Všetky limitné hodnoty emisií stanovené v tejto prílohe sú vymedzené pri teplote 273,15 K, tlaku 101,3 kpa a po korekcii obsahu vodných pár v odpadových och a pri štandardnom obsahu O 2, ktorý predstavuje 6 % pre spaľovacie zariadenia používajúce tuhé, 3 % pre spaľovacie zariadenia používajúce kvapalné a né pre motory a ové turbíny. 6 Justification for the whole annex II Medium Combustion Plants shall be required to apply best available techniques as it is the case for larger installations and as it is already required in some Member States. This would create a level playing field for the sector concerned. Justification on NOx The Commission s proposal s emission limit values for NOx are extremely weak compared to what is already required in several national legislations and compared to what is nowadays technically achievable. NOx emissions can be significantly reduced with the use of several existing abatement techniques. End of pipe technology such as SCR and SNCR lead to emissions below 100 mg/nm3. In the case of natural gas fired boilers, an emission limit value of 70 mg/nm3 can be achieved simply with the help of primary abatement technology such as low NOx-burners. For engines, existing abatement techniques can lead to NOx emissions below 30 mg/nm3. Justification on PM PM emissions can be significantly reduced with the use of fabric filters or electrostatic precipitators. With such equipment in place, plants can easily reach PM levels below 10 mg/nm3, and even 1 mg/nm3 for the best performing filters. Tight PM emission limits are particularly important from a health point of view, PM being the pollutant with the highest estimated impact on human health. Justification on SO2 For boilers using liquid and solid fuel, the use of low sulphur fuel combined existing abatement techniques such as dry sorbent injection can lead to emissions below 150mg/Nm³ and 100 mg/nm³ respectively. Biomass and gas boilers emit relatively low SO2 emissions. Engines using liquid fuel should be required to use fuel with a low sulphur (0.05% sulphur content) as a way to reach emission levels < 5 mg/nm³. Low sulphur fuel leads to reduced SO2 emissions into the air. A fuel quality requirement is therefore an effective and costeffective way of reducing SO2 emissions. Justification on additional pollutants The Commission left out a wide range of pollutants which can be emitted by medium combustion plants and have a harmful effect on human health and the environment. The proposed emission limits are based on existing technology and would ensure a more comprehensive approach to reducing air pollution from medium combustion plants. Justification on mercury Mercury is a highly toxic metal, in particular when it turns into methylmercury, its most dangerous form. Methylmercury has the capacity to accumulate in organisms and concentrate in food chains, especially in fish. Even at low doses, it can seriously affect the nervous system PE v /89 AM\ doc

7 and harm immune and reproductive systems. It has serious effects on brain development and can pass through both the placental and blood-brain barriers. Children and women of childbearing age are therefore most at risk. Or. xm Limitné hodnoty by sa mali stanoviť v súlade s najlepšími dostupnými technikami, tento prístup sa už uplatňuje na väčšie zariadenia a je povinný vo viacerých členských štátoch. Limitné hodnoty pre tuhé častice z malých zariadení na bio by sa mali stanoviť tak, aby sa obmedzilo využívanie biopalív. For NOx limits, the ELVs presented in Annex II of the MCP Directive Proposal are significantly higher than those found in many existing member states' legislation. Some proposed figures are higher than the raw exhaust emission values for many systems in operation today. The proposed values lag behind existing market practice and behind existing technology, and far from the levels needed to improve European citizens air quality. It can be foreseen that the SO2 emission from existing plants will be higher than the emission limit value in the proposal of the directive in case of using straw with high sulfur content as fuel. Compliance with an emission limit value on 200 mg SO2/m3 would imply investments in retrofit of flue gas cleaning device on existing straw-fired plants, which might not be economically viable for the specific plant. The straw-fired plants are an important part of heat and combined heat and power production in for example Denmark, which is a prioritised mean to reduce fossil fuel consumption. Locally sourced biomass is a widely used energy source in several sparsely populated member states with large forest areas. Biomass is often a dominant fuel for heating in smaller communities outside of the main urban areas. In these small communities centralised use of biomass in district heating has improved the local air quality by replacing individual heating systems with higher emissions and lower stacks. There is no evidence that centrally used biomass has worsened air quality significantly. The Commission proposal sets relatively low dust emission limit values for all solid fuel combustion, achievable only by costly secondary flue gas treatment either with fabric filter or electrostatic precipitator. The investment cost of an electrostatic precipitator is approximately PE v /89 AM\ doc

15 euros for a 1-10 MW plant and the total costs of retrofitting these technologies to existing plants are estimated to be 2-3 times the equipment cost. The poor cost efficiency for retrofits to existing plants has been demonstrated in several cost calculations. The situation is particularly problematic in rural areas where the potential human health gains are relatively low compared to urban areas. Emission limit value 150 mg/nm3could be achieved with multicyclones. In majority of the cases this emission limit value would require replacement of the existing multicyclones or other dust abatement techniques with modern multicyclones. (1) The ELVs for solid biomass boilers 1-10 MW should allow for the use of multicyclones as abatement technique. Emission. Regarding For solid biomass plants between 10 and 50 MW, the ELV should be 50 mg/nm3 in line with the Gothenburg Protocol. The increased use of bioenergy is part of actions to reach the general EU objectives of reducing the emissions of greenhouse gases. Emissions from biomass are considered carbon neutral. Biomass is renewable and can substitute fossil carbon fuels and products. As the use of bioenergy is beneficial from a climate aspect, its use should be promoted and not hindered, e.g. by introducing too stringent ELV on existing small biomass fuelled combustion plants. The new installations are able to meet the stricter requirements. (2)(3) Iron and steel gases are produced in the normal operation of the steelmaking process in mainly two different facilities: Coke ovens (Coke oven gas - COG) and Blast Furnaces (Blast Furnace gas - BFG). The primary task of the energy management in the steel industry is to reduce the primary energy consumption by using these gases and avoiding simple flaring (waste of resources). The particularities of these gases need to be addressed, in line with the Industrial Emissions Directive, and ensure coherence in the MCPD, due to its origin, treatment and composition. 19 for both new and existing medium combustion plants, especially for those plants using biomass (including peat) as a domestic energy source. The originally proposed emission limit values are set too high and would require disproportional additional costs for operators of smaller and medium plants to meet these limits. That could lead to generally increased costs of heat energy supply for society, as one should take into account that notable part of those plants are being used, for instance, in hospitals, schools and various establishment of social services. The dust emission limit value for existing MW biomass plants should be more in line with the Gothenburg protocol (30 mg/nm³ in 11 % excess O2 for these plants, which is 45 mg/nm³ in 6 % excess O2). Emission limit value 50 mg/nm3 has been widely applied in national legislation in several MS and it can be achieved using a multiple technologies. In biomass combustion there is high potential to utilise flue gas condensation with additional heat recovery. With this technology emission limit value 50 mg/nm3 could be achieved. In order to achieve current lower emission limit values electrostatic precipitators or fabric filters need to be used. Locally sourced biomass is a widely used energy source in several sparsely populated member states with large forest areas. Biomass is often a dominant fuel for heating in smaller communities outside of the main urban areas. In these small communities centralised use of biomass in district heating has improved the local air quality by replacing individual heating systems with higher emissions and lower stacks. There is no evidence that centrally used biomass has worsened air quality significantly. The Commission proposal sets relatively low dust emission limit values for all solid fuel combustion, achievable only by costly secondary flue gas treatment either with fabric filter or electrostatic precipitator. The investment cost of an electrostatic precipitator is approximately euros for a 1 10 MW plant and the total costs of retrofitting these technologies to existing plants are estimated to be 2 3 times the equipment cost. The poor cost efficiency for retrofits to existing plants has been demonstrated in several cost calculations. The situation is particularly problematic in rural areas where the potential human health gains are relatively low compared to urban areas. Emission limit value 150 mg/nm3 could be achieved with multicyclones. In majority of the cases this emission limit value would require replacement of the existing multicyclones or other dust abatement techniques with modern multicyclones. Therefore, to justify the investments already made, new emission limit values for dust from solid biomass for existing plants should be achievable when using multicyclone (e.g. dust emission limit of 150 mg/nm3). We have two medium size combustion plants using retort gases as a fuel. Estonia proposes to raise emission limit value of SO2 for gaseous fuels, other than natural gas.
