In 2004 the company was bought by German multinational company Hella. >2800 employees, ~ 300 in development Hella competence centre for development and production of small lamps and interior illumination located in Ljubljana. Development and production centre for LED headlamps and radomes. Annual production: ~ 2,5 mil headlamps, ~ 7 mil foglamps, ~ 1,5 mil light modules and ~ 2,4 mil radomes. Main technologies: injection moulding (thermoplastics/duroplasts), multicomponent injection moulding, metallization, automated gluing and lacquering. 6 Autonomous driving 101 Nejc Jezeršek Ljubljana, July 2018

Levels of autonomy Autonomous vehicle Definition: Autonomous vehicle is computer controlled vehicle requiring no human assistance to navigate itself. 8 Autonomous driving 101 Nejc Jezeršek Ljubljana, July 2018

Levels of autonomy Examples of automated driving funded projects 16 Autonomous driving 101 Nejc Jezeršek Ljubljana, July 2018
Levels of autonomy Human factor Human factor? Even in level 4 and 5 autonomous vehicles? Mixed traffic includes: Drivers and passengers Other road users operators Automation does not remove the human it changes the way humans interact with vehicles. No fail proof software human designed machine replaces another human Machine successful only in very static and predictable/controllable environment Human Factors can help analyse: Driver workload, distraction, situation awareness Trust, acceptance, fears, disuse and misuse Performance and loss of skills Differences in driver populations 17 Autonomous driving 101 Nejc Jezeršek Ljubljana, July 2018
Agenda Introduction Levels of autonomy Examples Human Factor Autonomous EU? PRO et CON Legal aspects Future of autonomous vehicles 18 Autonomous driving 101 Nejc Jezeršek Ljubljana, July 2018
Autonomous EU? Pro et Con Pro Accessible to anyone (kids, seniors, intoxicated/fatigued passengers, etc.) Passengers have more available time Redundant drivers no longer needed Less/no parking places required Less/no need for road signage Better traffic flow Fewer accidents (lower human error influence) Less cars needed to transport more people car sharing Little to no drivers attention needed Con Human fear of change Job losses (taxi/lorry drivers) More expensive cars Give up driving (car enthusiasts) Lots of sensors required on all roads GPS connectivity required No fail-proof programming Simple misuse/exploits (kidnaping, terrorism, ) Mixed traffic In case of accident, who s responsible Ethical dilemmas (trolley problem) 19 Autonomous driving 101 Nejc Jezeršek Ljubljana, July 2018
Autonomous EU? Legal aspects 20 Autonomous driving 101 Nejc Jezeršek Ljubljana, July 2018
Autonomous EU? Legal aspects Are governments prepared for raise of autonomous vehicles? Peek into History: Red Flag Act (1865): Self-propelled vehicles should be accompanied by 3 people (more for longer vehicles) A man with a red flag has to walk at lest 55 m ahead of each vehicle and is required to assist with the passage of horses and carriages vehicle had to stop on the flagbearer signal Additionally vehicles were also required to have functional lights, and not sound whistles or blow off steam whilst on the road A speed limit of 4 mph (2 mph in towns) was imposed for road locomotives 21 Autonomous driving 101 Nejc Jezeršek Ljubljana, July 2018
Autonomous EU? Legal aspects Are governments prepared for raise of autonomous vehicles? Peek into History: Vienna-Convention on road traffic 1968: All moving vehicles shall have a driver all drivers shall possess the necessary physical and mental ability and be physically and mentally fit when driving All drier of a power-driver vehicle shall possess the necessary knowledge and skill to drive the vehicle All driver shall be able to control his vehicle in any circumstances: to ensure safety to keep commands within reach to maintain proper placing to perform all maneuvers al all times 22 Autonomous driving 101 Nejc Jezeršek Ljubljana, July 2018
Autonomous EU? Legal aspects Are governments prepared for raise of autonomous vehicles? US Department of Transportation (USDOT) is taking an eyes-on, hands-off approach some states allow autonomous vehicle testing under certain conditions Germany is taking precautions Step-by-step approach Vienna Convention might not be compatible with high Automation Guarantee of correctness and safety of German road traffic (Governmental duty to safeguard its citizen) Securing of legal victim protection in case of incident with Automated Driving System ECE regulations currently have no specific regulative for Automated Driving. ECE R79 Steering equipment The driver must be able at any time to override the function [para ] and remain in primary control at all times [para ] 23 Autonomous driving 101 Nejc Jezeršek Ljubljana, July 2018
Autonomous EU? Legal aspects There are some changes approaching regarding autonomous driving Conditional level 3 automation (condition of activation, driver needs to take over in some cases, ) Data collection and data storage (Was offense caused by driver or Level 3 System? Recording of activity of Automated Driving Mode (on/off) / Conservation of specified evidence in case of defined events.) Driver is not responsible for offenses of a properly used Level 3 System Official administrative reporting channel enables OEMs to perform their product monitoring obligation: Possibility of conditions for legally obligated recall Legal challenges in respect to liability implications Criminal liability: Driver is not responsible for offense / Problem of assignment of criminal responsibility in case of existing corporate criminal law Civil liability: Difficulty of assignment of civil liability (Who is legally responsible for the incident?) 24 Autonomous driving 101 Nejc Jezeršek Ljubljana, July 2018
Autonomous EU? Legal aspects Aschaffenburg Case A car with a lane keeping assistant system drives into a small city in the southern part of Germany. At the entrance of the village, the driver suffers a stroke and looses consciousness. His hands still hold the wheel. The car moves to the right. Under normal circumstances it would have come to a stop in some bushes. But the lane keeping system brings the car back on the street. The car moves on for another 1.5 kilometers. Inside the village, it hits a young mother and her child, both are dead on the spot. The father gets hurt, but survives. A B 25 Autonomous driving 101 Nejc Jezeršek Ljubljana, July 2018
