Low density residential area Ward No: 7 Municipal Plan: Zoning: Existing Land Use: Previous Applications: Residential Residential Zone Two (R-2) Single Detached Dwelling None EXECUTIVE SUMMARY: The applicants are seeking a conditional use variance to permit the keeping of three hens on the subject property. The proposal complies with the requirements for the keeping of backyard hens in residential areas and Staff support this application subject to terms and conditions.
28 APPLICATION: Jamie Cameron and Jill Carroll have made an application for a conditional use variance to permit the keeping of three (3) hens on property located at 38 Rebecca Drive. PLANNING COMMENTS: Proposal The applicants are proposing to keep three egg-laying hens on their property at 38 Rebecca Drive. The applicants wish to provide an education for their young children about sustainable and locally grown food and allow the children to participate in the care of an animal. The applicant is aware of the conditions required for this use such as the sale of eggs or meat is prohibited, as is the slaughtering of the animals and that there be regular removal or composting of any waste materials. Zoning Bylaw The proposal complies with the standards for keeping backyard hens in residential areas as follows: Standard Distance from coop to Adjacent dwellings (min) Standard 10m Proposed +18m n/a Variance The proposed location of the coop is at least 18 metres from the nearest single detached dwelling and meets the minimum setback requirements. The coop will be adequately screened from Rebecca Drive by the existing 5 foot high fence. An existing shed on the subject property as well as on adjacent lots will help provide further screening. The subject property is not located within Zones A 1 or A2 of the City's Wellfield Protection Areas and the Engineering and Operations Department has no issues with this application. Based on the aforementioned, Staff are prepared to support a conditional use variance to permit the keeping of three hens subject to terms and conditions. RECOMMENDATION: It is recommended that the application submitted by Jamie Cameron and Jill Carroll for a conditional use variance to permit the keeping of three (3) hens on property located at 38 Rebecca Drive be approved subject to the following term and condition: a) That the site be developed substantially in accordance with Map II attached to P.R. 30/18 to the satisfaction of the Development Officer; b) The hen coop be developed substantially in accordance with Map Ill attached to P.R. 30/18 to the satisfaction of the Development Officer; c) A maximum of three (3) hens be kept on the property (roosters are not permitted);
