2 INVITATION FOR BIDS The KODIAK ISLAND BOROUGH will receive sealed bids until 3:00 pm (local time), October 19, 2015, for the HYDRAULIC EXCAVATOR PROCUREMENT, Kodiak, Alaska. The scope of work is to provide a Hydraulic Excavator as described in the specifications, including all freight costs to Kodiak, Alaska. The Kodiak Island Borough reserves the right to reject or accept any or all bids, to waive irregularities or informalities in the bid or in the bidding, and to give particular attention to the qualifications of the Bidder. 3 I. SCOPE OF WORK The Kodiak Island Borough desires to purchase a Hydraulic Excavator. Unit shall include all standard equipment and accessories as advertised in manufacturer s specification sheet of model offered, unless otherwise specified herein. Procurement of all specified equipment to include all freight costs to Kodiak, Alaska. II. TYPICAL UNITS CAT Model 323F or equivalent provided all of the following minimum specifications are met. III. EQUIPMENT SPECIFICATIONS 1) Basic Specifications Engine net power according to SAE J1349 shall be at least 161 hp (120 kw) Lift capacity over the front at ground level, 31 (790 mm) track, 9040 lb (4100 kg) counterweight, 18 8 (5.7 m) HD Reach Boom, and 9 6 (2.9 m) stick: 20 (6 m) shall not be less than 17,350 lb (8050 kg). 25 (7.5 m) shall be no less than 12,550 lb (5850 kg). Lift capacity over the side at ground level, 31 (790 mm) track, 9040 lb (4100 kg) counterweight, 18 8 (5.7 m) HD Reach Boom, and 9 6 (2.9 m) stick: 20 (6 m) shall not be less than 10,900 lb (5050 kg). 25 (7.5 m) shall be no less than 8,100 lb (3750 kg) Maximum digging depth with 18 8 (5.7 m) HD Reach Boom, and 9 6 (2.9 m) stick shall not be less than 22' 1" (6,720 mm). Maximum reach at ground level with 18 8 (5.7 m) HD Reach Boom, and 9 6 (2.9 m) stick shall not be less than 32' 4" (9,860 mm). Operating weight with 18 8 (5.7 m) HD Reach Boom, and 9 6 (2.9 m) stick, 31 (790 mm) track, 9040 lb (4100 kg) counterweight, and 47 (1200 mm) GD bucket shall be at least 50,700 lb (23,000 kg). Shipping height with 18 8 (5.7 m) HD Reach Boom, and 9 6 (2.9 m) stick shall be no greater than 10' 3" (3130 mm). Shipping length with 18 8 (5.7 m) HD Reach Boom, and 9 6 (2.9 m) stick shall be no greater than 31' 4" (9,540 mm). Tail swing radius shall be 9' 3" (2830 mm). Ground clearance shall be 1' 6" (450 mm). Shipping width shall be 10 5 (3170 mm) with 31 (790 mm) shoes. Cab height shall be 9' 11" (3010 mm). Maximum drawbar pull shall be at least 46,090 lb (205 kn). 2) Engine Engine shall be U.S. EPA Tier IV Final compliant. Engine shall be equipped with an exhaust gas after treatment regeneration solution that requires no operator intervention. Engine shall include three selectable power modes: high power, standard power, and economy power. Page 2 of 11

4 Engine shall include bio diesel-ready high-pressure common rail fuel system and allow the use of bio fuel up to B20 (bio fuel 20% mixture). Machine shall include cooling system with side-by-side-mounted hydraulic oil and engine radiator with a tilt-up air-to-air after cooler and swing-out A/C condenser for efficient air flow and easy cleaning. Cooling fan shall automatically adjust to ambient temperature to help reduce fuel consumption and noise. The radial seal air filter shall have a double-layered filter core and shall be located in a compartment behind the cab. A warning shall be displayed on the monitor when dust accumulated above a preset level. Engine mounts shall be rubber-isolating. Engine bore shall be 4.1 (105 mm) and stroke shall be 5.3 (135 mm). Engine displacement shall be 433 cubic inches (7.1 L). 3) Hydraulic System Main system shall have a maximum flow of 112 gal/min (423 L/min) with two pumps. Maximum pressure shall be at least 5,076 psi ( kpa) under normal pressure and at least 5,511 psi ( kpa) under heavy lift pressure. Maximum pressure for the travel circuit shall be at least 5,076 psi ( kpa). Maximum pressure for the swing circuit shall be at least 3,698 psi ( kpa). An electric boom regeneration valve and a stick regeneration circuit shall save energy during boom-down and stick-in operations to increase efficiency. Control circuits for attachments, Hydraulic Thumb and Hydraulic operated Pin Grabber Coupler. Hydraulic cylinder snubbers shall be located at the rod-end of the boom cylinders and both ends of the stick cylinders to cushion shocks and reducing sound levels. The hydraulic pilot system shall control the front linkage, swing and travel operations. The straight-line travel circuit shall be incorporated into the hydraulic system to maintain low-speed, straight line travel even when operating the front linkage. 4) Undercarriage Undercarriage length shall be at least 14' 8 (4460 mm). Undercarriage width shall be at least 9 9 (2980 mm). 790 mm (31 in) triple grouser heavy-duty shoes. Two-speed axial piston hydraulic motors shall provide drive power and speed selection which shall be automatic when the high-speed position is selected. Machine shall be able to automatically change between computer-controlled high and low speeds depending on drawbar-pull requirements when high speed travel position is selected. Full length track guiding guards. 5) Operators Station Machine shall include reinforced upper frame, Roll-over Protective Structure (ROPS) certified Cab, and overhead guarding to protect operators. Seat shall include air suspension, heated, and air-cooled. Page 3 of 11

5 Seat shall have reclining back, upper and lower seat slide adjustments, height and tilt adjustments, adjustable armrests, and a retractable seat belt. Monitor shall include a color LCD screen capable of displaying up to two different camera images on the screen. Monitor shall be programmable to display messages or warnings in choice of 42 different languages in text form instead of codes. A rearview camera housed in the counterweight area and displayed through the cab monitor shall be offered standard Monitor shall perform pre-start fluid level checks. Monitor shall have a programmable service interval reminder for timely maintenance. An engine shutdown setting shall be accessible through the monitor to allow owners and operators to specify idle time before engine shutdown to conserve fuel. Cab shall have a drink holder, coat hook, service meter, literature holder, magazine rack and storage compartment. Space shall be provided near the auxiliary power supply for holding portable devices such as MP3 players and cell phones. Exterior design of the cab shall use thick steel tubing along the bottom perimeter of the cab to improve resistance of fatigue and vibration. This design shall allow the falling object guard to be bolted directly to the cab. The cab shell shall be attached to the frame with viscous rubber cab mounts to dampen vibrations and sound levels. All glass shall be affixed directly to the cab and eliminate window frames for enhanced visibility. The upper front windshield shall open, close and store on the roof above the operator with a one-touch action release system. Pillar mounted wipers shall offer continuous and intermittent modes. A skylight with sunshade shall provide visibility and ventilation. The operator shall be able to select the heavy lift mode at the push of a button to boost lifting capability and provide improved controllability of heavy loads. The hydraulic system shall provide automatic priority function for boom- up and swing operations based on operator demand and eliminating the need for work mode buttons. Machine shall utilize pilot operated control levers positioned so the operator can operate with arms on the armrests. 24V AM/FM radio with stereo speakers and flexible antenna. 12V power supply with 2 10amp sockets. 6) Stick and Boom Heavy-Duty Reach 5.7 m (18 18 ) boom Thumb-ready 2.9 m (9 6 ) stick 7) Swing System Swing torque shall be at least 45,580 lb ft (61.8 kn*m). 6 8) Serviceability Machine shall have sealed and lubricated track rollers, carrier rollers, and idlers. Service points shall be centrally located with easy access to facility routine maintenance. The hydraulic return filter shall be situated inside the hydraulic tank and filter elements shall be removable without spilling hydraulic oil. Machine shall be equipped with SOS sampling ports and hydraulic test ports for the hydraulic system, engine oil and for coolant. A concentrated remote greasing block on the boom shall deliver grease to hard to reach locations. Machine shall be equipped with an automatic electric fuel priming pump mounted to the primary filter base for greater reliability and easier service compared to traditional hand-priming pumps. Machine shall be equipped with a fuel tank overfill indicator that rises when the tank is full and visible from ground level. A service door on the right side of the upper structure shall allow ground-level access to the pump and pilot filter. The left rear service door shall allow easy access to the engine radiator, oil cooler and air-to-air after-cooler. The fuel tank shall feature a remote drain cock located in the pump compartment for easy water and sediment removal. A QuickEvac system shall be installed for fast engine and hydraulic oil removal. A coolant reserve tank shall be located in a position above the inlet and outlet of the engine radiator. Machine shall be equipped with drain cock attached to bottom of engine radiator accessible at ground level. 9) Minimum Service Fill Capacities Fuel tank capacity shall not be less than gal (410 L). Cooling system capacity shall not be less than 7.9 gal (30 L). Engine oil capacity shall not be less than 6.6 gal (25 L). Swing drive capacity shall not be less than 2.1 gal (8 L). Each final drive shall have a capacity of not less than 2.1 gal (8 L). 7 13) Warranty 1 year unlimited hours full coverage. 14) F.O.B.: All prices covered by this contract will include the freight cost to the Kodiak Island Landfill, 1203 Monashka Bay Rd., Kodiak, Alaska. 15) Training 1 day of operator and technical training in Kodiak, Alaska IV. SCHEDULE AND SUBMISSION 1) Schedule Bid Package Available: October 2, 2015 Sealed Bids Due: October 19, 2015 at 3:00 pm local time Tentative Contract Award: November 6, 2015 The Borough reserves the right to make adjustments to the above noted schedule as necessary. 2) Questions Bidders may contact the Borough for clarification and information pertaining to this request for bids. Any requests for information or clarification must be submitted in writing by to Joe Lipka at jlipka@kodiakak.us before October 9, 2015 at 5:00 P.M. All questions must be submitted in writing. All written questions and written responses to all questions will be posted on the Borough's web page as Addenda and ed to all bidders. 3) Bid Submission Bids submitted in response to this Invitation to Bid must meet the specifications set forth herein. Only those bidders providing complete information as required will be considered for evaluation. Any major deviation from these specifications will be cause for rejection of the bid at the Borough's discretion. Bids must include the following information: Cover Letter, including: a) Project title b) Name and address of the entity submitting the bid c) Contact person's name, mailing or street addresses, phone and fax numbers and address d) Submission of the letter will constitute a representation by your firm that your firm is willing and able to perform the commitments contained in the bid. 8 Manufacturer's warranty information must be provided in writing on equipment being proposed per the specifications. Completed Bid Form and Acknowledgement of Addenda Bidders are required to submit a bid price and acknowledge any issued addenda on the attached Exhibit A. The Borough intends to award this contract to the firm that it considers will provide the best overall product. The Borough reserves the right to accept other than the lowest priced offer and to reject any bids that are not responsive to this request. Proposed Equipment Bidders are required to provide sufficient documentation to define the equipment being provided in this scope of work. Such documentation may include, but is not limited to vendor catalog sheets, general data sheets, drawings and sketches or specification and warranty information. 4) Submittal One original and one copy of your bid package must be received by the Office of the Borough Manager no later than 3:00 P.M. (local time), October 19, Bids shall be sealed and addressed to: Office of the Borough Manager Room 125 Kodiak Island Borough 710 Mill Bay Road Kodiak, Alaska The outside of the sealed envelope must be identified as HYDRAULIC EXCAVATOR PROCUREMENT. Late bids and bids sent by facsimile or will not be accepted. It shall not be sufficient to show that the bid was mailed in time to be received before scheduled closing time, postmarks will not be accepted. V. TERMS AND CONDITIONS 1) Errors and Omissions Proposers are responsible for reviewing all portions of this Invitation to Bid. Proposers are to promptly notify the Borough, in writing, if the proposer discovers any ambiguity, discrepancy, omission or other error in the Invitation to Bid. Any such notification should be directed to the Borough promptly after discovery, but in no event later than seven working days prior to the date for receipt of bids. 2) Contract Bid shall be good for 90 days. A successful proposer will be expected to enter into a written contract with the Kodiak Island Borough prior to the purchase of the equipment. A copy of the standard Kodiak Island Borough Equipment Purchase Agreement is attached as Exhibit C. Page 7 of 11

9 3) Manufacturer's Name Any manufacturer's name, trade name, brand name, information and catalog numbers used herein are for proposes of description and establishing general quality levels. References are not intended to be restrictive of any products that manufacturer may offer. The determination as to whether any alternate product or service is equal shall be made by the Kodiak Island Borough and such determination shall be final and binding among all bidders. 4) Specifications Any deviations from bid specifications indicated herein must be clearly stated otherwise it will be considered that items offered are in strict compliance with the specifications, and successful bidder will be held responsible. Deviations must be explained in detail. 5) Placing of Orders The award of this bid does not constitute an order. Before shipments or service provided the bidder must receive a contract approved by the Borough Assembly and signed by the Borough Manager. Page 8 of 11

11 EXHIBIT C KODIAK ISLAND BOROUGH EQUIPMENT PURCHASE AGREEMENT Contract No XX THIS AGREEMENT, made this day of, 2015, between the Kodiak Island Borough, acting by and through its Borough Manager, party of the first part, and of, hereinafter called the Distributor. WITNESSETH: That the Distributor, for and in consideration of the payment or payments herein specified and agreed to by the party of the first part, hereby covenants and agrees to furnish for the Kodiak Island Borough per the Specifications [part of the Contract Documents] for same and for the sum of ( ) Dollars. The Distributor further covenants and agrees that the manufacturing of said HYDRAULIC EXCAVATOR shall be done to the complete satisfaction of the Kodiak Island Borough, subject to inspection at all times and approval by any participating agency of the Government of the United States of America, and in accordance with the laws of the State of Alaska and rules and regulations of said Federal Agency. The Distributor further covenants and agrees that the manufacturing of said HYDRAULIC EXCAVATOR shall be done and performed in the best and most workmanlike manner and that all and every of said materials and labor shall be in strict and entire conformity in every respect with the Specifications: that he will abide by and perform all stipulations, covenants, and agreements specified in the Contract Documents, all of which are by reference hereby made a part of this Contract, as to all premises therein: and in case any of said materials or labor shall be rejected by the Borough Manager or his assistant or authorized representative, as defective or unsuitable, then the said materials shall be removed or replaced with other approved materials and the said labor shall be done anew to the satisfaction and the approval of the Borough Manager or his representatives, at the cost and expense of the Distributor. To the fullest extent permitted by law, the Distributor agrees to defend, pay on behalf of, indemnify and hold harmless the Kodiak Island Borough, its elected and appointed officials, employees and volunteers and others working on behalf of the Kodiak Island Borough against any and all claims, demands, suits or loss, including all costs connected therewith, and for any damages which may be asserted, claimed or recovered against or from the Kodiak Island Borough, its elected and appointed officials, employees, volunteers or others working on behalf of the Kodiak Island Borough, by reason of personal injury, including bodily injury or death and/or property damage, including loss of use thereof, which arises out of or is in any way connected or associated with this Agreement. The agreement entered into by the acceptance of the Distributor's bid and the signing of this Agreement consists of the following documents all of which are component parts of said Agreement and as fully a part thereof as if herein set out in full, and if not attached, as if hereto attached. 1. Invitation to Bid In the event of any conflict or inconsistency between any of the foregoing documents, the conflict or inconsistency shall be resolved upon the basis of the numerical order. 12 The Distributor further covenants and agrees that said HYDRAULIC EXCAVATOR shall be furnished and delivered to the satisfaction of the herein aforementioned Borough Manager, on or before April 1, It is expressly understood and agreed that in case of the failure on the part the Distributor for any reason, except with the written consent of the Borough Manager, to complete the furnishing and delivery of said HYDRAULIC EXCAVATOR before the aforesaid date, the party of the first part shall have the right to deduct from any monies due or which may become due the Distributor, or if no monies shall be due, the party of the first part shall have the right to recover One Hundred Dollars ($ 100) per day for each and every calendar day elapsing between the time stipulated, and the actual date of delivery in accordance with the terms thereof: said deduction to be made, or said sum to be recovered not as penalty, but as liquidated damages. Provided, however, that upon receipt of written notice from the Distributor of the existing causes over which said Distributor has no control and which must delay the delivery of said HYDRAULIC EXCAVATOR, the Borough Manager may at his discretion, extend the period herein before specified for the delivery of the said HYDRAULIC EXCAVATOR, and in such case the Distributor shall become liable for said liquidated damages for delays commencing from the date on which said extended period shall expire. The Distributor hereby agrees to receive the prices set forth in the proposal as full compensation for delivering the HYDRAULIC EXCAVATOR to complete said Agreement to the satisfaction of the Borough Manager. It is further distinctly agreed that the said Distributor shall not assign this contract, or any part thereof or any right to any of the monies to be paid him hereunder. Payment for services rendered under this Agreement shall be made by the Kodiak Island Borough within thirty [30] days of delivery, acceptance by the Kodiak Island Borough and invoicing by Distributor.
