3 1. Issuance of Parking Passes Parking passes will only be issued to Resident Homeowners or Tenants (collectively referred to as Residents ) of Rancho Villas Community Association ( RVCA ). Prior to obtaining a parking pass, Residents must complete a vehicle Registration/Verification form and provide proof of residence. RVCA passes will be administered by an outside parking management company, Network Parking Solutions (NPS) [(866) ]. Residents must return a completed registration form to receive a RVCA parking permit. Registration will be considered complete when all required information is received by fax, or online registration and payment of registration fee. 1.1 Vehicle Registration Residents must register all vehicles under their control. Each Resident may register a maximum of two vehicles, per Unit, for parking within the RVCA Community. All vehicles registered with RVCA must be registered in the residents name, have a current registration with the Department of Motor Vehicles for street use and have current liability insurance. Regardless of the number of people residing in a RVCA Unit, only one parking pass will be issued per RVCA Unit address. In all cases, one of the two registered vehicles must be parked in the garage, and the other may be parked in the RVCA designated parking area with a properly displayed pass. The one pass may be transferred between the vehicles registered to that Unit. Owners can decide which of their vehicles they want to park inside the garage or in the parking area. Each Unit s garage is the primary parking space for that Unit. This means that if only one vehicle is registered to a Unit, that Unit will not receive a parking pass, and that one vehicle must be parked in the garage. 1.2 Moving within RVCA If a Resident moves from one Unit to another Unit within RVCA Community, the Resident must complete a new vehicle Registration/Verification form for the new address. 1.3 Placard Display Parking placards must be visibly displayed and hung from the rear view mirror or placed in plain view on the dashboard. A Resident will be penalized pursuant to Section 5.2 for failure to properly display RVCA s parking pass. Page: 1

4 2. Required Parking Pass Compliance and Enforcement All Residents and Resident s vehicles parked within the RVCA Community must comply with the following Parking Rules: - Residents must show proof that the vehicle(s) they are registering with RVCA is owned, leased, operated, or within the control of, the Resident residing at a RVCA address. - RVCA Unit Address: Is defined as a Unit within the Rancho Villas Community. - Vehicles registered with the DMV in a name other than the resident will be reviewed on a case by case basis by the Board of Directors. (Examples: company vehicles, government vehicles, and rentals) - In accordance with Article VIII, Section 8.2 of the CC&Rs, Resident s vehicles must be parked in the garage to the maximum capacity of the garage. Residents are given a 30-day grace period during move-in and move-out wherein a Resident may park outside of the garage. In order to implement the 30-day grace period, new and existing Residents must notify the Property Management Company of their move-in or move-out and request the 30-day grace period. Failure to provide notice of their move-in and/or move-out may result in enforcement procedures and/or immediate towing. - Only registered RVCA vehicles displaying a RVCA parking pass may park in the marked asphalt designated parking areas between the hours of 6:00 PM and 6:00 AM. Any vehicle registered with RVCA that does not have a parking pass (e.g. the first registered vehicle to a Unit) must be parked in the garage during the hours of 6:00PM to 6:00AM. - All vehicles must be parked within the confines of the parking area provided (From curb to expansion swell joint and within the white lines). Please see Attachment B photos of a properly parked vehicle. Marked asphalt parking spots are the only designated parking areas approved by the RVCA Board of Directors. Please see Attachment C for a map of authorized parking areas. - No back-in-parking allowed in front of any wood fencing, brick or stucco walls, and/or areas specified by signage. Page: 2

5 3. Oversized, Large Vehicles and Motorcycles: 3.1 Oversized Vehicles: Defined as all dual rear wheel vehicles such as industrial or recreational-type vehicles (i.e. dump trucks, cement mixer trucks, oil or gas trucks, camper units, motor homes, buses, trailers, trailer coaches, camp trailers, boats trailers, and mobile homes). Vehicles defined as oversized may not park within the RVCA Community. 3.2 Large Vehicles: Defined as pickup trucks, SUVs, and large sedans, or similar sized vehicles that do not fit inside a garage. The dimensions of a typical garage are shown in Attachment A. Registered LARGE VEHICLES that exceed the width or length of a parking spot will have to park at the tennis court lot or authorized spots designated by signage or off the premises. 3.3 Motorcycles: Must be street legal, licensed, and registered with RVCA as a vehicle. All Parking Rules apply to motorcycles in the same way as they apply to vehicles. 4. Visitor, Overnight and Extended Stay Parking Visitors must park in a designated visitor parking area and must display a current visitor pass or be registered with NPS by 10pm. Registration may be made thru the Residents web portal or by calling [(866) Option 2] upon arrival. Visitors parking after 10pm have 15 minutes to register with NPS before being subject to section Towing Without Notice. Visitors with a visitor parking pass do not need to register with NPS. Only 4 overnight stays are permitted in a calendar month per visitor. For extended stays, please refer to Section 9, Courtesy Hold Parking. 5. Parking Enforcement Procedures: All vehicles parked within the RVCA Community are subject to these Parking Rules. Owners are responsible for all parking violations caused by themselves, their tenants, and guests, as well as their tenant s guests. Page: 3

6 Residents who violate these Parking Rules are subject to section 5.2 Parking Enforcement Procedures. In the case of a tenant s violation of these Parking Rules, both the tenant and the non-resident Owner(s) will be notified of the violation(s). Any violations in whole or part are subject to the following Parking Enforcement Procedures. Owner(s), Tenants may have their parking privileges for common areas suspended for repeated violations of the community parking rules after notice and hearing with the board. 5.1 Parking Violations Parking violations include, but are not limited to, the following: Subject to Towing Without Notice - An unattended vehicle parked in an unmarked spot or on concrete, in excess of 30 minutes, anywhere throughout the entire RVCA Community is subject to towing without notice. - Vehicles blocking ingress or egress to the complex or individual unit is subject to towing without notice (California Vehicle Code 22658). - Use of a Handicap Parking Space without valid handicap identification. - Parking within fifteen (15) feet of a fire hydrant (California Vehicle Code 22658) is subject to towing without notice. - Parking in front of any of the dumpsters within the Community is subject to towing without notice. - Unregistered non-permitted vehicles parked on RVCA property after 6:00 pm is subject to towing without notice. - Vehicles parked in visitor parking not displaying a visitor pass or not registered by 10:00 pm and been parked for more than 15 minutes is subject to towing without notice. - Vehicles using permits that have been stolen, suspended, invalid, revoked, copied or duplicated is subject to towing without notice. 7 - Vehicles parked in designated mail pickup areas in excess of 10 minutes Subject to Section 5.2 Parking Enforcement Procedure - Resident parking of more than one registered vehicle in open common area and not displaying an RVCA parking permit, without prior authorization from the Board or Property Management. - Registered vehicles with a non-visible Parking Pass are subject to the Parking Enforcement Procedures. - Double-parking in one space is defined as a vehicle parked over the white lines or taking up more than one parking space. - Parking in the same parking space for more than 72 hours without being moved and without prior authorization. 5.2 Parking Enforcement Procedure First Violation - INTENT TO TOW NOTICE: Parking Patrol will issue an INTENT TO TOW Violation indicating the date, time, location, and specific parking rule that was violated Second Violation TOW NOTICE: Parking Patrol will issue a TOW NOTICE indicating the date, time, location, and specific parking rule that has been violated, along with the date of the first violation and parking rule that was not followed. Vehicle will be towed on the second cumulative violation within a 90-day period. Violations of these Rules will be reported to the Board. After a properly noticed hearing, the Board may levy fines or suspend privileges, pursuant to Association Bylaws, Article XII, Section Parking Passes are RVCA Property and are not transferable or assignable to other persons or to non-registered vehicles. Parking passes must be returned to RVCA when a Resident moves out of the RVCA Community. There is a $25.00 fee for replacement of a reported lost or stolen parking pass and/or visitor pass, which may be refundable if the pass is returned and Page: 5

8 in substantially the same condition it was in when distributed to the Resident. January 09, Implementation of Tickets, Towing and/or Fines The CC&Rs Article VIII, Section PARKING AND VEHICULAR RESTRICTIONS states: "Without in any way limiting the obligations of the Owners as elsewhere herein described, the Association or agency representing the Association, shall have the right, and shall be obligated, to enforce all parking restrictions herein set forth and to remove any vehicles in violation thereof, in accordance with the provisions of Section of the California Vehicle Code, or other applicable laws, codes, and statutes". The Board of Directors has approved issuing Tickets, Fines and Towing. Any required fines and/or towing will be at the vehicle owner and/or operator s expense. 6. Car Covers Car covers must have the license number and parking pass number visibly stenciled on the car cover for parking patrol perusal. A form (available upon request) must be completed and returned prior to the use of a car cover so that RVCA has a record of the vehicle and parking pass number that is being covered. 7. Garages 7.1 General Garage Information Residents must park a vehicle in their garage. The CC&Rs, Article VIII, Sub Section 8.2, state that, Parking and Vehicular Restrictions. The parking areas of the Property shall be used for parking authorized vehicles only and shall not be used for storage, living, recreational or business purposes.and Vehicles owned, operated, or within the control of an Owner, or of a resident of such Owner s Unit, shall be parked in the garage of such Owner to the extent of the space available therein; provided that each Owner shall maintain his garage in a manner which ensures that it is capable of accommodating at least one (1) such vehicle. See Attachment A, that is a schematic depicting the minimum clear garage space of 15 length, 6 width and 6 height of continuous Clear Garage Space that must be maintained by an Owner or Tenant regardless of if a vehicle or what size a vehicle is parked inside. 9 7.2 Garage Reporting In the case of reported garages that do not have, the required Clear Garage Space as defined in Attachment A, the Resident must show proof of compliance to the Property Management Company at a mutually agreeable time (within three (3) weeks of notification of the violation to the Property Management Company and/or Board of Directors) that they brought the garage into compliance with the Clear Garage Space requirement to avoid enforcement procedures. 7.3 Garage Enforcement procedures If the garage has not been brought into compliance within 30 days after notice by the management company to the owner of the residence, the owner will be sent a hearing notice. If the owner does not appear or cannot show proof of compliance upon board hearing date, owner will be assessed $ for each month that the garage remains in non-compliance. Upon the 60 th day of non-compliance, a second hearing notice will be sent out to owner. After the second hearing, if the RVCA finds the owner or resident is not compliant, the RVCA may revoke any parking pass that has been previously issued to the residence. Residents who have had their parking pass revoked pursuant to this section may apply for a parking pass for their additional vehicle only after the garage is brought into full compliance. 8. Handicap Parking Spaces. Any vehicle with a valid Handicap Identification, may park in any of the designated Handicap Parking Spaces. Anyone who parks a vehicle illegally in a RVCA Handicap Parking Space will be penalized pursuant to Section Courtesy Hold Parking For guests who are visiting for longer than 4 nights in a calendar month, Residents may apply to the Property Management Company for a Courtesy Hold request. Request for more than 7 nights requires board approval. Guest will be required to provide their make, model, license plate number, phone number and length of stay. All Parking Rules apply to the guest s vehicle. Residences who need a courtesy hold for their own vehicle may apply for a courtesy hold, pending Board approval. Page: 7

10 10. Vehicle Maintenance Violations 11. Appeals Violations of this section are will be penalized pursuant to Section 5.2. Vehicles owners will be notified in writing at the time of an identified Maintenance Violation under this section. Failure to comply with a Maintenance Violation within the period(s) listed below will lead to the vehicle being towed. Maintenance Violations include, but are not limited to, the following: - Vehicle leaking oil or other fluids will have a notice sent to the vehicle owner to cure violation within seventy-two (72) hours upon identification of the violation. - Degreasers are not permitted to be used on vehicles of any type anywhere in the Common Area. - Noise pollution from vehicles without proper muffler systems and/or revving up of vehicle engines or blaring sound systems. Residents who have been towed, may appeal enforcement by contacting Summit Property Management Company and providing them with reason for reimbursement. Summit will forward all requests to RVCA s Board of Directors. A decision will be made the following monthly general meeting. Page: 8
