-cordinators opened the meeting leading our group in the pledge of allegiance. Dennis Warren led our group in a moment of prayer and refelection, thinking of those who are having troubles in life. Brian Black, treasuer, was feeling a little under the weather, so financial report was waived until May. Tami Cuver presented a legislative report. She warned everyone the E85 blender pumps are popping up. This fuel is not suitable for scooter motors and will cause great damage. ABATE District One is pleased to have Ms. Tami Meeks from AirMedCare as special guest and speaker for our meeting. Ms. Meeks presented a program for membership into a program known as AirMed Association. With each membership each individual is covered to receive Life force or AirEvac helicopter services. There are over 240 aircraft locations covering 32 states. These services could cost as much as $10,000 fper flight. A program really worth looking into. Rosie Keener District Two District 2 monthly meeting. Sunday, April 10, 2016 at 2:00 PM Bill Mattison here helping District 2's Coordinator Anthony Love record the minutes. Normally we meet on the first Sunday of each month but Abate of Georgia held its swap meet this past weekend in Griffin. After waiting for a couple of people who were traveling a long distance to come to the meeting and got stuck in traffic we started the meeting at 2:18 PM. We had nine attendees and four officers. Anthony Love our District Coordinator began the meeting with the Pledge of Allegiance and a prayer was given by Rick from the Christian Motorcycle Association. Thank you Rick! Brian Love our Treasurer then told us that we will have a D2 membership table at "Music on Main" which will feature a cruisein and bike show in Clarksville Georgia on April 15. We will also have a table at The Forsyth County Sheriff's Office Motorcycle Safety Day April 30 10AM - 2PM at the Cumming Fairgrounds. The Rain-out date is May 1... Les Green then told us that we have a place that is going to promote a bike night in Helen: The Bohemian Bakery Cafe. They will offer a special menu for everyone riding a MC, so ride over on Wednesdays about 18:30 hours. (That is 6:30 pm for you 12 hr people...) 14 District News We meet at the Ingles in Cleveland at 10:00am. KSU 11:00am. We will also be having a ride on May 15 in conjunction with District 5 to Maggie Valley. We will meet at the Ingles in Cleveland at 9 AM and kick stands up will be at 11 AM. Richard Malcolm our legislative director then gave us an update including the AMA is reporting that the EPA is going to regulate street to competition conversions on motorcycles. Anthony then told us that Wayne Overholt the state legislative director will be holding a summit that he will be attending and asked us to give him our concerns and wishes for future legislative action. Brian then gave us his treasurer report. He then reminded anyone who isn't on our mailing list to leave their addresses to be added. You too can join the District 2 mailing list for information on meetings and events by sending an to webmaster@abatega.org and ask to be added to the list. Anthony then opened the floor for discussions about fundraising. He also told us that we still need people to step up for the open officer positions in the district and for volunteering at the district two tables at events. Les then gave us an update on Christopher Fister's motorcycle accident. Chris is doing OK and when his passenger went to the hospital in Chattanooga for her injuries they discovered a brain tumor that they did not know she had previously. The Lord works in mysterious ways indeed! We all wish them well and hope that they both have a full recovery. Les made a motion to close the meeting at 2:56pm Join us for our next meeting Sunday, May 1 at 2 PM at JW Reeds in Cleveland. District Four West 13 April 2016 Initial meeting Initial meeting of re-opened District 4West had 16 people attending at Mulligans on Roswell Street in Marietta. Tim Newberry has taken the DC position, with Randy Snyder ( of Full Throttle Magazine) as his assistant. Cheef (Smith) is grandfathered into the Legislative Director position; Ann Turner will be Secretary; Liz Dunn ( who owns Mulligans ) will be Treasurer. Ned Williams (State DC) suggested that we reach out to the people who were members of District 3 ( Douglas County ) and invite them to join us. Districts 4 East and 4 West are the two districts most closely aligned with metro Atlanta; we encompass Fulton County. Wayne Davis the DC of 4East has been quite instrumental in getting 4West restarted; he and Brian Clifford ( DC of District 5) rode to the meeting. Ned distributed copies of the Newsletter cover on 2011 that pictured bikes of many manufacturers to show that ABATE is not just for one brand, but encompasses all riders and all styles of riding. The next legislative session, hopefully, will again introduce the dead red bill (which ABATE has been trying to get passed for 10 years) as well as more information on lane filtering. HB 166, which hopefully will raise handlebar height to 25 is sitting on the Governors desk. He has until 3 May to either veto it, or to let it become law. (At this point, there are 41 motorcycles on sales floors that are not in compliance with the current 15 handlebar height. Not sure what the manufacturers are doing about it, although it is in their interest to support our bill.) There are 350 K motorcycle license holders in the state, and over 257K people with M/C endorsements. 13K permits have been issued, many of which have not been converted to full licenses. 14 May 2016 A.B.A.T.E. 15 District News Cheef reported that if one does encounter a light that will not turn green when your motorcycle is sitting at it, report it to 511, as that will go to the state. And some pressure may be applied to get it fixed. We need to educate the general public as to our legal presence on the roads. This could be done by a billboard campaign maybe showing kids and grandkids. But it would be expensive. More needs to be done to raise money for ABATE; the Swap Meet did produce some, but it should not be the only source for funds. Membership numbers need to go up. District Five During the month of April 2016 members of district five helped to setup, staff, and cleanup after the ABATE of Georgia state swap meet and rally in Griffin Georgia, on April 1 st, 2 nd, and 3 rd. On Sunday the 10 th of April, we set our information and membership booth at the Covington Bike Fest in Covington, GA. District five meet as scheduled on the 17 th of April 2016, (thethird Sunday of the month at 2:pm). At: Falcons Fury Harley Davidson of Conyers, GA. Five members and nine guests attended the meeting. We started at 2:pm with a picnic lunch and social hour, where several of the customers and employees of Falcons Fury visited with us for a bit of the free lunch. Our state legislative director Wayne Overholt missed the social hour because of taking part in a vehicular collision only a few blocks before arriving at our meeting. But he came to the meeting on his busted up bike, when emergency services released him. With the district coordinator presiding, the meeting was formally called to order with a pledge of allegiance to our national flag at 3:05pm.The opening prayer was waived as usual, against my opinion. The treasurer report by David revealed only $ 533.oo current funds remaining, minus the unpaid costs of the canopy things for our booth, and upcoming bank fees. And the other expenses that we expect. Officer reports commenced at 3:25pm: Our district coordinator Brian has been communicating with the Grace Riders chapter of the Christian Motorcycle Association from which we think a representative may start attending our meetings. And they wanted us to know about their regular CMA meetings on the 4th Monday of each month at 7:pm. At the IHOPrestuarant on 142 in Covington just south of I-20 Exit 93 at the Wal-Mart Parking Area. Brian also talked about using social media to inform people of our purposes and activities. David Neal led into the activities directors report, with a special thanks to our guests Tom Komjathy of the Georgia motorcycle safety program. And to Wayne Overholt, the state legislative director of ABATE of Georgia. The state spring swap meet in Griffin is believed to have been financially successful. And 46 people paid membership dues. Plans for ABATE s state fall swap meet and rally on September 24 th and 25 th are already underway, for the same location as last year, at ZipnTime in Helen, GA. ABATE of Georgia s education director Chris Carrwill instruct an upcoming rider safety class at Mountain Motorsports of Conyers on the 22 nd. District 13 will be at the car show at Angel City in Unadilla GA. on April 23 rd. Districts five and five north will be helping with the Ride 4 The Fallen on May 21 st to honor our fallen military veterans with a parade, ceremony, and a group ride. Harry Jones of district five north described this event, and a planning meeting is scheduled for the 5 th of May. Brian mentioned that we still need a few volunteers to help with our part. District five north meets the third Tuesday of the month at 7:pm at Cycle World, 4225 Atlanta Highway, Athens, GA. Cycle World also has an Open House Party 10:am- 4:pm on the 11 th of June. Flag day ceremonies are also held there in Athens, with formally retiring worn flags. Wayne Overholt gave a 15 minute legislative director s report including: The status of HB166 (the bill that will increase the current motorcycle handle bar height limit) has passed both houses of the state legislature and awaits the governors signature, or to automatically become law in June if not signed or vetoed. There are 44 factory model motorcycles being sold and ridden in Georgia that violate the current handle bar height limit. Wayne told us about some experiences or of talking with some of our state legislatures and other persons, to ask for introduction and support of favorable legislation, and explained certain aspects of lawmaking procedure. And that ABATE of Georgia has not felt a legislative victory for nine years. We also heard about the friendliness or dislike towards motorcycles expressed by several legislatures and public safety officials, through both spoken intentions and those proven by their actions towards motorcycle related legislation and such. And that our ABATE of GA, legislative directors are interested in what particular issues of law our members would like us to address in the near future. With the limited time and resources we have to influence our lawmakers, we must focus on a very few of the laws or administration of the laws that are not agreeable to a majority of Georgia s motorcyclist. More than 350,000 Georgians are licensed to operate a motorcycle, but there are less than 180,000 registered motorcycles, and less that 900 members of ABATE of Georgia. 16 District News It was mentioned that one of the items we are working towards, is to have questions that are relative to motorcycle awareness placed on the written driver licenses tests that apply to all drivers. The membership report estimates only a dozen ABATE members are listed in district five s locality. No officer report was given by the secretary because there was nothing to report that was not included in other reports or business. The sargent at arms did not report because that office is currently vacant. District business commenced at 4:12pm: Stacy Clifford was elected and immediately placed in the office of district treasurer. Search for a meeting place more adequate space or meeting at a different time was discussed, with a couple of suggestions to look into. Possibility of a need to obtain permits for certain fund raising activity was briefly discussed. Attendance at the quarterly state board of directors meetings was discussed, and Brian Clifford announced that it will be mandatory for all district five officers to attend those meetings. And we still offer a chance to win a one year membership for $1.oo. Tom Komjathy of the Georgia motorcycle safety programspoke about appreciation of our concerns about the funding that was taken away from the GMSP, and their willingness to work with ABATE in efforts to provide safety education. Kevin Donegan who is a member of the Dead End Hurst Club told about that club of drivers of funeral vehicles, and offers to drive his hurst to be a part of our events. Kevin is also a motorcyclist. 17 District News Ralph gave the treasurer s report as of March 31 st, which was approved by the membership. Gary welcomed everyone and gave opening comments. Steve asked Shannon with the Bomber Girls to give the details of their upcoming event on April 16 th at the Veterans Club. Gary said we should set up a booth there. Several members then mentioned other upcoming events. Reb informed us that HB166 (handle bar height) made it to the governor s desk and asked if anyone had been stopped in Peachtree City for a helmet violation. Gary gave the membership report the district has 37 members and 18 people were in attendance at the meeting. He said the state is showing members for the failed 6/3 district and he would contact those listed and let them know where we meet. Ralph said he would pick up the gift certificates from Jere s Cycle Craft before each meeting. Ralph went over the change of the by-laws to be voted on at the board of director s meeting to be held on May 7 th. One refers to the districts paying for insurance and one refers to the organization being able to deny membership to someone that has been deemed as unbecoming. There was a group discussion which did not include how Gary should vote. Reb said our state legislation director Wayne, is doing a great job. Linda said she had obtained the state treasurer s report for February. Karen reminded us that legislation is why we are here and Kevin said addresses need to be corrected. During a group discussion about our upcoming event, it was decided to hold it on Saturday, October 15 th and there were several suggestions made which leaned most heavily toward a cemetery poker run with the cards costing $20.00/each.JoLynne asked for a chairman to head up a committee for the event no volunteers. 19 District 13 News for April District News Greetings from South Georgia! Spring has sprung and it's time to put our knees in the breeze! Every third weekend in March Ashburn has it's Fireant Festival and it has always been a tradition for our district to hold a poker run that Saturday. Well this year was no exception and we are proud to say that we've officially named the run after Roger Musselwhite, a former member who passed away in 2012 Roger was a rare individual and if you ever met him you would know what I am talking about! He sincerely cared for the motorcyce community and their rights. Roger loved to talk and everything he said he spoke with sincerety and conviction. Roger was the first Coordinator for District 13 way back when. Over the years he remained a member and he and his lovely wife Sandra participated in a lot of District 13's events. Before the ride Brother Earl, The Pearl said a few words in honor of Roger and we all joined in Praise to God for having had Roger in our lives. We thank all the businesses and individuals who donated door prizes for our event and thank you also to everyone who participated.. As more experienced riders, we need to take them under our wings, and share wisdom and experiences. From anticipating hidden driveways to danger lurking in the shadows; noticing pavement and changes to negotiating blind turns; and choosing appropriate speeds to deciding when and where not to be a hoodlum, every lesson learned via a close call or scars has become an essential lesson to impart. Teenagers and new riders can t know all the survival tricks because they haven t experienced it all yet, and haven t learned the hard way. While a motorcycle safety course is essential, it s not the only education needed. A young rider s enthusiasm and lack of experience can lead to trouble, even if a good-faith effort to obey the rules is made. Here are four skills that can benefit younger and less mature street riders. Know What Speed Really Means. A quick twist of the throttle means it will now take way longer to turn, brake, or avoid trouble. Doubling your speed adds four times more energy into a riding situation. Plan Your Escape. Train your mind to constantly scan for threats and plans escape routes. What will I do if and, Where will I go if are essential questions to replay as road and traffic conditions change. Be Suspicious. Young riders sometimes assume they ll be safe if they just obey the speed limit. However, left-turning cars, road hazards, or even an unmarked turn can still take them out. Don t Wander. Instead of climbing aboard and mentally checking out, young riders should embrace the immediacy and responsibility of the ride. Then when the unexpected happens, they ll be ready. Enjoy the ride and the freedom, but always remember where you are. Help keep the next generation of riders safe, so they can share in the experiences and stories we all enjoy. 26 National and Regional News WASHINGTON, D.C. Preventing the U.S. Environmental Protection Agency from regulating the conversion of street bikes and other motor vehicles into competitiononly machines is the intent of recently introduced, bi-partisan legislation: the Recognizing the Protection of Motorsports Act of H.R (RPM Act) would create and clarify an exemption from a proposed EPA regulation for motor vehicles use solely for competition. The AMA wants language that specifically exempts competition motorcycles from EPA regulation. The RPM Act states that it was the clear intent of Congress in passing and amending the Clean Air Act that vehicles manufactured for, modified for or used in organized motorized racing events would not be included in the Clean Air Act s definition of a motor vehicle. The AMA is coordinating its efforts with the Specialty Equipment Market Association and other racing sanctioning bodies to block the EPA s proposed regulation of competition-only vehicles, including motorcycles. SEMA represents vehicle aftermarket manufacturers, marketers and distributors. Motorsports competition involves tens of thousands of participants and vehicle owners each year, both amateur and professional. The AMA sanctions more than 1,700 competition events each year. WASHINGTON, D.C. The Clear Creek National Recreation Area and Conservation Act, which would establish a national recreation area in California and reopen about 240 miles of off-highway-vehicle riding trails, was reported out of the House Committee on Natural Resources Committee on March 16 and now goes before the House for consideration. Sponsored by U.S. Rep. Sam Farr (D-Calif.), H.R would allow off-road vehicles to return to the 75,000-acre Clear Creek Management Area southeast of Hollister, Calif., and establish the 21,000-acre Joaquin Rocks Wilderness area, a compromise proposal that has bipartisan support among California's congressional delegation. Clear Creek was closed to motorized vehicles by the U.S. Bureau of Land Management in State News DOUGLAS, Ariz., The motorized travel system in the Coronado National Forest s Douglas Ranger District is the target of proposed changes. A preliminary environmental assessment has been prepared. The proposed project includes roads, trails and motor-vehicle-use areas on National Forest System lands in Cochise County, Arizona, and Hidalgo County, New Mexico. Comments on the proposal are being sought by the ranger district through April 4. Saddleview Road, Douglas, AZ, (520) DENVER Motorcyclists would no longer have to carry transponders to use high-occupancy-vehicle lanes under H.B But, according to ABATE of Colorado, the proposal is stalled because transportation officials can t figure out how to provide motorcyclists free access to the lanes without the transponders. Federal regulations permit motorcyclists to use HOV lanes toll-free. BALTIMORE A City Council committee began discussions in March to bring an off-highway-vehicle park to the community. With City Councilman Pete Welch leading the effort, committee members hope to establish a park that will attract dirt bike riders, as well as BMX riders, skateboarders and other wheeled recreational users. The idea was sparked in the summer of 2015 when dirt bike riders resumed weekly events along Reistertown Road near Druid Hill Park. City officials, residents and riders hope an OHV park will help alleviate complaints about traffic congestion and public welfare concerns created by the illegal riding. The AMA is participating in the process in an advisory role. BOSTON Motorcycle-only checkpoints would be prohibited under S. 1832, sponsored by motorcyclist and state Sen. Anne Gobi (D-Spencer). Specifically, the bill would prohibit a motor vehicle checkpoint that targets a particular type of motor vehicle decoration or adornment of the vehicle or rider. CARSON CITY, Nev. The Division of State Parks is seeking applicants for grants from the 2016 round of federal Recreation Trails Program funding. Nevada expects to receive about $1.1 million. Grants may be awarded to counties, municipalities, federal agencies, private organizations, nonprofits or Native American tribal governments. The grants may be used for outdoor recreational trail activities. An ad hoc Recreation Trails Program Committee will review the applications. The Carson National Forest has scheduled community meetings during April to gather input concerning land being evaluated for Wilderness designation. The forest has six Wilderness areas. The Forest Service is examining all of the land it manages for characteristics that would allow for the Wilderness designation. The federal Wilderness designation includes an area where the earth and its community of life are untrammeled by man, where man himself is a visitor who does not remain. An area of wilderness is further defined to mean an area of undeveloped federal land retaining its primeval character and influence, without permanent improvements or human habitation. More information is available from the New Mexico Off Highway Vehicle Alliance ( COLUMBUS, Ohio The Motorcycle Ohio rider training program is changing its course curriculum and taking the program in-house, beginning in January The new curriculum is based on the Idaho STAR materials and National Highway Traffic Safety Administration model standards for state motorcycle rider training programs. The revamped program will be known as Motorcycle Ohio Rider Enhancement, or MORE. Motorcycle Ohio will control content, delivery, instructor certification and future development. These materials will also form the basis for upper-level courses. MORE will be the only curriculum approved for motorcycle endorsement in Ohio, the memo states. 27 HARRISBURG, Pa. The profiling of motorcyclists would be prohibited under H.B. 1580, which passed the state House by a vote and is in the Senate for consideration. The bill would require that law enforcement training include instruction on what constitutes motorcyclist profiling and that each police department include in its procedures and operations policies a statement condemning motorcyclist profiling. RICHMOND, Va. Auxiliary lights, such as LED accent lights, would be allowed on motorcycles under H.B. 939, passed the House of Delegates and being considered by the state Senate. Current law requires that all vehicle lighting be approved by the superintendent of the state police. OLYMPIA, Wash. S.B would authorize a trial project allowing motorcycles to move around slow traffic. The bill, which passed the state Senate, would allow motorcyclists to use the left lane or shoulder to pass traffic, if the traffic is traveling no more than 25 mph and the rider is traveling no more than 10 mph faster than other traffic. The pilot project would run through July 31, Industry News Samsung and Yamaha are developing a Smart Windshield that would display information such as navigation instructions from a motorcyclist s smartphone and trigger automatic responses to text messages and phone calls. The effect would be similar to a head-up display on a helmet. Samsung touts the concept as a safety feature, allowing riders to watch the road while checking their smartphone information. Vista Outdoor will acquire the Bell, Giro, Blackburn and C-Preme brands for $400 million in cash plus an earn-out related to the future performance of the powersports business. The deal is expected to close by the end of April. EAST TROY, Wis. The first 2016 model motorcycles from Erik Buell Racing were produced on March 17 under the ownership of Liquid Asset Partners of Grand Rapids, Mich. Liquid Asset Partners bought the manufacturing assets of EBR at a court-ordered auction under Wisconsin s state bankruptcy procedures. The company says it expects to produce 1190RX and 1190SX models, slowing increasing production during the rest of this year. IRVINE, Calif. Motorcycle USA, magazine covering the motorcycling community, closed in March after 20 years of production. The magazine announced the move on Twitter on Feb. 24. The sister publication of Cycle News was part of Motorsport Aftermarket Group, which also includes such brands as J&P Cycles, Kuryakyn, Mustang Motorcycle Seats, Motorcycle Superstore and Vance & Hines. Motorcycle USA reported its website will remain active for an extended period of time to serve readers with content that has accumulated over the years. International News BANGKOK, THAILAND Uber, the taxi service that passengers hail with their smartphones, has established a motorcycle-on-demand service called Uber MOTO in Bangkok. The pilot project will evaluated the service, which was developed for emerging markets. April 21, 2016 Modified Motorcycles Potentially Under Attack Members of both Houses of Congress have introduced proposed legislation that would protect the rights of Americans to modify their vehicles for racing purposes. Dubbed the Recognizing the Protection of Motorsports Act of 2016 (RPM Act, H.R and S. 2659), this legislation would ensure that converting any motor vehicle (including street motorcycles) into a competition-only vehicle remains legal. This proposed legislation became necessary after the U.S. Environmental Protection Agency, under the guise of maintaining emissions as outlined by the Clean Air Act, announced plans to regulate the conversion of street motorcycles and other motor vehicles into race vehicles. This attempt is reminiscent of the EPA's efforts back in 2003 to regulate motorcycling through another unrelated proposed regulation aimed at heavy equipment, steam engines and diesel engines that would have prohibited owners from changing anything on their motorcycles except for paint color or chrome. Through the Color and Chrome initiative, the MRF was successful in separating motorcycles from the EPA s regulations and created exemptions to protect the custom and aftermarket industries and our lifestyle. 27 May 2016 A.B.A.T.E. 28 On April 15, 2016, the EPA announced that, under pressure from Congress, it would drop the language from its proposed regulations; nevertheless, it shows the clear intent of the EPA to attempt to overstep its bounds, as outlined by the Clean Air Act, in an effort to strip motorcyclists of the rights to modify their motorcycles as they see fit. The MRF urges its members to contact their U.S. Representative and Senator and ask them to support H.R. 4715/S. 2659, the Recognizing the Protection of Motorsports Act of 2016, so that the EPA makes no further attempts to erode motorcyclists rights. Federal Funds Available for Distracted Driving Programs April 13, 2016 Did you know that funds are available from the federal government for states that enact distracted driving legislation? The Motorcycle Riders Foundation (MRF) wants you to know that H.R. 22, the Fixing America s Surface Transportation Act (otherwise known as the FAST Act), authorizes funds for highway safety programs that include distracted driving initiatives. Section 2005, Article 4 of the bill specifically provides funding for distracted driving legislation, stating, In each fiscal year, 8.5 percent of the funds provided under this section shall be allocated among States that adopt and implement effective laws to reduce distracted driving. While there is specific language that spells out the details of eligibility, in general, states that are interested in applying for these grant monies need to: make distracted driving awareness a part of the driver s license examination; pass legislation making it illegal to text while driving; and pass legislation that prohibits drivers under the age of 18 (or on a learner s permit) from using a wireless communications device while driving. These grant funds can be used in a variety of ways, including public advertising campaigns that explain the dangers of texting while driving, traffic signs that warn motorists about distracted driving laws, or for the costs related to enforcing distracted driving laws. Too often state legislatures are reluctant to pass new legislation if there is a perceived cost, and these grant funds help offset any costs states would incur by passing distracted driving legislation. If your state is considering or currently debating distracted driving legislation, the MRF encourages you to make the appropriate legislators aware of these grant funds, as their availability can help sway a legislature towards passage of such laws that ultimately protect not just motorcyclists but all roadway users. Lester have filed a Federal Court law suit against the Eastern Idaho State Fair on behalf of members of the Idaho COC. The suit was filed in Idaho Federal Court for civil rights violations stemming from an incident where they were told to leave the fair for wearing so-called gang-colors. 28 May 2016 A.B.A.T.E. 29 On September 1, 2013, members of the Brother Speed, Black Hand, Draugr, and Ph*ts motorcycle clubs attended the Eastern Idaho State fair with AIM attorney Michael DeKruif to confront fair personnel regarding the fair s policy of discriminating against certain motorcycle clubs. The fair has a policy where anyone representing themselves as part of any outlaw/criminal motorcycle gang, or wearing attire that associates them with gang attire, will be asked to leave the fairgrounds. The fair claims that Brother Speed is a so-called gang, and that the other clubs are so-called support clubs. Rather than removing their colors, the club members decided to leave the fair, and they were given refunds. In the lawsuit, we are seeking damages and an injunction prohibiting the fair from enforcing such a policy as it violates the members rights of freedom of expression, assembly, and due process. The Law Office of Richard M. Lester, AIM, and NCOM will remain united in the fight for bikers rights as we have been doing for over three decades and will continue to do so. The case is in the discovery phase, with more depositions planned in the near future. CLACKAMAS COUNTY, OREGON PAYS $20,000 TO MOTORCYCLISTS FOR COUNTY FAIR DISCRIMINA- TION CLAIMS Two members of Portland area motorcycle clubs were refused entry to the 2013 Clackamas County Fair and Rodeo, SOLELY because their clothes displayed their club affiliations. After traveling miles to the fair, they were turned away at the gate. In response, Bruce Ankarberg, Chairman of the Oregon Confederation of Clubs (The COC) and member of The Flying 15 Motorcycle Club attended meetings of the County Fair Board, along with legal research analyst Kevin Phillips. Ankarberg told the board these motorcyclists were singled out and refused admission based ONLY on the writing on their attire, indicating their club affiliations. Jeff Williams of Brother Speed MC, and another biker from a local club worked with Portland civil rights attorney Kyle S. Clark, and in June, 2015, through the efforts of the COC and their attorneys, each motorcyclist was paid $10,000 for the violation of their civil rights under the First and Fourteenth Amendments to the U.S. Constitution. Ankarberg said he was impressed and pleased by how quickly the Clackamas County Fair Board understood they had erred and corrected their policy. As a gesture of their goodwill, the fair gave the COC free passes for the 2014 fair and demolition derby. The Oregon COC wants the public to know that Oregon motorcyclists are their friends and neighbors, and that they have a constitutional right to belong to any club, and to associate with whomever they choose, free from government interference or discrimination The two motorcyclists each donated part of their settlement to legal funds set up to assist other motorcyclists who are victims of discrimination, including the recent Waco tragedy, through NCOM, the National Coalition of Motorcyclists. 29 May 2016 A.B.A.T.E.
