Payment Terms Yosemite accepts cash, checks, money orders, Visa, Discover, MasterCard, American Express and Electronic Funds Transfer (EFT). Credit card payments require a signed credit card authorization form giving us permission to charge at time of order. Product will be held until payment is made or terms are issued. Checks are only accepted from customers located within the United States and are subject to a holding period of business days to allow time for funds to clear. Dealers may qualify for net 30 terms with approved credit. When applying for credit we require a completed and signed Yosemite credit application with trade references. For customers with established Yosemite credit, payment terms are net 30 days from the date of shipment or pick-up. If customer fails to make payment within thirty (30) days Yosemite may defer future shipments until such payment is made, or may, at its option, cancel all or any part of unshipped orders and account will be subject to finance charges of 1.5% per month. Minimum Order Any order that is less than $ will have a service charge of $ Freight Policy Shipping Charges Products are shipped F.O.B. from Fresno, California or Memphis, Tennessee. Freight costs will be paid by Yosemite and charged to the customer unless order qualifies for free freight. C.O.D. shipments are not permitted. Other terms and conditions may apply for freight collect, special handling, or shipments outside the contiguous United States. Any extra charges incurred for additional services, including but not limited to customer s carrier or special handling by the carrier (lift gate, residential charges, etc) will be billed to the customer. Title and risk of loss pass to the customer upon tender of shipment to the carrier. If product is damaged in transit, customer must file a claim with the carrier. Customer must file within 10 days of receipt of shipment to our customer services department for incorrect orders. Otherwise our responsibility stops at that time and the order is acknowledged as shipped correct. Shortages must be reported within 24 hours of receipt. ii

3 Return of Merchandise Products are not to be returned without written authorization from Yosemite Home Décor with an authorization number (RA). Any items sent to Yosemite Home Décor without an authorization form will be refused. If the return is approved the following will apply: 1. No charges will apply to product that is considered defective, however non-defective items must be paid for as scheduled. 2. Items that have an RA number and are returned within 6 months of purchase will be charged a restocking fee of 25% plus freight. In order to receive credit, the item must be returned freight prepaid in its original packaging and in resalable condition. 3. Items will be inspected and photographed by Yosemite Home Décor upon return. Credit may not be given if Yosemite Home Décor deems the damage to be a result of misuse or poor return packaging. 4. NO credit will be issued if the item returned is missing any parts, packaging or incomplete in any way. 5. Return Authorization (RA) number must appear on all return paperwork and cartons. Delivery Schedule We will normally process and ship your order within 48 hours. We do not control delivery schedules by the carrier but make every attempt to use the carrier that provides the best service. Damages It is our goal to provide quality products to our customers. All of our factories carefully inspect each item before it is packaged and shipped to our warehouse location. Every effort will be made to insure that your order arrives safely. Inspect your shipment immediately upon arrival. Should exterior damage to the carton be visible, make a notation on the shipper s delivery ticket. Report any losses or damages to us at our office at once and notify the carrier. All damaged cartons should be saved until the claim is settled. It is the customer s responsibility to handle any claims for freight damage or missing items. We are not responsible for any freight errors after the item has left our warehouse. Yosemite Limited Warranty All fireplaces sold are warranted by Yosemite against defects in workmanship or materials under normal use for two years after date of purchase from Yosemite. Any product determined by Yosemite to be defective in material or workmanship and returned to a Yosemite branch or authorized location, as designated by Yosemite, will be either repaired, replaced, or purchase price refunded at Yosemite s option.
