Chief Clint Shannon in my office to discuss a recommendation of Jiscipline he made in connection with the traffic crash you were involved in on March 31,2013. I have considered all the facts in this matter, including the information you presented at that meeting. Based on the totality of circumstances, including the fact that you have accumulated 5 points within the past two year period, I concur with the reconunendation and a three-shift suspension is imposed. 2 DISCIPLINARY ACTION FORM Employee Name: Jeneve Labossiere ID#: 357 Violation(s): Damage: Members shall be held accountable for damages resulting from accidents wherein the evidence shows abuse, carelessness, negligence and/or a violation of a traffic ordinance. Summary: (attach additional sheets as needed) On March 31, 2013, at 9:34pm, Officer Labossiere was operating a marked Palm Beach Gardens Police vehicle ( # ), a 2011 Dodge Charger. While backing down her street on Capeside Circle in Wellington, Officer Labossiere struck a stop sign located on the shoulder ofthe roadway. The left rear quarter panel of the police vehicle scrapped the sign support. No injuries were sustained and police vehicle #11438 sustained minor damage ($487.00). Pursuant to a traffic crash review, Officer Labossiere was found to be at-fault/careless involving a minor violation and one point was assessed. Officer Labossiere had a previous at-fault crash on July 11, 2011 in which she was found to be careless, received one point, and a corrective action form. On December 3, 2011 she was involved in a crash involving a serious violation and three points were assessed. She subsequently received a one-shift suspension. Recommendation: Due to this incident and the two previous at-fault accidents, Officer Labossiere has accumulated five points within the past two-year peliod. The disciplinary guidelines in the departments 'Crashes Involving City Vehicles Policy' provides for outlined disciplinary action. Chief Clint Shannon in my office to discuss a recommendation of discipline he made in connection with the traffic crash you were involved in on December 3, I have considered all the facts in this matter, including the information you presented at that meeting and the one point previously assessed for a prior crash within the past two years. Based on the totality of circumstances, I concur with the assessment of three points for this event. Therefore, a total of four points is assessed and a one-shift suspension is imposed. Officer Labossiere had just finished clearing a traffic crash scene at the intersection of Alternate AlA and Gardens Parkway and was driving south behind the tow truck that was towing a motorcycle. The tow truck suddenly slowed to check on the motorcycle that was being towed as it had slightly shifted. Officer Labossiere indicated that she was traveling slowly and looked at her computer to make sure that she was showing as "in service". She then looked up and noticed that the tow truck had suddenly slowed. Officer Labossiere attempted to stop, but was unable to do so and struck the rear of the tow truck's mechanical lift with the front ofher patrol vehicle. No injuries were sustained and police vehicle# sustained more than $3,000.. worth of damage. Neither the tow truck, nor the motorcycle being towed sustained any damage. Pursuant to this review, Officer Labossiere was found to be at-fault/careless involving a serious violation and it is recommended that three points be assessed. Chief Clint Shannon in connection with the traffic crash you were involved in on December 3, In accordance with Department Policy , Crashes Involving City Vehicles, a recommendation of three (3) points has been made in this incident. If upheld, this - combined with the one point assessed in a previous at-fault within a two-year period (July 11, 2011) -makes a total of four (4) points, which would result in a one-shift suspension. A copy of the recommendation is enclosed for your information. I anticipate making my decision in this matter in the near future. If you wish to present any information which you feel I should take into consideration before I make my decision, you may attend the predetermination hearing which has been set for Tuesday, January 3, 2012 at 4:30p.m. in my office.
