2 STATEMENT OF PROPOSAL FOR THE DRAFT AMENDMENT No 4 OF 2015 TO THE QUEENSTOWN LAKES DISTRICT COUNCIL SPEED LIMITS BYLAW 2009 INTRODUCTION This is a statement of proposal prepared in accordance with section 83(1)(a) of the Local Government Act 2002 ( the LGA 2002 ) in relation to the making of Amendment No 4 of 2015 to the Queenstown Lakes District Council Bylaw The Bylaw 2009 was made by the Queenstown Lakes District Council ( the Council ) in 2009 using powers contained in the Land Transport Act 1998, Regulations and Land Transport s made under that Act, in particular the Land Transport 54001: Setting of 2003 ( the ), the LGA 2002 and the Local Government Act 1974 ( the LGA 1974 ). The first amendment to the Bylaw 2009 (Amendment No. 1 of 2010) was made in May 2010, and the second amendment (Amendment No 3 of 2012) was made in December 2012, both also under the relevant powers in these Acts. Note that Amendment No 2 of 2012 did not proceed due to an incomplete consultation process. In response to requests, the Council has undertaken a review of speed limits on a number of roads. Recommendations have been made to adjust the existing speed limits on local roads within the Queenstown Lakes District, including the associated extension and creation of urban traffic areas. This requires making amendments to the Bylaw These will be the third amendment to the the amendment will be known as Amendment No 4 of 2015 to the Queenstown Lakes District Council Bylaw A draft of the elements to be amended in the Bylaw has been prepared by the Council for consultation in terms of s86 LGA The amended Bylaw will be made by the Council using powers contained in the Land Transport Act 1998, Regulations and Land Transport s (and in particular, the ) and the LGA In accordance with section 86(2) of the LGA 2002 the Council, when amending a bylaw, is required to include in the Statement of Proposal: (a) (b) A draft of the amended Bylaw; The reasons for the proposed amendment; and (c) A report of any relevant determinations by the Council under s155 of the LGA A. DRAFT OF AMENDED BYLAW A draft of the amended Bylaw schedules and maps are attached as Appendix 1 to this Statement of Proposal. A copy of the existing Bylaw is included as Appendix 2 to this Statement of Proposal. B. REASONS FOR PROPOSAL Background/legislative framework In accordance with section 684(1)(13) of the LGA 1974, the LGA 2002 and the, the Council was required to formally assume responsibility for setting vehicle speed limits on roads under its control within its district by means of a speed limits bylaw. The Bylaw 2006 was made in 2007, with speed limits coming into effect on 1 November This bylaw had a number of purposes; to identify urban traffic areas within the district, set speed limits on roads within the district and set a date when those speed limits would become effective.

3 Following the making of the Bylaw 2006 the Council undertook a comprehensive review of the speed limits set in that bylaw. This included the introduction of schedules of maps designating urban traffic areas and specifying the various roads of the district subject to the speed limits. As a consequence of the review, the Bylaw 2006 was revoked and was replaced with the Bylaw As specific speed limits should be changed as circumstances change, speed limits are periodically reviewed. The first amendment to change speed limits in the Speed Bylaw 2009 was made in May 2010 and is known as Amendment No. 1 of The second amendment to change speed limits in the Speed Bylaw 2009 was made in December 2012 and is known as Amendment No 3 of Amendment No 2 of 2012 did not proceed due to an incomplete consultation process. A further review of speed limits set in the Bylaw 2009 has lead to some more proposed changes. These proposed changes are to be made through this amendment to the 2009 Bylaw and will be known as Amendment No 4 of Discussion The proposed changes to the speed limits are: Tucker Beach Road, 1,100m from State Highway 6 to its end (including Hansen Rd (north)): o This section of road currently has an 80 km/h speed limit. A reduction to 60km/h has been sought to address a number of factors: relatively narrow, unsealed road, no alternatives for pedestrians, including children, except to walk on the road, and an increasing level of development. o A 60 km/h speed limit has been proposed as a 70 km/h would likely have limited effect on current speeds and therefore safety, while a 50 km/h speed limit would appear unusually low. o This change is shown on the Speed Maps Frankton, Quail Rise & Lake Hayes: Sheet 12 Version 4. Aubrey Rd, 100m in both directions from the intersection with Gunn Road: o This section of road currently has a 70 km/h speed limit. A reduction to 50km/h has been sought due to pedestrian movements, including children, in the vicinity of the roundabout. o The proposed speed limit of 50 km/h extends the 50 km/h speed limit from Gunn Road. This is shown on the Speed Maps Wanaka North & Albert Town: Sheet 4 Version 3. Speargrass Flat Road, from Arrowtown-Lake Hayes Road to Slope Hill Road (east): o This section of road currently has an 80 km/h speed limit. A reduction to 70 km/h has been proposed as the level of development and road environment is typical for this lower limit. o This change will effectively be an extension of the recently implemented 70 km/h speed limit on the adjoining Arrowtown-Lake Hayes Road. o This change is shown on the Speed Maps Wakatipu Basin: Sheet 9 Version 4. Arrowtown-Lake Hayes Road from Speargrass Flat Road to 150m south of Malaghans Road and Butel Road: o This section of road currently has a speed limit of 100km/h except the first 150m from Speargrass Flat Road which currently has a 70 km/h speed limit. A change to 80 km/h has been sought due to the number of residential properties and Butel Road with limited sight distance issues and to match the speed limits on other rural roads in the area. o This change is shown on the Speed Maps Wakatipu Basin: Sheet 9 Version 4. Centennial Avenue from McDonnell Road to 50m south of Jopp Street and McDonnell Road from Centennial Avenue to State Highway 6: o These sections of road are continuous (no stopping or turning required) and have a speed limit of 100 km/h. An 80 km/h speed limit is sought as the speed limit on State Highway 6 is now 80 km/h, the speed limit on the adjoining section of McDonnell Road is 80 km/h and the speed limit from 50 m south of Jopp Street into the Arrowtown urban area is 50 km/h.

4 There is also an out of context curve and some potentially unexpected pedestrian and cyclists crossing points, particularly those associated with the Arrowtown Golf Course. o This change is shown on the Maps Wakatipu Basin: Sheet 9 Version 4. Whitechapel Road, full length: o This road currently has a speed limit of 80 km/h. A speed limit of 50 km/h is sought as this is a narrow, unsealed road with increased cyclist activity due to a section of this road now being part of the Queenstown Trail. o This change is shown on the Maps Wakatipu Basin: Sheet 9 Version 4. Kinloch Road from the Gorge Creek bridge to a point 540m south: o This section of road has the open road speed limit of 100 km/h, although the actual road environment restricts speeds to well below this speed. A 30 km/h holiday speed limit to be implemented between 20 December and 10 February is being sought to address the increase in pedestrians in the area, particularly due to the camp ground on one side of the road and Kinloch Lodge on the other. o This change requires the an additional line to be added to Schedule 11: Roads with a variable speed limit which will include a definition of the speed limit area and the period of operation as described above. Roads surrounding Arrowtown School including: the loop of roads Hood Crescent, Adamson Drive, Centennial Avenue, Cotter Avenue plus all the minor cul-de-sacs off these roads. o These roads are currently have the general 50 km/h urban speed limit, with a 40 km/h school speed limit applied to Centennial Avenue from 30m north of Cotter Avenue to 100m north of Cornwall Street. o A 40 km/h school speed limit is proposed on these roads as there are exits from the school onto all of these roads. The school has a large number of students walking and cycling although the surrounding roads have limited pedestrian and cycling facilities. Hood Crescent is also quite narrow, especially when students are being dropped off and picked up. o Illuminated variable speed limit signs will be placed on Centennial Avenue and Adamson Drive to define the 40 km/h school zone while static signs with the times of operation shown will be placed on side roads where required to define the school zone area. o The time of operation will remain the same as for the existing school zone: a) 8.25am to 9.00am; b) 2.55pm to 3.15pm; and c) 10 minutes at any other times during a school day when at least 50 children cross the road or enter or leave a vehicle.) o This change requires changing the Road Description in line S11/3 within Schedule 11: Roads with a variable speed limit to include the additional roads to be covered by the extended 40 km/h school zone as described above. Plantation Road from 30m north of Kings Drive to 55m east of Totara Terrace: o This section of road currently has the general 50 km/h urban speed limit. A 40 km/h school speed zone is proposed to replace the existing variable children crossing signs as existing speeds of vehicles are not appropriate for the amount of student activity travelling to and from school. o This will principally affect students attending Mt Aspiring College and hence the activation of these signs will be controlled by the College. However, they will also assist students attending schools in the wider school precinct north east of Plantation Road. o Illuminated variable speed limit signs will replace the existing variable children crossing signs on Plantation Road. o The time of operation will be: a) 8.00am to 8:35am; b) 2.55pm to 3.15pm; and c) 10 minutes at any other times during a school day when at least 50 children cross the road or enter or leave a vehicle. o This change requires the addition of a line to Schedule 11: Roads with a variable speed limit to include Plantation Road from 30m north of Kings Drive to 55m east of Totara Terrace with the times of operation as described above. Frankton Marina: o This area is defined as the Frankton Marina Local Purpose Reserve within the District Plan and is subject to the current 50 km/h urban speed limit. A reduction of the speed limit to 20 km/h is being sought to address the complex mix of users in the area including, vehicles

5 with boat trailers, commercial vehicles accessing businesses, general traffic accessing various businesses with pedestrians and cyclists passing through the area. o This change will require an additional line to be added to Schedule 12: Designated Area noting the area s name and the associated speed limit. Shotover Country development: o This area is defined as Shotover County as defined in Plan Change 41. As this will be an urban area and construction has already begun, it is appropriate to define an urban traffic area to ensure all constructed roads will be subject to a 50 km/h speed limit when opened to traffic. The urban traffic area will begin on Stalker Road, 50m south of State Highway 6. o This change is an extension of the Lake Hayes urban traffic area and as shown on the Speed Maps Frankton, Quail Rise & Lake Hayes: Sheet 12 Version 4. Cardrona Valley Road from 50m to 90m south of West Meadows Drive: o This section of road currently has a 70 km/h speed limit. A reduction to 50km/h has been sought to match the more appropriate location of the speed limit sign. o This is shown on the Speed Maps Wanaka South: Sheet 5 Version 4. The following are changes required to sections of no exit roads where the open road speed limit of 100 km/h applies, but their length is less than the 2 km required in the for a 100 km/h speed limit. They are proposed to be changed to the speed limit of the adjoining road section. Shown on Speed Maps Cardrona: Sheet 7 Version 3: Pringles Creek Road (365m) off Cardrona Valley Road: 70 km/h. Curtis Road (86m) off Pringles Creek Road: 70 km/h Shown on Speed Maps Wakatipu Basin: Sheet 9 Version 4: Threepwood Drive (1,200m) off Slopehill Road (east): 80 km/h Jane Williams Place (434m) off Threepwood Drive: 80 km/h Shown on Speed Maps Arthurs Point: Sheet 11 Version 2: Watties Track (545m) off Gorge Road: 70 km/h Moonlight Track (1,050m) on the same road beyond the Arthurs Point urban traffic area boundary: 50 km/h Oxenbridge Tunnel Road (550m) on the same road beyond the Arthurs Point urban traffic area boundary: 50 km/h Due to the addition of rural 50 km/h speed limits, the title and description of Schedule 5 needs to be changed as follows: Change the title to Schedule 5: Roads with a speed limit of 50 km/h. Within the description of this schedule the words or otherwise indicated to be added after the words urban traffic areas. The amendments noted above have been incorporated into the Draft Amendment No 4 of 2015 to the Queenstown Lakes District Council Bylaw 2009 (attached), as follows: Speed Maps The Speed Maps have been changed as explained above.

The times during which the variable speed limit signs are permitted to operate are limited to: a) 8.00am to 8.35am; b) 2.55pm to 3.15pm; and c) 10 minutes at any other times during a school day when at least 50 children cross the road or enter or leave a vehicle. The speed limit is 50 km/h at all other times when the variable speed limit signs are not operating. The Date Speed Comes Into Force is 12/10/2015. 7 limit is 30 km/h. At all other times of the year speed limit is 100 km/h. The Date Speed Comes Into Force is 20/05/2015. Schedule 12 Add Frankton Marina Local Purpose Reserve to Schedule 12 as Row S12/29, with a speed limit of 20 km/h. C. RELEVANT DETERMINATIONS UNDER SECTION 155 LGA 2002 The Council, in making the Bylaw 2009, considered that it was the appropriate means for addressing the actual and likely problems associated with increasing urban development and road traffic throughout the Queenstown Lakes District. It considered that the Bylaw 2009 would safeguard both pedestrian and vehicular traffic and assist enforcement agencies to manage the road network safely and assist in reducing accidents. The Council is of the view these considerations apply equally to the amendments proposed to the Bylaw 2009 to be known as Amendment No 4 of 2015 to the Queenstown Lakes District Council Bylaw Other options for addressing the issues raised were considered by Council and were rejected in favour of the proposed changes in this Statement of Proposal. The Council considers that the proposed amended Bylaw is not inconsistent with the New Zealand Bill of Rights Act 1990 and only seeks to impose justifiable and reasonable limitations on persons in the interests of public health and traffic safety. D. SUMMARY OF STATEMENT OF PROPOSAL A Summary of the Proposal containing the information required by section 83(1)(a)(ii) of the LGA 2002 is included in Appendix 3 to this Statement of Proposal. E. DISTRIBUTION OF SUMMARY OF STATEMENT OF PROPOSAL The Summary of the Statement of Proposal (Appendix 3) will be distributed in accordance with section 83 LGA 2002: Notices will be placed in the Mirror and the Otago Daily Times summarising the provisions of the amended Bylaw and inviting submissions. Copies of the draft amendments to the 2009 Bylaw and information about making submissions will be placed at public libraries throughout the district and Council service centres. Copies of the proposal and the draft amendments to the Bylaw may be inspected and a copy obtained for no cost from: (a) Either of the Council offices at 10 Gorge Road, Queenstown or the Wanaka Service Centre, 47 Ardmore Street, Wanaka; (b) Any Council library within the Queenstown Lakes District; (c) The Queenstown Lakes District Council website: F. TIMETABLE FOR CONSULTATION The following timetable is proposed for consultation: Timeframe Saturday 17 January 2015 Milestone Press release and Statement of Proposal is made available. Any change will take into account any issues that arise from the consultation process. G. RIGHT TO MAKE SUBMISSIONS AND BE HEARD Any person or organisation has a right to be heard in regard to this proposal and the Council encourages everyone with an interest to do so. All parties wishing to make a submission should set out their views in writing and submit them to the Chief Executive, Queenstown Lakes District Council, Private Bag 50072, Queenstown no later than 5.00pm on Friday 27 February Persons making submissions, who wish to be heard by the Council, will have the opportunity to do so. Copies of submissions will be available on request from the Council. The Council will convene a hearing on a date to be determined, but within the period 9 20 March 2015 to hear submitters who have indicated their wish to speak to their submission. Equal weight will be given to written and oral submissions. Late submission or oral submission (without prior written material) will only be accepted where exceptional circumstances apply. Every submission made on this proposal will be acknowledged. Submitters should note that their submission will be copied and made available to the public and will be heard in a meeting that is open to the public. 49 Queenstown Lakes District Council Bylaw Introduction 1.1 The purpose of this Bylaw is to set speed limits on roads within the jurisdiction of the Queenstown Lakes District Council ( the Council ) and to designate urban traffic areas within the Queenstown Lakes District. 1.2 This Bylaw is made under the Local Government Act 1974, the Local Government Act 2002 and Land Transport 54001: Setting of 2003 ( the ). 2.0 Title 2.1 The title of this Bylaw is the Queenstown Lakes District Council Bylaw Application 3.1 This Bylaw applies only to roads under the jurisdiction of the Council. 3.2 It does not apply to state highways or motorways passing through the Queenstown Lakes District under the control of the New Zealand Transport Agency. 4.0 Interpretation: 4.1 Except as expressly provided or the context requires otherwise the expressions used in this Bylaw shall have the same meaning as in the including: holiday speed limit minimum speed limit permanent speed limit road rural area rural speed limit speed limit urban speed limit urban traffic area variable speed limit

50 4.2 In relation to the following expressions used in this Bylaw: means Land Transport 54001: Setting of 2003 Vehicle means the same as in section 2(1) of the Land Transport Act Date the speed limits come into force 5.1 The speed limits described in the Schedules come into force on the dates specified in the Schedules. 6.0 Setting of speed limits 6.1 The roads or areas described in the Schedules specified in clause 7 or as shown on a map referenced in the Schedules are declared to have the speed limits specified in the Schedules and associated maps, which are part of this Bylaw. 6.2 Without limiting the generality of 6.1 the following applies: (a) All areas shown in Schedule 5 or as shown on speed limit maps declared to be urban traffic areas are subject to a speed limit of 50 km/h except for those roads that are: (i) (ii) described as having a different speed limit in a Schedule to the Bylaw; or shown on a map as having a different speed limit and referenced in a Schedule to the Bylaw. (b) All the roads or areas outside an urban traffic area shown in Schedule 5 have a speed limit of 100 km/h, except for roads that are: (i) (ii) described as having a different speed limit in a Schedule to the Bylaw; or shown on a map as having a different speed limit and referenced in a Schedule to the Bylaw. (c) (d) The roads or areas described in Schedule 11 or shown on a map and referenced in the Schedule are declared to have variable speed limits as set out in the Schedule. The roads or areas described in Schedule 12 or shown on a map referenced in the Schedule are declared designated locations in accordance with section 4 of the and the speed limits for the roads in the designated locations are as specified in the Schedule.
