9 Wednesday, May 7, :30 A.M. Meeting Minutes Los Angeles County Metropolitan Transportation Authority TECHNICAL ADVISORY COMMITTEE 1. Call to Order/Roll Call Matthew Abbott (Alternate Chair) called the meeting to order at 8:34 a.m., took roll and declared a quorum was present. 2. TAC Membership Changes Renee Berlin (Metro) reported that Director Mike Bonin was unable to attend the TAC meeting due to a scheduling conflict. She introduced Paul Backstrom (Transportation Deputy to Director Bonin) who was present to discuss Director Bonin s views regarding the addition of Bicycle, Pedestrian, and Public Health representatives to the TAC. Mr. Backstrom thanked the TAC members for arriving early and apologized on behalf of Director Bonin for his absence. He reported that Director Bonin values the opinions of the TAC and that his motion to reconsider TAC s earlier recommendation was not an attempt at disrupting the Committee s voting balance. Mr. Backstrom noted that the planning profession is fundamentally changing and evolving. Director Bonin strongly believes that TAC must adapt to those changes. He recognizes that currently there is diverse representation on the TAC, with the omission of bicycle and pedestrian representation. Mr. Backstrom noted that there are unique points of view and skill sets associated with both bicycle and pedestrian planning and that one member cannot serve both the Bicycle and Pedestrian modes as there are often conflicting views amongst the modes. Mr. Backstrom reported that Director Bonin believes that having the unique perspectives of a bicycle and pedestrian representatives is incredibly valuable and consistent with Metro s interest with regard to sustainability, complete streets, and first/last mile planning. Director Bonin strongly believes that having both a Bicycle and a Pedestrian Representative on TAC would enhance the recommendations that come out of this Committee. In terms of the Public Health Representative, Mr. Backstrom noted that Metro s sustainability policies and goals are tied with health outcomes. Director Bonin strongly believes that having a health perspective on TAC would be valuable as well. The goal of the Board motion was to ensure that all points of view are represented on the Committee so that Metro can deliver the best projects that are in the best interest of the public. 10 John Walker (County of Los Angeles) thanked Mr. Backstrom for sharing Director Bonin s perspective. Dave Roseman (City of Long Beach) asked if the Board had a recommendation to make the Public Health Representative a voting or ex-officio member? Mr. Backstrom replied that an ex-officio member would be appropriate, but a voting representative would be welcomed as well. The Board has no concern as to who serves as the Public Health Representative, but believes that it is important to have the health perspective represented on the TAC. Allen Thompson (League of California Cities North Los Angeles County) asked who would appoint the members? Ms. Berlin replied that TAC would appoint the members. The Streets and Freeways Subcommittee had previously solicited applications countywide for their Bicycle and Pedestrian representative and recommended that a Bicycle and Pedestrian representative be added to TAC as well. It is anticipated that the Bicycle and Pedestrian representative on TAC would be two of the four Bicycle and Pedestrian Representatives from the Streets and Freeways Subcommittee. Mr. Walker reminded the TAC that at the April 2 nd meeting, TAC passed a motion to reconsider their previous decision to add one voting and one ex-officio Active Transportation representative to TAC based on the Metro Board s request. Larry Stevens (League of California Cities San Gabriel Valley COG) asked if the issue of a Health representative was also under discussion, or if that was a separate matter? Ms. Berlin replied that the issue was bifurcated so that two separate discussions could occur. Motion Mr. Roseman made a motion to add two voting members to TAC, one Bicycle and one Pedestrian representative. The two members will be chosen from the existing Bicycle and Pedestrian representatives currently on the Streets and Freeways Subcommittee. James Lefton (City of Los Angeles) seconded the motion. Ms. Berlin opened the floor for discussion. Patrick DeChellis (County of Los Angeles) commented that since TAC is adding members, the Committee has an opportunity to get wider agency representation from throughout the County. He noted that there are 88 cities within the County and only a small percentage are represented on the TAC. He suggested that if two members are being added to TAC, the Committee should do its due diligence to get representation from agencies not already at the table. Mr. Roseman responded that the Streets and Freeways Subcommittee had already conducted an extensive countywide solicitation for their Bicycle and Pedestrian representatives. Mr. Walker noted that he agrees with Mr. DeChellis. He stated that this is a good opportunity for TAC to look for broader, more diverse agency representation on the Committee. Mr. Walker respectfully requested that Mr. Roseman amend his motion so that that the Committee is not beholden to the four members recommended by the Streets and Freeways Subcommittee. 11 Karen Heit (Staff to Metro Board Chair Diane Dubois) reiterated that Chair Dubois recognizes the importance of the input from TAC. She believes that TAC should not change their recommendation solely as a response to the Board. TAC membership should evolve as the members see fit. Ms. Berlin commented that there are two separate issues: 1) approving the addition of a Bicycle and a Pedestrian representative; and 2) how those representatives are selected. She noted that TAC should take a vote now on the actual membership and can discuss how the representatives are selected at a later time. Ms. Berlin explained that a Working Group was formed for the Streets and Freeways solicitation of the Bicycle and Pedestrian representatives. If the addition of the members is approved, TAC can conduct another solicitation Mr. DeChellis clarified that his comment stemmed from the motion specifically stating that the members would be chosen from the existing Streets and Freeways Subcommittee Bicycle and Pedestrian representatives. He noted that the motion needs to be revised to reflect that TAC is not beholden to the Streets and Freeways Subcommittee Bicycle and Pedestrian representatives. Ms. Berlin replied that staff can work with the Subcommittee to determine how those representatives would be selected, if TAC approves the addition to the memberships. Marianne Kim (Automobile Club of California) asked if the TAC members have terms? Ms. Berlin replied no, TAC members serve at the will of their appointing bodies. Mr. Roseman replied that he would revise his motion and withdraw the portion in regard to the selection process. Ellen Blackman (Citizen Representative on ADA) reemphasized that there are some similar perspectives between the bicycle and pedestrian modes, but there are also conflicting perspectives. She noted that there is value in having two voting members perspectives, one focusing on pedestrian issues and one focusing on bicycle issues. Mr. Stevens added that there is at least some level of representation for bicycle and pedestrian modes just by virtue of the variety of the current TAC members. He asked whether the unique specialization of bicycle and pedestrian issues warrants an additional level of representation. Roubik Golanian (League of California Cities Arroyo Verdugo Cities) noted that many of the current TAC members deal with bicycle and pedestrian issues in their day-today duties. Mr. DeChellis replied that if TAC can get a wider representation of agencies on the Committee, there will be a wider perspective of issues and concerns. Mr. Golanian asked if Mr. DeChellis is suggesting that the Bicycle and Pedestrian Coordinators cannot be from an agency that is already represented on TAC? Mr. DeChellis replied yes. Mr. Roseman noted that he agrees that this opportunity to provide extra expertise on the Committee is vitally important. He explained that the first few Bicycle and Pedestrian representatives may be from agencies already represented on TAC, but that is because larger agencies have the resources to bring that expertise to the Committee. 12 Mr. Lefton noted that there is a motion on the table with regard to the addition of both a Bicycle and a Pedestrian representative. The discussion on what agencies those representatives come from is a separate issue and can be discussed later. He suggested that TAC vote on the motion that is on the table. Ms. Berlin replied that a Working Group can be formed with all the Subcommittees to figure out how to solicit for these representatives. Joyce Rooney (Bus Operations Subcommittee) reiterated that most of the agencies in the County do not have a dedicated bicycle or pedestrian coordinator. A second round of solicitation may not produce the diversity that TAC is hoping for. Ms. Berlin responded that when staff first sent out the solicitation letter, it did not ask for a specific dedication to bicycle or pedestrian modes, but rather that the majority of their time had been spent on bicycle or pedestrian issues. Mohammad Mostahakami (League of California Cities Gateway Cities COG) suggested that an amendment be made to the motion to limit the term of the Bicycle and Pedestrian representatives. Ms. Berlin replied that none of the other TAC members have term limits and therefore adding a term limit to the Bicycle and Pedestrian representatives would be inappropriate. Mr. Lefton added that it is more important to get the best person for the position rather than getting held up on trying to get wider agency representation. Mr. Backstrom stated that the Board report specifies that a periodic review of the TAC composition should be conducted every two years. Revised Motion Mr. Roseman revised his motion which was seconded by Mr. Lefton to add two voting members to TAC, one Bicycle Representative and one Pedestrian representative was called to a vote. 17 members voted yes; 4 members voted no. One member abstained. The motion passed. Ms. Berlin reported that consideration for a Public Health Representative was also included in the Board request to TAC. Mr. Roseman commented that the Long Beach Health Department plays a significant role in Active Transportation projects and programs. He believes that it would be beneficial to have a Health representative on TAC. Mr. Mostahakami noted that TAC already has an Air Quality Management District (AQMD) representative. He asked what the Public Health Representative s role on the TAC will be? Mr. Backstrom replied that the Public Health representative s perspective will overlap with the AQMD representative, but the Health representative will also be concerned with physical activity, mobility, safety, etc. Ms. Berlin suggested that a potential option could be to make the AQMD representative a voting member rather than an ex-officio member. Mr. Backstrom replied that there is overlap, but the Public Health representative would focus on much more than air quality. Mr. Mostahkami commented that a Public Health representative s role may also overlap with the new Bicycle and Pedestrian Representatives. He explained that there is a strong emphasis on bicycle and pedestrian modes because they are directly related to healthy lifestyles. Mr. TAC Minutes, May 7,

13 Stevens noted that there may be difficulty finding the appropriate representative who has the right type of health focus. Mr. Roseman agreed that finding the right representative for this environment could be challenging, but that public health is not just about active transportation. He explained that in Long Beach, a plan was developed to ensure that seniors are able to safely move around the City. These are the type of aspects of society in which health professionals are involved. He stated that the advice from a Public Health representative could be valuable. Ms. Kim explained that the Automobile Club has a traffic safety group that works with many public health organizations. She reiterated that public health covers many different areas ranging from safety, mobility, active transportation, air quality, etc. Ryan Thompson (Local Transit Systems Subcommittee) commented that much of the Public Health representative s role is covered by the current TAC members. Motion Mr. Lefton made a motion to add one ex-officio Public Health representative to TAC. The motion was seconded by Mr. Roseman. 23 members voted Yes; 1 member voted No. There were no abstentions. The motion passed. 3. Agenda Reports by Standing Committees Handouts were distributed in lieu of oral reports. 4. Consent Calendar A motion to approve the April 2, 2014 TAC minutes was made by Ms. Rooney and seconded by Mr. Mostahkami. The minutes were approved with no objections. 6. Congestion Management Program (CMP) Local Conformance Finding A handout was distributed in lieu of an oral report. 7. Call for Projects Deobligation Appeals (Teresa Wong/Renee Berlin, Metro) Ms. Wong reviewed the Call for Projects Appeals protocol, which was included as Attachment 4 of the TAC agenda packet. She reminded the TAC that project sponsors have a total of three minutes to appeal their project, followed by two minutes for TAC member s questions and answers. It is expected that the City Council will award and issue the Notice To Proceed (NTP) in June Construction is anticipated to be completed in December Mr. Abbaszadeh reported that the project was delayed due to right-ofway (ROW) acquisition. Four properties are needed, two of which have been uncooperative. In addition, Caltrans required additional air quality and historic preservation studies. The studies have been completed. Environmental clearance will take three to four months. Formal ROW acquisition offers will occur after environmental clearance. One-year extension to June 30, 2015 to complete construction. All other portions have been completed. Delays have been due to pending Southern California Edison (SCE) and Chevron Encroachment Agreements to underground SCE transmission lines. The project sponsor, SCE, and Chevron have been meeting bi-monthly to resolve the agreement. Supervisor Knabe's office and the City Mayor have been made aware of the delay. Mr. Hunt reported that the project has been divided into two phases due to an adjacent Costco development. Phase 1 design will be completed June 2014 with no ROW issues. Construction is anticipated to start in March 2015 and conclude in September Phase 2 includes ROW. Design will not be completed until December 2014 and construction is anticipated to be completed in The Costco cannot open for business until Phase 1 is completed. One-year extension to June 30, 2015 to complete negotiations with Chevron/SCE and to advertise for construction. The City is currently undergoing condemnation proceedings and the trial date is set for June Construction is anticipated to take one year and be completed by June Philbert Wong (Metro) noted that one amendment has been executed. Mr. Hunt reported that the City is requesting the funds to be deobligated at the May 13 th City Council Meeting. Ms. Berlin requested the City let Metro know what the Council decision is. Mr. Hunt reported that the project is currently at 99% design. The City wants to keep the project open until the development of the site traffic control plan is complete. The project is 50% through the ROW process and the City has made offers on three properties. Mr. Henein reported that the City has acquired the necessary ROW and is in the process of receiving Caltrans ROW certification. The project sponsor will apply for the E- 76 this afternoon, but is unsure whether it will be approved before the funding lapse date. One-year extension to June 30, 2015 to reaffirm Order for Possession court date and ensure that the project is fully funded. Concur with City of Los Angeles request to deobligate project pending formal notification after City Council action in May. The signal project has been shifted to a different route and the City hopes to execute a LOA with Metro shortly. Metro staff has approved the scope change. Mr. Gabig reported that the project will fund procurement of three 100% electric fuel buses. There is no change of scope, but delays have been due to execution of the LOA. The gasoline-hybrid bus model originally planned for purchase is no longer available which has caused delay in bus procurement. The City has submitted a revised project schedule and the LOA is being finalized. Further delay is due to timing this bus procurement with a larger replacement of other fleet vehicles. Mr. Liu reported that the project has been delayed due to ROW issues. Acquisitions are underway and the project sponsor is confident that ROW activities will be concluded by the end of Construction is anticipated to begin June 2015 with no additional anticipated delays. In response to the public comments, the City is conducting additional technical analysis of a multi-modal improvement alternative. This additional analysis has caused delay in the environmental process. The technical study will determine if a change of scope is needed or if it is feasible. Ms. Lau reported that the City is having difficulty identifying and committing to the overmatch and has been working with Caltrans to identify potential funds. The project does not qualify for Highway Bridge Program funds. Potential other funds that will be sought include Highway Railroad Safety and High Speed Rail Authority funds.
