3 SECTION 1 ANIMALS 1. No farm animals or wild animals are allowed in the park, including rabbits in outside hutches. 2. Residents may have a maximum of two pets, one of which may be a dog. Residents at Valley Green who had two dogs as of January 1, 1999 will be allowed to keep those two dogs until such time as one of the dogs dies or is placed outside of Valley Green. After one of the dogs dies, or is placed outside of Valley Green, the resident may only have one dog. 3. Aggressive Breeds such as pit bulls, doberman pinschers, rottweillers are not accepted breeds of dogs. 4. It is each resident s responsibility to clean up after their animals and no animals will be allowed to defecate on another resident s lot. Animal litter should be cleaned up as often as necessary for a clean, healthy environment, but at least once weekly. 5. All animals must be leashed at all times, except when indoors or kenneled. 6. All animals must be tagged with current vaccinations. 7. No commercial pet activities, including the breeding of dogs, cats, or any other type of animal will be permitted. 8. Dogs, cats or other domestic animals are not permitted to run at large within the park. 9. Persons keeping animals in the park must comply with Chapter 5 of the City of Jordan Ordinances. 3

4 10. Animals, when leashed outside, are to be leashed in the backyard area of the lot. 11. Pet houses and kennels are to be located in the backyard area of the lot. Pet houses are to be painted to match the home and kept in good condition. Dog kennels must follow the same requirements as fences. SECTION 2 AUTOMOBILES, BOATS AND OTHER LICENSED VEHICLES 1. A ten-mile per hour speed limit must be obeyed at all times at Valley Green. 2. Each residential lot is permitted one vehicle per licensed driver, not to exceed two vehicles per lot. Three vehicles may be parked, only if the parking area is paved to accommodate three vehicles. All parking is to be off street. No street parking is permitted. No boats, motorized recreational vehicles or trailers may be stored on any manufactured home site from the first day of November until the last day of April in any given year. 3. No motor vehicle mechanical work, including oil changes, is permitted on any lot by any resident or guest at Valley Green. Motor vehicles include cars, trucks, motorcycles, snowmobiles, ATV s, etc. 4. All vehicles must have current license plates and tabs. 5. All vehicles (autos, trucks, trailers, motorcycles, snowmobiles. etc.) shall be parked on the asphalt parking area of each lot. 6. All vehicles must be in good mechanical repair. No vehicles will be permitted with broken mufflers. 7. No detached tires are permitted on any lot at Valley Green. 8. Vehicles for any visitor staying for more than 3 days at Valley Green must be registered at the office. 4

5 9. In the event any vehicle violates any rule or ordinance of Valley Green, it will be subject to removal from Valley Green, with the towing charge the responsibility of the resident or guest. 10. Vacant lot driveways may be used for additional parking if necessary. These driveways used will become the residents responsibility for snow removal, if needed. They will not be plowed by the management. 11. Vehicles not driven during the winter months are not to be kept in the park. Inoperable vehicles / snowbirds are not allowed. 12. No semi-trucks, work vehicles and trailers, flatbed trucks, tow trucks and large construction trailers are permitted in the park. 13. Utility trailers may not be kept in the park, unless they are used daily for work and must be kept on the driveway. 14. Car stereos are not to be played so that they can be heard outside of the vehicle. SECTION 3 BUILDING ADDITIONS 1. No building addition construction may be commenced without park approval. 2. No building addition construction may be commenced without first calling Gopher One to locate the public utilities. 3. No building addition is permitted on any manufactured home site without a building permit from the City of Jordan. 5

6 4. No building addition may interfere with access to the sewer and water utilities. 5. Any building addition must be sided and roofed with a material consistent with the main residence, and have the same color as the home and garage, if applicable. 6. No building addition will be permitted that violates the life safety standards of the State of Minnesota. SECTION 4 CHILDREN, RESIDENTS AND GUESTS 1. Residents are responsible for the acts of their children. 2. Residents are responsible for the acts of their guests. 3. Residents are responsible for any violation of curfew by their children. 4. Residents are responsible for their children violating any playground rules. 5. No public address or speaker systems are permitted on any home site. 6. Each homeowner and each person residing in a manufactured home must abide by Manufactured Home Ordinance No. 42 of the City of Jordan. 7. Each resident must be registered with the management office and must have obtained park approval, prior to occupancy. 8. ANY VISITOR OR GUEST residing in the home for more than 2 weeks must apply for park approval. 6

7 9. Occupancy at Valley Green is limited to four persons in a two-bedroom home, six persons in a three-bedroom and seven persons in a four-bedroom home. 10. No persons shall play at the playground or basketball courts after dark. 11. Loitering at the bus shelter is prohibited. SECTION 5 COURT PROCEEDINGS/RENT PAYMENTS 1. Rent is due and payable on or before the first of the month. All payments are to be mailed to or brought into the park office at 300 Valley Green Park Jordan, MN Checks should be made payable to Valley Green MHC, LLC. An 8% delinquent fee will be charged to any unpaid accounts the first business after the 5 th of the month. 2. Payments made after the 5 th of the month are accepted only in the form of a cashier s check or money order. 3. Cash is not accepted as a means of payment. 4. Each resident will be responsible for all attorney fees and costs incurred in any unlawful detainer proceeding, including service fees. 5. Each resident will be responsible for all collection fees, including attorney fees and service fees. 6. Each resident will be responsible for all attorney fees incurred in the enforcement of any law or rule relating to Valley Green Park. 7

8 SECTION 6 CURFEW 1. SCOTT COUNTY ORDINANCE Section 1: Prohibited Acts (A) It is unlawful for a juvenile under the age of twelve (12) to be present in any public place or establishment within Scott County: Anytime between the hours of 9:00 p.m. on any Sunday, Monday, Tuesday, Wednesday or Thursday and 5:00 a.m. of the following day. Anytime between the hours of 10:00 p.m. on any Friday or Saturday and 5:00 a.m. of the following day. (B) It is unlawful for a juvenile from the ages of twelve (12), thirteen (13), or fourteen (14) to be present in any public place or establishment within Scott County: Anytime between the hours of 10:00 p.m. on any Sunday, Monday, Tuesday, Wednesday or Thursday and 5:00 a.m. of the following day. Anytime between the hours of 11:00 p.m. on any Friday or Saturday and 5:00 a.m. of the following day. (C) It is unlawful for a juvenile, ages fifteen (15), sixteen (16), or seventeen (17) to be present in any public place or establishment within Scott County: Anytime between the hours of 11:00 p.m. on any Sunday, Monday, Tuesday, Wednesday or Thursday and 5:00 a.m. of the following day. Anytime between the hours of 12:01 a.m. and 5:00 a.m. on any Saturday or Sunday. (D) It is unlawful for a parent or guardian of a juvenile knowingly, or through negligent supervision, to permit the juvenile to be in any public place or establishment within Scott County during the hours prohibited in paragraphs (A), (B) and (C) of this section. 8

9 SECTION 7 DISTURBANCES AND CRIMINAL ACTS 1. Quiet time is to be observed between the hours of 10:00 p.m. and 8:00 a.m. This is especially important in the spring and summer months when windows are open. 2. Stereos, televisions, radios, etc., playing on the inside of the home must not be heard from the outside of any home. Radios or stereos played outside of the home must be at a level not to be heard by your neighbor. 3. Yelling, screaming, fighting, etc. is not acceptable behavior and is in violation of the Valley Green guidelines. 4. The commission of any criminal act or the commission of domestic abuse at Valley Green is grounds for immediate termination of the lease agreement with any resident. SECTION 8 EXTERIOR APPEARANCE 1. Each manufactured home must be maintained in a safe, clean and sanitary condition, in good repair, structurally sound and fit for human habitation. 2. Storage sheds and additions must be sided with a material consistent with the main residence and have an exterior color that is the same as the home. 3. Management must approve any paint color changes on homes. 4. The area around the manufactured home must be skirted within 30 days of installation at the home site. Skirting type must be of a horizontal aluminum or steel. Such enclosure needs to be accessible for inspection and no obstruction will be permitted that impedes the inspection of the manufactured home, plumbing, electrical facilities and related equipment. No storage is permitted beneath the home. 9

10 5. All home hitches must be removed or enclosed within 30 days of installation, with a permanent material and painted to match the home color. Enclosures must be constructed to be of a square or rectangular shape, not a triangle. 6. Each home must have steps and decks built in accordance with the State Building Code, and must be maintained in good condition. All steps and/or decks must be cement or treated wood. All decks, front or back, if they have three or more risers, must have a grooved handrail and side rails, as well as spindles surrounding the top of the deck. No metal steps are permitted. 7. Each home must have drapes, curtains or blinds. Covering of windows with blankets, sheets, flags or any other material is not permitted. 8. All manufactured homes need to be anchored. All anchors shall be state-approved devices providing for the stability of the manufactured home. The placement of such anchors shall be in compliance with the State Building Code. 9. Laundry may be hung outdoors only on retractable, umbrella-type hangers, not to exceed one per home lot. Clotheslines must be located in the backyard area of the lot. The drying device can be no larger than 8X8 feet when fully extended and must be retracted when not in use. All clothing needs to be removed prior to nightfall. 10. No tents may be erected or occupied, except on a temporary basis, such as pup tents for children overnight. There can be no camping anywhere within the manufactured home park grounds. 11. All land areas must be free from refuse, garbage, rubbish or debris. 12. No plastic may be applied to the exterior of the home. No hay or straw bales, bags of leaves, etc. may be used for insulation. 13. Exterior siding and skirting that is damaged must be replaced or covered with a new exterior material approved by the park. 10

11 13. Holiday decorations must be removed from the house, fence, storage building, or lot Within thirty (30) days after the holiday. SECTION 9 FENCES 1. No fence may be erected without park approval. 2. No fence may be erected without a city permit. 3. No fence may be erected without first calling Gopher One. Call the park office for other details before constructing a fence. 4. All fences must consist of chain link or wood, of a type approved by Valley Green: No privacy fencing All mesh types must have a top rail and be stretched so there are no sags. Wood fences must be stained, painted or made of treated wood to weather naturally. 5. All fences must be erected to completion within a two-month time period, from the beginning of installation to the end. 6. Upon vacating from Valley Green by any resident with their home, the lot must be restored to its original condition and any fencing removed, unless otherwise agreed to in writing by Valley Green. 7. All fences need to comply with the life safety standards for fire protection. 11

12 8. No fence may be erected that interferes with access to underground utilities. This section may be waived in writing by the park with the understanding that the resident will be responsible for removal and restoration of the fence, if access is necessary. 9. Fences must be kept in good repair. 10. All chain link fence must be galvanized steel, no colored fencing. 11. No privacy slats in chain link fences. 12. No snow fencing SECTION 10 FINES 1. An enforcement fine is a fine for the failure of a resident to obey a law, rule or ordinance of Valley Green. 2. A repair fine is a fine for the cost of any repair performed by Valley Green to bring a home into compliance with the laws and rules of Valley Green. The cost of the actual repair will be assessed to the homeowner, in addition to the fine. 3. A cleanup fine is a fine for the necessary removal of any debris, materials, tires, trash or the like from any lot. The labor cost for the actual removal will be assessed to the homeowner, in addition to the fine. 4. A mowing fine is a fine for failure to maintain the grass. You will be billed additionally for the service of Valley Green to maintain the yard, if needed. 5. A tire removal fine is a fine for the pick up and disposal of any tires at any resident s lot. The labor and disposal cost will be assessed to the homeowner, in addition to the fine. 6. All fines are billed as additional rent. 12

13 7. Procedure A violation notice will be sent to the resident indicating the specific violation, along with the time frame within which to cure the violation. A second violation notice will be sent, if the specific violation is not cured within the specific time frame. A fine of $25.00 will be assessed after the second violation notice of noncompliance. A fine of $25.00 will be issued for each subsequent notice on the same violation. SECTION 11 GARAGES 1. No garage construction may be commenced without park approval. 2. No garage will be permitted on any home site without a building permit from the City of Jordan. 3. No garage construction may be commenced without calling first Gopher One to locate the public utilities. 4. No garage can interfere with access to the sewer and water utilities. 5. Garages must have an exterior color that is the same as the home. 6. No garage will be permitted that violates the life safety standards of the State of Minnesota. 7. ALL GARAGES should be sided with a material consistent with the main residence on that lot. 8. Space permitting, each lot may have either a garage or a storage building, not both. 13

14 9. No flammable or combustible items may be stored in garages. SECTION 12 MAILBOXES 1. Each resident is responsible for maintaining their mailbox and will be responsible for replacing the mailbox in the event it is damaged. 2. Each resident is responsible for keeping his or her mailbox shoveled during the winter months. 3. Mail will not be delivered if access to the mailbox is blocked. SECTION 13 RECREATIONAL, OFF-ROAD VEHICLES, AND SNOW REMOVAL EQUIPMENT 1. No snowmobiles, all-terrain vehicles, trail bikes, go-carts etc. may be operated in Valley Green. 2. Snowmobiles and all-terrain vehicles must be stored in the asphalt parking area. They may not be stored on the grass area or randomly on any lot. 3. All snowmobiles must be removed from any manufactured home lot between April 1 and November 1 of each year. 4. Snow removal equipment may not be stored on any manufactured home lot between April 1 and November 1 of each year. 14

15 SECTION 14 REGISTRATION 1. A registry is maintained, at the Valley Green management office, containing the following information: Names, addresses, and phone numbers of each permanent resident. The brand name, the year and the vehicle identification number of each home in the manufactured home park. The name of the lender and insurance carrier for each manufactured home. Identification of vehicles at each residence, including the color, year, license number and owner. 2. Each resident must provide the above information upon request, and each resident will periodically update any changes in the information upon request. SECTION 15 RUBBISH 1. Each home is allowed one 90-gallon container to be picked up once a week on a regularly scheduled day. Trash is to be kept in the covered regulation rubbish containers and placed in the backyard area of each lot, storage building or garage, or on the driveway side of the home. The rubbish container will be provided by the rubbish hauler. 2. Use of the recycle center is encouraged. 3. Rubbish is to be placed in a sealed container or sealed bag, by 8:00 a.m. on the scheduled pickup day. The containers must be returned to the rear of each home by 6:00 p.m. of the same day. 4. There will be an extra charge per 30-gallon bag, by volume, of any rubbish in excess of the provided 90-gallon container. 15

16 5. Large furniture, such as mattresses, box springs, couches, chairs, etc., are not part of the normal rubbish pickup and will be subject to an additional charge per item for removal. 6. Additional rubbish will not be picked up without notifying the Valley Green Office prior to 8:00 a.m. on the scheduled pickup day. 7. Paint, household chemicals, motor oil or hazardous wastes are not normal rubbish and should be disposed of by the resident at a designated Scott County site. 8. Leaves, grass clippings and branches are not part of normal rubbish and will not be picked up on a weekly basis. 9. Appliances, hot water heaters, or air conditioners of any type are not considered part of the normal rubbish. The manager should be contacted for assistance in removing these items, for which there will be an additional charge. SECTION 16 SEVERE WEATHER SHELTER 1. The severe weather shelter is located in the basement of the office building. It is for residents of the park and their guests. Absolutely no pets of any kind are permitted in the shelter at any time. The shelter is open whenever there is a severe weather alert. SECTION 17 STORAGE BUILDING 1. No storage building construction may be commenced without park approval. 2. No storage building construction permit may be commenced without first calling Gopher One to locate public utilities. 16

17 3. No storage building can interfere with access to the sewer and water utilities. 4. Only one additional structure is allowed per lot, either a garage or a storage building. You may not have one of each or two of either one. 5. Storage buildings may not be larger than 10 feet wide, 12 feet long and 9 ½ feet high. 6. Storage buildings must be located at least 5 feet from the side lot line, 3 feet from the rear lot line and 4 feet from the home. 7. Any storage building must have an exterior color that is the same as the home. 8. No storage building will be permitted that violates the life safety standards of the State of Minnesota. 9. Each storage building must also comply with the building standards of Valley Green which include: Pitched roof with lap shingles. Building siding of grooved exterior plywood (stained or painted) or siding to match the home. No metal or vinyl buildings are acceptable. Hinged door. SECTION 18 UTILITIES 1. Residents are responsible for the maintenance of the water line from the underground connection (ball valve) to their home. 17

18 2. Residents are responsible for any water leakage, repairs and/or damage from their home s plumbing. 3. Caution should be given to faucet and toilet repairs so as to not allow for dripping or running water. Dripping and running water is a waste of a precious natural resource and very costly. SECTION 19 WATER 1. Residents are responsible for their individual water and sewer usage. Each home is separately metered and is billed monthly according to the current City of Jordan rates. 2. Each resident shall be responsible for the maintenance of any water meter installed. 3. An unpaid water bill shall be considered additional rent and each resident shall be responsible for its payment, including all collection fees, attorney fees and service fees incurred. SECTION 20 YARDS 1. The backyard area of a lot is defined as the driveway side and rear of the home. 2. Yards must be kept neat with toys, tools or other items put neatly next to the back deck, or in the storage building. Only toys, barbecue grills and lawn furniture may be kept outdoors. 3. Firewood must be stacked as follows: Wood may be stacked against the house so long as it does not block doors, windows or is not creating a hazard or nuisance. Wood shall be stacked off the ground in usable lengths. There shall be no more than 1 ½ cords stacked in rows 8 feet long, 4 feet high and 4 feet wide. 18

19 All wood shall be stacked in the back yard area of the lot. Unorderly piles or unsightly tarps are not acceptable. 4. No recreational fires or burning of any type is permitted on any lot at Valley Green. 5. Each resident is responsible for mowing his or her own yard on a regular basis. The height of the grass must not exceed 3 inches. 6. Pruning of trees and bushes is done by management twice per year, in coordination with the city s program of chipping tree branches and brush. 7. Each resident is responsible for snow removal on his or her driveway and sidewalk areas. 8. Each resident is responsible to remove any debris from his or her property. 9. No vehicles, boats, campers, snowmobiles, all-terrain vehicles, snowplows and snow blades and truck toppers may be parked or stored on any lawns. 10. No ice houses are permitted in the park. 19
