1 Cavalier Arms Condominium - Parking Rules & Regulations Last Modified February 9, 2012 Parking Rights Ownership of a unit in a building section and current on payment of Cavalier Arms dues shall entitle said unit Owner(s) and/or their designated tenants to the use of one (1) designated parking space, for approved vehicles displaying valid parking stickers. An approved vehicle shall include any conventional passenger vehicle, truck or van. All owners, their tenants, invitees, visitors, guests and/or agents shall observe and comply with the Cavalier Arms Condominium Association Parking Regulations and any and all additional rules and regulations as may be promulgated by the Association from time to time with respect to the use of the Cavalier Arms parking areas. Parking Stickers Owners who meet the above referenced Parking Rights, and are current on their Cavalier Arms dues, will be provided up to two (2) parking stickers per unit. Parking stickers must be affixed to the lower, right hand corner of a vehicle s rear window. Vehicles displaying a valid parking sticker may park in their respective unit s assigned parking space. Residents with more than one (1) vehicle must park additional vehicles in an unnumbered space or on a public street. If you expect a guest, be sure that the guest does not park in the reserved spot of another condominium. Parked vehicles may not extend over the white lines that outline designated parking spaces. Application for parking stickers must be made to Cavalier Arms Management Company. For application to be considered complete and to be processed, the Cavalier Arms Memorandum of Lease (Page 4) and the Parking Registration Form (Page 5) must be filled out, in its entirety. Visitor Pass Owners who meet the above referenced Parking Rights, and are current on their Cavalier Arms dues, will be provided one (1) visitor pass per unit. A visitor pass must be hung from the rear-view mirror inside of a vehicle. The visitor pass must be displayed so that it is visible through the front windshield of the vehicle. Visitor parking is not specifically assigned to a particular unit and shall be available on a first-come, first-serve basis in the unmarked spaces. If there a no available unmarked spaces, the vehicle must park on a public street. Revoked Parking Stickers and Visitor Pass Parking stickers will be invalidated for any unit if the owner falls behind in the Cavalier Arms dues. Owners will be informed in writing that their dues must be paid in full within 10 days of the date of the letter or the parking privileges for their respective unit will be revoked. Owners are responsible for updating their renters to any changes in their parking stickers or visitor pass status. If an owner s parking stickers and visitor pass are invalidated, any vehicle that continues to display the revoked parking sticker or visitor pass will be towed at the sole risk and expense of the vehicle s owner of record. Vehicle Requirements All motor vehicles that are required to be registered in the State of Virginia shall display valid license plates, a valid state inspection sticker and a valid County/Town sticker and must be maintained in proper operating condition so as not to be a hazard or nuisance due to noise, exhaust emissions or appearance. Vehicles not registered in the State of Virginia shall display valid license plates.
2 Restricted Vehicles/Uses In addition, no unit, common area, or parking area may be used by any person for the purpose of body repair work on motor vehicles, except emergency measures, such as jumping a battery, or changing a flat tire. No Unit Owner shall keep and/or maintain in any unit or on the Common Elements, junk or abandoned vehicles, or any vehicles which are inoperative or unlicensed, or any vehicles having an empty weight in excess of ten thousand (10,000) pounds. No motorized vehicles may be used or maintained on the property lawns or sidewalks. Storage of trailers, boats, campers, etc., is prohibited anywhere in the parking areas or on common grounds of the Association. There will be no washing of vehicles on the premises. Gasoline, oil or emission leaks shall be repaired by the vehicle s owner promptly. In case of damage to pavement by oil or other fluids, the owner of the offending vehicle will be held responsible for costs of repair. Vehicles in violation of this section (Restricted Vehicles/Uses) shall be towed at the expense of the vehicle s owner of record. Commercial Vehicles Commercial vehicles larger than three-quarter (3/4) ton capacity shall not be parked within the confines of the Association, expect for those present for the performance of service or property maintenance. Enforcement I Overview The Board of Directors reserves the right to contract with a local towing company to perform enforcement services at such time and hours as the Board deems necessary. The towing company s name and telephone number is posted on a sign at the entrance of the neighborhood. Enforcement II Vehicle Status In cases involving expired, invalid, or missing county decals, inspection stickers, or license plates, an agent, designated by the Board of Directors shall place a violation sticker on the driver s passenger side window of the offending vehicle, allowing seven (7) days to remove the vehicle or correct the violation. Should the violation not be corrected within the allotted time, the vehicle will be towed without further notice at the sole expense and risk of the vehicle s owner. Enforcement III Residential Parking is allowed only in marked spaces. Motorcycle parking is restricted to the proper unit s reserved parking space or on a public street. Motorcycles are not allowed to park in unnumbered spaces If someone has occupied your reserved parking space, please contact the posted towing company. They will validate who has authority to park in a particular space. Note: The towing company will be provided a master cross-reference list identifying the parking sticker/space assignment for each space. Only cars parked in the wrong space based on the sticker/space assignment form will be towed. Any vehicle towed for ANY reason will be removed at the sole risk and expense of the vehicles owner. Replacement Parking Stickers or Visitor Pass A replacement parking sticker or visitor pass, as of January 1, 2012 is $75.00, per item being replaced, regardless of situation. If you remove a parking sticker, it can be exchanged for a new sticker by contacting Cavalier Arms Management Company. All replaced parking stickers or visitor passes will be invalidated. Any vehicle that displays an invalid parking sticker or visitor pass will be towed at the sole risk and expense of the vehicle s owner of record without notice. The Board reviews all fees annually.
