2 The Baxter Meadows Community While Baxter Meadows is commonly known as a single family development it is, in fact, several communities each developed by different builders with various types of dwellings in mind. As of January 2017, the community is primarily single family dwellings with the exception of the Central Condominiums which are still under development. There are a total of 6 Home Owners Associations responsible for the management and maintenance of varied services and common grounds through the community, As of January 2017 these HOAs include the Master HOA and the following subassociations: Central HOA, Central Condos, *Duck Creek Townhomes, Baxter West, *Crossing 1. All Homeowners are members and pay dues to the Master Homeowner Association. In addition, depending on the location of your property, you are also a member of one of the sub-associations. Sub-associations were created to support areas within the community that provide unique services to that particular area only. For example, Central HOA provides snow removal on boulevards and lawn care in Phases 2C&2D due to the high density of that are. In Baxter West, for homes built on the alley (alley-loaded), residents are billed for snow removal for the alleyway only. More specific details of services provided by each HOA is included in the following pages and in the chart on page 4. *Crossing 1 are managed by Al Skogen or skograin@gmail.com. 3 Services Provided by the Master HOA Mowing, Weed Control & Irrigation of Open Spaces aka Common Areas - Linear Park, 10 Acre Park, Ph 2C & 2D Pocket Parks and trail system throughout. (see attached map for detail of open space areas the HOA maintains) Snow removal of Sidewalks bordering Open Spaces Snow removal of alleys in Baxter West Snow removal of streets are provided by the City of Bozeman Services Provided by Central HOA to Central Residents Only Phase 2C mowing of front yards, boulevards, planting bed maintenance, alley & sidewalk snow removal. Phase 2D mowing of boulevards and sidewalk snow removal. Phase 6 mowing of front yards, boulevards, alley & sidewalk snow removal Services Provided by Duck Creek Townhomes Lawn Care & snow removal of parking lot and sidewalks Irrigation start up, winterization and repairs Water and Trash services Homeowner Responsibility Lawn Care in Phase 2D and Baxter West Snow removal of driveways and sidewalks in Baxter West 3

Design Review: For new construction and remodel, contact Luna Properties for an application. Once the application has been completed, submit to Penny Murray of Penny Lane Home Builders. pennymurray@msn.com or Design Review Fee: Performance Deposit: $550 (Check payable to Penny Murray) $1000 (Check payable to Baxter Meadows Master HOA) For Fence Review submit application to Luna. They will submit to the design review board. Please remit review fee and deposit to BAXTER MEADOWS HOA. Review Fee: $50 Performance Deposit: $250 Montana Opticom: The HOA is contracted with Montana Opticom for internet services. The fee is $40/month. For more information contact Mt. Opticom directly Public Streets: The streets of the community are public streets. Snow Removal of streets is the responsibility of the City of Bozeman. Parking restrictions on city streets are enforced by city ordinances. In Bozeman, a vehicle must be moved every 48 hours if parked on a public street and may be towed after 5 days. There is no automatic right to park a vehicle in front of your home on a public street. Or visit Trash Cans: For Baxter West and Crossing I Only, trash cans must be stored out of sight. Section 7.1 Use of Lots All Lots within the Community shall be used only for those uses and/or purposes as allowed by the local zoning, control and regulation. Occupancies may also be subject to the rules and regulations adopted by the HOA. Home occupations shall be allowed so long as such use is incidental and secondary to the use of the Lot and does not change the residential character and complies with local zoning ordinance and regulations. In no event shall external advertising, of any kind be permitted. Also not permitted is the use or rental of any structure on a Lot for any transient, hotel, motel, bed and breakfast, restaurant, bar or other commercial purposes. Section 7.2 Design Approval! Any improvements to the lot must be approved by the Design Review Board. This includes new construction, remodel, fence installation and landscaping. Landscaping parameters include tree plantings, planting beds, shrubs and hedges. Section 7.3 Landscaping All portions of the Lot not improved with a residence, driveway, walkways, patios or decks (referred to as the unimproved area of a Lot) shall be landscaped by and maintained, repaired, replaced and improved by THE OWNER. No Owner may make any changes without prior written approval of the HOA. 8
9 Central HOA Con t. Section 7.5 Lot Maintenance Owners are responsible for the maintenance, repair and replacement of improvements and properties located within their lot boundaries, ie. sidewalks. Section 7.6 Fences and Privacy Walls Must be approved by the DRB. Section 7.7 Restrictions on Vehicles, Parking & Storage Parking on common elements is not allowed. The following may not be parked or stored within the community (they must be stored out of sight): oversized vehicles, trucks or pick-up trucks over 3/4 ton, commercial delivery vans/vehicles, commercial vehicles, vehicles with commercial writing on the exterior, trailers, camping trailers, boat trailers, hauling trailers, boats, and RVs. THEY MAY BE PARKED TEMPORARILY FOR NO LONGER THAN 48 HOURS FOR LOADING, CLEANING AND EMERGENCIES. NO ABANDONED, UNLICENSED OR INOPERABLE VEHICLES MAY BE STORED OR PARKED ON A LOT UNLESS STORED IN A GARAGE. Section 7.11 No Clothesline & Storage No clotheslines, equipment or storage areas shall be so located on any Lot as to be visible from a street and public view. Section 7.12 Pet Restrictions No more than 2 pets and the pet cannot be a nuisance to other owners and occupants. Pets must be leashed and owners must pick up after their pets. Section 7.16 Satellite Dishes Are permitted as long as they do not exceed one meter in diameter. They must be installed in the least conspicuous location. 9

Covenant Reminders: Section 4.8 Association Maintenance The board shall determine the specs, scope, extent, nature of HOA responsibilities. The HOA is responsible for maintenance, repair, upkeep and reconstruction of common elements. The maintenance of water and sewer lines that server more than one unit, trash removal, snow clearing and perimeter fencing and landscaping. Section 6.2 Leasing Restrictions Owners have the right to lease but lease terms may not be less than 6 months. The board shall be informed of units rented, name of tenants and contact information. Section 6.4 Pet Restrictions No more than 2 pets and the pet cannot be a nuisance to other owners and occupants. Pets must be leashed and owners must pick up after their pets. Section 6.5 Satellite Dishes Dishes are permitted as long as they are placed in the least conspicuous location. Section 6.6 Nuisances a) Articles of clothing and furnishing shall not be air-dried using exterior clotheslines or hung over balconies. b) Holiday decorations must be removed no later than 30 days after the date of the respective holiday. c) The following are not allowed to be parked on site: oversized vehicles, RVs, camping, hauling, boat, snowmobile trailers or abandoned inoperable vehicles. Section 6.9 Restrictions on Annoying Lights, Sounds, Odors No light shall be emitted from any portion of the Community which is unreasonably bright or causes unreasonable glare and no sound or odor to be found obnoxious by surrounding neighbors. 10
11 Duck Creek Townhomes SUB ASSOCIATIONS CONTINUED Number of Lots: Dues: Membership: 15 with potential to build 23 total units. 9 units are built to date. $192/mo Owners are also members of Baxter Master and Central Condos HOA. Governing Documents: Covenants # Bylaws # Copy found on HOA website and Luna s website. Covenant Reminders: Section 11 - USE a) Unit owners are responsible for the maintenance, repair and replacement of the improvements located within their unit boundaries which are not specifically the obligation of the association to maintain, replace and keep in good repair, including exteriors of windows and doors of their unit. b) Each unit, at all times, shall be kept well maintained, in good repair and condition, and in a clean and wholesome condition. No sign, poster, billboard, advertising device or display of any kind shall be erected or maintained anywhere with the Community except such signs approved by the Board. c) No bicycles, boats of any kind, sport recreational equipment, trash, litter, junk, boxes, containers, bottles, cans, implements, machinery, lumber, building materials or any item or personal property maybe kept stored in sight. Such items cannot be made visible from the street. f) Restrictions on Animals & Pets Owners are only allowed up to two pets. g) Antennae Restrictions Satellite dishes are allowed. h) Nuisances Articles of clothing and furnishing shall not be air-dried using clothes lines nor hung over balconies. Holiday decorations must be removed or mad invisible no later than 30 days after the date of the respective holiday. i) Vehicular Parking, Storage & Repair Restrictions Parking designated as visitor or guest may not be used by Owners or their family. All other parking spaces shall be used by Owners as a first come, first served basis. Oversized vehicles, trailers, camping trailers, boat trailers, hauling trailers or other oversized vehicles/equipment may not be stored within the Community. No abandoned or inoperable automobiles or vehicles may be parked within the Community. Parking in fire lanes shall not be permitted. j) Restrictions on Structural Alterations No structural alterations to any Unit or Common/Unlimited element shall be done by any Owner without written approval from the ARC. 11

Such maintenance shall include, but not be limited to, picking up and appropriately disposing of debris and garbage, mowing and trimming of the alley right-of-way.
