1 The Corporation of Delta COUNCIL REPORT Regular Meeting F.07 To: Mayor and Council File No.: /GAT; /GAT/FTG From: Engineering Department Date: September 19,2012 Request for Relaxation of the Delta Noise Control Bylaw for Construction Works at the 9600 Block of River Road - Extension Requested The following report has been reviewed and endorsed by the Chief Administrative Officer. RECOMMENDATIONS: A. THAT the Concessionaire for the South Fraser Perimeter Road project, the Fraser Transportation Group, be granted an extension of. relief from enforcement of the Delta Noise Control Bylaw No. 1906, 1972 for the purpose of road construction works in the vicinity of the 9600 Block of River Road. B. THAT the period of relief be granted between 7:00 p.m. and 5:00 a.m. Sunday to Friday and between 9:00 a.m. and 7:00 p.m. on Sundays between October 2 and December 15, PURPOSE: The purpose of this report is to seek an extension to the relaxation of the Delta Noise Control Bylaw No. 1906, 1972 for the purpose of road construction works in the 9600 Block of River Road as part of the South Fraser Perimeter Road (SFPR) project. BACKGROUND: Council granted a relaxation of the Delta Noise Control Bylaw at the July 30, 2012 Regular Meeting which permitted the Concessionaire to complete culvert works in the 9600 Block of River Road at night. These works were required to facilitate the construction of a new intersection that will allow River Road traffic to connect to the SFPR, Highway 99 and/or Nordel Weigh Scales. The Concessionaire is now requesting an extension of the relaxation as additional utility and road works are required for the new intersection. A map showing the extent of the work zone has been included as Attachment A. Council Policy: The Delta Noise Control Bylaw No. 1906, 1972 with amending Bylaws No. 2357, 4987 and 5271 states:
2 Page 2 of 3 Request for Relaxation of the Delta Noise Control Bylaw for Culvert Works along River Road /GAT; July 12, /GAT/FTG.~ No person shall carry on or cause to be carried on any works in connection with the construction, reconstruction, alteration or repair of any highway in such a manner as to disturb the quiet, peace, rest, enjoyment, comfort or convenience of the neighbourhood or of persons in the vicinity before 7:00 a.m. or after 7:00 p.m. any day of the week from Monday to Friday, inclusive, before 9:00 a.m. or after 5:00 p.m. on Saturday, or at any time Sunday. DISCUSSION: Construction works will include excavating, backfilling and/or paving operations. Overhead power line work using truck mounted cranes may also be required. As a result, single lane closures may be required along River Road. As the Ministry of Transportation and Infrastructure's contract with the Concessionaire does not allow the Concessionaire to have traffic control on River Road during day time hours due to impacts to traffic, the Concessionaire is requesting that this work be completed at night between the hours of 7:00 p.m. and 5:00 a.m., Sunday through Friday. Given some works may require equipment that produces elevated noise levels, the Concessionaire is suggesting that they also be allowed to work limited hours on Sundays so that these activities can be completed during the day to reduce disturbance. Any work on Sundays during the day will need to be approved by the Province. Works will occur between October 2 and December 15, 2012 with scheduling dependent on other project activities. Night works will not be continuous. Sources of noise will be from heavy equipment (e.g., excavators, backhoes) and impacts are expected to be low given it is an industrial area of Delta. The Concessionaire will notify adjacent businesses in advance of the work and provide a contact number for information. No complaints for previous work in the area have been received to date. An from the Province supporting the initial noise variance application was previously provided (see Attachment B). Implications: Financial Implications - There are no financial implications to Delta. Community Implications - Noise impacts are anticipated to be low given the work area is in an industrial area of Delta. Undertaking construction at night will minimize traffic disruptions along River Road. CONCLUSION: The Fraser Transportation Group requires a relaxation of the Delta Noise Control Bylaw No. 1906, 1972 to complete utility and road work along River Road in the 9600 Block of River Road. These works are required to facilitate the construction of a new intersection associated with the South Fraser Perimeter Road and are anticipated between October 2 and December 15, 2012.
