1 CITY OF PALM DALE REPORT to the Mayor and Members of the City Council from the City Manager DATE: February 5, 2014 SUBJECT: Authorize Payment to Southern California Edison for Engineering Advance Costs Associated with Relocation of SCE Facilities for the Avenue S Widening Phase II Improvements (Project No. 590). ISSUING DEPARTMENT: Public Works SUMMARY Issue: Shall the City Council authorize payment of $60,000 to Southern California Edison for Engineering Advance costs associated with relocation of SCE facilities for the Avenue S Widening Phase II Improvements? Recommendation: It is recommended that the City Council authorize payment of $60,000 to Southern California Edison for Engineering Advance costs associated with relocation of SCE facilities for the Avenue S Widening Phase II Improvements, and authorize to the City Manager to issue funds for the above stated relocatin work. Fiscal Impact: Currently, the project has approximately $3, 100,000 available in Prop. C-25 funds (Metro Grant) and local funds (Measure R, and Traffic Impact Fees) under Account No. S0028, Avenue S Widening Phase II, for design and right of way acquisition.

As part of the project, existing Southern California Edison (SCE) transmission, distribution, and telecommunication facilities along Avenue Swill need to be relocated or adjusted to grade within new

2 Report to the Mayor and the City Council SCE Engineering Advance Avenue S Widening Phase II Improvements February 5, 2014 Page 2 BACKGROUND The Avenue S Widening Phase II project will provide 3 lanes in each direction from 30th Street East to 45th Street East, to match the traffic capacity east and west of the project limits. The project will also include the construction of a Class I Bikeway on the south side of Avenue S for the full length of the project. Final design is underway and the City is moving forward with the acquisition public roadway and bikeway purposes required for the project. As part of the project, existing Southern California Edison (SCE) transmission, distribution, and telecommunication facilities along Avenue Swill need to be relocated or adjusted to grade within new right of way. SCE requires an Engineering Advance in the amount of $60,000 to proceed with the design of relocation plans for SCE's transmission, distribution, and telecommunication facilities affected by the Avenue S widening project. SCE will not proceed any design work without the engineering advance payment from the City. Based on the current purchasing policy the City Manager is authorized to sign invoices for up to $50, dollars. The amount of this SCE invoice is $60,000 and exceeds the City Manager's authorization amount therefore City Council is required to authorize this expenditure. You agree to pay to SCE the actual costs incurred in the course of Design and Estimation, recognizing that the actual costs may differ from the amount above. If this project is cancelled, SCE will calcu late the actual costs SCE has incurred through the date of cancellation and provide you with a final invoice. If the actual costs exceed the amount of the engineering advance, you agree to pay SCE the difference. If the actual costs are less than the engineering advance, SCE will deduct the actual costs from the engineering advance, and will refund the difference to you. If the project is not cancelled, any unused funds from the engineering advance will be applied to the total actual cost of the project.
