1 AGREEMENT ADDENDUM COMMUNITY RULES AND REGULATIONS This Addendum ( Addendum ) is made part of the Residential Lease/Rental Agreement ( Agreement ) dated, between ( Resident and you ) and PACIFIC BEACON LLC ( Owner and us ) for real property (the Property ) known as PACIFIC BEACON. To the extent that this Addendum conflicts with the Agreement, this Addendum will prevail. You and we agree that the following Community Rules and Regulations ( Rules ) and any other additional reasonable rules and regulations that we promulgate that do not substantially modify the Agreement and of which you receive reasonable notice, will be part of the Agreement. Noncompliance with these Rules by you, or your Associated Parties, therefore, constitutes a material noncompliance with the Agreement. We strive to render efficient service and to maintain the Property in good condition. To accomplish these objectives, we must have the full cooperation of you and your Associated Parties in observing these Rules. These Rules are intended to promote the convenience, safety and welfare of all residents, to preserve the Property from abusive use and to make a fair distribution of services and facilities held out for the residents generally. Any expense we incur as a result of a violation of these Rules will be assessed against the responsible resident. Where the term you or resident is used in these Rules, the Rules will also apply to conduct by your Associated Parties. You are responsible for the acts and conduct of your Associated Parties. If an Associated Party commits an act which violates the Agreement or California law, we may proceed against you for termination of the Agreement based upon the violation of an Associated Party. 1. COMMON AREA AMENITIES FITNESS CENTER - POOL SPA RECREATION AREA POSTINGS Within the various Common Area Amenities at PACIFIC BEACON, signs are posted which define in detail the safety requirements and appropriate use specific to that area / piece of equipment. Posted signs may include information such as, safe use, times of operation, rules of conduct, dress requirements and other important information. Posted signs are an integral part of the Rules and adherence is required as a part of this Agreement. 2. OFFICE HOURS The Management Office hours will be as posted at the Management Office, at a minimum. Emergencies after normal working hours should be phoned to (619) KEYS You must return door and mailbox keys, if any, to us when vacating. If not returned, you will be charged for the replacement and the amount will be deducted from your security deposit; if applicable; or payable at the time you depart. Current key replacement charges
2 will be posted at the Management Office, at a minimum. You may not install any door locks requiring an entry key without our written permission. 4. MOVING Moving in and out of the Unit must be accomplished between the hours of 8:30 a.m. and 9:00 p.m. You must promptly fold moving boxes flat and place in designated trash disposal areas. No parking of moving trucks or vans, nor use of hand trucks, dollies or hauling devices, on any landscaped area will be allowed. 5. MAINTENANCE / REPAIRS Requests for maintenance and repairs may be submitted in writing to the office during regular office hours or the security desk after hours, or at any time via electronic form/ to service@pacificbeacon.net or called in to the Service Call Center at ( ) -. Emergency maintenance requests can be phoned to (619) The following constitute Emergencies and will be responded to within 1-hour: o Loss of heat or water; o Electrical safety hazard; o Broken water line; o Inoperable toilet; and o Resident lockout. You will not be charged for maintenance repairs or adjustments unless necessitated by your negligence or mistreatment. Repairs determined to be your responsibility will be charged to you based on time and materials. 6. LOCK OUTS You should take care not to lock yourself out of your Unit. If you lock yourself out of the Unit, we will let you back in at no charge, if the Management Office is open. After hours access will be coordinated through the Service Desk on-site or through an emergency maintenance request at the phone number noted in paragraph 5 and may result in a charge. We will NOT, under any circumstances, let someone other than you or occupants as listed on the Agreement into the Unit without your prior written approval, a copy of which has been provided to us. 7. SIGNS Posting signs, notices, advertisement(s) or other lettering on the Property is restricted to the apartment community bulletin board, and then only with our prior written consent. 8. SOLICITATION Solicitation of any type is not permitted anywhere on the Property. You should report any and all unauthorized solicitors immediately to us. 9. OBJECTIONABLE CONDUCT Each resident is entitled to Quiet Enjoyment of the premises.
3 You agree that no loud noise from radio, television, phonograph, tape-player, automobile sound system or human voice may emit from the Unit or on the Common Areas between the hours of 10:00 p.m. and 7:00 a.m. on any day. At all other times, a reasonable degree of quiet shall be maintained for the benefit of other residents. You will not engage in, or participate in, such conduct which is objectionable or prejudicial to the rights, privileges, safety and general welfare of the other residents living on or employees working on the Property. Examples of objectionable conduct would include, but are not limited to, the following: 1) Criminal Conduct. Any misdemeanor or felony under the laws of California, e.g., public consumption of alcoholic beverages; use of profanity in public, breach of the peace; assaulting or threatening any person, resident or employee of the Property; sexual displays in public; larceny of residents personal property or personal property of the Property; gambling; discharging of firearm; arson; destruction of private property, or 2) Other Objectionable Conduct. Any non-criminal activity which interferes with the rights of other residents or employees of the Property; creates a risk as to the safety of other residents or employees of the Property; or interferes with our operation of the Property, e.g., door-to-door solicitation, unsafe operation of a motor vehicle on the Property, honking horn of a motor vehicle for reason other than safety; use of sexually suggestive language or signs towards others in common areas of the Property, operating a commercial enterprise from the Unit, throwing any object about the Property other than in a game or sport in a designated recreation area, littering, and creating a nuisance. You may not disturb, annoy, endanger or unreasonably inconvenience other residents of the Property, or neighbors, nor use the Unit for any unlawful purposes, nor violate any law or ordinance, nor commit waste or nuisance upon or about the Unit. 3) Unlawful purposes include, but are not limited to, the following: (1) Possession, use and / or sale of illegal drugs; and (2) Disturbances or acts of violence that damage or destroy the apartment or common areas, or disturb or injure other residents or our employees. 10. PARKING AND AUTOMOBILES If assigned parking is provided, parking may be altered, modified or discontinued by us with five (5) days written notice to you. In the absence of assigned parking, at our sole option, we may adopt a parking arrangement for the Property, modify the parking arrangement, and/or elect to assign parking spaces. Parking area is for currently licensed vehicles used in daily transportation only. All vehicles (including motorcycles) must be registered at the rental office. The following information MUST be provided us to qualify for registration of each vehicle: (a) current driver s license or picture ID for identification purposes; (b) current legal registration (if registration is not in your name, a written copy of permission of the vehicle owner must be on file); (c) license plate number and full description of vehicle. It is your responsibility to inform the Management Office of newly acquired vehicles and to obtain a parking permit for that vehicle.
4 A parking permit may be assigned to each registered vehicle and, if assigned, must be visible in the vehicle at all times. We reserve the right to restrict the number of vehicles allowed on the Property per Unit. All unregistered vehicles will be treated as belonging to guests and MUST park in spaces designated for visitors ONLY. Guests may park in designated areas within the community, if provided, for only a maximum of twenty-four (24) hours unless we have issued a "Temporary Parking Permit that is visible within the vehicle. You may keep motorcycles only in the standard parking areas we designated. Under no circumstances will they be kept inside the Unit, in the hallways or on the patios. You must park any automobile, motorcycle or other allowed vehicle within the lines of marking a single parking space. Anyone, resident or guest, parking in a designated handicapped parking space in which the vehicle is not displaying either a handicapped license plate or other visible handicapped parking permission, will be towed immediately without prior notification. Vehicles parked in fire lanes, blocking access to dumpster areas, obstructing free flow of traffic or parked in another resident s assigned parking space, if provided, or in other areas we designate as no-parking areas will be towed immediately without prior notification. Red curbed areas indicate fire lanes. Trucks weighing over one (1) ton, boats, trailers, campers, and motor homes are not permitted to park on the Property without our written permission which may be withheld in our sole discretion. Vehicles shall be parked only in the parking areas we designate. We may cite vehicles with oil and/or transmission fluid leaks. Cited vehicles may be towed from the Property within 24 hours of ticketing, at the owner s expense. If your parking space requires extensive clean up, you will be charged for cleaning supplies and labor and you will be responsible for the cleanliness of your designated parking space(s). With the exception of changing of flat tires or other MINOR adjustments, there is to be no vehicle maintenance repair, tune-up, replacement of engine or transmission, change of oil or other fluids, or any other MAJOR repair allowed anywhere on the Property, unless prior written consent is obtained from the Management Office. Every vehicle parked on the Property must be an operating motor vehicle with current license plates, be properly inspected, and be otherwise in compliance with this Paragraph. A vehicle appearing to be stored on the Property is subject to tow within twenty-four (24) hours of ticketing, at the vehicle owner s expense. A speed limit of not more than five (5) miles per hour MUST be observed at all times when driving within the apartment community. All vehicles must be parked with the front of the vehicle facing the curb to prevent damage to curbs and landscaping. Washing or hosing of vehicles is prohibited, except if and where we designate. You are responsible for any damages we incur as a result of your improper vehicle parking.
5 You are responsible for securing your vehicle. Always lock vehicle doors and windows. Do not leave valuables in your vehicle where they may be seen from outside. WE RESERVE THE RIGHT TO HAVE ANY VEHICLE TOWED, AT THE VEHICLE OWNER S EXPENSE AND RISK, FOR THE FAILURE TO COMPLY WITH ANY PARKING POLICY OR REGULATION. 11. SAFETY EQUIPMENT Smoke Detector and/or Carbon Monoxide Detectors(s) 1) Each Unit is supplied with one or more smoke detector devices and may be supplied with a carbon monoxide detector. You acknowledge the detector(s) was tested and its operation explained by us in your presence at time of initial occupancy and the detector(s) in the Unit was working properly at that time. 2) Upon occupancy, it will be your responsibility to test the device weekly to ensure that the device is in operable condition. 3) You must inform us immediately, through the Service Request process, of any defect, malfunction or failure of the smoke detector. 4) The safety and security of all residents requires us to test the smoke detector at least once per year. You must allow us access to the Unit for that purpose. 12. These Community Rules and Regulations are incorporated by reference into, and made a part of, the Agreement between us and you executed as of the date first above written. Date: Date: Owner Resident
