3 The Rules & Regulations outlined explain the policies and guidelines established by the Martha s Vineyard Board of Directors to help protect and provide a peaceful environment for our community. It is the responsibility of the board of directors to administer and enforce the rules. However, it is the responsibility of each resident to cooperate and adhere to the rules of the condominium and residents are encouraged to report any violations of these rules to the management company. 4 MARTHA'S VINEYARD HOMEOWNERS ASSOCIATION RULES AND REGULATIONS OF THE COMMON AREA On this _1st day of July_, 2016, these rules and regulations have been duly adopted by the Board of Directors of Martha s Vineyard Homeowners Association by the authority vested in them pursuant to the CC & R s paragraph Association Rules to regulate common elements for the good common sense and designed to enhance and improve the safety, and overall enjoyment of the complex for all residents. These updates rules and regulations supersede all previously adopted rules and regulations concerning Martha s Vineyard. 1. GENERAL VEHICLE/PARKING REGULATIONS: 1.1. It is the responsibility of each unit owner (and his or her tenants) to fully comply with these rules and regulations. Unit owners (and their tenants) will be responsible to communicate and properly instruct all tenants, visitors, guests, family members, tradesmen, callers and others who may have legitimate reasons for access or cause to be on the property, regarding the operations and effect of these rules and regulations Unit owners who lease or rent their units to others are ultimately responsible for the actions of said tenants. The unit owner must include said rules and regulations in the lease or rental agreement, or 30 days after a new effective date. A violation of these rules and regulations by a tenant shall be deemed a default under the lease or rental agreement The Board of Directors shall be authorized, in the manner and to the extent permitted by law to enforce these rules and regulations and may call upon the service of municipal law enforcement agency to assist in the achieving compliance or may use the services of a qualified towing service to remove any vehicle which may be in violation. 2. PERMITTED PARKING: Parking of motor vehicles with a Martha s Vineyard parking permit placard will be permitted in designated parking areas Designated Parking Areas (four areas): 1.) South outside main entrance to complex; five (5) stalls. 2.) Facing East, between Units 10 and 11; four (4) stalls. 3.) Facing West between Units 11 and 65; two (2) stalls. 4.) North/East near Units 25 and 26; three (3) stalls. In addition, each unit is designed with an attached garage for two vehicles. Page 1

5 2.2. Parking Stalls: Vehicles must have a parking permit to park in a stall. (Parking Permit Placard to be placed on the rear view mirror with the permit number in view). Parking is on a first come basis, there are no assigned parking stalls. Vehicles are to be parked within the designated lines, no overlapping and parked front-in only (no back-in parking). All vehicles must have current legal California registration tags, or vehicle will be towed. Parking Stalls are not for storing vehicles Time Limit Parking in Stalls: 72 hours is the maximum time to park in a marked stall. Parking stalls are for temporary parking to be enjoyed by all residents. Owners or tenants are prohibited from: Car Swapping; this is when one vehicle leaves a stall and is immediately replaced by another vehicle from the same unit. Spot-jumping; this is when a vehicle leaves a stall and immediately proceeds to park in another open stall to extend the 72- hour limit. Parking Permit Placard Sharing; is when an owner or tenant makes arrangements to give his or her parking permit to another owner or tenant, to allow for additional vehicle parking privileges. Any action by owners/tenants to increase the 72-hour maximum time is considered fraud and will subject the owner to a fine. (If you vacate a stall in the morning and return in the afternoon or evening (or vice-a-versa) and the same stall is still empty, there is no violation.) (Not to be confused with the 72-hour time) Parking Stalls are full: When all stalls are full, parking on the street is the next alternative. This is the responsibility of the vehicle owner. 3. PROHIBITED PARKING: Parking of motor vehicles is prohibited in all other locations within the complex, including: 3.1. No Parking Areas: Parking is prohibited in all of the locations within the complex which are fire lanes, no parking in front of a closed garage door (if you are not parked in a permitted lined designated stall you are in a fire lane and in violation. All areas other than your garage and designated parking areas are considered FIRE LANES. The only exception to this rule is for loading or unloading purposes or washing your vehicle, and your vehicle must be moved to your garage or other designated parking area when you re done. No parking on lawns or shrubbery. No double parking Prohibited Vehicles: No commercial vehicle, truck, and/or by common usage and practice, not including light pick-up trucks of threequarter (3/4) ton capacity or less, less than twenty (20) feet in length, unlicensed or inoperable motor vehicle (which shall include, without limitation, any vehicle which would not pass applicable state inspection criteria), vehicles without current tags or registration, trailer, mobile home, camper, house trailer, recreational vehicle, boat or other similar vehicles, machinery or equipment of any kind or character (not including such equipment and machinery as may be reasonable, customary and usual in connection with the use and maintenance of any dwelling and any equipment Page 2

6 and machinery as the Board of Directors may require in connection with the maintenance and operation of the complex) shall be kept upon any portion of the complex (except for bona fide emergencies). No toys, bikes, skateboard or other items or personal property is to be left or stored in the parking areas or common areas Speed Limit: is 5 miles per hour and all drivers are to stop at the Stop signs before proceeding in the thorough ways. Convex mirrors near entrance and exit gates and speed bumps are located in the driveways throughout the complex and are installed to encourage safe driving Double Parking: double parking is prohibited. 4. VEHICLE REPAIRS/OIL OR FUEL LEAKS/NOISE: 4.1. Vehicle repairs are prohibited inside any garage or parking stall within the complex. The exception is emergency repair such as flat tire, charge or replace battery and add needed fluids Vehicle oil/fuel leaks caused by the owner, a tenant or guest is subject to be fined and charged for the clean-up costs if not cleaned immediately Bad mufflers lead to noisy autos and are prohibited Loud music from automobile s is not permitted at any time within the complex. Volume should be turned down when entering the complex Revving of engines in motor vehicles and motorcycles is prohibited. 5. THEFT/VANDALISM TO VEHICLE: 5.1. The Homeowners Association (nor the Board of Directors) shall not be responsible for the maintenance, insurance, liability, theft, vandalism or any damage which may come to any vehicle. THE VEHICLE(S) OWNER SHALL BE TOTALLY RESPONSIBLE FOR ANY VEHICLE PARKED UPON THE HOMEOWNERS ASSOCIATION PROPERTY AND SHALL INCLUDE PERSONAL AND/OR PRIVATE PROPERTY. 6. ENFORCEMENT PROCEDURES: 6.1. The Board of Directors shall be responsible for enforcing these rules and regulations. In fulfilling its obligation to enforce these rules the Board may enlist the assistance of its managing agent and/or such other agents (such as a towing contractor). Unit owners or residents who observe a violation or wish to lodge a complaint should contact a Board member or its Management Page 3

7 Property Agent, and make such complaint in writing. Any vehicle found to be parking in violation of these rules and regulations may be immediately towed from the property at the expense of its owner and without prior warning Towing violations: Without limiting the generality of Section 5.1 of these rules and regulations the following violations will result in immediate towing without warning; Vehicles threatening the safety of the complex residents, including but not limited to parking in designated fire lanes Vehicles blocking or improperly impeding access to any portion of the general common elements Prohibited vehicles which shall include commercial vehicles, inoperable or unlicensed vehicles and covered vehicles No unit owner nor any guest of a unit owner may park in the common area directly in front of another unit owner's garage, blocking the area Vehicles exceeding the 72-hour stall parking maximum time Vehicles which are not operational or properly equipped for travel on public roads or highways may not be parked on the property The Board may fine a violator of these rules and regulations up to $25.00 for each violation. Collection of fines may be enforced against the responsible unit owner. In addition to any other remedies provided by the HOA s governing documents and/or applicable law, in the event of a failure by a unit owner to pay any fine assessed within thirty (30) days of written notice of the fine having been given to a unit owner, the Board of Directors may initiate a lawsuit against the unit owner for failure to pay the fine. If a lawsuit is filed, the HOA may recover its costs and expenses, including reasonable attorney's fees incurred in connection with the initiation of such legal action. 7. ANIMAL REGULATIONS 7.1. All dogs when outside must be on a leash. The owner is responsible for cleaning up the animal s waste products which must be removed from lawn areas, sidewalks, driveways and shrubbery areas immediately Each unit is limited to two (2) usual domesticated household pets. Each pet must weigh less than forty (40) pounds. Pet means any domesticated bird, cat, dog, aquatic animal kept in an aquarium. Note: a new litter of kittens or puppies is NOT an exception to the rule. No livestock farm animals, poultry of any kind or wild animals are allowed. Page 4

8 7.3. No animal shall be kept for breeding or maintained for any commercial purpose A continuous barking dog or any dog left in a patio when owners are away or home, is not allowed. This is a nuisance to the surrounding tenants, Restrictive action will be taken. Control should be exercised over the noise made by pets All animals shall be the exclusive responsibility of the homeowner and occupant/tenant of the home. Aggressive dogs, that threaten a homeowner/occupant/tenant, or their pets are not allowed Harboring and feeding stray cats is prohibited. Violators will be fined for having the cats removed from the complex. Fees will include cage transport, transportation and fees from the animal shelter. 8. Homeowners Rules for Renting to Tenants/Occupants: 8.1. Any owner who chooses to rent or have occupied his/her unit must provide their tenants/occupants with a copy of the RULES AND REGULATIONS and all notifications sent to them of up and coming activities occurring at the complex Upon renting or having occupied your unit, owners are to notify the property management company and provide the name and phone number of the new tenant(s). Key cards and/or remote gate openers to access the entrance gate will be provided at this time IT IS THE OWNER'S RESPONSIBILITY TO ENSURE THEIR TENANT(S)/ OCCUPANT(S) COMPLY WITH THE RULES AND REGULATIONS. ANY FINES OR CORRECTIONS REOUIRED WILL BE LEVIED ON THE OWNER. NOT THE TENANT/OCCUPANT. 9. ARCHITECTURAL RULES Exterior Modifications: 9.1. All alterations, modifications or additions to the exterior of your home are prohibited. The only exception is a white picket gate to units with a patio to their front entrance. Cost is the responsibility of the owner. Specifications will be provided upon request Common area modification or additions are prohibited, except as authorized in writing by the Board of Directors. 9 9.3. Garage Doors, Garage Door Openers and Garage Springs are the responsibility of the homeowner. If a Garage Door requires replacement, call Property Management for the correct door to be replaced. All replacement garage doors must be approved by the Board of Directors. Garage Door Replacement Tan Buildings: White Embossed Simulated Wood Grain Texture of 16 Long Rectangle Panels, 4 per row. Dual Metal Framed Vents to be placed on Lower left and right corners of garage door. Blue Buildings: White Embossed Wood Grain Texture of 32 Short Panels, 8 per row. Dual Metal Framed Vents to be placed on Lower left and right corners of garage door. Specifications: Electronic Roll-up Garage Door, Color White, Non-Insulated or Insulated (homeowner s preference), Embossed Simulated Wood Grain Texture, hot-dipped 26 gauged galvanized steel with two coats of baked on polyester paint. Bulb-type bottom weather seal guards against wind and rain while providing a cushion when closing door. No windows. (Garage requires an electric garage door opener). Additional Specifications: Garage doors are custom made because they are not standard size. Custom Size: 16 L X 7 H X 3 D, rows measure 21 H, with a bottom measuring 24 H. 10 9.4. Garage doors are to be cleaned by the homeowner/tenant/occupant periodically Exterior Doors; Front Entrance, Patio and Balcony doors and hardware are the responsibility of the homeowner for replacement. Doors must match existing doors. Doors may be purchased at the local hardware store. Doors that do not match are not acceptable and will require removal at the homeowner s expense. Doors may be made of wood, steel or fiberglass. Check with Property Management for specifications. Read Section 12. Painting for colors of doors. Front Door Unfinished Patio Door 10 Glass Panel Balcony Door 6 Panel No Design 9.6. Window Replacement: Check with Property Management for correct Specifications and obtain approval. All replacements must be approved by the Board of Directors prior to installation. As the homeowners you will have two option either Retro-Fit Window Replacement or New Construction Window Replacement. Retro-Fit Window Replacement Retro-fit windows replacement is the removal of the window panes only and leaving the existing metal frame, and exterior wood window trim in place. Retrofit windows will set within the existing frame of original window and be caulked on the exterior, they are measured to fit in an existing window opening and will only replace the actual window itself. Retro-fitting have been developed so the exterior materials of the structure do not need to be removed, Specifications: Retro Fit, Premium Sliding Vinyl Window (Size according to opening), with Window Grids, Dyna Flex caulking White. New window to be flushed with wood frame. Page 7

Wood repair for the window box is completed, upon all wood repair the new construction window is placed back in the original opening weather flashing is placed around the fixture to prevent water from entering lastly, siding and trim is replaced. Specifications: Retro Fit, Premium Sliding Vinyl Window (Size according to opening), with Window Grids. Wood Trim: 2X6 Rough Cut Wood, 6X12 Hardi Backer Siding, Widow Flashing Grace Vycor Plus 4, Pure White Dunn Edwards Acri-Hues Paint (review Paragraph 12. Painting, Section 12.3 for exact color. 13 9.7. Exterior lamp fixtures will be repaired and replaced by the Association. Exterior Attachments: The following exterior attachments are permitted: 9.8. TV antennas, including Cable TV Satellite Dish; wires are to be secured, until all satellite/antenna box mounts are installed in all units One satellite dish per unit is common. A request in writing for a second dish is to be addressed to the board of directors with a justification. Association will cover the charges for an additional roof cable mount and installation. When changing carriers and/or installing a new dish, old dish is to be removed A roof satellite or antenna box mount to hold the satellite dish will be provided for all units. The mount will be installed in a designated area on the roof (This will be done as roof replacement takes place for each unit). Mount will hold all wires. No additional items may be added to a mount or to the roof. Advise your cable carrier of the new mounts. Satellite or Antenna Box Mount, Commdeck (Mfg.) Exterior Attachments: The following exterior attachments are prohibited: Awnings Aluminum foil covering windows Mesh screen door covers on outside of exterior doors (you may place on the interior side of your door, you may open the interior door exposing the mesh screen, but once door is closed no mesh screen is to be exposed on the exterior) Screen Doors on front entrance door, side patio or balcony doors are prohibited Bars or gates made of any structure (wood, metal etc.) are prohibited on Windows, doors and walls. 14 9.16. Exterior Fans in Windows are prohibited. Fitted Interior Window fans are permitted. Screens must be left on the windows. Window screen are to be cleaned periodically when using fitted window fans Floor Fans are prohibited in windows Window Air Conditioners are prohibited. 10. Window Covering/Window Screens/Broken Glass Windows All windows, sliding doors etc. shall be properly covered with appropriate window dressings. Sheets, blankets, newspapers, boards or other such items shall be specifically prohibited. Window dressing shall be of a reasonable quality and shall compliment the property. Curtains, drapes, blinds etc., are recommended Window drapes are not to be hanging out of windows, nor tied in a knot, this is does not a compliment to the property Window Screens are to be kept cleaned, and replaced when torn or frayed. Replacement is the responsibility of the homeowner Broken Glass Windows are the responsibility of the homeowner and to be replaced within 30 days when cracked/broken Windows with broken springs; it is recommended to use two wooden dowels (thin) to hold up each side of window (cut and measure to your preferred open height), until springs or window is replaced. Prohibited are unsightly items to hold up a window in open position. 11. Patio/Balcony Patios and Balconies are not to be used as storage areas. Storage of trash containers, refrigerators, non-patio furniture is prohibited. Homeowner will be responsible for damaged to upper balconies if additional repairs are required due to wood damage Barbecue grills and other cooking equipment should be confined only to open patios and open balconies. Prohibited are garages, closed patios and balconies and any enclosed area Outdoor Umbrellas to compliment your unit may be placed in your patio or balcony (or both). Color must match your unit: blue, tans or beige colors only. Page 11

15 11.4. Laundering of clothes or exterior of drying clothes is permitted in patios or balconies with use on a drying rack which is an apparatus from which laundered items may be hung to dry or air. A patio or balcony ledge, awning, or other part of a structure of building shall not qualify as a drying rack Plants and containers on ledges are prohibited. (The containers and water ruin the wood on the ledges) Decorative Patio/Balcony Lights are permitted. Exterior light fixtures must be approved by the board of directors You may landscape your patio area to your own preference as long as trees, plants, shrubs, and ground cover (both living and solid structural material) do not cause damage to buildings, privacy walls, ledges etc., do not affect the natural slope for drainage, and do not obviously disrupt the character of the complex. Hanging plants and pots are permitted when hung on poles, stakes, or posts that are placed into the ground. 12. PAINTING The repainting or refinishing of the exterior surface of any building or other structure by anyone is prohibited Any exterior surface in-need of painting or stucco repair should be reported to the Board of Directors and the Property Management Painting of Exterior Front Door, Front Door Trim and Garage Door Trim may be done by homeowner when a painting schedule has been missed after two attempts by the contractor selected by the board of directors. 16 Holiday Decorations Holiday decorations are permitted. Such decorations may be put up no sooner than one month (30 days) prior to the holiday and must be taken down no later than one month (30 days) after the holiday Decorations are to be of good taste and not offensive in nature. 14. Trash Waste/Recycle Products Trash containers are to be stored in your garage with lids closed at all times. Trash containers are prohibited to be stored in patios or balconies Trash Waste/Recycle Products pick-up day is once a week, every Friday. Two containers are provided by the waste management services. One for recycled products and one for regular waste For disposing of large items such as furniture, beds, cabinets, electronics, etc. a call to the Waste Management must be made for special handling at no extra charge. A date for pickup will be scheduled. Items are not to be left on the curbside on Waco Street. Homeowners or tenants found placing items on curbside will be notified and fined $ Trash Containers may be placed outside your complex, near your garage driveway no earlier than 6:00 p.m. Thursday (day before pickup) and empty containers must be removed from public view by midnight, Friday (day of pickup). If trash day falls on a holiday the same rules apply, days will be Friday to Saturday Cleaning and odor-free trash containers are the responsibility of the homeowner/tenant/occupant of the unit Trash Containers in locked gated area is for the gardener s use only. 15. Noise No obnoxious or offensive noise or activity shall be carried on, which may Page 13

17 cause a source of annoyance to residents or which interferes with the peaceful possession and proper use of the property by its residents; is prohibited Owners and occupants shall exercise reasonable care to avoid making or permitting loud disturbing or objectionable noises and when using, playing or permitting the use of musical instruments, radios, phonographs, televisions, amplifiers and any other instruments or devices in such manners as may unreasonably disturb owners, tenants or occupants of other homes Homeowners are urged to exercise restraint in using annoying noise working with tools and appliances during late night hours or before 8:00 A.M. on weekdays and 9:00 A.M. on weekends. 16. Disposal of Toxic Waste No owner or occupant shall dispose of any toxic material on the complex in a manner which is inconsistent with local and federal law. Toxic materials include, but are not limited to, oil, antifreeze, solvents, gasoline, paint etc. 17. Common Area Any common sidewalks, driveways, or passageways shall not be obstructed or used by any owner for any purpose other than entrance to and exit from the homes. Bicycles, skates, skateboards, scooters are permitted but not on walk-ways etc Any damage to buildings, equipment, or any other common area property caused by an owner, his family or guests, or employee contractors or pets shall be at the expense of the applicable owner Electronic Entrance Gates for vehicles; There are two electronic entrance gates for vehicles on Waco Street that require a key card or a remote control to enter. The electronic gates require a clearance opening of 20 feet. There is no riding, hanging or jumping over the gates by any person Walk-In Gates: There are two walk-in entrance gates located on Waco. One as you enter the first driveway with the Martha s Vineyard sign (main entrance) and a side entrance gate facing North, towards Tracy School. For your protection, close the walk-in gates when you enter or exit. Do not open to persons you do not know Use of any sporting, recreational or entertainment equipment which may cause bodily harm /injury or property damage is prohibited such as basketball, baseball, softball, or football. Ball playing against exterior walls, garages or tossing balls onto roof ladders is prohibited. Whiffle balls are acceptable. Page 14

18 17.6. BB guns, archery equipment and bats are strictly prohibited Loitering is strictly prohibited at all times Littering is prohibited within the common areas Tree climbing and swinging in trees is prohibited. The responsible homeowner will be billed for the cost to replace any damaged tree Climbing or jumping over walls and fences is strictly prohibited Consuming of alcoholic beverages or smoking (of any type) is prohibited in the common areas Miscellaneous All homeowners must promptly repair and maintain their home to the extent it affects any other home. (Example: water leaking into another home) All homeowners are to ensure that all water leaks are repaired in their unit and report exterior leaks to Property Management All garage doors must remain closed during any period in which the garage is unattended. After loading and unloading of a vehicle or washing a vehicle, etc. has been completed vehicle is to be parked in an open stall or inside of a garage. GARAGE DOORS CANNOT BE LEFT PARTIALLY OPEN FOR VENTILATION Water Hoses are to be removed after each use and stored out of the common area Front Doors are to be cleaned periodically by the homeowner/tenant Smoking in patio/balcony; homeowners/tenants are to be sensitive and conscientious to their surrounding neighbors when smoking. Use good practices. ANY INFRACTION OF THE ABOVE RULES AND REGULATIONS WILL RESULT IN A POSSIBLE FINE OF $25.00 IN ACCORDANCE WITH THE CC&R S OF MARTHA'S VINEYARD HOMEOWNERS ASSOCIATION. THE ABOVE RESTRICTIONS ARE NOT INTENDED TO BE ALL ENCOMPASSING. THE COVENANTS. CONDITIONS, AND RESTRICTIONS AND BYLAWS OF THE ASSOCIATION CONTAIN FURTHER LIMITING PROVISIONS WHICH BIND ALL OWNERS AND RESIDENTS. As you can see, most of the above is just GOOD COMMON SENSE. Your cooperation will really enhance the living quality of Martha's Vineyard. Page 15

19 Martha s Vineyard Homeowners Association Fine Schedule The Board of Directors has approved the following list of potential fines for violations: Schedule of Fines: $25.00 for each Item Listed Below DOGS ($25.00 per incident) (Example: Excessive Dog barking for two days: $50.00) -Dog running loose or with owner but not on a leash -Not picking up feces after dog defecating on common areas (dog owner must clean up after their dog) -Excessive dog barking DRIVING ($25.00 per incident) -Improper Driving -Improper Entry or Exit -Breaking Gate -Improper Use of Gate Access Control Card or Remote PARKING ($25.00 per incident) -Improper Parking -Improper use of Parking Stalls -Parking on Grass -Parking /storage of improper vehicle (non-registered, expired tags) MISCELLANEOUS ($25.00 per incident) -Creating nuisance or disturbance -Cruelty to animals -Interfering with employees or service contractors assigned by management -Vandalism -Mechanical work on vehicle -Holiday Decorations -Trash Containers left out -Furniture, electronics, misc. items, left on curb site. -Other: If you engage in any of the above, you will receive a letter from the HOA in reference to the violation and the fine.
