2 Definitions An Advanced braking system is a braking system in which either an antilock brake system and/or combined brake system is present. An Antilock Brake System / ABS is a system for sensing and controlling the amount of relative slip velocity between the tyre and road surface during braking. A Combined Brake System / CBS is a type of PTW braking system in which each brake manipulator (i.e., either lever and/or pedal) actuates a brake on the front wheel and a brake on the rear wheel. Definitions and performance and construction requirements for each of these brake systems are as laid down in ECE 78 or GTR3. Both braking systems (ABS and CBS) can be combined and complemented with additional features e.g. rear lift off protection, automatic brake force distribution, powered braking system, braking by wire system etc. Any other brake system with a function and braking performance equivalent to ABS or CBS, or better, is considered as Advanced braking system. Any innovative architecture of motorcycles (powered two wheeler above 50cc) with a brake system, whose function and braking performance are equivalent to ABS or CBS, or better will be consolidated in the above mentioned monitoring of Advanced braking system deployment.

6 Background & Status ACEM Commitment on Advanced Braking Systems 2004 ACEM manufacturers committed to develop the offer of street PTWs equipped with advanced braking systems. By 2010, the majority will be available with advanced braking systems, at least as an option Street motorcycle offer reaches 40% with a market penetration of 35%

7 ACEM proposal for Commitment on Advanced Braking Systems ACEM commitment and individual commitment from each ACEM manufacturer Proposal to refer to commitment in the Regulation Joint monitoring system ACEM EC 2009 ACEM manufacturers propose to extend the commitment, establishing a further 75% objective for street motorcycles (excluding trial, enduro and small series as in 2002/51) by 2015, at least as an option

10 ACEM Critique of TRL Report First ACEM review June 2009 MCWG BCR results show a 180 reversed trend between February and May versions of the TRL report the February version Option A has the best BCR for the short, mid & long term and May version Option B has the best BCR for the mid & long term Response from TRL Differences highlighted by ACEM are due to new key information and technical review of method/assumptions.

11 ACEM Critique of TRL Report Second ACEM review August Under evaluation of market penetration of Advanced Braking Systems in Option A TRL: 10% in 2011 While the market penetration of advanced braking systems already reached 35% in 2008 And could reasonably be estimated at 40% in 2011 Resulting in a gap from the starting point of 30%! Question: Why ACEM figures were not taken into account?

12 Second ACEM review August Under evaluation of market penetration of Advanced Braking Systems in Option A TRL: between 2011 and 2014, market penetration of ABS/CBS does not progress and sticks at a level of 10% While the % of ABS/CBS offer raises regularly from 50% up to 65% Question: Why is there inconsistency between consumer takingup and offer increase between 2011 and 2014?

13 ACEM Critique of TRL Report Second ACEM review August Inconsistent and unrealistic ABS costs TRL: same costs between ABS and CBS for option B & C due to lack of data ACEM: Unacceptable assumption! TRL: economy of scale for ABS cost between Option A and Option B/C from 539 down to 150 (registrations multiplied by 5+) ACEM: difference between Option A (corrected ) and Option B/C represent only a factor 1.5 Economy of scale cannot be justified

14 ACEM Critique of TRL Report Second ACEM review August Over estimation of registrations fitted with ABS/CBS in Options B & C TRL: 100% of new registrations are affected by the mandatory fitment ACEM: Exemptions for Trial and Enduro and new architecture vehicles (3 wheelers) TRL: 100% of new registrations are affected by the mandatory fitment since the first year of application ACEM: 2 years+ are necessary to sell out existing stocks of traditional braking vehicles

15 ACEM Critique of TRL Report Conclusion 1. ACEM recalculation of BCR analysis with correct inputs results in option A (ACEM commitment) being the most advantageous 2. Cooperation was offered to TRL to reach common conclusions, but TRL did not react since August ACEM urges the Commission to ignore TRL data until clarification, correction of the input figures and production of a revised report
